PART 3 - EXECUTION

3.1 UNIT PRICE ITEMS

A. Unit Price No. 1. “Uncontrolled Fill” Excavation:

1. 2. Unit of Measurement: Cubic Yard.

3. The Contractor shall include the cost in their Base Bid lump sum price for the work, all required earthwork to construct all of the facilities and infrastructure indicated in the Contract Documents. This Base Bid amount also includes an estimated 'overexcavation' amount of 850 cubic yards (at the time of bid) of 'uncontrolled fill' (as defined in the contract documents/specifications) that is anticipated to exist within the construction limits-refer to the Geotechnical Report as Supplemental Information. Note that the geotechnical report is for the Contractor's reference only as Supplemental Information only to the Contract documents. All earthwork shall be accomplished in accordance with the contract documents (plans and specifications) which have taken into account the data in the geotechnical report. It is the Contractor's responsibility however to verify all existing conditions. Also note that 'over-excavation' is excavation beyond the lines and grades required by the contract documents for proper construction of the facilities and infrastructure as specified in the contract documents. The Contractor shall not proceed with any 'over-excavation' without written permission from the Contracting Officer. If such written permission is granted by the Contracting Officer, then the Contractor shall also not proceed with any 'overexcavation' work without the onsite presence of the Government's construction inspection representative and the Contractor's Independent Soil Inspection and Testing Agent in any areas where the Contractor deems it necessary to perform 'over-excavation'. The Contractor shall provide Daily Reports to include weight tickets with quantities of approved over-excavation material amounts to the Contracting Officer within 5-working days following over-excavation work. For the purpose of this Unit Price, the over-excavation quantity shall be based on actual field measurements and without considering any expansion or contraction factors. It is anticipated that the 'uncontrolled fill' material will be able to be utilized onsite, however, only in landscaped areas for such items as berms, etc. In no case shall 'uncontrolled fill' material be utilized as backfill or fill for areas under pavements, sidewalks, buildings, in or under utility trenches, under roadways or under building slabs, foundations, or other structures. If the total amount of 'over-excavation' required turns out to be more than 115% of the estimated 850 CY (more than 978 CY), then the Contractor shall be paid at the Unit Price for removal and proper disposal of such extra material. If the total amount of 'over-excavation' required turns out to be less than 85% of 850 CY (less than 723 CY), then the Contractor will be required to provide a credit back to the Owner at the Unit Price provided for such 'over-excavation'.
