C. BID OPENING: The bid opening date and time are hereby changed to September 17, 2013 at

11:00 AM CDT.

D. 401 PERMIT: The required 401 Permit has been acquired. Therefore, the contingency statement is hereby removed from this Solicitation.

E. Pre‐Bid Meeting Attendance: The sign‐in sheet for the Pre‐Bid Meeting is attached hereto.

F. USACE’s RESPONSES TO CONTRACTOR’S INQUIRIES: Provided below are the USACE’s responses to all questions received from contractors.

Question 1. Plan sheet CD101 Demolition Plan. There is a pipe pile structure located in the water and adjacent to the parking lot. It looks like a weather station. The plan does not show

it. It will be in the sand fill area. Is this to be removed under this contract?

USACE Response 1: The weather station mentioned above, should be removed and safely stored on‐site during which time the Highland Park Park District will make plans to pick up the weather station. See revised sheet CD101.

Question 2. Plan sheet CD101 Demolition Plan. Adjacent to the concrete fish pier there are slabs of concrete and pieces of the structure lying on bottom and on shore. Are these to be removed as well?

USACE Response 2: Yes.

Question 3. Bid item 0002AC. Sheetpile Groin Removal. The payment item includes removal and disposal of the existing sheet pile structures. Section 31 41 16 page 4, 3.3 Removal. This section mentions extracting, sorting, cleaning, and storing piling by groups as if the intent was to salvage and reuse existing piling. Please clarify that none of the existing piling is to be salvaged and that the new groins will be new material.

USACE Response 3: There is no intention of salvaging the existing sheet pile called out for removal on the plans. See the revised spec section 31 41 16, which is included in this amendment, paragraph 3.3 has been removed. The proposed groins shown on the plans will be constructed from brand new sheet piling.

Question 4. Plan sheet CS501 Typical Beach Cross Sections. The sections for the Middle and South Groin show heavy black lines and dimensions. Are these supposed to represent the lengths (60’ and 30’) and heights (6’ and 3’) of the optional concrete cap? If so, the 6’ dimension is shown to extend below elevation 577.5’. With the top of sheet at 585.0’ the bottom of concrete should be 579.0’. Please confirm that the concrete is to be 6’ tall and not 8’ that is shown on the sections.

USACE Response 4: The heavy black lines are depicting the optional concrete cap. Included in this amendment is a revised sheet CS501 that revises the length and height of the optional concrete cap. The revised sheet now shows the optional concrete cap running the full length of the groin and the height transitions from 6’ to 4.5’ ft to a 3’ height.

Question 5. Optional Bid Item 0014 Groin Armor Stone 1.5 – 3.0 Tons. Where will this material be placed?

USACE Response 5: This material will be placed around the two proposed groins located south of the parking lot. See the callouts in the plan view and notes on sheets CG001 and

CG002.

Question 6. On Sheet CS502 of the plans there is a designation for Armor A4 on the Class 1 Revetment and Armor A5 on the Class II Revetment. There is not description of these in the specifications.

USACE Response 6: See the revised specification section 35 31 19.45 that is part of this amendment. It addresses the missing information.

Question 7. On Sheet CS503 there is a typical section entitled “Groyne Armor Stone Typical Section”. Could you define the limits of this work regarding which Groynes are to be protected and the length of each?

USACE Response 7: See the callouts in the plan view and notes on sheets CG001 and CG002 to determine which groins are to be protected. The length can be determined from the plans based on the amount of exposed sheet pile and the proposed beach sand contours.

Question 8. I see that the above job is set aside for “Small Businesses”. Does that require a SBA certification?

USACE Response 8: No separate certification is required to compete for this acquisition.

The contractor’s business size must be in compliance with the small business size standards provided in block 10 of the Standard Form 1442. Per the “IMPORTANT NOTES” of Section 00010, bidders must fully complete Section 00600 of this Solicitation. These REPRESENTATIONS AND CERTIFICATIONS contain the required business size representations.

Question 9. What is the compaction requirement for the dune restoration material?

USACE Response 9: Per specification section 32 93 03, subpart 3.1.1 "The Contractor shall prepare the planting area for optimal germination and establishment of native plant species and so that the performance standards are met."

Question 10. Any there any load limits on the access road to the site?

USACE Response 10: The access road to the site is a private road owned by the Highland Park Park District. There are no load limits on the access road. However, any damage to the access road due to the contractor’s construction activities shall be restored to pre‐ construction condition at no additional cost to the government. See note 9 on sheet G‐002.

Question 11. Bid items 0004AA Armor Stone – A4 and 0004AB, Armor Stone‐ A5 size. Is there a specification for these materials missing from section 35 31 19.45 03 Stone Materials and Placement part 2.3?

USACE Response 11: See the revised specification section 35 31 19.45 that is part of this amendment. It addresses the missing information.

Question 12. Bid Item 0005AA Beach Nourishment: can this pay unit be changed into a “per ton” price

USACE Response 12: No.

Question 13. Is the temporary construction fence meant to be 8’ with 3’ concrete posts

USACE Response 13: Yes, per specification section 01 56 26.03.

Question 14. Will 8’ screened fence be required at the perimeter of the project or just around the storage area?

USACE Response 14: 8’ screened fence will be required around the staging and storage area only, and not around the perimeter of project. See notes 1 and 2 on sheet C‐001.

Question 15. Are we to salvage the existing sheet pile walls that are to be removed?

USACE Response 15: There is no intention of salvaging the existing sheet pile called out for removal on the plans. See the revised spec section 31 41 16, which is included in this amendment, paragraph 3.3 has been removed. The proposed groins shown on the plans will be constructed from brand new sheet piling.

Question 16. Item 4 – Awarding of Options on Page 22 of 61 states the options may be awarded 365 days after Notice to Proceed. In the case of Bid item 0014, Groyne Armor Stone, this work could very well be performed the next year after original stone placement, which would include a remobilization to the project site and greatly increase the unit price. Would it be possible to reduce the time limit to a range of 60‐90 days?

USACE Response 16: The time limit for awarding the options has been reduced to 182 days.

See the revised portion of the solicitation document included in the amendment.

Question 17. Section 01 10 00‐1.7 and 31 00 00‐1.4 require that surveys be done by an independent registered land surveyor. Many firms have a registered land surveyor in their employ, and requiring an independent surveyor unnecessarily adds to the cost to the project.

By definition, any registered land surveyor must live up to the code of ethics of its profession.

Furthermore, the requirement for a registered land surveyor is in itself an unnecessary requirement, since the previous projects of this type have not included this requirement.

USACE Response 17: Bid the project according to what is required in the plans and specifications. An independent registered land surveyor will be required as called for in the specifications.

Question 18. Section 01 10 00‐1.21 concerns accommodations for inspectors on marine plants.

Is a field office on site acceptable in lieu of an office on the marine plant?

USACE Response 18: Per section 01 10 00 paragraph 1.21 a field office on‐site is adequate for the government inspector. However, per paragraph 1.21 the contractor is required to provide transportation to and from the marine plant for the government inspector (at no additional cost to the government) who may need to perform inspection of/from the marine plant performing the work.

Question 19. Section 01 22 00‐1.2.4 discusses the measurement and payment for the Beach replenishment. Currently the measurement is by the in place neat line cubic yard. This places the burden on the Contractor for settlement, loss due to waves, and other immeasurable issues. In fairness to all bidders and to deuce the unknown quantity of risk, we would request you consider changing the unit of measure to the ton. We believe that ultimately the price of this work will be reduced by changing the unit of measure.

USACE Response 19: The unit of measure for beach replenishment will not be changed.

