B. BASIS FOR AWARD (Section M)
The award will be made to a single responsible small business Offeror whose proposal is determined to be the lowest price, technically acceptable offer (FAR 15.101-2). To receive consideration for award, an "Acceptable" rating must be achieved for the Combined Technical /Management factor (to include all sub factors) and the Past Performance factor. The Cost/Price factor will not be rated, but will be evaluated for completeness, reasonableness and for realism as specified in this solicitation. Any proposal receiving a rating of "Unacceptable" in any non-price Factor will not be eligible for award. The evaluation criteria detailing the Factors and Subfactors are contained in Section M of the solicitation and are herein incorporated by reference.
The Government reserves the right to award without discussions; therefore, offerors will be cautioned to ensure that their proposals contain all required information and are complete in ALL respects.
FACTORS AND SUB-FACTORS TO BE EVALUATED
The following evaluation factors and sub factors will be used to evaluate each proposal. Award will be made based on the lowest price of the proposal that is deemed technically acceptable.
A detailed explanation of the criteria for evaluation is set forth in the "Evaluation Approach," paragraph C of this section. During evaluation of each proposal, the Government will assign each factor/sub factor, excluding Price, an Acceptable/Unacceptable rating. Each sub factor will be evaluated to determine if the proposed approach associated with each sub factor meets or does not meet the minimum performance or capability requirements. To receive an overall "Acceptable" factor rating, all sub factors must receive an "Acceptable" rating.
This analysis may include, but is not limited to, determining if 1) the costs are realistic for the work to be performed, 2) reflect a clear understanding of the contract requirements, and 3) are inclusive of all services requested. A detailed explanation of the criteria for the evaluation is set forth in the "Evaluation Approach", Paragraph C of this section.
Factor 1: Combined Technical/Management:
The Combined Technical/Management factor is further divided into the following sub-factors:
Sub-factor 1a: Technical Approach
Sub-factor 1b: Staffing
Sub-factor 1c: Experience
The sub-factors are of equal importance. Each sub-factor will be evaluated to determine whether the proposal meets the minimum requirements of the solicitation. Each sub-factor will be rated as acceptable or unacceptable and combined for an overall Factor 1 Technical rating.
Factor 2: Past Performance:
Each offeror's past performance will be reviewed to determine whether the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown. This assessment shall be based on the offeror's record of relevant and recent past performance information pertaining to the services outlined in the SOLICITATION and a determination of how well the offeror performed on those contracts.
Factor 3: Cost/Price:
a. Price will not be adjectivally rated. Each offeror is to submit a price proposal in both hard copy and electronic Microsoft Word and Excel formats. A copy of a totaled Section B shall be included as part of the offeror's price proposal. The price proposal shall include a narrative and supporting documentation, loaded labor rate schedules, etc. to establish price reasonableness of the proposed loaded labor rates and total prices. Certification of the submitted data is not currently required in accordance with FAR 15.403-1(b)(3).
b. Offeror price proposals will be evaluated for price reasonableness in accordance with the criteria in FAR 15.404-1(b), and FAR 15.403-3(c). The analytical techniques used to determine price reasonableness will be determined by the Contracting Officer in accordance with FAR 15.404-1(a) (1). In accordance with FAR 15.404-3(c) each offeror shall submit the following as part of their price proposal
i. Any current catalogs or price lists supporting the proposed commercial loaded labor rate prices.
ii. History of prior sales to governmental and non-governmental customers, including proposed loaded labor rates, for the last 5 years for the same or similar being proposed. Explain any differences with respect to similarity.
c. CLINs with an ESTIMATED normalized amount for travel are specified for proposal purposes.
Each Offeror is to include the below amounts in their proposals and Section B. Since Travel are estimated amounts that may or may not occur, no profit shall be proposed or accepted. Please use these exact amounts in your submitted proposal.
Travel Transition - $2,000.00
Travel Base Yr - $10,000.00
Travel Option Yr 1 - $10,000.00
Travel Option Yr 2 - $10,000.00
Travel Option Yr 3 - $10,000.00
Travel Option Yr 4 - $10,000.00
d. The Government shall use evaluated underling cost/price data when making a responsiveness determination concerning an offeror's compliance with FAR Clause 52.219-14, Limitation on Subcontracting. Clause paragraph 52.219-14 (e) (1) states, "Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor's 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract. Other direct costs are excluded to the extent they are not the principal purpose of the contract and cannot be obtained from small business concerns." The Government shall use fully burdened labor costs inclusive of profit to determine if the Prime small business offeror as the concern meets the at least 50 percent of the cost of contract performance during each period of performance. An Offeror proposal found not in compliance with aforementioned clause shall be determined non-responsive and is ineligible for award.
C. EVALUATION APPROACH
All proposals shall be subject to evaluation by an evaluation team. The overarching evaluation approach for all factors and sub-factors is the adequacy of the offeror's response. The proposal will be evaluated to determine whether the offeror's methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine if each requirement has been addressed in accordance with the proposal submission instruction section of the RFP.
Keep in mind that mere promises to comply with contractual requirements are an insufficient basis for an acceptable rating. Offerors are cautioned that "parroting" of the technical requirements or the PWS with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. The Government reserves the right to award without discussions;
therefore, Offerors are cautioned to ensure that their proposals contain all necessary information and are complete in ALL respects.
