SECTION 00120
PROPOSAL EVALUATION AND CONTRACT AWARD
1. ELIGIBILITY FOR CONTRACT AWARD
In accordance with the FAR, no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the contracting officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in Part FAR 9 and any special standards set forth in the solicitation.
2. SOURCE SELECTION USING LOWEST PRICE TECHNICALLY ACCEPTABLE
(a) The Government will make award to the Offeror submitting the lowest priced technically acceptable proposal. The Government will first review unpriced technical proposals to determine which proposals are acceptable to the Government. Offers that are determined to be technically “Acceptable” will be evaluated on the basis of price.
Offers that are determined to be “Non-Acceptable” will not receive further consideration.
(b) Responses that the Offeror understands, or will comply with the specifications, statements paraphrasing the specifications, and general or overly broad responses such as “standard procedures will be employed” or “well known techniques will be used”, will be rated “non-acceptable”.
(c) The objective of the Government is to award a contract to the Offeror who submits a proposal that when evaluated is determined to meet or exceed the acceptability levels established in the solicitation for non-price evaluation factors. Each non-price evaluation technical factor will receive a rating of Acceptable/Non-Acceptable. The award will be made to the technically acceptable proposal with the lowest evaluated proposed price.
3. LIST OF EVALUATION FACTORS (VOLUME II) AND SPECIFIC TECHNICAL
EVALUATION CRITERIA.
The Technical Proposal will be evaluated based on the following technical evaluation factors and standards:
FACTOR 1, TECHNICAL NARRATIVE ON THE FOLLOWING: EXPERIENCE ON SIMILAR
PROJECTS, SPECIFICALLY ON HOSPITAL AND/OR CLINIC ENVIRONMENT;
INFECTION CONTROL PROCESSES
FACTOR 2, PAST PERFORMANCE ON SIMILAR PROJECTS, SPECIFICALLY ON
HOSPITAL AND/OR CLINIC ENVIRONMENTS
FACTOR 3, TECHNICAL APPROACH, METHODS AND PROCEDURES AND SCHEDULE
00120 - 3
FACTOR 4, NARRATIVE ON THE FOLLOWING: CORPORATE/MANAGEMENT STRUCTURE;
CAPABILITY TO MANAGE AND CONTROL PROJECTS; KEY PERSONNEL;
PRESENT WORKLOAD.
In order to be considered technically acceptable, proposals must meet ALL of the following requirements listed in the factors below:
FACTOR 1: TECHNICAL NARRATIVE ON THE FOLLOWING: EXPERIENCE ON SIMILAR
PROJECTS, SPECIFICALLY ON HOSPITAL AND/OR CLINIC ENVIRONMENT; INFECTION
CONTROL PROCESSES
Offeror shall identify at least three projects of similar scope, magnitude (projects no less than $3,000,000) and complexity as the RFP requirement it and/or its proposed team (i.e., predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement) has/have successfully completed within the past five years and provide a technical narrative of those projects identified with the following:
experience on similar projects, specifically on hospital and/or clinic environment involving infection control processes. Projects referenced in Factor 1 are required to be reference in Factor 2.
EXPERIENCE ON SIMILAR PROJECTS, SPECIFICALLY ON HOSPITAL AND/OR CLINIC
ENVIRONMENT.
The Offeror and its proposed team will be evaluated by identifying at least three successfully completed projects within the past five years in a functioning, operational Department of Veterans Affairs Hospital and/or clinic or other hospital and/or clinic environment and providing a narrative of experience on similar projects, specifically on hospital and/or clinic environment. The narrative shall include a description of the project; total dollar value of the project at the time of award and at the time of completion, the Offeror’s role in the project (i.e., as a prime or a subcontractor), and the name, address and telephone number of the owner. In the case of a federal, state or local government project, provide the name, address and telephone number of the contracting officer. Offeror may include projects completed by predecessor companies. Offeror must include a general description of the infectious control processes involved in the projects. Offeror must explain why it believes the proffered projects are similar in scope, magnitude and complexity to the RFP requirement. When relying on the specific, relevant experience of key personnel, and/or major subcontractor, the description must include, in addition to all the above information, and explanation of what role the key person or subcontractor played in the former project, and what specific role that company, key person or subcontractor would perform in this project.
