52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

Award will be made using the Lowest Price Technically Acceptable Process (LPTA), in accordance with FAR 15.101-2. The LPTA process does not permit tradeoffs between price and non- price factors.

**The term “relevant” or “relevancy” refers to the present/past performance effort involving essentially the same scope and magnitude of effort and complexities this solicitation requires.

Evaluation Factor 1: Technical Evaluation Factor 2: Past Performance Evaluation Factor 3: Price

Factor 1 -Technical: The term “technical,” as used herein, refers to non-price factors other than past performance.

The purpose of the technical factor is to assess whether the offeror’s proposal will satisfy the Government’s minimum requirements. The technical elements below will be used in the evaluation:

Technical Element 1: Specifications and Schedule Related Items

a) Completed table documenting the proposed pieces of equipment and system components.

b) Provide descriptive literature such as illustrations, specifications, drawings, Brand Name, Part/Model Number, or a clear reference to the equipment and/or system being proposed. This equipment and/or system shall include, but not limited to, the following equipment: Exciters, Governors, 15kV Switchgear, 480VAC Switchgear, Switchgear Building, Duct Bank, 15kV Cables, surge protection, transformers, and tray. a) Identify the specific individuals (IE site superintendent and primary installation technicians) who will be on-site during the installation and testing, and provide documentation/certifications demonstrating that the individuals proposed to perform the work have the necessary training and certifications to install the systems being proposed.

b) The Offeror must demonstrate that its firm has relevant technical experience for Project

Management. The Offeror must self-perform the overall Project Management for this contract.

Proposals will be evaluated to determine Project Management Experience for relevant projects of the scope and complexity required in the solicitation. Provide a description of relevant projects to include the title and location of the project, contract amount, the start and completion dates (or anticipated completion date) of the contract, a brief description of the work, the offeror’s specific role on the project, and a point of contact for the project customer/client that includes the person’s name, title, and current phone number. Project descriptions shall include adequate detail to demonstrate the relevancy of the scope of work for comparison to that required in this solicitation.

The Offeror shall demonstrate experience of key members of the proposed project management team for completion of the planning, scheduling, submittal management, equipment and material procurement, management of subcontractors and suppliers, installation, and commissioning/testing for electrical construction projects similar in type and complexity. c) The Offeror must demonstrate that its firm or proposed sub-contractors have the relevant technical experience in the following fields:

i. Electrical Construction Experience

i. Electrical construction in any type of power plants which required the installation,

ii. Installation and commissioning of equipment types and classes for 15kV metal-clad switchgear, 15kV cable, 480V switchgear, 750 kVA or larger dry-type transformers, Supervisory Control and Data Acquisition (SCADA) systems, hydropower generator digital governors and exciters.

ii. Electrical Equipment Commissioning Experience

i. Commissioning in any type of power plants which required the installation,

ii. Commissioning of equipment types and classes for 15kV metal-clad switchgear, 15kV cable, 480V switchgear, 750 kVA or larger dry-type transformers, Supervisory Control and Data Acquisition (SCADA) systems, hydropower generator digital governors and exciters.

iii. Engineering Experience

i. Engineering design in any type of power plants which required the installation,

ii. Engineering of equipment types and classes for 15kV metal-clad switchgear, 15kV cable, 480V switchgear, 750 kVA or larger dry-type transformers, Supervisory Control and Data Acquisition (SCADA) systems, hydropower generator digital governors and exciters.

iv. Programming Experience for equipment proposed

i. Programming in any type of power plants which required the installation,

ii. Programming of digital equipment for Supervisory Control and Data Acquisition (SCADA) systems, hydropower generator digital governors and exciters, and digital protective relays.

d) Proposals will be evaluated to determine Subcontractor and Supplier Experience for relevant projects of the scope and complexity required in the solicitation. For purposes of this evaluation, major subcontractors and suppliers are defined as:

i. Equipment Installation Subcontractor

ii. Supplier and Installation Subcontractor of Switchgear Building

iii. Testing and Commissioning Subcontractor

iv. Governor Controls System Subcontractor and/or Supplier

v. Exciter Subcontractor and/or Supplier

vi. Governor Hydraulic System Refurbishment Subcontractor(s)

vii. Governor Oil Pump Motor Rewind Subcontractor

viii. Suppliers of Switchgear, Substations, Motor Control Centers and Panelboards, Transformers and Controls Equipment.

The Offeror shall document the roles and responsibilities of each proposed company and list which company will furnish what equipment or services required by this solicitation. The proposal must demonstrate that each of the above subcontractors and suppliers have a minimum of ten (10) years relevant experience.

In order to be rated Acceptable for Technical Elements 1 and 2, contractor proposal must provide all requested information. Failure to provide requested information for Technical Elements 1 and 2; or providing information that does not show technical relevance to the information being requested will result in the contractor proposal receiving an Unacceptable technical rating.

Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

Factor 2 – Past Performance: Past performance will be used as an evaluation factor within the LPTA process in accordance with FAR 15.101-2(b). It shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. The Government reserves the right to obtain Past Performance information from any other sources available to the Government. This includes, but is not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency. While the Government may elect to consider data from other sources; the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror. The past performance elements below will be used in the evaluation:

1. A minimum of three comparable projects submitted by Contractor and subcontractors that are similar in size, scope, and complexity as proposed contract action for the Philpott Rehab Project. Projects must have been completed in the past 10 years by both the prime contractor and any subcontractors proposed as part of the team. Include reference contact information for each project.

Past Performance Evaluation Ratings Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).

Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Factor 3 – Price: The LPTA process is applied to known, firm requirements, usually readily available in the commercial marketplace where a fair and reasonable price determination is based on adequate price competition.

Therefore, price analysis will be used to determine the total evaluated price to support the selection of the lowest priced, technically acceptable offeror. Price will be the determining factor for award after the determination of the technical acceptability of all offers. It is the Government’s intent to award to the offeror who presents the lowest priced, technically acceptable proposal. The price elements below will be used in the evaluation:

Completed bid schedule that includes pricing for each CLIN of the solicitation.

Contractor quotes must include the following:
