The required response date/time has changed from 03-Jan-2023 02:30 PM to 03-Feb-2023 02:30 PM.

The following have been modified:

AMENDMENTS/ Q&A'S

AMENDMENT / Q&A'S

AMENDMENT 0001: To correct the solicitation number and remove multiple contract on the DD FORM 254 block 2c (Attachment 2) posted on 01 December 2022.

AMENDMENT 0002:

Question 1: Section L 2.A

“Are we required to submit past performance contracts only under NAICS Code 541614? Or can we provide past performance contracts similar in scope and size to the requirements in the solicitation?”

Government answer:

The language was updated in Section L 2.A, highlighted in yellow, to address this question and clarify this requirements.

Question 2: Section L 2.A

“L.2.A states, Each example shall not exceed three (3) pages and shall include:

The numbering of Section L.2 is unclear regarding what information is required to be included within the 3-page-per-example page count.

Will the Government please clarify if only items L.2.A (a-j) are intended for inclusion within the 3- page limit? Or does the Government intend for the Section 2 (Relevance to Solicitation Requirements) to also be included within the 3-page limit?”

Government answer:

Only items L.2A(a-j) are included within the 3-page limit.

Question 3: Section B

“Each CDRL CLIN is designated as FFP.

Typically, CDRLs are designated NSP. Additionally, if FFP is the correct designator, there is no location in the Attachment 6 workbook to add these costs.”

Government answer:

CLINs 0003, 1003, 2003, 3003, and 4003 were updated. (See Section B).

Question 4: Section M page 117

“Accounting System Adequacy.

Will the DCAA/DCMA approval memoranda suffice or is the audit report(s) also required to be provided with the memoranda?”

A DCMA/DCAA approval memoranda is acceptable as part of the accounting system and purchasing system adequacy.

Question 5: Section L.2.a

“L.2.a states, example under a different CAGE from the offeror, the offeror shall describe therelationship within the legal entity of the offeror and include an affirmative statement that the example was performed by the same legal entity as the offeror or major subcontractor and is not the experience of a subcontractor or teammate.

Will the Government please confirm that an offeror can submit examples performed under a different CAGE Code if they are both subsidiaries of a common parent company and therefore belong to the same legal entity?”

Government answer:

Yes, the Government will accept different CAGE Code if they are both subsidiaries of a common parent company.

Question 6: DD254 PWS 3.7.1

“PWS 3.7.1 states, “Contractor’s computer will have security to a level to meet SECRET.”

There appears to be a disconnect between the PWS and the DD254. PWS 3.7.1 requires that the Contractor computer security meets the level of SECRET. However, the DD254, Section 1.b does not include “safeguarding.”

Since Classified computers call for Risk Management Framework (RMF) implementation, DCSA approval, and personal clearances for system administrators, will the Government please clarify this disconnect?”

Government answer:

The first sentence in PWS 3.7.1 “Contractor’s computers will have a security to a level to meet SECRET” has been removed from the PWS. (See revised PWS dated 12/14/2022)

Question 7: PWS 3.7.2

Question 8: PWS 2.2.6.2

“PWS 2.2.6.2 states, “Arrange for transportation of material from the owner country to the Contractor's Source of Repair (SOR)/repair facility within 180 days of receipt of instructions and provide shipping documentation to the Contractor when available.”

Will the Government please clarify that USG will cancel if the 180 days is not met?”

Government answer:

The following has been added to PWS 2.2.6.2 “Material not shipped within 180 days is subject to cancellation by the USG”. (See revised PWS dated 12/14/2022).

Question 9: PWS 3.1.1.5

“The Contractor shall ensure Defense Contract Management Agency (DCMA) inspects CSI repairs in accordance with DFARS 209.270.

Will the Government please confirm the Contractor's responsibility for 3.1.1.5? Since the Contractor has no control other than notification to DCMA for inspection and acceptance the Contractor can only notify DCMA. Request the Government consider 3.1.1.5 state "The Contractor shall ensure Defense Contract Management Agency (DCMA) notification for inspection of CSI repairs in accordance with DFARS 209.270."”

Government answer:

The PWS 3.1.1.5 has been changed to read “The Contractor shall notify Defense Contract Management Agency (DCMA) to inspect CSI repairs in accordance with DFARS 209.270.” (See revised PWS dated 12/14/2022).

Will the Government please clarify that the timeline is a yearly average of 60 calendar days within receipt OR notification of receipt of the item at the repair facility?”

Government answer:

The PWS 3.1.7 has been changed to read “The Contractor shall complete TT&E and provide an Estimated Completion Date (ECD) via WebRoR within a yearly average of 60 calendar days of receipt, or notification of receipt, of the item at the repair facility.” (See revised PWS dated 12/14/2022).

Will the Government please clarify that the timeline is an average of 150 calendar days within receipt OR notification of receipt of the item at the repair facility?

Government answer:

The PWS 3.1.8 has been changed to read “The Contractor shall complete all repairs within a yearly average of 150 calendar days from receipt, or notification of receipt, at the repair facility.” (See revised PWS dated 12/14/2022).

Question 12: PWS 3.1.9

“PWS 3.1.9 states, “The MEL waiver request shall include the repair cost and estimated lead time to enable the FMS customer to make an informed decision to continue with repair or not.”

Will the Government consider including a reasonable deadline for receiving the FMS customer's decision as well as Government issuance of a mod, if accepted?”

Given this is a Small Business 8(a) set aside, it’s understood that a Subcontracting Plan (FAR 52.219-9) is not required. Is this clause not applicable?”

Government answer:

Clause 52.219-16, Liquidated Damages- Subcontracting Plan has been removed from Section I. (See Section I).

