Justification and Approval for Other than Full and Open Competition Justification

1. Contracting Activity:

National Guard Bureau Operational Contracting Division (NGB-AQ) 43200 Maple, Bldg. 105, Room 36 Selfridge ANGB, MI 48045

2. Description of Action: A new competitive firm fixed price construction contract which includes “Brand name only” components listed below, which will be awarded using O&M ANG funding.

3. Description of Supplies/Services: Repair Building 909 (Project No. CRWU06-2003) in support of the Colorado Air National Guard (COANG) at Buckley Air Force Base, Colorado that includes the four (4) “Brand Name” components below:

a. Best Lock Cores. These are the door hardware lock cores required to be utilized on all facilities on Buckley Air Force Base in order to comply and integrate with the current system utilized by the 460th Space Wing, Buckley Air Force Base Host, on all facilities located on Buckley Air Force Base. The use of a single lock core enables the systematic management of the lock system on the host base facilities including those belonging to the COANG. Providing a single lock core for all installation buildings allows for single keying a tracking mechanism, an emergency response master key to work properly in emergency situations for both security forces and fire department and reduced maintenance and training costs for the COANG over the lifecycle of the building. The current government estimated direct material cost of the brand name component listed is $3,200.

b. Delta Direct Digital Controls (DDC). This is an integrated base wide mechanical controls system required by the installation to control services, monitor performance and energy use. This system enables the project facility controls system to interface with the existing Energy Management and Control System (EMCS) on the base via fiber connection to the project facility. A single controls vendor for the COANG Buckley ANGB allows for the seamless integration between all facilities, simplified and reduced training costs for end users, reduced maintenance costs over the lifecycle of the building, reduced cost of spare parts and service maintenance contract costs, and in the event of a system failure reduced downtime for the unit. The current government estimated direct material cost of the brand name component listed is $20,800.

c. AES Fire Alarm Radio Transceiver. The system is currently utilized by the 460th Space Wing, Buckley Air Force Base Host, on all facilities located on Buckley Air Force Base. The system is required to communicate with the established base wide fire alarm system currently installed and utilized at Buckley Air Force Base and to communicate with the Base Fire Control Room thus assuring immediate fire rescue response time to the facility and users when triggered. Providing a single Fire Alarm Transceiver allows for the seamless integration between all installation facilities reduced maintenance costs over the lifecycle of the building, reduced cost of spare parts and reduced service maintenance contract costs. The current government estimated direct material cost of the brand name component listed is $11,600.

d. High Expansion Foam (HEF) Ansul Jet X. HQ Air Force Civil Engineer Center (AFCEC) hangar Fire Protection Engineer (Subject Matter Expert) for all Air Force hangars requires each base to utilize HEF generator systems. The use of a single Ansul Jet X HEF generator and concentrate vendor for the COANG enables the installation to systematically manage the HEF systems on the base. The HEF generators and concentrate will be of the same manufacturer as all the other installed and functioning systems on the installation, including Hangar 801, the Fuel Cell/Corrosion Control facility, the six (6) Alert Hangars, and the Colorado Army National Guard Hangar.

Providing a single HEF vendor and 2.75% concentrate for all the aircraft hangars allows for seamless integration between the facilities, reduced system maintenance costs and upkeep, reduced requirements for storage space, significantly reduced the risk of system failure by introducing the incorrect concentrate into the system, and less expensive HEF testing contracts for the COANG over the lifecycle of the building.

The current government estimated direct material cost of the brand name component listed is $247,600.

4. Authority Cited: The statutory authority permitting Other than Full and Open Competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.203-1, Only one responsible source and no other supplies or services will satisfy agency requirements – it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

5. Reason for Authority Cited: HQ Air Force Civil Engineer Center (AFCEC) hangar Fire Protection Engineer has national standards for installation of High Expansion Foam (HEF) systems for all new or renovated hangars. The requirement is in response to mitigating the risk of repeated false alarms and inadvertent discharges of the system. This COANG requirement will reduce the risk of accidental aircraft damage, unnecessary cleanup and lost mission or aircraft down time and allow for systematic management of these systems in Building 909 and all other hangars for the COANG.

Maintenance and repair training for these systems is brand name specific, and it is necessary to integrate the Building 909 facility and facilitate the seamless communication between the COANG facilities and the Buckley AFB base host facilities as well as allow for spare parts compatibility and reduce storage and efficient training requirements. With multiple brand names, the end user of the facility would need to be trained on how to utilize, maintain, and repair all the different systems. The costs over the lifecycle of the facility would also be increased for service and annual maintenance.

The Base Civil Engineer spare parts inventory will remain manageable will all systems of the same brand name. Also for every brand name specified, a different software system is required;

resulting in additional costs to the government for the purchase and maintenance of each system.

By using the aforementioned systems listed in this document, communication and compatibility issues will be alleviated and result in a fully integrated and functioning base wide system.

Having the same brand name on all required systems would be the most cost effective solution for the government.

6. Efforts to Obtain Competition: The solicitation being issued will be a total small business set aside competitive Request for Proposal. The brand name components represent a small portion (2.5%) of the overall construction project that is being competed.

7. Actions to Increase Competition: The solicitation being issued will be a total small business set aside competitive Request for Proposal. The brand name components represent a small portion (2.5%) of the overall construction project that is being competed.

8. Market Research: The following market research techniques (FAR Part 10) were conducted within the previous 12 months:

a. Contacted knowledgeable individuals in the Government, including the COANG Base Civil Engineer and Deputy Base Civil Engineer, and industry regarding the market capabilities to meet the requirements.

b. Querying the Government wide database of contracts and other procurement instruments intended for use by multiple agencies that provide information relevant to agency acquisitions. Search of www.fbo.gov indicated within the last 12 months that other agencies, such as Department of the Army USACE District Los Angeles and Department of the Navy NAVFAC Southwest have also posted similar justifications for brand name requirements for their applicable construction contracts.

There are no know alternative systems that are fully compatible with the systems based on lessons learned from previous similar construction projects and expert judgement by subject matter experts and the experience of the COANG and Air Force.

9. Interested Sources: To date, no other sources have written to express an interest. There are no known alternative systems that are fully compatible with the aforementioned systems based upon lessons learned and expert judgement by the subject matter experts and experience of the Colorado Air National Guard, National Guard Bureau, and Air Force. The notice of intent to sole source was posted to www.fbo.gov on 29 March 2016 as part of the construction pre-solicitation notice.

10. Other Facts: The selection of these systems has been used on all previous construction contracts accomplished at Buckley AFB for the COANG. Consistency of the systems is required to:

a. Ensure facility security on the installation

b. Ensure seamless integration and communication of COANG facility to Buckley

AFB host systems

c. Reduce maintenance costs over the lifecycle of the facility

d. Reduce training costs and requirements for end users

e. Reduce response time in emergency situations

f. Reduce spare parts stock costs for COANG

This justification will be posted with the solicitation of the construction project.
