SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
SECTION L PROPOSAL INSTRUCTION
D. PROPOSAL SUBMISSION INSTRUCTIONS (Section L)
1. INTRODUCTION: This requirement is set aside for Small Businesses under NAICS 562910 – Environmental Remediation Services, small business size standard of 750 employees.
Proposals shall remain valid for a period of at least 180 days after the closing date of the solicitation.
Proposals must be submitted electronically through the DoD Secure Access File Exchange (SAFE) website at https://safe.apps.mil/. The SAFE system will provide a confirmation to the sender when files are transmitted successfully. It is the responsibility of the Offeror to allow adequate time to submit ALL proposal files before the submission deadline. Any proposal that is received in the SAFE system after the appointed deadline is “late” and may not be considered for award.
All Offerors and Subcontractors that will be submitting proposal information to the Government shall notify the Contracting Officer, Erin Weber (erin.k.weber.civ@army.mil), and Contract Specialist, Roxanne Barbaris (roxanne.barbaris.civ@army.mil) by email at least 7 business days before the closing date of the solicitation. The Offeror will be sent a drop-off request with a link to use through the SAFE system. The drop-off request is valid for 14 days. Note that any submissions filed after the due date and time for proposal submissions will be late and will not be considered.
In order to be considered for award, each offeror must submit their proposal in accordance with these instructions. Failure to adhere to these instructions may result in rejection of the offeror’s proposal without evaluation or consideration for award. All proposal information submitted shall be concise, complete and demonstrate that the offeror understands and meets the requirements established in the solicitation for all factors. The Government will consider how well the offeror complied with the instructions when evaluating the offeror’s ability to perform the requirements of the solicitation. The Government will consider an Offeror’s non-compliance with these instructions, or any attempt to take advantage of loopholes in these instructions, to be indicative of the type of conduct that it may expect from the Offeror during contract performance.
This solicitation requires all offerors to submit proposals for Phase 1 and 2 seperately. Proposals for Phase 1 are due on 15 June 2023 and proposals for Phase 2 are due on 6 July 2023. During Phase 1, the Past Performance, Work Experience and A-E Services Qualifications will be evaluated. The contracting office shall safeguard the Phase 2 Technical and Cost Factor proposals from the technical and cost/pricing teams. In accordance with FAR 36.602-3, a minimum of 3 of the most highly qualified proposals will be selected to proceed to Phase 2.
More than 3 proposals may be selected if it is in the best interest of the Government. Offerors will be notified if their proposal is selected for Phase 2. After the offerors are notified of their selection, the Phase 2 proposals shall be sent by the contracting office to the technical and cost teams for evaluation. In order to be considered for Phase 2, a proposal must have an Acceptable rating in Factor 1 – Past Performance, Factor 2 – Work Experience, and Factor 3 – A-E Services Qualifications.
As this requirement is a Small Business set-aside, there are no subcontracting goals, and a subcontracting plan is not required.
The offeror’s complete approach shall consist of six (6) proposal volumes in total. The Volumes are identified below:

c. Content Requirement. All information shall be confined to the appropriate file. The offeror shall confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal. Each file of the proposal shall consist of a Table of Contents, Summary Section, and the Narrative discussion. The Summary Section shall contain a brief abstract of the file. The Government will use information provided under each Volume strictly to evaluate the applicable Factor and may not use that information to evaluate any other Factor in other Volumes. Within the Technical Factor Volume, Sections for each subject area within the Technical Volume shall be clearly identified.
The following information shall be included in the Narrative discussion:
4. VOLUME 1: FACTOR 1 –PAST PERFORMANCE
This volume shall contain past performance information regarding recent and relevant contracts.
The narrative should clearly identify the number, name of the contractor, contract title, annual dollar value, period of performance, duration (in years), a description of the work performed, and the labor categories that were used that are similar to this RFP. References for past performance shall be provided on Solicitation Attachment A15 (Contract References Form).
Offerors shall, at a minimum, include the same projects/contracts submitted under Factor 2 (Work Experience) for evaluation under Factor 1 (Past Performance). Offerors shall submit a maximum of six (6) contracts. The contracts must have been performed or awarded during the past ten years, from the issue date of this RFP, which are relevant to the efforts required by this solicitation. Offerors shall describe how past performance information relates to specific paragraphs of Section C of the PWS and which entity (prime Offeror or major subcontractor(s)) within the Offeror’s organization will perform the work.
Additionally, at least 50% of the contracts submitted for Factor 1 (Past Performance) are required to have been contracts performed by the prime contractor, under the CAGE code of the prime contractor. If the offeror submits under another CAGE code then it must explain why it thinks the information is relevant. If the information is not relevant, then the Government evaluators may not attribute the information to the prime contractor and the offeror may be deemed Unacceptable.
