SECTION 01000 - GENERAL REQUIREMENTS

PART 1 - GENERAL

1.01 GENERAL

A. The Drawings and all Supplementary Documents are essential parts of the Contract and a requirement occurring in one is as binding as though occurring in all. They are intended to be complimentary, descriptive, and provide for a complete Work.

B. All parts of this Contract are intended to complement each other. However in cases of conflict then the order of precedence is as follows: Specifications, Technical Drawings, and General Conditions.

C. The Owner will be represented by the USP&FO, Contracting Office or by a representative to insure performance by the Contractor.

D. On projects where no architectural or engineering firm has been employed by the Ohio National Guard, then any references to "Architect" or "Engineer" in any of these contract documents will specifically refer to the Contracting Officer.

1.02 PERFORMANCE

A. Submittal of a Bid by a Contractor shall be accepted as prima facie evidence that he has examined the Drawing and has satisfied himself as to the nature and location of the work and all matters which can in any way affect the work or cost thereof, under the Contract. Any failure of the Contractor to acquaint himself with all available information including the physical survey of the site of the proposed work will not relieve him from successfully performing all work to be done for a complete and acceptable job.

B. The above brief outline of principle features of the work in no way limits the responsibility of the Contractor from performing all work and furnishes all labor and materials, required by the Contract Documents, referred to herein. Any omission from the Contract Documents, or mis-descriptions thereof, shall not relieve the Contractor from performing all work required, and furnishing the materials required to completely fulfill the intent of the Contract.

C. All Contractors submitting proposals for this work shall first examine the site and shall take into consideration all such conditions as may affect the work under this Contract. All work completed is to tie into or blend into the existing land or structures in a natural, professional and workmanlike manner.

D. All measurements, dimensions and distance listed in the or Drawings are to be verified in the field prior to bidding by the Contractor. Any discrepancies between the Drawing and the actual conditions shall be reported immediately to the Contracting Officer.

3280-20 GENERAL REQUIREMENTS 01000 - 2

E. Should any requirement in the Drawings for the project as a whole appear to the bidder to be in disagreement with those for the part of the work on which he proposes to bid, a request for classification or clarification in writing should be addressed to the Contracting Officer. The Contracting Officer will reply to all such inquiries in case a correction of the Drawings is required, by means of an Addendum to be sent to all firms and persons to who complete bidding documents have been issued. Any discrepancy in quality of materials called for in the Drawings, not clarified by the Contracting Officer shall be resolved by using the higher quality materials.

F. Submit sufficient information for all materials to be used for the project to the Contracting Officer on the proposed items, at least 14 days after Notice to Proceed.

1. List the proposed items by name on the submittal form to be provided by the Contracting Officer. Submit sufficient information with the submittal to clearly demonstrate that the item(s) meet or exceed industry standards in quality.

G. The Contractor shall guarantee workmanship and materials for a period of one year from the date of acceptance by the Adjutant General's Department and shall leave the work in perfect order at completion. Should defects develop within the guarantee period, the Contractor shall, upon written notice of same, remedy the defects and reimburse the State for all damage to the other work, whether caused by the defects or the work of correcting same.

Guarantees, if any, extending beyond said one-year period shall be specifically provided for in the Contract and may be fulfilled by assignment of a bond or written warranty of the manufacturer.

1.03 EXECUTION

A. In general, the Contractor shall coordinate all construction activities with the Office of Installations Management, including delivery of material.

B. The Contractor shall place orders for materials and equipment to be employed in the work as soon as possible after the award of the Contract. The Contractor shall keep the Contracting Officer informed as to the availability of all specified materials and equipment and of such materials and equipment as may not be obtainable for purpose of the limiting and governing factors. Verification of lack of availability of any materials and equipment must be on the manufacturer's order or letter, a copy of which must be furnished to the Contracting Officer.

C. In order to perform a complete Work, the Contractor must employ adequate numbers of skilled workman who are thoroughly trained and experienced in the necessary crafts and who are completely familiar with the specified requirements and the methods needed for proper performance of all work in these Specifications. The Contractor must be prepared to submit evidence of the experience and equipment necessary for proper completion of this project if requested by the Owner. Such evidence may include a list of previous jobs similar in nature, a list of personnel with years of experience to be used on this project, or certification as an approved installer from the materials manufacturer.

3280-20 GENERAL REQUIREMENTS 01000 - 3

D. The Contractor shall confine operations at the site to areas permitted by the Contracting Officer. He shall not unreasonably encumber the site with materials or equipment and shall assume full responsibility for the protection and safekeeping of products stored on the premises. The Contractor shall move any stored products that interfere with the operations of the facility and, if necessary, obtain and pay for additional storage areas.

The Contracting Officer will determine Coordination of the areas of work.

E. Where existing adjacent properties, structures, streets, curbs, etc., have been damaged or destroyed as the result of work operations, it is the responsibility of the responsible Contractor to see that he restores the foregoing items to their original state at his own expense, as part of the work of the project.

F. Any unusual existing conditions, other than as those indicated, specified and/or shown on the Drawing, shall be brought to the attention of the Contracting Officer prior to any removal and/or changing. Any changes must be directed by the Contracting Officer. All other changes are considered unauthorized and if performed will be at the contractor's cost.
