Indiana National Guard Restoration and Renovation of Buildings 216 and 217 (Project #12) at Camp Atterbury.
This procurement is being solicited as a 100% Small Business Set-Aside. The North American Industry Classif ication System Code (NAICS) is 236220. The size standard for Small Business is $39.5M average revenue for the three previous years. The Project magnitude is betw een $1M and $5M. Persons intending to submit a bid, should attend the site visit. A bid bond is required w ith this bid and a bidder w ho fails to submit an acceptable bid bond w ill be determined non-responsive.
All documents including plans and specif ications w ill be available only from the betaSAM w ebsite beta.SAM.gov
Funds are not presently available for this contract. Currently, the Government anticipates funds w ill become available prior to but no later than midnight 30 Sep 2020. This action has been identif ied on the National Guard priority list for aw ard if funds become available and the prices received are w ithin an aw ardable range.

INSTRUCTIONS
SECTION 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS
Description of the Project: Work shall consist of furnishing all labor, equipment, materials, and warranties to accomplish the complete renovation of barracks 216 and 217 (Project 12). The mechanical work will include, but is not limited to, the installation of geothermal loops, water cooled heat pumps, and ERVs. The electrical work will consist of new AFCI circuits, new panel, fire alarm, and lighting. The Plumbing work will consist of new fire suppression system, backflow preventers, waterlines, and new gas and water service. 1. Instructions to Bidders:
1.1. You are invited to submit a bid in response to our Invitation for Bids (IFB) entitled) W912L9-20-B-0005 entitled Renovation of Buildings 216-217 Project 12, Project Number 2020-008-12, at Camp Atterbury, Edinburgh, IN 46124.
1.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the Government, considering only price.
1.3 This solicitation is set-aside 100% for small businesses, The North American Industry Classification (NAICS) Code is 236220, with a size standard of $39,500,000.00. The magnitude is between $1,000,000 and $5,000,000.
2. Funds are not presently available for this contract. Currently, the Government anticipates funds will become available prior to but no later than midnight 30 Sep 2020. This action has been identified on the National Guard priority list for award if funds become available and the prices received are within an awardable range.
2.1 Award will be made to the responsible bidder whose bid conforms to the invitation for bids and is most advantageous to the Government considering only price and price related factors.
3. NOTICE OF PRE-BID CONFERENCE AND SITE VISIT:
3.1. A pre-bid conference will be conducted on August 19, 2020 at 10:00 a.m. Eastern Standard Time for the purposes of briefing on the bid requirements and answering questions regarding this solicitation. This conference will be held at the Camp Atterbury Purchasing and Contracting, Building 244 Eggleston Street Edinburgh, IN 46124. Interested Contractors are highly encouraged to attend the pre-bid conference. The site visit will be held following the conference.
3.2. Due to security conditions, all offerors must register to attend this conference and site visit. Email the following information for all attendees to Sheri Herrin and Thomas Fleming at the following addresses:

Firm Name and Telephone Number Visitor’s first name, middle initial, last name, date of birth, and country of birth, race, sex, and Social Security Number.
3.3. This information must be provided in advance, no later than 10:00 a.m. Eastern Standard time August
18, 2020, in order to ensure access to the military base and conference site and ensure adequate seating for the conference attendees. Even if you have access to the base you must register to ensure adequate seating. The furnishing of the above information is voluntary; however, your failure to furnish all or part of the requested information may result in the Government’s denial of your access to the pre-proposal conference. This information will be provided to the Base Security Forces who will authorize your entrance to the site. If you have registered for other site visits the same day, you do not have to submit registration information for this project.
3.4. The most current ORM Self-Assessment COVID-19 Tool will be emailed to those who register for the pre-bid/site visit. Please honestly review this and consider the risk level for each attendee listed. If this is not provided you WILL NOT be allow to attend. Please notify the Base POCs of each attendee’s risk level. During the entire site visit you must be wearing a face covering IAW CDC guidelines. Instructions from the CDC website describing a way to make your own face covering will be emailed to those who register. Please maintain at least 6 feet of distance between you and others during the site visit.
3.5. Visitors must arrive at the Installation’s Main Gate forty-five (45) minutes prior to scheduled site visit in order process. You will be required to present the following information upon arrival: (1) Vehicle Registration, (2) Valid Driver’s License, (3) Proof of Insurance for Vehicle, (4) Safety Inspection and Car Rental agreement if applicable. Any of the above information furnished by you is protected under the Privacy Act and shall not be released unless permitted by law and/or you have consented to such.
3.6. Information provided at this conference or site visit shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.
3.7. A record of the conference shall be made and furnished to all prospective bidders via posting at http://beta.sam.gov. The record will include minutes of the meeting, including questions (on a non-attribution basis) and answers.

4.1. Any explanation desired by an offeror regarding the meaning or interpretation of the solicitation, or proposals, drawings, specifications, etc. must be requested in writing and with sufficient time allowed for a reply to reach bidders before the submission of their bid.

4.4. Receipt by the offeror must be acknowledged in the space provided on the SF 1442 or by returning a signed copy of the amendment by the time set for receipt of bids.
4.5. For security reasons, all technical and engineering data related to this solicitation will be distributed using the Contract Opportunities (Beta.SAM.gov) system. Plans and specifications are locked on Beta.SAM.gov and require Contractors to request explicit access from the Contracting Officer OR export controlled access through DLA. See complete instructions on Beta.SAM.gov. Beta.SAM.gov is a web-based dissemination tool designed to safeguard acquisition-related information for all Federal agencies. 5. BID REPOSITORY AND BID OPENING:
5.1. A bid repository is provided for hand carried bids and is located at Building 244 Eggleston Street

Hand carried bids delivered prior to the bid opening date MUST coordinate with Sheri Herrin sheri.r.herrin.civ@mail.mil or Thomas Fleming at Thomas.s.fleming.civ@mail.mil Hand carried bids must be deposited in the repository prior to the time established for opening of bids. Bidders are cautioned that they will be required to sign-in and obtain a visitor’s pass to enter the facility and should allow time to accomplish this. See instructions for obtain access to the base in the Site Visit instruction. Follow the same instruction for obtaining entry to hand carry bid. Late receipt of bids due to entry delays may not be deemed excusable and the Contracting Officer may declare the bid “late” in accordance with FAR 14.304.
5.2. The bid opening will occur at the time and date specified in Block 13 of the SF1442 September 18, 2020 at 10 a.m. Eastern Standard Time at Camp Atterbury, building 244 Eggleston Street Edinburgh, IN 46124.
All interested offerors and their major subcontractors are encouraged to attend the bid opening.
5.3. Facsimile transmission of bid is not authorized. Electronic submission of bids will NOT be authorized.
5.4. Interested offerors must be registered in System of Award Management (SAM) prior to submission of bids.

7. BID PREPARATION EXPENSES AND PRE-CONTRACT COSTS: This IFB does not commit the Government to pay costs incurred in preparation and submission of bids or for other costs incurred prior to award of a formal contract.

9. DISPOSITION OF UNSUCCESSFUL BIDS:

10. OFFERORS QUALIFICATIONS:
To establish its responsibility, the apparent low bidder may be requested by the Government prior to award, to submit a statement regarding previous experience in performing comparable work, business and technical organization, financial and bonding resources and plant available to be used in performing the work. EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. (d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Edinburgh, Indiana. Johnson County.

52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be __20%__ percent of the bid price or $_3,000,000_, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)
(a) Definitions. As used in this provision--
Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
Federal contracts and grants with total value greater than $10,000,000 means--
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