Question 20. Section 31 00 02.2.2.1 requires a petrographic analysis, and freeze thaw test be taken after the initial stockpile of 50% of the sand before the material is approved for use. This could take at least 30 days from the stockpile until material could be shipped. Please consider use of current test results of the commercial pit for approval of the material.

USACE Response 20: See revised specification section 31 00 00.

Question 21. Section 31 00 00‐3.10 refers to compaction testing. What is the compaction requirements for the Beach replenishment material?

USACE Response 21: Section 3.5 addresses the compaction requirements as 95% of the Standard Proctor density.

Question 22. Would hydrographic surveys be acceptable for below water surveys as described in Section 35 31 19.45‐1.6.4.1?

USACE Response 22: Yes.

Question 23. The frequency of stone testing is described in Section 35 31 19.45‐2.5. Please consider revising the frequency of tests of A‐Stone to every 5,000 tons. Please clarify the quality frequency of the A Stone and which tests will be required.

USACE Response 23: See revised specification section 35 31 19.45.

Question 24. Due to the size of the stone, please consider revising the tolerance for the backshore revetment as specified in 35 31 19.45‐3.1.1 to +12” to ‐6”.

USACE Response 24: This has been changed. See the revised spec section 35 31 19.45.

Question 25. Will turbidity barriers be required during the stone placement as implied in Section 35 31 19.45‐3.3? This is not practical in Lake Michigan, and has not been previously required during stone placement.

USACE Response 25: Bidders should follow what is in the specifications and provide what is required.

Question 26. Will compaction of bedding stone be required below water? See Section 3.5.2.1.

USACE Response 26: No, underwater compaction is not practical.

Question 27. Can you provide clarification on the following for the Rosewood Park Solicitation.

The following Seed/Plug and Woody Plant Communities listed in the Spec Section 23 93 03 Herbaceous Plant Lists do not match up to any specific CLIN. For the purposes of bidding we will need to know the acreages for each Seed/Plug community & location for Woody Plants and under which CLIN they should be priced. Seed/Plug Communities:

Beach Toe Zone Bank Zone Crest Woody Plants Community Stream Daylighting/Ravine

USACE Response 27: The names of plant communities on the seed/plug/woody plant lists in specification section 32 93 03 have been revised to match names shown on the contract plans. Please note "Dune" on the contract plans has been changed to "Beach". Acreages for each seeding/planting are provided for each plant community within the bid schedule.

The contractor will need to determine the appropriate total quantity of plugs and seed needed within the toe, bank, and crest of the stream restoration area to meet performance standards within specification section 32 01 90.45, but the quantity of seed and plugs within the toe, bank, and crest shall conform to the quantities per acre provided at the end of specification section 32 93 03; the contractor shall provide a planting plan per specification section 32 93 03 for approval showing planting locations within the toe, bank, and crest that meet the quantities per acre provided at the end of specification section 32 93 03. Please note the boundaries for the stream restoration planting area have been revised and the bid items for ravine planting have been deleted.

Question 28. Should the costs for the 4.95 ACRE of beach planting (Beach Grass & Sand Reed @ 20,500 Plugs / Acre) be included in the beach nourishment line item or should the bid form have a separate line for this?

USACE Response 28: The names of plant communities on the seed/plug/woody plant lists in specification section 32 93 03 have been revised to match names shown on the contract plans ‐‐ please note "Dune" on the Contract plans has been changed to "Beach" and the location for "Beach" planting/invasive species removal has been extended into the "Beach Nourishment" areas identified on the contract plans; however, the 1.15 acres of Beach planting identified in the bid schedule has not changed. The contractor shall provide a planting plan per specification section 32 93 03 for approval showing planting locations within the Beach that meet the quantities per acre provided at the end of specification section 32 93 03.

Question 29. Drawing CS502 cross sections for typical sections show the core stone to be 300lbs minus. The Type C spec has 100% smaller than 150 lbs. Please clarify

USACE Response 29: See revised specification section 35 31 19.45.

Question 30. Section 35 31 19.45 Stone Materials. Part 2.2 2.3.4 Type C Stone. The stone is sampled in 1,000 lb samples. Of which, 500 lbs are greater than 60 lbs, and 500 lbs less than 60 lbs. Will the stone samples be measured by weight or by the stones per sample? Will 50% of the material weigh more than 60lbs or 50% of the pieces weigh more than 60lbs?

USACE Response 30: Any reference to type C stone has been removed and this specific testing frequency has been updated to Armor stone types A‐4 and A‐5. Quantities for this stone are 511 and 252 tons respectively so one test will be required and 1,000 lb samples seems appropriate. See revised specification section 35 31 19.45.

Question 31. It appears that there is a discrepancy in the existing ground elevation between the contours depicted on sheets CG101, CG102 & CG103 and the Existing beach profile shown in the elevations on sheet CS501. For example, on sheet CS501 in the North groyne extension elevation it appears that the existing grade is at 572.00 at the very end of the proposed sheeting installation. On sheet CG101 it appears that the exact same location is at approximately 575.75. Which is correct?

USACE Response 31: The existing ground contours and elevations shown on plan sheets CG001, CG002, and CG003 are correct.

Question 32. The Ravine restoration line item of 2.05 acre is comprised of three different zones, the Toe, Bank, and Crest. Because of the differing amounts and types of seed & plant plugs present in these areas, the price for each area is significantly different. Do you have a typical detail or other way to help us, with some degree of accuracy, determine the quantities of each planting zone within the Ravine Restoration area?

USACE Response 32: The names of plant communities on the seed/plug/woody plant lists in Spec Section 32 93 03 have been revised to match names shown on the Contract plans;

please note "STREAM DAYLIGHTING/RAVINE" has been changed to "STREAM" and line items 0008AB and 0008AC under "Ravine Restoration" have been deleted. Acreages for seeding/planting are provided for each plant community within the bid schedule; please note the boundaries within the Contract plans for "Stream Restoration/Invasive Species Removal" have been revised and quantities for line items 0006AE, 0006AF, and 0006AG under "Stream Restoration" have changed. The Contractor will need to determine the appropriate total quantity of plugs and seed needed within the toe, bank, and crest of the Stream Restoration area to meet performance standards within Spec Section 32 01 90.45, but the quantity of seed and plugs within the toe, bank, and crest shall conform to the quantities per acre provided at the end of Spec Section 32 93 03; the Contractor shall provide a Planting Plan per Spec Section 32 93 03 for approval showing planting locations within the toe, bank, and crest that meet the quantities per acre provided at the end of Spec Section 32 93 03.

Question 33. Pay Items and plan callouts determine 5 different planting areas, but species lists for seed and plugs include only 4, with the Stream Daylighting/Ravine are broken out into 3 separate communities. Can you provide estimated required quantities for each of the communities on the species lists?

USACE Response 33: The names of plant communities on the seed/plug/woody plant lists in Spec Section 32 93 03 have been revised to match names shown on the Contract plans;

please note "STREAM DAYLIGHTING/RAVINE" has been changed to "STREAM" and line items 0008AB and 0008AC under "Ravine Restoration" have been deleted. Acreages for seeding/planting are provided for each plant community within the bid schedule; please note the boundaries within the Contract plans for "Stream Restoration/Invasive Species Removal" have been revised and quantities for line items 0006AE, 0006AF, and 0006AG under "Stream Restoration" have changed. Question 34. For the Stream Daylight / Ravine planting mix. How much Toe Zone, Bank Zone and Crest Zone should we be bidding on?

USACE Response 34: The names of plant communities on the seed/plug/woody plant lists in Spec Section 32 93 03 have been revised to match names shown on the Contract plans;

please note "STREAM DAYLIGHTING/RAVINE" has been changed to "STREAM" and line items 0008AB and 0008AC under "Ravine Restoration" have been deleted. Question 35. What portion of the Stream Daylight / Ravine Planting Mix (shrubs) goes in the ravine line item and what portion goes in the streambank? What portion of the Stream

Daylight / Ravine Planting Mix (plugs) goes in the ravine line item and what portion goes in the streambank?

USACE Response 35: The names of plant communities on the seed/plug/woody plant lists in Spec Section 32 93 03 have been revised to match names shown on the Contract plans;

please note "STREAM DAYLIGHTING/RAVINE" has been changed to "STREAM" and line items 0008AB and 0008AC under "Ravine Restoration" have been deleted. Question 36. For payment of the native plant establishment, would it be possible for payment immediately following plantings, and use retention for performance criteria.

USACE Response 36: Payments for the Native Plant Establishment Period will be made as described within Spec Section 01 22 00.

Question 37. Is any information available as to the sheeting types and depths of the existing groynes that are to be removed? According to Spec Section 314116, after the sheeting is pulled, it is to be sorted, cleaned and stored. Is it the intention of the Corp to reuse this sheeting in the proposed groynes or will that have to be new material? Once the existing sheeting is sorted, is that sheeting owned by the Army Corp or does the contractor take possession of the removed sheeting? If the sheeting is retained by the Army Corp, where is it to be stored, onsite or hauled away to another yard location?

USACE Response 37: There is no intention of salvaging the existing sheet pile called out for removal on the plans. See the revised spec section 31 41 16, which is included in this amendment, paragraph 3.3 has been removed. The proposed groynes shown on the plans will be constructed from brand new sheet piling. All costs associated with sheetpile groyne removal, including off‐site disposal, is the responsibility of the contractor per specification section 01 22 00 paragraph 1.1.2.1.

Question 38. How open will you be to substitutions after the bid has been awarded for plant material that is not available? How open will you be to plant material that is from outside of the 100 mile radius of the project, but still within the same region (e.g northern IL, southern

WI)?

USACE Response 38: At this time bidders should assume that no substitutions will be allowed and base their bids on the information provided in the plans and specifications.

Question 39. Are as‐built / existing drawings available for the concrete pier and/or box culvert that are to be removed?

USACE Response 39: No.

Question 40. Once the contractor begins work on beach area and starts using the parking lot for storage, will temporary fencing be required around the whole parking lot and site or can fencing just be placed at the entrance to the lot, along the beach on both the north and south end of the site, and a small sections to close off the trail access points? Does the temporary fence have to be installed using driven posts / concrete bases or can stands and pedestal be used? Please define the temporary fence location so that all contractors are bidding the same amount of fencing.

USACE Response 40: An 8’ screened fence and gate, with driven posts and concrete bases, will be required around the staging and storage area only, and not around the perimeter of project. See notes 1 and 2 on sheet C‐001 and specification section 01 56 26.03 for fencing requirements.

Question 41. Spec Section 310000, 1.3.1, mentions a slurry wall that is not to be impacted. Is there a slurry wall on this project, and if so, please define the limits and provide more information about the slurry wall?

USACE Response 41: There is no slurry wall on this project. Paragraph 1.3.1 of specification section 31 00 00 is outlining the type of information that is required in the Earthwork Plan of Operation submittal if it pertains to the work called for in this solicitation package.

Question 42. Plan sheet CD101 shows the location of four existing concrete weirs that are to be removed. I walked the majority of the creek area down in the bottom of the ravine and could not locate any of the weirs. Please provide some additional information as to the type, size, location or even pictures of the weirs if available.

USACE Response 42: The weirs called out on sheet CD101 are present in the ravine bottom.

The only known dimension of the weirs is a 10 ft width across the ravine which is shown on sheet CD101 under the weir symbols.

Question 43. There are pay items for A4 and A5 Armor Stone, however, I could not locate gradations for this material in Spec Section 353119. Also, section 2.3.6 of this same spec has a gradation for the Core / Bedding Stone stating CA‐1 and CA‐6, however, the plans list the Core Stone as being 300 LB minus material in the cross sections on page CS502. Please provide additional information on the A4 and A5 Stone and clarify what is required for the Core Stone.

