SECTION 01 00 00
GENERAL REQUIREMENTS
This section comprises an explanation of the general contract requirements needed to accomplish the work for the items described in the bidding schedule. This section is not intended to be all encompassing in the descriptions. All work specified herein shall be accomplished in accordance with the procedures prescribed in the specifications and contract drawings. The Contractor shall bid each type of work under the applicable bid item. Compensation for any item of work described in the contract documents, but not listed in the bid schedule shall be included in the price for the item of work to which it is made subsidiary.
The scope of this contract includes repairing the left descending bank of the Bennett's Fork diversion, just downstream of the concrete lined channel, at the Middlesboro Local Flood Protection Project in Middlesboro, KY. The work consists of clearing and grubbing vegetation on the existing bank, removing an existing gabion basket retaining wall, regrading the bank to a 2H:1V slope, and armoring the soil slope with an articulating concrete block revetment to protect against erosion. The concrete block revetment shall extend approximately 125 feet downstream of the concrete channel. A section of riprap shall be used as a transition media from the revetment to the natural bank of the channel. An existing gravity culvert which daylights just downstream of the concrete channel shall be repaired and integrated into the concrete block revetment system. The total length of the channel repair project is estimated to be 150 feet. No work is planned for the right descending bank.

1.3 WARRANTY
The Contractor shall provide the Government a one year warranty from the
SECTION 01 00 00 Page 3 date of final acceptance by the Contracting Officer's Representative (COR), and comply with applicable warranty requirements of Section 01 78 00 CLOSEOUT SUBMITTALS. The warranty shall cover defective materials, design and workmanship. In instances where the material or equipment manufacturer's advertised minimum warranty is in excess of one year, it shall remain in force for its full period. Upon receipt of notice from the Contracting Officer of failure of any of the material or equipment during the warranty period, the Contractor shall promptly furnish and install new replacement parts at no additional cost to the Government.
1.4 SAFETY REQUIREMENTS
The Contractor shall comply with all applicable provisions of EM 385-1-1 Safety and Health Requirements Manual and Section 01 35 26 GOVERNMENTAL
SAFETY REQUIREMENTS.
1.5 NON-COMPLIANCE OF SAFETY REQUIREMENTS
If the Contractor fails or refuses to promptly comply with the safety requirements, the COR may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stoppage shall be made subject to claim for extension of time or for excess costs or damages to the Contractor. The Contractor will not be paid for work not performed as a result of the stop order.
Work shall not resume until the Contractor provides evidence to the COR that he/she has complied or will comply with appropriate safety regulations.
1.6 CONTRACT EMPLOYEES
a. Contractor, subcontractors, and their employees shall conduct themselves in a proper manner at all times. No alcoholic beverages or controlled substances shall be consumed by the Contractor, subcontractor or his/her employees while on duty.
b. The Contractor expressly agrees to remove from the site any individual whose continued employment is deemed by the COR to be contrary to the public interest or inconsistent with the best interest of the Government.
c. The COR may require the Contractor to immediately remove from the work site any employee who is incompetent or who endangers persons or property or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform the work.
Notification to the Contractor shall be promptly made in writing if time and circumstances permit.
1.7 SUBMITTALS
Located at the back of Section 01 95 00 FORMS AND ATTACHMENTS is list of required submittals. The Contracting Officer may request submittals in addition to those listed when deemed necessary to adequately describe the work covered in the contract.
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

The Contractor shall submit a project schedule for this contract as required by Contract Clause 52.236-15 SCHEDULES FOR
CONSTRUCTION CONTRACTS.
1.8 CONTRACTOR'S STAGING AREA
The Contractor will be assigned an area near the jobsite for use as a staging area. The building of structures, the erection of tents or other forms of protection will be permitted only at such places as the Government shall approve, and the sanitary conditions of the grounds in or about such structures shall at all times be maintained in a satisfactory manner.
Temporary Contractor facilities provided during site operations shall be removed prior to final acceptance from the Government. As a minimum the area shall be left looking "broom clean" and at least as clean as before the structure placement.
1.9 DAILY CLEANUP AND DISPOSAL
Work areas shall be kept reasonably neat on a daily basis. Debris resulting from the work, such as empty paint cans, packing cases, scrap lumber, oil and grease spills, and other debris shall be collected, removed, and disposed of off-site to an approved facility at least once per week. Government trash cans, dump boxes and other containers shall not be used. Liquid waste shall not be disposed of in existing drains.
1.10 STORAGE OF EQUIPMENT AND MATERIALS
Storage of equipment and materials will be permitted only in designated staging areas.
1.11 ENVIRONMENTAL PROTECTION
The Contractor shall comply with the contract requirements stated in Section 01 57 20 ENVIRONMENTAL PROTECTION. Contractor shall maintain all work within and outside the project boundaries free from environmental pollution that would be in violation of any federal, state, local regulations or permits.
1.12 PROJECT SIGNS
1.12.1 General
The Contractor shall furnish and erect within 30 days after issue of the notice to proceed, at the location directed, a PROJECT IDENTIFICATION SIGN and a SAFETY PERFORMANCE SIGN. The signs shall be lettered on one side only and shall conform to EP 310-1-6a, EP 310-1-6b, and to the details and colors shown on the sketches attached at the end of Section 01 95 00 FORMS AND ATTACHMENTS. The name of the project shall be as follows:

