About this file

This is a Domestic Workforce Utilization Certification form required by the Commonwealth of Pennsylvania for the procurement of twelve Heath Remote Methane Leak Detector (RMLD) Complete Solution devices with Bluetooth connectivity and twelve Li-ion replacement battery packs. The RMLD-CS devices must utilize tunable diode laser absorption spectroscopy technology to detect gas leaks remotely and include intrinsically safe features, graphical user interface, internal data logging, color camera and display, and built-in Wi-Fi, GPS, and wireless connectivity capabilities. This is a no substitution procurement, meaning only the specified Heath product is acceptable. No specific response dates, due dates, site visits, bidders' meetings, award dates, or contract term information is provided in this certification document.

The certification requires offerors to commit to performing direct labor exclusively within the United States or within countries that are parties to the World Trade Organization Government Procurement Agreement, or to specify the percentage of direct labor that will be performed in compliant locations and identify any work to be performed outside compliant jurisdictions. Offerors must complete and sign the certification to receive any consideration under this scoring criterion, and failure to do so results in no score for this evaluation factor. Any misstatement in the certification will be treated as fraudulent concealment under Pennsylvania law and is subject to criminal penalties. The certification becomes a contractual obligation upon execution of the contract. No pricing information, set-asides, incumbent information, or funding sources are addressed in this certification document.

DOMESTIC WORKFORCE UTILIZATION CERTIFICATION

To the extent permitted by the laws and treaties of the United States, each proposal will be scored for its commitment to use the domestic workforce in the fulfillment of the contract. Maximum consideration will be given to those offerors who will perform the contracted direct labor exclusively within the geographical boundaries of the United States or within the geographical boundaries of a country that is a party to the World Trade Organization Government Procurement Agreement. Those who propose to perform a portion of the direct labor outside of the United States and not within the geographical boundaries of a party to the World Trade Organization Government Procurement Agreement will receive a correspondingly smaller score for this criterion. In order to be eligible for any consideration for this criterion, offerors must complete and sign the following certification. This certification will be included as a contractual obligation when the contract is executed. Failure to complete and sign this certification will result in no consideration being given to the offeror for this criterion.
