About this file

This is a project description document related to Unit 4 Cell 5 Liner Construction at Twin Chimneys Landfill in Greenville County, South Carolina. The project encompasses construction of an 8.6-acre base liner system incorporating multiple components: 1x10-5 cm/sec clay, geosynthetic clay liner (GCL), 60-mil high-density polyethylene (HDPE), geocomposite, protective cover, and leachate collection pipes. The contractor is responsible for construction quality control (CQC) and surveying activities, while Greenville County will provide separate Construction Quality Assurance (CQA) oversight through a different RFP. The County established an aggressive project timeline requiring Substantial Completion within 180 calendar days from Notice to Proceed and Final Completion within 210 calendar days from Notice to Proceed.

The project is subject to liquidated damages provisions of $1,000 per day for failure to achieve Substantial Completion and $500 per day for failure to achieve Final Completion. The document indicates the County has experienced weather-related delays affecting project scheduling and execution. No specific pricing information, set-asides, incumbent contractor details, or funding source documentation is provided in this file.

Weather-Related Delays

a. If “abnormal weather conditions” are the basis for a request for an equitable adjustment in the Contract Times, such request must be documented by data substantiating each of the following:

1) that weather conditions were abnormal for the period of time in which the delay occurred,

2) that such weather conditions could not have been reasonably anticipated, and

3) That such weather conditions had an adverse effect on the Work on the critical path at the time of the delay.

b. The existence of abnormal weather conditions must be documented by the Contractor (using Table 1 – Weather Related Days) and submitted to the Owner and/Engineer to review on a monthly basis in accordance with the following:

1) Every workday on which one or more of the following conditions exist will be considered an abnormal weather day:

i) Total precipitation (as rain equivalent) occurring between 7:00 p.m.

on the preceding day (regardless of whether such preceding day is a workday) through 7:00 p.m. on the workday in question equals or exceeds 0.1-inch of precipitation (as rain equivalent, based on the snow/rain conversion indicated in Table 1 – Weather Related Days).

2) Determination of weather days during performance of the Work will be based on the weather records measured and recorded by the local weather monitoring station weather monitoring station and/or the site weather monitoring station.

3) The existence of abnormal weather conditions will not relieve Contractor of the obligation to demonstrate and document that delays caused by abnormal weather are specific to the planned work activities or that such activities thus delayed were on Contractor’s then-current Progress Schedule’s critical path for the Project.
