SUMMARY OF CHANGES
The following have been added by full text:
SITE VISIT Q&A
Questions & Answers W912P5-14-R-0008 Prototype Project
Middlesboro Flood Protection Project
1. Site Safety & Health Officer and Quality Control Manager. Question can these positions be combined for this project? Since this project is small in nature, can the superintendent fulfill these tasks? This will make a difference in costs.
Ans: Per MATOC Technical Specifications, Section 01 45 01, paragraph 3.4.2 “The CQC System Manager may serve as the Safety and Health Manager but shall be assigned no separate duties as project superintendant.”
2. Is RMS (Resident Management System) required for this project?
Ans: Yes. See MATOC Technical Specifications, Section 01 45 02, paragraph 1.2.
3. Reference specification 35 31 19 20 pp 3.10 – Field testing of miscellaneous concrete – The specification requires testing every 10 cubic yards. This seems to be overkill. I would suggest every fifty cubic yards.
Ans: The test frequency for miscellaneous concrete shall be one set of testing for each truck delivered, or one set of testing for every 10 cubic yards (or fraction thereof), whichever is less.
4. Environmental Protection – Does the Government have any suggestion for erosion control while removing the gabion baskets from Bennett’s Fork? Could a floating silt fence be used downstream of project area for this?
Ans: The Government has no suggestions for erosion control at this time. It will be the responsibility of the Contractor to implement best management practices and comply with permit and regulatory requirements.
5. The spec’s does not allow burning of clearing debris on site, can the material be chipped and left on site or does it have to be removed offsite?
Ans: Vegetation can be chipped / mulched and spread on site, particularly to protect the gas line as referred to in Question #9.
6. The spec’s refer to designated offsite disposal areas; please provide the location of these areas and the volumes that can be dumped at each site.
Ans: See Question #29.
7. Please provide specifications that the designated offsite disposal areas have to be graded to and the new vegetation expected.
Ans: See Question #29.
8. Please clarify the diameter, material and length of the proposed pipe to be extended through the excavated slope.
Ans: The dimensions and material of the replacement culvert will be consistent with the existing culvert, which is a 32-inch diameter corrugated metal pipe (CMP).
9. Are there underground utilities within the excavation limits and if there are utilities encountered, what is the contingency plan for dealing with them?
Ans: Yes, Delta Gas has an 8” gas main parallel to the channel. The gas company is requesting a 10’ digging buffer around the line and 1-3’ of earth be placed over the line to protect from heavy traffic during construction. The line is being physically marked, and a table indicating the approximate distance from top of slope is provided in the table below.
10. During the Site Visit it was explained that contract awards would be made to the 5 lowest bidders that were technically acceptable. If this is true what will keep bidders from “buying” a contract by pricing the project below industry standards?
Ans: The construction management hourly rates on the price schedule are maximum rates in place for the life of the contract.
11. Will there be a Government Estimate completed, and if so will it be released after award for review by the bidders?
Ans: Unlike a sealed bid IFB (Invitation For Bid), the Government Estimate (IGE) will not be published for this RFP.
12. The solicitation asks for demonstration of experience for at least 6 of 10 construction disciplines but limits
Project Detail Sheets that can be submitted to 7. The USACE’s view of what constitutes of an example of a particular construction discipline and what would be an “Acceptable” vs “Unacceptable” from that of the
Distance downstream of Concrete Channel (ft)
Distance from gas line to top of slope (ft)
0 (downstream edge of concrete channel)
15 48 40 42 65 (first gas line marker) 47 90 38 115 25 140 15 165 20 185 (second gas line marker) 10 195 8 205 8 215 10 240 20 265 23 bidder. Also unless a bidder is a General Contractor this will limit all bidders from being able to show experience in all 10 disciplines. We request to able to submit 10 Project Detail Sheets.
Ans: As stated is subparagraph 4.1.5 of Section 00130 Proposal Evaluation, the Offeror must demonstrate experience in at least six (6) of the ten (10) construction disciplines. Therefore, seven
(7) Project Detail Sheets are sufficient to accomplish this.
13. Is there a minimum EMR rate the bidders must meet on this contact? If so will they be a factor in the evaluations and awards?
Ans: No, EMR rate will not be a factor in award.
14. Will the Awardees be required to demonstrate bonding capacity?
Ans: Yes. Bid Bonds are required for the MATOC RFP, but not on subsequent Task Order RFPs.
Performance and Payment Bonds are required within 10 days of award of a Task Order. See FAR Clauses 52.228-13, 52.228-2, 52.228-14, and 52.228-15 included in the RFP.
15. Can the Bidder submit prior experience by Teaming Partners (with written teaming agreement)? If so how will that be evaluated?
Ans: Yes, in the same manner outlined in Section 00130.
16. Will letters of commitment from key personnel, subcontractors and teaming partners be required?
Ans: Only if key personnel are not employees of the Offeror’s firm and the experience of subcontractors and teaming partners are used to fulfill the requirements and elements of Factors I and II.
