The following items are applicable to this modification:
SUMMARY OF CHANGES
C. BID OPENING: The bid opening date is hereby changed to September 23, 2013. Bids remain due by 11:00 AM CDT. The designated bid opening room remains the Fort Dearborn Room, located on the 16th floor at 231 South LaSalle Street, Chicago, Illinois 60604.
D. DELIVERY OF BIDS: Section 00010, “Important Notes” Paragraph 5.f is hereby revised to read as follows:
Hand-carried Bids Delivered on the Day of the Bid Opening: For bids being hand-carried after 9:00 AM12: NOON on the date of the bid opening, the bidder shall contact the Contracting Branch at 312-846-5373 or 312-846-5370 to have its bid retrieved from the Lobby Area of the District’s facility, located at 231 S. LaSalle St., Suite 1500, Chicago, Il. 60604. Prior to 9:00 AM 12: NOON on the date of the bid opening, it is the responsibility of each bidder to ensure that its Bid is received by the Chicago District’ – USACE Contracting Branch, located at 231 S. LaSalle St., Suite 1500, Chicago, Il. 60604 prior to the date and time set of the opening of bids.
E. FUNDING STATUS: The required funding approval has not been acquired. Pursuant to the Contingency Statement provided in Amendment 0002, the USACE is under no obligation to receive bids for this project until the required funding approval has been acquired. The USACE has not acquired said approval; when said approval is acquired, offerors will be notified by another Amendment.
F. USACE’s RESPONSES TO CONTRACTOR’S INQUIRIES: Provided below are the USACE’s responses to all questions received from contractors.
Question 1. This question pertains to Question 2 in Amendment #3. We understand that the contractor is responsible for the proposed disposal location plan and that all the testing of the material and certifications are our responsibility. We don’t understand what costs we need to include in our proposal. Should we presume for bidding that the material is “clean” fill and can be disposed of in a CCDD facility? If we do that and environmental testing shows the material to be contaminated will the contractor be awarded a change order for the additional cost to landfill the material?
USACE Response 1: The bidder should assume CCDD disposal for all material except for soil. As part of this amendment two option bid items have been added for the disposal of excess soil at either a CCDD facility or landfill. These option bid items are cost reimbursable and payment will be executed based on the results of the testing required in specification section 01 57 20.01.
Question 2. Response 21, in Amendment #1, stated that Section 3.5 of the Specs addresses the compaction requirements for the beach replenishment materials. According to Spec Section 310000, 3.5 Degree of Compaction, wetland or native plant areas are not compacted and pathways are compacted to 95% of Standard Proctor. Is the entire beach area considered wetland area or pathway area? Please define “pathway area” and “wetland area” as they apply to the beach.
USACE Response 2: Subpart 3.5 goes on to state "...or at least minimized in order to promote native plant growth." Unless the Contract plans have areas designated as "pathway" (which shall be compacted to 95% Standard Proctor density in accordance with ASTM D 698) the beach replenishment material should be placed within the beach area in order to promote native plant growth whether or not the areas will be planted.
In areas that will be planted, please note that per Spec Section 32 93 03, subpart 3.1.1 "The Contractor shall prepare the planting area for optimal germination and establishment of native plant species and so that the performance standards are met."
Question3. Addendum #4, Summary of Changes part D., references bids being Hand Carried after noon on the date of the bid opening. However, this conflicts with the bid time which is 11:00 am. Please clarify the bid opening time.
USACE Response 2: Delivery of Bids language has been revised via this Amendment.
See “D” above.
G. SPECIFICATIONS: The text of the below listed specification section has been revised and is attached hereto. Deletions are struck through and additions are underlined.
01 22 00 MEASUREMENT AND PAYMENT
H. SECTION 00010 BID SCHEDULE: The bid schedule has been revised and is attached hereto.
Contractors shall use the revised bid schedule to submit their Bids.
I. AWARDING OF OPTIONS: Section 00010, “Important Notes” Paragraph 4 is hereby revised to read as follows:
4. AWARDING OF OPTIONS: At the government’s discretion, any, all or none of the Option Line Items (CLINS 0012 through 00140015, and 0017) may be awarded no later than 182 days after the Notice to Proceed has been acknowledged by the contractor. At the government’s discretion, any, all or none of Option Line Items 0015 through 0016, and 0017 may be awarded within 30 days following Government approval for the Contractor’s Disposal Plan. No additional time will be added to the contract for award of Option CLINS. Should the government determine it necessary to exercise an Option (Line Items 0012 through 00160014), Options may be awarded in any order at the government’s discretion. The order of awarding the Options does not apply to the Payment and Performance Bond (Line Item 0017 0015); additional bonding is required any time the contract value is increased, meaning Option Item 0017 0015 must be awarded if any of the options are exercised.
