About this file

This is a Worker Protection and Investment Certification Form (BOP 2201) required by the Commonwealth of Pennsylvania for all contractors and grantees under Executive Order 2021-06. The form mandates compliance certification across thirteen categories of Pennsylvania labor and workforce safety laws, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and various other employment protection statutes. The certification must be executed by an authorized official of the contractor or grantee entity and submitted to the purchasing agency prior to contract award.

The form establishes significant compliance obligations and enforcement mechanisms. Contractors and grantees must certify ongoing compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and all applicable state labor and safety regulations. Any changes in compliance status must be reported immediately to the purchasing agency. Pennsylvania law imposes substantial penalties for false certifications, including contract termination and three-year debarment from bidding on Commonwealth contracts under 62 Pa. C.S. § 531. Additionally, false certifications are subject to criminal penalties under 18 Pa. C.S. § 4904 (Unsworn Falsification to Authorities). The certification is a mandatory prerequisite for contract eligibility and represents the contractor's legal acknowledgment of compliance obligations throughout the contract term.
