About this file

This is a Warranty Bond form issued by the City of Napa, California for public works contracts. The bond serves as a guarantee mechanism between the City of Napa (obligee), the contractor (principal), and a surety company, establishing the surety's obligation to ensure the contractor fulfills its warranty obligations on the Soscol Avenue Rehabilitation Project. The warranty period extends for one year following the City's acceptance of the project work, during which the contractor must guarantee its work and that of all subcontractors against defects in materials or workmanship. Should the contractor fail to repair or remedy any defects discovered during this one-year warranty period, or fail to reimburse the City for losses sustained due to such failure, the surety remains obligated to cover these costs at its sole expense.

The bond amount is set at 15% of the final contract price unless otherwise specified in the contract documents. The surety waives provisions under California Civil Code sections 2819 and 2845. The bond is governed by California law with exclusive venue in Napa County Superior Court, and the surety assumes responsibility for the City's attorney fees and costs in any enforcement action. The bond requires completion of signature blocks for the surety company with notary acknowledgment and power of attorney documentation, the contractor, and City approval. This warranty bond form is part of the standard City of Napa public works contract documentation (Form 4.4, dated February 13, 2024) and applies to the sealed bid project with submission deadline of May 6, 2026 at 3:00 pm through the City's electronic procurement portal.