Relevant efforts are defined as services/efforts that are the same as or similar in scope and complexity to the portion(s) of the PWS that the prime offeror or applicable major subcontractor is proposed to perform. In order for an Offeror to rely on the experience or past performance of the Offeror’s parent, sister, subsidiary or an affiliate company, the offeror shall identify the relevant parent, sister, subsidiary company or affiliate company as a Major Subcontractor in its proposal and identify what portion of the work that entity will perform under this contract (must be at least ten (10) percent (%) or more of the total proposed price for this effort). Data concerning the offeror shall be provided first, followed by each proposed major subcontractor, in alphabetical order. The offeror shall also submit the written consent of its major subcontractors to allow the disclosure of its subcontractor’s past performance information to the Government. In addition, letters of commitment shall be included for all major subcontractors for their past performance to be considered. Letters of consent and/or commitment will not count against the stated page limits.
Joint ventures. If an offeror proposes as a legal joint venture, the CAGE provided shall be specifically for the joint venture submitting the proposal as the offeror. If an offeror proposes using the CAGE for only one of the companies participating in the joint venture, that company shall be considered the one and only offeror. If an offeror proposes as a legal joint venture, experience examples from individual partners may be submitted; the offeror shall note the relationship of the partner to the joint venture.
Predecessor companies. If the proposed past performance was performed by a predecessor company, provide the information for the recent and relevant contract of the predecessor company, document the history of the evolution from the predecessor company, and provide explanation for why the past performance information of the predecessor company should be attributed to the offeror, not to exceed one (1) page. Any past performance of a company that in the future might, but has not yet, become part of the offeror's company, including but not limited to any pending novation agreements, mergers, and acquisitions, will NOT be considered. Any past performance of a predecessor company or division divested away from the offeror also will NOT be considered. Submission requirements in accordance with this paragraph are not included in the page limitations in Section L.2.
This volume shall be organized into the following sections:
(1) Section 1 – Contract Descriptions. This section shall include the following information in the following format.
(a) Contractor/Subcontractor place of performance, CAGE Code and DUNS Number. If the work was performed as a subcontractor, also provide the name of the prime contractor and Point of Contact (POC) within the prime contractor organization (name, current address, e-mail address, and telephone number(s)).

Offerors shall provide a specific narrative explanation of each contract listed above in Volume 1, Section 1, a contract description, describing the objectives achieved and detailing how the effort is relevant in size and complexity to the PWS task area(s) that the applicable prime or major subcontractor is expected to perform. Past Performance can be defined/limited to a single contract/task order, but may also be defined as work at a site that has been continuously performed under successive/multiple contracts/task orders. The Government will consider contracts that are still in progress and performance is not yet complete.
(a) For any contracts that did not/do not meet the original schedule, technical performance requirements or cost estimates, provide a brief explanation of the reason(s) for the shortcomings and any corrective action(s) taken to avoid recurrence. The information provided for the prime Offeror and each proposed major subcontractor must include the entire company name, company address, CAGE Code, DUNS Number and type of work to be performed under this contract by citing the applicable Government PWS paragraph number. This includes all subcontractors whose subcontract is for more than 10% of the total proposed cost/price (Major Subcontractor).
Past Performance Questionnaire. For all contracts identified above in Volume 1, Section 1, Contract Descriptions, the offeror shall complete Part 1 of the Past Performance Questionnaire.
For Government contracts, the offeror shall e-mail the questionnaire to both the Government contracting activity and the Government technical representative responsible for the past/current contract. For private industry, the offeror shall email the questionnaire to the private industry technical representative responsible for the past/current contract. The POCs shall be instructed to electronically complete Part II of the questionnaire and e-mail the entire questionnaire to the Contracting Office no later than the proposal due date, to (roxanne.barbaris.civ@army.mil and erin.k.weber.civ@army.mil). The Offeror shall e-mail to the Contracting Officer a list of all the POCs who were sent a questionnaire. The Government must receive this list no later than the proposal due date. The POC List shall be submitted in Word for Windows Table Format to include the following fields: Solicitation Number; Company Name; Contract Number;
Government Agency (if applicable); POC Last Name, First Name; POC Title; POC Telephone Number; POC E-mail Address; and Date E-Mail to POC (month/day). Submission of this list does not relieve the contractor of the responsibility to ensure all Past Performance Questionnaires are submitted on time. Furthermore, receipt of this list does not obligate the Government to contact any of the POCs identified.
The Government will focus its inquiries on the offeror’s (including major subcontractors) record of performance as it relates to the solicitation requirements that the Offeror or major subcontractor is proposed to perform, including cost, schedule, performance and management of subcontractors. Offerors are reminded they must include the most recent and relevant efforts (performance within the past ten (10) years) in their proposal. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Offeror will not be evaluated either favorably or unfavorably on past performance.