17. It seems as if there are two bid schedules shown on page 6 of 63. At the top is a bid schedule with 8 item numbers that are specific to the prototype project. Are we to assume that this bid schedule is similar to what we will see on future task orders? Near the bottom of the page are given labor hours, which we presume are for evaluation purposes only, and not applicable to the prototype project. These rates are multiplied by G&A and profit, all of which would normally have been included in the project bid items above (1-8). Shouldn’t the bottom section (labor) be totaled separately from the upper section?
Ans: This revised Price Schedule contained within this amendment is similar to Price Schedules that will be used for future task orders. The hourly rates for the construction management positions are not only applicable to the prototype project, but are binding for the remainder of the contract (subject to the note on the price schedule regarding escalation) as maximum rates on future task orders. See also Questions #20e, and #21.
18. Is the bid schedule that is provided for the Prototype project typical to what will be used for other task orders? If so, it is in conflict with “Note 2” on the same page, which states, “All hours for each discipline shall be negotiated for each individual task order”. As the award criteria for task orders will generally be based on the lowest price, it would seem that negotiating labor hours is unnecessary.
Ans: See Question #17, above. Negotiations for task order pricing only occurs if we enter into discussions, generally when no contractor returns a proposal within 25% of the IGE.
19. The paragraph in the middle of the page reads, “The hourly rates should be fully burdened and include overhead, General/Administrative (G&A), Labor Burden Fringe…” The bottom of the page includes a multiplier for G&A. It seems G&A is being applied twice to labor. Please clarify.
Ans: The G&A is only applied once. You are merely asked to state what your G&A rate is on the price schedule.
20. Per the solicitation, bidders are to supply maximum fully burdened hourly labor rates for 5 labor categories- Superintendent, Project Manager, CQC System Manager, SSHO, and Combined SSHO and CQC System Manager, however, there are no minimal qualifications provided for any of these positions (years of experience, degrees, certifications, etc).
a. Please specify minimum qualifications for each labor category in order for bidders to effectively staff and price each.
Ans: See the MATOC Technical Specifications, Section 01 45 01 paragraph 3.4.2 for qualifications of the CQC System Manager. See EM 385-1-1 paragraph 01.A.17 for qualifications of the SSHO. An Experience Matrix in Section 01 45 01 paragraph 3.4.3 lists qualifications for other disciplines.
b. How will the fully burdened labor rates for these positions be utilized in evaluating bidders cost for the prototype project?
Ans: To fulfill the requirements of the Competition in Contracting Act, these rates will be an element of the Factor III evaluation. They are binding and will apply to future task orders.
c. Previous solicitations have required that an organization chart be provided for key staff. Is providing an organization chart a requirement for this solicitation?
Ans: No, but if an organization chart is helpful to convey information associated with your Proposal Data Sheet, you may certainly include one.
d. Also, previous solicitations have required certain key positions to be filled by the prime contractor. How many key positions in this solicitation must be employed by the Prime contractor?
Ans: Per MATOC Technical Specifications Section 01 45 01, paragraph 3.4.2 the CQC System Manager shall be employed by the prime Contractor. Per MATOC Technical Specifications Section 01 45 01, paragraph 3.4.1, the Safety and Health Manager must report to a senior project official, and while he will also serve as a member of the CQC Staff Personnel and as part of the CQC organization, he must be independent of the CQC System Manager. The Contractor's CQC staff must have complete authority and responsibility to take any action necessary to ensure contract compliance. Per MATOC Technical Specifications Section 01 45 01, paragraph 3.4.3, certain specialized personnel may be employed by either the prime or subcontractor. Per MATOC Technical Specifications Section 01 45 01, paragraph 3.1 the project superintendent will be held responsible for the quality of work and is subject to removal by the Contracting Officer for non-compliance with the quality requirements specified in the contract.
e. The solicitation states on page 6 of 63 that “The amount to be paid to the Contractor for each firm-fixed price task order shall not exceed the fully loaded hourly rates (included profits) for the identified disciplines.” Please clarify.
Ans: The prices for the Construction Management disciplines will be maximum prices for all task orders. See Question #17.
21. Are the respective bid items for the prototype project to include all applicable project professional costs (e.g., Superintendent, Project Manager, CQC System manager, SSHO, etc.) or will the required project professionals be compensated separately from the professional’s listed time on the pricing schedule?
Please clarify.
Ans: The Price Schedule for each task order, including the Prototype Project, must have the Construction Management costs broken out. Depending on the requirements of the particular project, you may not use all the positions, but you must price the ones used at or below the established rate.
22. If project professional costs are to be included in the respective bid items for the prototype project, which project professionals will be required on site fulltime? Please clarify.