1.12.2 Materials
The sign shall be constructed with a face sheet of 3/4 inch exterior grade plywood mounted on a substantial framework of treated 4-inch by 4-inch material. Screws shall be commercial quality and of sizes shown.

1.12.3 Painting
The signs and posts shall be given one prime coat and two finish coats of exterior oil paint before lettering. Letters and trim shall be applied to one side only using one coat of enamel of color, style, and size shown.
1.12.4 Erection and Maintenance
The signs shall be erected at the designated locations. Signs shall be plumb and backfill of post holes shall be well tamped to properly support the signs out the life of the contract. The signs shall be maintained in good condition until completion of the contract, shall remain the property of the Contractor, and shall be removed from the site upon final acceptance of the contract work.
1.13 EVALUATION OF CONTRACTOR PERFORMANCE
The Contractor's performance will be evaluated in accordance with ER 415-1-17 (MAR 1993). Evaluation will be based on quality of work, timely performance, effectiveness of management, and compliance with safety and labor standards. The format for the evaluation will be DD FORM 2626 and the Contractor will be rated either outstanding, above average, satisfactory, marginal, or unsatisfactory. A copy of DD FORM 2626 is attached at the end of Section 01 95 00 FORMS AND ATTACHMENTS.
Following initial completion by the Government, the Contractor will have thirty (30) calendar days to review, comment, and return the evaluation.
If the Contractor desires a meeting to discuss the evaluation, it must be requested in writing to the Contracting Officer no later than seven calendar days following receipt of the evaluation. This meeting will be held during the thirty (30) day review period.
The Contractor's review of the evaluation shall be completed electronically at the CPARS / CCASS website, http://www.cpars.gov. Upon contract award, the Contractor shall provide the Contracting Officer with the name and e-mail address of the Contractor's Reviewing Representative to be registered into the system. Due to security provisions, the Contractor shall be required to purchase and utilize a valid DoD PKI (Public Key Infrastructure) certificate to access the CPARS / CCASS website. This requirement applies to DoD contractors who operate computer equipment that is not the property of the Government. The DoD PKI certificate shall be purchased from an External Certificate Authority (ECA) or an Interim External Certificate Authority (IECA). Because the IECA offers only interim certificates, it is recommended to purchase certificate(s) from ECAs. Contractors accessing CPARS / CCASS will need an Identity Certificate only; an Encryption Certificate is not required. Contractors will need to purchase a separate certificate for each computer used to access the system.
It shall be the Contractor's responsibility to monitor up-to-date information on obtaining PKI certificate(s) including price, application procedures, and renewal processes. A list of ECAs is provided below.