Question 15:

“Solicitation Page 107 of 118

3. VOLUME III Factor III-Small Business Participation (Attachment 4)

This section references a proposed SBP Plan. According to FAR 19.708(b)(1), 52.219-9, Small Business Subcontracting Plan, is not be included if the acquisition is set aside or is to be accomplished under the 8(a) program. Based on this understanding, is a Small Business Plan a requirement?”

Government answer:

The Small Business Participation Plan is required.

Question 16:

“Attachment 4 Small Business Participation Form

The detail being requested is typically what is seen for a Small Business Plan. If a Small Business Plan is not required per 19.708(b)(1), 52.219-9 does this form not apply?”

Government answer:

The Small Business Participation Form is required to be completed and submitted with proposal submission.

Question 17:

“Section L.4 Section L.4 states, “Total Evaluated Price (TEP) will include the summation of Section B CLINS as outlined in the Attachment 6 – Cost Model Spreadsheet”

Section M.4.5 Section M.4.5 lists all CLINS, not just the FFP CLINs. Section M.4.5 states, “…the costs for Repair and Return (R&R) will not be evaluated as part of the evaluation process.”

Attachment 6 Attachment 6 sums only the FFP CLINs in the ROLLUP tab.

There appears to be a discrepancy between how Attachment 6 calculates the TEP and how Sections L and M say it will be calculated. Please clarify.”

Government answer:

The Section M.4.5 has been changed to read “Total Evaluated Price: The total evaluated price (TEP) will be the sum of all Firm Fixed Priced CLINs (0001, 1001, 2001, 3001, and 4001). Pricing information shall be contained and addressed ONLY in the Factor 4 – Cost/Price volume.” (See Section M).

AMENDMENT 0003: 22 DEC 2022

Question 1:

“Will the government provide a one month extension to the proposal due date from 3 Jan 2023 until 3 Feb 2023. This extension allows for proper response to the RFP.”

Government answer:

Yes, the Government will provide an extension to the proposal submission date. The new date and time are:

03 February 2023, 2:30PM EST

Question 2:

“Can the government clarify the Small Business Plan percentages when the prime contractor is an 8(a), SDB and the use of other SBs is contingent on individual task order requirements and Sources of Repair (SOR) and no specific requirements are identified in the RFP.”

Government answer:

When a Small Business (SB) proposes a Participation Plan the numbers for the SB are included (for example if a company is a SB and SDB then they are automatically at 51% for performing the contract).

Question 3:

“The government ‘plugged’ in values for CLIN XXX2 and a number for estimated repairs without sufficient detail to determine what SOR will be required in order to provide cost reasonableness. Can the government provide more detail on the repairs required?”

Please see Section 5.0 of the PWS which details the different types of components that could be repaired during the base contract’s ordering period. The Sources of Repair (SORs) are determined on a Task Order (TO) basis.

4. VOLUME IV Factor IV – Cost/Price

Each Offeror’s cost/price proposal shall contain sufficient quantitative and narrative documentation necessary to adequately support and explain the reasonableness and realism of the proposed cost/price proposed in proposal Section B.

Proposed cost/price will not be adjectively rated. A total price will be evaluated for each offeror. The total evaluated price will be the summation of the Section B CLINs, as outlined in the attached Attachment 6 – Cost Model Spreadsheet.

Each offeror’s cost/price proposal will be evaluated in accordance with the price and cost criteria in FAR 15.404-1 as determined necessary by the Contracting Officer based on competition and other factors. The objective of cost/price proposal analysis is to ensure that all proposed costs are fair, reasonable and realistic. Accordingly, the analytical techniques and procedures described in FAR 15.404-1 may be used singly or in combination with others to ensure the costs are fair and reasonable. Cost realism analysis IAW FAR 15.404-1(d) will be performed only on cost reimbursable CLINs and SLINs in accordance with FAR 15-404-1(d).

The Government may use external sources of information to perform its cost evaluation. Such external sources may include, but not be limited to, the Bureau of Labor Statistics, Department of Labor, Department of State, DCAA, or DCMA. This DOES NOT preclude the offeror from submitting the required supporting documentation for its proposed rates.

The Government may determine that an offeror’s cost/price proposal is unawardable if the prices proposed are materially unbalanced. Unbalanced pricing exists when, despite an acceptable total evaluated price, one or more contract line item numbers (CLINs) are significantly overstated or understated by the application of price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an Unacceptable risk to the Government.

Note: The offeror is cautioned that the variance from proposed rates will be used as a performance metric for the awardee and used as input for the award of additional contracts/ordering periods as well as for past performance reviews issued under CPARS.

A proposal is presumed to represent the offeror’s best effort to respond to the solicitation. Any inconsistency between the cost/price proposal and other sections of the offeror’s proposal (e.g., technical proposal), whether real or apparent, shall be explained in the proposal. Any significant inconsistency, if unexplained, raises a fundamental issue of the offeror’s understanding of the nature and scope of the work required and may be grounds for rejection of the proposal.

NOTE: The Sourcing & Management Cost shall include ANY and ALL costs/profits proposed by the offeror.

Indirect costs such as overhead, handling, and/or any other types of fees are not allowable on CLINs: 0002, 1002, 2002, 3002 and 4002. These CLINs are Cost Reimbursement CLINs for the direct cost paid to the Contractor's Source of Repair (SOR) ONLY.

For CLINs: 0001, 1001, 2001, 3001, and 4001, offerors shall include direct labor rates and fringe rates for applicable professional labor categories in accordance with FAR 52.222-46 as well as provide a copy its compensation plan with supporting narrative.

Offerors should carefully read the terms and conditions of this solicitation and review ALL solicitation documents and attachments.