INFECTION CONTROL PROCESSES.
The Offeror will be evaluated by providing a technical narrative of demonstrated knowledge and experience performing construction projects requiring strict adherence to stringent Infection Control Requirements.
Standard for Acceptability: This standard is met when the Offeror can provide a technical narrative of construction experience in three or more completed projects within the past five years; similar in scope, 00120 - 4 magnitude (no less than $3 million) and complexity on the following:
experience on similar projects, specifically on hospital and/or clinic environment involving infection control processes. Experience of predecessor companies, key personnel, and major subcontractors may be used to qualify for this factor so long as the key person and/or major subcontractor will participate in this project in a meaningful way.
Projects referenced in Factor 1 are required to be referenced in Factor 2.
FACTOR 2: PAST PERFORMANCE ON SIMILAR PROJECTS, SPECIFICALLY ON
HOSPITAL AND/OR CLINIC ENVIRONMENTS.
For each project identified in Factor 1, provide a customer survey describing the scope of the work, contract price at the time of award, project cost growth during contract performance, and contract price at the time of completion. Describe the contract performance period set forth in the contract, time growth during contract performance, if any, and the number of days from the start of the project to acceptance by the owner/government agency. Provide a general description of the safety protocols employed and the number of safety-related incidents or accidents, if any, and if there were infectious control protocols involved, a description of any breach events and how they were resolved. Identify and describe any warranty issues raised by the owner, and how the problems were resolved. If no warranty issues were raised, Offerors should so state. Offerors may provide information on problems encountered on the projects and the Offeror’s corrective action. Identify and include results, if any of litigation regarding the project.
The Government may consider any and all sources of information about the projects, including, but not limited to, contacting the owner or contracting officer of the project, and the CCASS rating system. Firms who have a less than satisfactory performance evaluation should explain from the perspective what happened and lessons learned from the experience. This factor will evaluate how well an Offeror has performed on projects of a similar scope, magnitude, and complexity, and is an indicator of the likelihood of completion of the project in terms of time, cost and quality of work. Past performance must be demonstrated within a functioning, operational Department of Veterans Affairs Hospital and/or Clinic, or other Hospital and/or Clinic environment.
In addition, the Government will consider Client’s Overall Satisfaction with Project. A Past Performance Questionnaire to be submitted by Offeror’s current/former client/customer is included for your use;
refer to Section 00110. The Offeror must provide its client information, as described in Factor 4. The Offeror’s Client will be contacted. The clients’ responses to the following questions will be considered:
(1) Where Key Personnel responsive to Client’s needs?
(2) Did Key Personnel have the authority to meet the project objectives?
(3) Were Key Personnel responsive to Client’s requested changes?
(4) Was the Client satisfied with technical knowledge of Key
00120 - 5
Personnel?
(5) Would the Client use this company again?
(6) Was the staffing level consistent with the project size and complexity?
(7) Was communication of schedule and/or project issues adequate and consistent?
(8) Was the team’s response time to Client’s questions acceptable?
(9) Did the Offeror’s or Subcontractor’s performance conform to the terms of the contract?
Standard of Acceptability: This standard is met when the Offeror has demonstrated an overall satisfactory performance evaluation or higher, on similar contracts/projects within functioning, operational Hospital and/or Clinic, completed within the past five years. In the event that the Offeror does not provide a record of relevant past performance, the Offeror will not be rated favorably or unfavorably on this factor.
Consideration of Client Overall Satisfaction will be made. Projects referenced in Factor 1 must be referenced in Factor 2. Experience of predecessor companies, key personnel, and major subcontractors may be used to qualify for this factor so long as the key person and/or major subcontractor will participate in this project in a meaningful way.
The Government may will consider information submitted by the Offeror and the past performance surveys submitted by the owner/client along with any other relevant and reliable information that the Government may obtain from other sources (including information from Government personnel and databases).
FACTOR 3: TECHNICAL NARRATIVE ON TECHNICAL APPROACH, METHODS AND
PROCEDURES AND SCHEDULE