5. VOLUME 2 - FACTOR 2: WORK EXPERIENCE
For the purposes of the evaluation, the term “Offeror” refers to the entire entity proposing to the requirement which may include a Prime Contractor and all subcontractors. Subcontractors who perform ten (10) percent (%) or more of the total proposed price for this effort are considered Major Subcontractors.
The submitted projects may be completed for the U.S. Government or other clients. For all submitted projects, a narrative of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this solicitation.
In order for an Offeror to rely on the experience of the Offeror’s parent, sister, JV member, subsidiary or an affiliate company, the Offeror shall identify the relevant parent, sister, subsidiary company or affiliate company as a Major subcontractor in its proposal and identify what portion of the work that entity will perform under this contract (must be at least ten (10) percent (%) of the contract proposed cost/price or more). Offerors shall provide a description of how the effort required by the solicitation will be assigned for performance within the Offeror’s corporate entity and among the proposed major and other subcontractors. This description shall include an estimate of the total contract value that the prime and all Major Subcontractors are expected to perform.
If the proposed work experience was performed by a predecessor company, provide the information for the contract of the predecessor company, document the history of the evolution from the predecessor company, and provide explanation for why the work experience of the predecessor company should be attributed to the offeror, not to exceed one (1) page. Any work experience of a company that in the future might, but has not yet, become part of the offeror's company, including but not limited to any pending novation agreements, mergers, and acquisitions, will NOT be considered. Any work experience of a predecessor company or division divested away from the offeror also will NOT be considered.
Submission requirements in accordance with this paragraph are not included in the page limitations in Section L.2.
At least 50% of the contracts submitted for Factor 2 (Work Experience) are required to have been contracts performed by the prime contractor, under the CAGE code of the prime contractor.
If the offeror submits under another CAGE code then it must explain why it thinks the information is relevant. If the information is not relevant then the Government evaluators may not attribute the information to the prime contractor and the offeror may be deemed Unacceptable.
A maximum of six (6) projects can be submitted to demonstrate relevant, recent experience. The Offeror shall demonstrate that they have a minimum 3-years (occurring within the past 10 years) of experience providing support in the following primary competency work areas:
Groundwater Treatment Operations & Maintenance (PWS C5.2) Groundwater Monitoring and Sampling (PWS C5.3) Landfills and Covers Operations and Maintenance (PWS C5.4)
Infrastructure and Facilities Maintenance (PWS C5.5) Design and Field Project Management and Oversight (PWS C5.1.1 and C5.14)
Work Experience can be defined/limited to a single contract/task order, but may also be defined as work at a site that has been continuously performed under successive/multiple contracts/task orders. The Government will consider contracts that are still in progress and performance is not yet complete.
To demonstrate experience under this evaluation factor, the Offeror may utilize experience of another Major Subcontractor that will perform support in the primary competency work areas as identified above . If an Offeror is utilizing experience of Major Subcontractors, then Major Subcontractor projects submitted must include recent and relevant work similar to the work to be performed by the Major Subcontractor for this requirement. Years of experience are measured by elapsed time of directly applicable experience of the entity and not the equivalent accumulated time of personnel on staff. For the purposes of the proposal and subsequent evaluation, Experience is defined as experience on the part of the offeror and any major subcontractor.
Each offeror shall submit their summary of the experience on Solicitation Attachment A16 (Summary of Experience Form). As stated above, at least 50% of the contracts submitted for Factor 3 (Work Experience) are required to have been contracts performed by the prime contractor.
As applicable, Offerors must submit a signed copy of their joint venture agreement, partnership agreement, teaming agreement, approved mentor-protégé agreement, or letter of commitment for each above member of the Offeror's team in order to receive credit for their work experience.
6. VOLUME 3 FACTOR 3: A-E SERVICES QUALIFICATIONS
Offerors shall complete a Standard Form 330 that provides information about the qualifications and experience of the Prime Contractor or qualified Subcontractor for Architect-Engineering Services. The Government will determine whether the Offeror has demonstrated an ability to provide qualified A-E Services. The Government will base this determination on the information provided by the Offeror on Standard Form 330. SF 330s will be evaluated to determine if the offeror has demonstrated an ability to provide licensed architects, engineers, and surveyors that would be required to perform program management, construction management, architectural and engineering, surveying and mapping, and related services as necessary in performance of this contract.