USACE Response 43: See revised specification section 35 31 19.45.

Question 44. What portion of the Stream Daylight / Ravine Planting Mix (shrubs) goes in the ravine line item and what portion goes in the streambank? What portion of the Stream Daylight / Ravine Planting Mix (plugs) goes in the ravine line item and what portion goes in the streambank?

USACE Response 44: The names of plant communities on the seed/plug/woody plant lists in Spec Section 32 93 03 have been revised to match names shown on the Contract plans;

please note "STREAM DAYLIGHTING/RAVINE" has been changed to "STREAM" and line items 0008AB and 0008AC under "Ravine Restoration" have been deleted. Acreages for seeding/planting are provided for each plant community within the bid schedule; please note the boundaries within the Contract plans for "Stream Restoration/Invasive Species Removal" have been revised and quantities for line items 0006AE, 0006AF, and 0006AG under "Stream Restoration" have changed. The Contractor will need to determine the appropriate total quantity of plugs and seed needed within the toe, bank, and crest of the Stream Restoration area to meet performance standards within Spec Section 32 01 90.45, but the quantity of seed and plugs within the toe, bank, and crest shall conform to the quantities per acre provided at the end of Spec Section 32 93 03; the Contractor shall provide a Planting Plan per Spec Section 32 93 03 for approval showing planting locations within the toe, bank, and crest that meet the quantities per acre provided at the end of Spec Section 32 93 03.

Question 45. What plant/seed mix is supposed to be used for Dune Restoration?

USACE Response 45: See the revised seed/plug/woody plant list attached to specification section 32 93 03 and revised plan sheets that are part of the amendment for clarification.

G. SECTION 00010 BID SCHEDULE: The bid schedule has been revised and is attached hereto.

Contractors shall used the revised bid schedule for bidding purposes.

H. SECTION 00010 IMPORTANT NOTES: The below paragraph is revised to read as follows (Deletions are struck through and additions are underlined).

4. AWARDING OF OPTIONS: At the government’s discretion, any, all or none of the Option Line Items (CLINS 0012 through 0015) may be awarded no later than 365 182 days after the Notice to Proceed has been acknowledged by the contractor. No additional time will be added to the contract for award of Option CLINS. Should the government determine it necessary to exercise an Option (Line Items 0012 through 0014), Options may be awarded in any order at the government’s discretion. The order of awarding the Options does not apply to the Payment and Performance Bond (Line Item 0015); additional bonding is required any time the contract value is increased, meaning Option Item 0015 must be awarded if any of the options are exercised.

I. SECTION 00700 CLAUSE: Clause 52.211‐10 is hereby replaced in its entirety with the following:

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR

1984)

The contractor will be issued two separate Notice to Proceed Letters for this project:

a. Notice to Proceed Letter #1 will be issued following the Government’s approval of the Contractor’s Bonds and Insurance. Under this particular Notice, the contractor will be authorized to initiate all work, except physical construction of features and demolition of existing features at or below elevation 581.5 IGLD-85. The Contractor shall be required to (a) commence work under this contract within 10 calendar days following its acknowledgement of the first Notice to Proceed letter, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 1,825 calendar days after the acknowledgement of the first Notice to Proceed letter.

b. Notice to Proceed Letter #2 will be issued once the Illinois Department of Natural Resources (IDNR) has issued the Individual Permit for Construction of Shore Protection Projects in Lake Michigan, which is expected to occur by March 31 of 2014. Under this particular Notice, the contractor will be authorized to initiate physical construction of proposed features and demolition of existing features at or below elevation 581.5 IGLD-85. The Contractor will be required to complete the entire work ready for use not later than the remaining time provided in the Contract (this time relates to the commencement & completion period provided under the Notice to Proceed Letter #1). The time stated for completion shall include final cleanup of the premises.