Ans: Per MATOC Technical Specifications Section 01 35 26, the SSHO or an equally-qualified Designated Representative/alternate shall be at the work site at all times. Per Section 01 45 01 paragraph 3.4.2, the CQC System Manager shall be on the site at all times during construction.
Per Section 01 45 01 paragraph 3.4.3, specialized CGC personnel are to be physically present during work on their areas of responsibility.
23. What is the applicable Davis Bacon Act wage determination that is to be used for pricing the prototype project?
Ans: As noted in the attachment to the RFP posted to FBO, the Wage Determination is KY140081 dated 07-04-2014.
24. Regarding the "Similar in magnitude is defined as construction contracts valued between $250k - $1.5M" requirement”… if a project is submitted as one of the 5-7 Volume I Experience Projects with a contract value greater than the dollar value range stated above, does it qualify as ‘similar in magnitude’?
Ans: No.
25. Page 11 of 63, Section 2.1.1 states "...provide descriptions of no less than five (5) and no more than seven
(7) projects completed ....w/I the past 5 years". vs. p.21 of 63, Section 4.1.3 which states "All of the projects must be at least substantially complete (90%) within the last 5 years." Please clarify.
Ans: This means you are allowed to use projects in progress. The wording of Section 00115 subparagraph 2.1.1 and Section 00130 subparagraph 4.1.1 has been changed to clarify this.
26. Will the Corps accept existing PPQs of the same or similar format in lieu of requesting additional versions from our clients?
Ans: Existing PPQs using the USACE/NAVFAC form will be acceptable. See also Question #30.
27. Do PPQs and other performance recognition documents count toward the overall page limit of 75 pages for Volume 1?
Ans: Yes, and the page limit has been changed to 25 with this amendment.
28. The unit measure for both Pay Item 0004 Permanent Turf Grass Seeding and Pay Item 0005 Temporary Seeding are listed on the pricing schedule as 1 Job respectively. However, subsections 1.1.4 and 1.1.5 of 01 22 00 – Measurement and Payment indicates that the referenced pay items will be measured and paid by the nearest 1,000 sq. ft. (MSF). Please clarify how the referenced pay items will be measured and paid.
Ans: See Appendix A – Prototype Task Order Technical Specifications, Section 01 22 00, subsections 1.1.4 and 1.1.5; which specifies payment for seeding will be made at the 1 Job price.
29. It was mentioned at the site visit that there was a possible spoils/waste area for excess soils. Does the USACE have a place where this waste material can be wasted (location, miles, etc.) and if so what do we need to do to place it there? Will there be silt fence, seeding, or other activities that will need to be performed at this waste area?
Ans: The city of Middlesboro has taken over the site previously used for construction debris on past MFPP repair projects, and typically allows its use on a no-fee basis for these projects.
Depending on the type of debris, most spoil and waste will be spread at the project site. USACE will coordinate disposal for any debris not suitable for on-site placement on a no-fee basis at a local site to be designated at the pre-construction meeting. The MATOC Appendix A – Prototype Task Order Technical Specifications has two sections (31 11 00, paragraphs 1.2 and 3.5) which refer to disposal on private property. You can expect this alternative to be deleted from the next Technical Specifications revision, due to the long lead time for the associated approvals with this method. Section 32 92 19 paragraph 1.4 outlines seeding requirements for disposal areas and disturbed earth.
30. Can past performance evaluations as found in CCASS, when available, be used in lieu of sending out past performance questionnaires?
Ans: See Section 00115 subparagraph 2.2.2; the statement “…the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror” applies.
Also: “If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).” See also Question #26.

Additionally, should the proposal include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the proposal may be determined to be “unacceptable” and thus ineligible for award. Offerors shall limit submissions to the data essential for evaluation so that a minimum of time and funds are spent in preparing the information. For additional examples of efforts that fall within the above-identified 10 construction disciplines, reference Solicitation, Section 00100, Instructions, Conditions & Notices to Offerors, Paragraph 1.3, Project Description.
Similar in magnitude is defined as construction contracts valued between $250,000 and $1,500,000.
2.1.2 Describe how the projects were managed and how the on-going work was controlled to result in a quality product. Include a description of work self-performed and experience in working with subcontractor(s), where applicable.
2.1.3 A Project Detail Sheet is included at the end of this section for your use. Use as many forms as necessary to meet the criteria. If you elect not to use the form, all information identified on the form is still required for evaluation of this item and should be ordered the same.

Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Mr. J.W. Purcell, via email at James.W.Purcell@usace.army.mil prior to proposal closing date.
Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. Performance recognition documents received within the last six (6) years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition should be included.
In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS/ACASS/CCASS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror. The Government may not contact all of the identified client references/ points of contact.
This assessment is based on the offeror’s record of relevant and recent past performance information that pertains to the construction services outlined in the solicitation requirements. If the firm is divided into severable segments (e.g., division, group, or unit) the Government will evaluate only the past performance of those segments of the firm(s) that will actually perform the work.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