Offeror’s should limit the number of resumes submitted to the minimum required to demonstrate their qualifications to perform A-E services for this contract (minimum of three, maximum of five). Offeror’s shall submit descriptions of three projects that are similar in nature to the example projects listed in Section C.5.14 of the RFP. The projects can be the same as provided for Factor 1 and 2. The Offeror shall demonstrate that example projects have occurred within the past ten (10) years. Projects will be evaluated to confirm the Offeror’s capability to perform design and fieldwork oversight on projects similar to the examples listed in Section C.5.14 of the
RFP.
A teaming agreement or letter of commitment from a qualified subcontractor that is proposed on the SF 330 shall be included in Volume 3 and shall not count towards page limitations.

This plan shall also include a transition-out section detailing plans to transfer the work to the incoming contractor during the last 30 calendar days of contract performance. Full performance of the contract shall begin on day 31 after award. The Transition Plan shall address the following:
1). Events, actions and associated time frames required during the transition-in period, including; interviewing, hiring, human resource actions, training, start work dates, health screening, acquisition of Government computer Common Access Cards (CAC), and any other items that the Offeror deems important to ensure a smooth transition of work shall be addressed in the plan. e. Realism of Hours Proposed
Each offeror may propose manpower identical to the levels stated in the ERS Cost Model provided as an attachment to the RFP. If the offeror proposes to match the LOE then the offeror shall state in this portion of its proposal that its proposal matches the LOE. In which case its proposed LOE shall be deemed realistic and no additional proposal information is required.
If, however, the offeror has an alternative concept for manpower, then the offeror may deviate from the LOE manpower in the ERS Cost Model. In which case, the offeror shall clearly indicate, on a labor category by labor category basis, its proposed revisions and shall include written narrative for each deviation explaining how the revisions enable completion of the required tasks and provide benefits to the Government. The Government’s technical evaluators will then evaluate the deviations in the labor categories, labor mix, and labor hours for strengths, weaknesses, and deficiencies, as well as for realism. If the manpower levels, upon Government evaluation, are not feasible then the Government evaluators may also adjust the manpower levels, in which case such adjustments shall have a corresponding dollar value adjustment in the Government’s evaluation of the offeror’s cost/price proposal.
8. VOLUME 5 – FACTOR 5: COST/PRICE:
Price/cost data shall only be included in the cost volume, Volume 5, and not within any other proposal volume. Major subcontractors must provide a separate cost proposal directly to the Government and in accordance with the information below.
This volume shall consist of all information, required to support proposed costs and prices.
Competition is anticipated therefore Certified Cost and Pricing Data are not currently required in accordance with FAR 15.403-1(b)(3); however, the Government reserves the right to request such data prior to award if none of the exemptions in FAR 15.403-1(b) apply. There is no page limitation for this volume.
Offerors shall consider the Section H clause which states, “Offerors shall be required to manage to the contract ceiling stated in their proposal. Offerors will be evaluated on their ability to manage to the target cost for each year of the contract. Any overrun above the target cost will result in a negative CPARS rating under cost control.”
Proposed cost/price will not be adjectively rated. A total price will be evaluated for each Offeror.
The total evaluated price will be the summation of the Section B CLINs, including any probable cost adjustments made by the Government. Each offeror must propose manpower identical with the levels stated in the ERS Cost Model, unless there is another approach the Contractor believes will be preferred for this requirement. The alternative approach must be clearly documented, and supporting rationale must be provided to demonstrate how the proposed approach can meet the technical requirements and benefit the Government.
Each offerors’ cost/price proposal will be evaluated for price fairness and reasonableness in accordance with FAR 15.404-1. Only cost reimbursable requirements/CLINS will be evaluated for cost realism in accordance with FAR 15.404-1. Each offeror’s proposed direct labor rates will be analyzed for realism. It is incumbent upon all offerors, subcontractors, and teaming partners to propose realistic direct and indirect rates.
To support its total compensation plan of professional employees in accordance with FAR 52.222-46, offerors shall submit a total compensation plan setting forth salaries and fringe benefits proposed for the professional employees who will work under the contract. Supporting information will include data, such as recognized national and regional compensation surveys and studies of professional, public and private organizations, used in establishing the total compensation structure.
As noted above, the offeror's proposed costs will be evaluated by determining what the Government expects the offeror's approach would most probably cost the Government when the work performed under the contract is completed. To the degree that the Government's most probable cost estimate is higher than the Offerors proposed cost; the cost will be adjusted upward for the purposes of evaluation only.
NOTE: The Government may use external sources of information in performing its cost analysis to include, but not limited to, Bureau of Labor Statistics, Department of Labor, Department of State, DCAA, or DCMA. This DOES NOT excuse the Offeror from following the proposal submission instructions.
Offeror and subcontractor proposals will be evaluated based on the cost/price reasonableness and cost realism criteria contained in FAR 15.404-1. The manner and degree of the criteria used will be determined by the contracting officer based on competition and other factors.