1.14 MEASUREMENT AND PAYMENT

MEASUREMENT AND PAYMENT
1.1 PAYMENT ITEMS
Payment items for the work of this contract are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular lump sum or unit price payment item, shall be included in the listed item most closely associated with the work involved. The payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
1.1.1 Excavation
Payment will be made for costs associated with excavation activities as shown in the contract drawings and specified in Section 31 00 00 EARTHWORK. Excavation will be measured by the cubic yard in place, based on the average end area method from cross sections taken before and after the excavation operations. Payment for excavation will be made at the contract unit price per cubic yard (CY) for "Excavation". Payment will constitute full compensation for all labor, equipment, tools, supplies, and incidentals necessary to complete all the work required under this section. Disposal of excavated materials shall be considered incidental to this pay item.
1.1.2 Geotextile
Payment will be made for costs associated with procuring and installing geotextile as shown in the contract drawings and specified in Section 31 05 22 GEOTEXTILES USED AS FILTERS. Installed geotextiles will be measured for payment in place to the nearest square yard of protected area. Payment for placing geotextile will be made at the unit price per square yard (SY) for "Geotextile," and will constitute full compensation to the Contractor for providing all plant, labor, material, and equipment and performing all operations necessary for the complete and satisfactory installation of the geotextile. The following items are included in the unit price for Geotextiles and will not be counted a second time in the process of determining the extent of geotextile placed: Material and associated equipment and operation used in laps, seams, or extra length;
securing pins and associated material, equipment, and operations. No payment will be made for geotextiles replaced because of waste, contamination, damage, repair, or due to Contractor fault or negligence.
1.1.3 Clearing, Grubbing, and Demolition
Payment will be made for clearing, grubbing, and demolition satisfactorily performed in accordance with the contract drawings and specified in Section 31 11 00 CLEARING, GRUBBING, AND DEMOLITION. Payment for clearing and
SECTION 01 22 00 Page 3 grubbing will be made at the lump-sum price for "Clearing, Grubbing, and Demolition". This lump-sum price shall include consideration for all required equipment, materials and associated work including removal of existing gabion baskets, and disposal of all associated materials.
1.1.4 Permanent Turf Grass Seeding
Payment will be made for costs associated with installing permanent turf grass seeding as specified in Section 32 92 19 TOPSOILING AND SEEDING. The unit of measurement for permanent turf grass seeding will be per 1,000 sq.
ft. (MSF). The areas to be paid for shall be those actually seeded computed to the nearest 1,000 sq. ft. Payment for the complete turf grass seeding operation will be made at the unit price per MSF for "Permanent Turf Grass Seeding"; which price shall include all costs in connection with tilling, seeding, fertilizing, incorporating, protecting, and maintaining.
Measurement and payment will also be made of areas that are required to be reseeded by the Contracting Officer, if such reseeding is necessitated through no fault of the Contractor.
1.1.5 Temporary Grass Seeding
Payment will be made for costs associated with installing temporary grass seeding as specified in Section 32 92 19 TOPSOILING AND SEEDING. The unit of measurement for temporary seeding will be per 1,000 sq. ft. (MSF). The areas to be paid for shall be those actually seeded computed to the nearest 1,000sq. ft. Payment for the temporary seeding operation will be made at the unit price per MSF for "Temporary Seeding;" which price shall include all costs in connection with fertilizing, tilling, seeding, incorporating, protecting, and maintaining.
1.1.6 Riprap
Payment for riprap acceptably placed will be made at the applicable contract unit price for "Riprap". Price and payment shall constitute full compensation for furnishing, hauling, handling, placing, and maintaining the riprap until final acceptance by the Government. No payment will be made for excess riprap left in place. Existing stone placed in lieu of new stone from off-site sources will be excluded from measurement and payment.
Riprap will be measured for payment by the ton in the presence of the Contracting Officer, by weighing on approved, accurately calibrated scales furnished by and at the expense of the Contractor. The scales shall be capable of printing a weight ticket including time, date, truck number, and weight. Weight certificates furnished by a public weighmaster will be acceptable. Quantities shall be computed to the nearest whole ton.
1.1.7 Articulating Concrete Block Revetment
Payment will be made for costs associated with installing articulating concrete block (ACB) revetment, as shown in the contract drawings and specified in Section 35 31 19.20 ARTICULATING CONCRETE BLOCK REVETMENTS.
Measurement of ACB revetment for payment will be made on the basis of the face area. The pay lines of ACB revetment will be neat lines taken off the drawings; and will include embedded blocks and concrete anchor trenches.
Work includes furnishing and installing the ACB, filling the voids, securing cable fasteners, and installing soil anchors where necessary.
Engineering services and product testing shall be incidental, if required.
Placing cast-in-place concrete joints and cutting blocks shall be incidental, if required. Payment will be made at the respective unit price per square foot listed on the Bidding Schedule. Payment will be full
SECTION 01 22 00 Page 4 compensation for all material, labor and equipment to complete the work.
1.1.8 Culvert Repair
Payment will be made for costs associated with repairing an existing culvert as shown on the drawings and as specified in Section 35 31 19.20.
Payment for culvert repair will be made at the contract lump sum price for "Culvert Repair," which price shall include all costs of demolition and removal of portion of existing pipe; furnishing, hauling, handling, and placing the new section of pipe as specified.
1.2 FIELD SURVEYS
No separate payment will be made for field surveys. All costs for surveys shall be considered incidental to the closest associated feature of work.
Payment for riprap will be lump sum based on stone placed to the lines and grades shown on the drawings. The volume of material for payment of excavation shall be determined by the average end area method and the pre-and post excavation surveys. The Contractor will not be paid for material remaining outside of the specified tolerances.
Pre- and post-placement survey cross sections shall be performed for the excavation and riprap and the results submitted to the Contracting Officer. Surveys shall be performed by a land surveyor with current State registration. The Contractor shall notify the Contracting Officer not less than three working days in advance of each survey. Surveys shall be conducted in the presence of the Contracting Officer or his designated representative unless this requirement is waived. In the event of unavailability of the Contracting Officer, the Contractor shall perform the survey and certify that it complies with the specifications.
The Contractor will be responsible for establishing, protecting and maintaining a baseline. A schematic of the baseline shall be provided to the Contracting Officer along with horizontal coordinates at the endpoints and at all changes in alignment. These horizontal coordinates shall be in the UTM 16, NAD 83 coordinate system and shall be to the nearest foot with accuracy of +/- 0.5 foot.
Cross-sections shall be surveyed perpendicular to the channel alignment and shall be no more than 25 feet apart as measured along the baseline. The readings shall be at 5-foot intervals and at breaks in grade unless otherwise specified. Additional sections at closer spacing for significant changes in topography may be required as determined appropriate by the Contracting Officer. The station at which the cross-section intersects the baseline shall be used to identify it. Surveyed elevations shall reference the same datum used on the drawings and shall be to the nearest tenth of a foot with an accuracy of +/- 0.1 foot. Additional elevations shall be taken if the Contracting Officer deems such to be necessary or advisable.
The top elevation of placed riprap shall be determined by the use of a leveling instrument and a rod having a base 12 inches in diameter.
1.2.1 Surveys of Riprap Areas
In order to define the original ground surface, the Contractor shall take cross sections of the area to receive riprap after preparation of the foundation and prior to placing riprap. Another survey at the same sections shall be performed after riprap has been placed. The Contractor shall perform partial surveys as the work progresses to verify lines, grades and thickness established for completed work. Surveys made are
SECTION 01 22 00 Page 5 required to determine that the material has been acceptably placed. At least one in-progress survey shall be made by the Contractor as determined appropriate by the Contracting Officer. Following placement, the cross-sections shall be approved by the Contracting Officer before proceeding with the next section of work. Approval of cross-sections based upon in-progress surveys shall not constitute final acceptance of the work.
A final as-built survey shall be performed after all riprap has been placed. Survey results shall include electronic scaled drawings of data submitted as cross section plots. The Contracting Officer may also require the Contractor to submit survey field notes. For the purpose of coordinating with the Government, the Contractor shall schedule surveys during the normal business hours of Monday through Friday 7:00 a.m. to 3:30 p.m. Central Time with the exception of Federal Holidays.
1.2.2 Surveys of Excavated Areas
For surveys of excavation, the same procedures specified above shall be followed. The initial survey shall be taken after clearing and grubbing has been completed and prior to excavation. The final survey shall be taken after excavation and grading is complete. The volume of excavated material for payment shall be determined by the average end area method based on these two surveys. Survey results shall be submitted to the Government.