Factor 1: Combined Technical/Management
The offerors shall address each of the sub-factors within its technical proposal. Offerors must receive a rating of acceptable in each of the sub-factors to receive an acceptable rating for factor
1. The technical factor is divided into the following sub-factors, all of which are of equal importance:
Sub-factor 1a: Technical Approach
Sub-factor 1b: Staffing
Sub-factor 1c: Experience
Each sub-factor within Factor 1 will be rated as Acceptable or Unacceptable. The ratings for the sub-factors will then be summarized and one overall rating will be given for Factor 1 of either Acceptable or Unacceptable. The proposal content shall clearly address the topics listed in Section L. If an offeror receives a rating of Unacceptable for any of the individual sub-factors in Factor 1, the entire factor will be rated as Unacceptable. Factor 1 ratings are defined as follows:
Table 1 - Combined Technical/Management Relevancy Ratings
Rating Definition
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Factor 2: Past Performance
Each offeror's past performance proposal will be rated as either "Acceptable or Unacceptable" and is based on an assessment of the past performance submitted by the offeror and the Government's expectation that the offeror will successfully perform the required effort. This assessment is based on the offeror's record of relevant and recent past performance information that pertain to the services described in the solicitation . The Government will evaluate whether the offeror's present/past performance is relevant or not relevant to the services the contractor is expected to perform as described in the solicitation. The Government will also evaluate how well the offeror performed on the contracts detailed in the offeror's proposal.
The Government will focus its evaluation on the information provided by the Offeror in its proposal and may consider data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance Government contracts for same or similar services that are relevant and recent.
Under this factor, the Government may evaluate third party references provided as to each Offeror's relevant and recent efforts, to verify the probability of successful accomplishment of the required effort. Relevant efforts are defined as services/efforts that are the same as or similar in size and complexity to the portion(s) of the PWS that the contractor is proposed to perform. Recent efforts are defined as those performed during the last ten years, from the issue date of this RFP.
Marginal ratings in CPARS may be considered Unacceptable. Where a reference indicates that an Offeror's performance was Unacceptable or Marginal in a particular area, the Government will consider any information provided by the Offeror to explain or rebut any Unacceptable or Marginal performance in a particular area. The burden is on the Offeror to identify in its proposal any and all extenuating circumstances which may bear on the Government's evaluation of unfavorable reference information.
For the past performance factor, offerors will be evaluated in accordance with the chart below. This rating considers the assessed quality of the relevant/recent efforts gathered.
Table 2 - Past Performance Relevancy Ratings
Rating Definition
Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort or the Offeror's performance record is unknown
Unacceptable Based on the Offeror's performance record, the Government has little to no reasonable expectation that the offeror will be able to successfully perform the required effort.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral ratings shall be considered "acceptable."
Years of experience are measured by elapsed time of directly applicable experience on the part of the entity and not the equivalent accumulated time of personnel on staff.
Marginal ratings in Contractor Performance Assessment Reporting System (CPARS) may be considered unacceptable.
Factor 3: Cost/Price
Adjectival ratings shall not be used for offerors' Cost/Price proposals. The Government will fully evaluate and negotiate all priced Contract Line Item Numbers (CLINs) for award. For award purposes, the total proposed price for all CLINs will be added together into a total sum (contract ceiling). The evaluation of ordering period CLINs will not obligate the Government to place more than the minimum order. In accordance with 15.404(b)(2) The Government shall use various price analysis techniques and procedures to ensure a fair and reasonable price. Examples of such techniques include, but are not limited to, the following:
1. Comparison of proposed prices received in response to the solicitation. Normally, adequate price competition establishes a fair and reasonable price
2. Comparison of the proposed prices to historical prices paid, whether by the Government or other than the Government, for the same or similar items. This method may be used for commercial products or commercial services including those "of a type" or when requiring minor modifications for commercial products.
i. The prior price must be a valid basis for comparison. If there has been a significant time lapse between the last acquisition and the present one, if the terms and conditions of the acquisition are significantly different, or if the reasonableness of the prior price is uncertain, then the prior price may not be a valid basis for comparison.
ii. The prior price must be adjusted to account for materially differing terms and conditions, quantities and market and economic factors. For similar items, the contracting officer must also adjust the prior price to account for material differences between the similar item and the item being procured.
iii. Expert technical advice should be obtained when analyzing similar items, or commercial products or commercial services that are "of a type", or requiring minor modifications for commercial products, to ascertain the magnitude of changes required and to assist in pricing the required changes.
3. Use of parametric estimating methods/application of rough yardsticks (such as dollars per pound or per horsepower, or other units) to highlight significant inconsistencies that warrant additional pricing inquiry.
4. Comparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangements.
5. Comparison of proposed prices with independent Government cost estimates.
6. Comparison of proposed prices with prices obtained through market research for the same or similar items.
7. Analysis of data other than certified cost or pricing data (as defined at 2.101) provided by the offeror.
If the contracting officer determines that information on competitive proposed prices or previous contract prices is not available or is insufficient to determine that the price is fair and reasonable, the contracting officer may use any of the remaining techniques as appropriate to the circumstances applicable to the acquisition in accordance with 15.404-1(c) where the review and evaluation of any separate cost elements and profit or fee in an offeror's or contractor's proposal, as needed to determine a fair and reasonable price or to determine cost realism, and the application of judgment to determine how well the proposed costs represent what the cost of the contract should be, assuming reasonable economy and efficiency.
