Department of the Army U.S. Army Corps of Engineers Los Angeles District

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN

COMPETITION

1. Contracting Agency: The contracting agency responsible for this procurement action is the U.S. Army Corps of engineers, South Pacific Division, Los Angeles District (CESPL), Los Angeles, CA.

2. Description of Action: A new competitive firm fixed price construction contract which “includes brand name only” components listed below as their standard.

3. Description of Supplies/Services: Construct a new Community Living

Center at the Tibor Rubin VA Medical Center (VALB MC), Long Beach, CA.

This new construction includes the “Brand Name” component:

Johnson Controls Inc, Metasys Building Automation and Control Systems (Metasys System) is the Medical Center’s standard for Direct Digital Control systems. The current government estimated direct material cost of the brand name component listed is: $

4. Authority Cited: 10 U.S.C. 2304(c)(1) and FAR 6.302-1 and 11.105. Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: VAMC Long Beach has established or received accreditation for the item listed above as their standard for the use on the Medical Center campus.

Maintainable connectivity and system integration are the basis for the authority cited in paragraph 4. Johnson Controls Inc, Metasys Building Automation and Control Systems (Metasys System) is the overall control for Heating and Ventilation and Air Conditioning (HVAC) systems in the main hospital building (Building 126) and all surrounding buildings. The operations, maintenance, and training for these systems is brand name specific. A noncompatible system will cause increased maintenance problems as well as an increase in acquisition cost by having to purchase the front-end hardware/software. Conformity with the existing Metasys System will also allow for spare parts inventory to remain manageable and cost effective.

6. The Solicitation being issued will be an unrestricted competitive RFP. The brand name components represent a small portion of the overall construction project that is being competed.

7. Actions to Increase Competition: See Paragraph 6 above.

8. Market Research: An internet search was done and there are other mechanical control systems which could be used; however, the installation of other systems will not be compatible with Metasys, which is the Medical Center’s standard for the security system and would cause increase maintenance problems and equipment monitoring.

The Metasys System has been installed in this medical center to monitor and control all Critical and non-critical mechanical equipment throughout the facility.

The system is currently monitoring and controlling the temperature, humidity, and pressures required by Joint Commission. The system also monitor the Critical alarms and provide Notifications to facility staff to provide timely response to emergencies.

The Metasys System (proprietary) was originally furnished and installed in 1990's by Johnson Controls, Inc. who is the sole source manufacturer/provider of the Metasys System products listed on GSA contract number GS-07F-190CA. The system has been upgraded to the latest version.

The purpose of the subject project is to connect the new Community Living Center building to the existing campus wide system. The new buildings will be served by the existing central plant. VALB MC's goal is to expand on the existing system in order to reduce building energy consumption and improve building indoor air quality and environment for the patients. If another vendor is selected, the cost to replace the existing system will have to be added to this project. That cost could be in the range over few million dollars. Furthermore, additional training for the facility staff and cost of service agreement will also have to be considered.

A different software system is required; resulting in extra costs for the purchase of each system. By using Metasys alleviates communication and compatibility issues caused by using multiple brand name systems and the result is a fully functioning base wide system.

In compliance with FAR 8.405-6, it is important to have the Johnson Control to upgrade the HVAC control systems and to connect them to the existing Metasys system, so that the on-going warranty of the existing Metasys System will not be interfered. In addition, it will be more economical to do so, since Johnson Controls, Inc. has the maintenance and repair contract with this medical center.

Construction time and costs can be saved due to their familiarity to the facility and utility systems of this medical center.

There are no known alternative systems that are fully compatible with these systems based on lessons learned and expert judgment by subject matter experts and experience of the VA Medical Center.