HELPFUL HINTS FOR THE PREPARATION OF THE
CONTRACTOR’S
ACCIDENT PREVENTION PLAN (APP)
1. The following are minimum considerations for developing the Contractor’s Accident Prevention Plan. These helpful hints raise a number of basic questions that need to be answered for the Contractor’s accident prevention plan to be an effective management tool for use by on-site supervision. This plan shall be specific for this job.
a. Time Of Submittal. The accident prevention plan and the activity hazard analysis for the first phases of the job shall be acceptable prior to start of work. The plan and analysis shall be submitted for review within ten (10) calendar days after notice of award so that discussion can take place at the pre-construction conference. Job hazard analysis for later phases of work shall be acceptable prior to the start of that phase. It is recommended that the activity hazard analysis for the next phase of work be submitted twenty days before scheduled phase start in order to give ample time for review. The accident prevention plan shall contain a list of the phases to complete the works. Each phase shall have an anticipated start date. On short jobs one submittal covering the total job will be sufficient.
b. Responsible Individual(s). Who will be responsible for enforcing the accident prevention program and what are the basic duties? How will this person be held accountable? Include a statement that there will be compliance with pertinent provisions of the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1.
c. Subcontractor Supervision. What procedures will be followed to assure that Subcontractor activities are fully integrated into the project accident prevention plan and activity hazards analysis?
d. Indoctrination of New Employees before Start of Work. Every employee is required to receive an initial safety briefing prior to starting work. The accident prevention plan shall establish the procedure for ensuring the following items are covered:
(1) General safety policy and pertinent provisions of EM-385-1-1.
(2) Requirements for employee and project safety.
(3) Employee’s responsibilities for property and safety of others.
(4) Employee’s responsibilities for reporting all accidents.
(5) Medical facilities and required treatment.
(6) Procedures for reporting or correcting unsafe conditions or practices.

