JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: US Army Engineer District, Corps of Engineers, PO Box 59, Louisville, KY 40201-0059

2. Description of Action: Approval is requested to utilize a Fire Alarm and Mass Notification System (MNS) parts manufactured by SimplexGrinnell, as to be compatible with the current Detroit Arsenal network.

3. Description of the Supplies/Service: Description of the Supplies/Service: The contract solicitation will include a sole-source brand requirement for SimplexGrinnell Fire Alarm and MNS parts that will tie into the installation’s existing system. The estimated dollar value of the SimplexGrinnell parts is

4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This authority is applicable to brand name acquisitions in accordance with FAR 6.302-1(c).

5. Reason for Authority Cited: Currently all buildings at Detroit Arsenal use the SimplexGrinnell Fire Alarm and MNS. This system utilizes the IDNet protocol to communicate with the signaling devices, which is a closed source system that utilizes proprietary communication protocols. Because of this, the installation mandates the use of SimplexGrinnell parts in their project design requirements in order to ensure compatibility with the current installation wide network. Attempting to integrate parts outside the current network poses unacceptable risks, because it would affect the system’s ability to maintain proper communication with the Detroit Arsenal Fire Station, which could negatively impact the Station’s response time and lead to significant life, health, and safety consequences.

6. Efforts to Obtain Competition: None, for the reasons cited above.

7. Actions to Increase Competition: None, for the reasons cited above.

8. Market Research: SimplexGrinnell parts are available commercially through various avenues and are not limited in availability to other sources.

9. Interested Sources: SimplexGrinnell is the sole provider of fire alarm system parts that tie into the existing system at Detroit Arsenal.

10. Other Facts: N/A

11. Technical Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
