About this file

This document is a federal contract solicitation amendment (SF 30) for the San Joaquin/Port of Stockton Deep Water Ship Channel (DWSC) FY25 Maintenance Dredging Project. The amendment addresses several key modifications, including incorporating the government's responses to two Request for Information (RFI) sets, correcting the title of the dredging plan and equipment schedule, and deleting the FAR 52.246-21 Warranty of Construction clause.

The amendment includes responses to contractor questions covering topics such as dredging reaches, fish monitoring requirements, sediment trap overdepth specifications, and disposal suitability. Notably, the government clarified that contractors must use a methodology to monitor for entrained fish with a goal of monitoring at least 30 percent of dredged material. The project involves annual maintenance dredging of the San Joaquin River/Stockton DWSC to -35-ft MLLW with 1-ft paid overdepth, with the sediment trap to be dredged to -38.5-ft MLLW plus 1-ft paid overdepth. The effective date of the amendment is 05 MAY 2025.

It is possible that the information below does not reflect 100% of the questions and responses. The questions and comments do not necessarily represent questions received from any particular contractor.

RFI # 1

SPEC SECTION/DRAWING RFI QUESTION RESPONSES

1 Topic: Dredging Reaches

Drawing: G-002

Section: Bid Schedule

Subpart: N/A

Specification Language:

1.1 Question: The Bid Schedule lists 23 reaches to be dredged and based on the depths shown, Reach 22 corresponds to the Sediment

Trap. However, the Plans and language in the specifications reference 15 dredging reaches with Reach 15 corresponding to the

Sediment Trap. Please clarify which is correct and update the documents for consistency between the Bid Schedule and the

Specifications and Drawings

The Bid Schedule is incorrect. For the 15 correct reaches please refer to the plans. The Amendment 0001 Schedule has been issued in SAM.gov.

2 Topic: Reporting of Biobased Products

Drawing: N/A

Section: 00 70 00

Subpart: FAR 52.223-2 Reporting of Biobased

Products Under Service and Construction

Contracts. May 2024

Specification Language:

2.1 Question: Upon careful review, the Contract does not set forth any minimum biobased content percentage for any product within any Biobased Product Category. Because the contract will not involve the use of biobased products in USDA-designated product categories at https://www.biopreferred.gov or 7 CFR part 3201, we respectfully request that you remove FAR 52.223-2 from this

Contract.

Due to the uncertainty of whether the prospective awardee will utilize any biobased products in the USDA-designated product categories, the clause is required at this time.

3 Topic: Warranty of Construction

Drawing: N/A

Section: 00 70 00

Subpart: 52.246-21 Warranty of Construction.

(Mar 1994)

Specification Language:

3.1 Question: Unlike land-based construction, completed dredging activities are subject to natural forces that are entirely outside the control of the Contractor. To clarify the intent of the warranty, please confirm that the warranty provisions do not apply to the dredging portion(s) of the work. With respect to dredging, upon

Contractor’s advising Owner that the dredging has been completed, Owner shall inspect the Work and, if acceptable, shall advise Contractor of Owner’s acceptance thereof. Contractor in no way represents, guarantees or warrants that any dredging or excavation will stay open, dredged or excavated for any period of time whatsoever.

FAR 52.246-21 Warranty of

Construction is deleted from the solicitation via Amendment 0002.

QUESTIONS & RESPONSES

4 Drawing: N/A

Section: 01 57 19

Subpart: 3.1.4 and 3.1.4.1

Specification Language: 3.1.4: The Contractor will either utilize a fish entrainment device at the point of discharge of the dredged material, sample scows (if dredging is conducted using a clamshell), utilize a fish entrainment device fashioned to work with a clamshell, or other similar methods.

3.1.41: The Contractor shall furnish a fish monitoring apparatus and transport the apparatus to the various dredged material placement sites as well as within each placement sites.

4.1 Question: If 30% of dredged material is

sampled at the dredged site (scow or bucket), is the fish monitoring apparatus still required at the point of discharge?

No, a fish monitoring apparatus is not required at the point of discharge, per the United States Fish and Wildlife Service (USFWS) Stockton Deep Water Ship Channel Biological Opinion (2023-2028) attached to the specifications. The Contractor can propose any methodology so long as the goal of at least 30 percent of dredged material monitored can be met. The Government will review and approve of the methodology via the Submittal: Fish Entrainment and Biological Resources Monitoring Work Plan.

5 Topic: Sediment Trap Overdepth

Drawing: N/A

Section: 35 20 23 and 01 11 00

Subpart: 1.5.1.5 and 1.1.1.

Specification Language 1.5.1.5: Dredging in this 2' Prism is authorized but not required except Reach 15 (the sediment trap). Dredging within the Allowable (Unpaid)2' Overdepth

Prism is NOT permitted for the sediment trap.

Specification Language 1.1.1: Dredge the specified dredge reaches to -35-ft MLLW plus

1-ft of allowable paid overdepth in San

Joaquin River / Stockton DWSC in all

Reaches, except for the Sediment Trap, which shall be dredged to -38.5-ft MLLW with 1-ft of allowable paid overdepth.

5.1 Question: The above referenced specification

language is unlcear. Please clarify what, if any, overdepth dredging is allowed for the Sediment

Trap. Does the Sediment Trap include 1’ of paid overdepth to -39.5’ MLLW? If so, is any additional dredging/disturbance allowed beyond this?

The sediment trap includes 1’ of paid overdepth to 39.5’. No dredging below 39.5’ is allowed in the sediment trap per environmental restrictions.

6 Topic: Environmental

Drawing: N/A

Section: Sacramento DWSC BO 2023-2028 (1)

The Corps Engineering Research and Design

Center is currently in the process of designing a fish monitoring screen for use with mechanical dredgers which would function similarly to the

6.1 Question: Is the Government requiring the

Contractor, if utilizing a mechanical dredge, to use an

“experimental device” for the San Joaquin/Port of

Stockton DWSC FY25 Maintenance Dredging

Project?

6.2 Question: If yes, what is the device, how will it

be implemented, and what is required of the

Contractor regarding the use of the device?

6.1 - Yes, the Contractor must use a methodology to monitor for entrained fish, with goal of at least 30 percent of dredged material monitored.

6.2 - The Contractor can propose any device so long as the goal of at least 30 percent of dredged material monitored can be met. The Government will review and approve of the device and how it will be

fish entrainment monitoring device in use for hydraulic dredgers. To further this effort to quantify take of listed species in real time, maintenance dredging completed under this project would utilize the experimental device and provide reports to determine the feasibility of permanently including this monitoring measure.

6.3 Question: Can the Owner please provide

information on how the fish monitoring requirement has been fulfilled with clamshell dredges in the past?

implemented via the Submittal: Fish Entrainment and

Biological Resources Monitoring Work Plan.

6.3 - Offloading upland, where a screening device was furnished that was able to sift out water and sediment away that made it able to monitor for entrained fish.