(7) Safe clearance procedures.
(8) Fire fighting and other emergency procedures.
(9) Activity hazard analysis.
(10) Personal protective equipment.
e. On-the Job Safety Meetings.
(1) When and where will monthly safety meetings for all supervisors be held? Who will conduct the meetings and what will be covered?
(2) How will the weekly “tool box” meetings be conducted?
f. Accident Reporting. The contract requires prompt reporting of injuries, fire, and property damage. Initial reports must be made immediately to the on-site Government representative and written reports shall be submitted within one to four working days. How does the accident prevention plan reflect responsibilities assigned for immediate oral reporting, accident investigation, determining proper corrective action, and preparation of reports?
g. Sanitary Facilities. What toilet facilities will be provided considering the number and distribution of employees? What other considerations are planned for drinking water and washing facilities?
h. First Aid and Medical. Describe first aid facilities and qualifications of attendant. List telephone numbers of physician, ambulance, and hospital.
i. Housekeeping. How will access ways to work areas be maintained during work hours? What procedures will be followed to assure daily cleanup?
j. Fire Protection. Considering the availability of existing fire protection, what general types and size of extinguishers and fire barrels will be required to protect buildings, shops, and storage areas as well as to deal with special hazards such as welding and flammable liquids? Name the local professional fire fighters. List their telephone number.
k. Machinery and Mechanized Equipment. How will inspection of cranes, trucks, and other mechanical equipment be accomplished? Frequency, by whom, what type of records will be kept?
2. Posters, contests, safety awards help develop positive attitudes toward safety rules. What methods, if any, will be used on this project? Most accidents are preventable by well thought out and executed accident prevention plans.
APPENDIX B
GUIDELINES FOR THE PREPARATION OF
THE ACTIVITY HAZARDS ANALYSIS (AHA)
1. Activity Hazards Analysis Development. Before starting any major phase of work an activity hazards analysis shall be developed and reviewed with the Government representative. This analysis will evaluate anticipated hazards and outline the proposed methods and techniques which will be utilized to accomplish the work in a safe manner.
2. Phases of Work. Listed are examples of major phases of work, but this list is not all inclusive. Phases of work shall be tailored to the specific characteristics of the contract.

3. Sample Activity Hazards Analysis. Enclosed is a blank form and a partially completed form of an activity hazard analysis that might be submitted on a construction project. This sample incorporates a phase of work, the safety hazards that may be encountered, actions that will be taken to eliminate or minimize these hazards, and a risk assessment for each hazard. Each safety hazard identified must be accompanied by the appropriate paragraph reference number from EM 385-1-1. A risk assessment code must be determined for each hazard utilizing the risk assessment code matrix. A fillable Acrobat version of this form may be found at:

4. Indoctrination. Employees performing the work must be made aware of the activity hazard analysis. For this reason, an important part of any phase plan is the indoctrination of all employees who will be performing the work.

EARTHWORK
The scope of work for this section includes excavation and all other incidental earthwork performed in the contract.
1.2.1 Topsoil
Material suitable for topsoils obtained from offsite areas or excavations is defined as: Natural, friable soil representative of productive, well-drained soils in the area, free of subsoil, stumps, rocks larger than one inch diameter, brush, weeds, toxic substances, and other material detrimental to plant growth. Amend topsoil pH range to obtain a pH of 5.5 to 7.

Blasting will not be permitted.
1.4 SUBMITTALS

2.1 MATERIAL FOR RIP-RAP
Provide stone conforming to Section 35 31 19 STONE PROTECTION for construction indicated.

Provide geotextile filter fabric in conformance with Section 31 05 22
GEOTEXTILES USED AS FILTERS.
3.1 STRIPPING OF TOPSOIL
Strip all topsoil and organic material to a depth of 6 inches. Spread
SECTION 31 00 00 Page 3 topsoil on areas already graded and prepared for topsoil, or place topsoil in stockpiles convenient to areas that are to receive application of the topsoil later. Stockpile topsoil at a maximum slope of 2H:1V in a manner approved by the Contracting Officer. The Contractor shall install and maintain silt fencing around all stockpiles in order to provide sediment control.
