SUMMARY OF CHANGES

SECTION 00010 - SOLICITATION CONTRACT FORM

The contractor period of performance end date has increased by 106 days from 184 days to 290 days.

SECTION 00700 - CONTRACT CLAUSES

The following have been added by full text:

52.211-18 VARIATION IN ESTIMATED QUANTITY (APR 1984)

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.

The following have been modified:

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) - ALTERNATE I (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 290 days. * The time stated for completion shall include final cleanup of the premises.

*The Contracting Officer shall specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by 17 June 2014. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

Questions and Answers

Section 00 41 00 – Bid Schedules (para. 1.1 Basis of Bids) This section instructs bidders to fill out and attach the Unit Price Schedules to the proposal and then carry the totals from each unit price schedule to the respective lump sum CLIN items in the Solicitation Contract Form. Will this contract be administered as a unit price contract (i.e.: will the contractor be paid its stated unit prices for all quantities of work actually performed)?

Response: The project is lump sum. See Specification 00 41 00.

Section 01 00 00 – General Requirements (para. 1.2 A-D Project Schedule) The stated project schedule anticipated a project award in the winter of 2014 (2013) and a start of construction in the spring of 2014 with a completion date of October 31, 2014. This would have allowed the contractor the winter months to perform all Stage I material testing, mix design studies, and submittals. Now, with an anticipated award date of mid- June, a NTP date of July 1, and all material testing, mix design studies and submittals required prior to actual construction of the project, it will not be possible to meet the contract completion date. This places considerable risk on the contractor. Please consider revising the project schedule and completion date to reflect the now known bid, award and NTP dates.

Response: The period of performance will be changed from 31 October 2014 to 290 calendar days. This time period includes the required aggregate testing requirements, and developing and approval of the required mix designs. The contractor shall continue construction as long as possible in the Fall of 2014 while being able to meet the requirements of each individual specification in regards to placement and required cure times. A winter exclusion period will be issued to stop work until the weather is suitable in the Spring of 2015.

Section 01 00 00 – General Requirements (para. 1.2 E Project Schedule) This paragraph states that the contractor will be responsible for actual inspection costs at overtime rates if inspectors are required to work in excess of their normal duty hours. It is likely that the contractor will need to work extended hours on this project. Will the contractor be responsible for the additional inspection costs? If so, at what rate?

Response: The new period of performance stated above shall allow for a typical Monday through Friday schedule. No overtime is anticipated for the inspector, but if additional work hours are required outside the normal duty hours and weekend work, the contractor will be required to pay the rates stated in paragraph 1.5.D.

Section 01 00 00 – General Requirements (para. 1.8 A Permits and Taxes) This paragraph states the contractor is responsible for various permits and forms include an NPDES permit. At the pre-bid meeting it was stated that all the contractor is responsible for is the County SESC permit. Is the NPDES permit already in place for this project or will the contractor be required to apply for and obtain this permit?

Response: The plans and specifications state that the Contractor will be responsible for obtaining both the required National Pollutant Discharge Elimination System (NPDES) permit through the Michigan Department of Natural Resources and Environment (MDNRE), and the County Soil Erosion and Sediment Control (SESC) permit. An erosion control drawing, along with required notes and table, is added to the plan set to aid the Contractor in generating the required forms for the permits.

Section 01 00 00 – General Requirements (para. 1.40 Maint. & Repair of Haul Roads) This section states that the contractor is responsible for repairing all base roads utilized for this project to a condition equivalent to its condition prior to start of construction. We will be required to use over 5 miles of roads with substantial heavy truck volume throughout the project. These potential repairs will be very difficult for bidders to quantify and places considerable risk on the bidders. Please consider adding unit price items to compensate the contractor should repairs be needed.

Response: Perimeter Road is a class A road that did not have any issues during the last airfield project in 2011. The government is anticipating some damage due to trucks going on the shoulders or shoulder damage due to sharp corner turns at the intersections or road bends. These areas are to be repaired per Section 01 50 00. If damage does occur to the roadways, it is to be repaired as stated on the revised drawings and according to Section 01 50 00 of the specifications. Sheet G-084 has been updated and included in the amendment to address the repair of the haul routes.

Section 01-45-00 Quality Control (Contractors Quality Assurance) Can the Contractors’ on-site QC lab be inspected and approved for material acceptance testing?

Response: See Section 01 45 00 for the requirements of the approved testing laboratory’s. All lab’s used for the testing of materials for this project are to be certified as stated in the specifications.

Section 32 11 16 Base Course for Rigid & Subbases for Flexible Paving (para. 3.7 & 3.8) Are both compaction testing and proof rolling testing required to accept the rigid base course?

Response: Items required to be proof rolled consist of the subgrade, subbase and crushed aggregate layers in the apron asphalt sections located at each end of the new concrete apron where it connects to the adjacent taxiways.

The crushed aggregate layer is to be proof rolled in the asphalt shoulder areas. The subgrade, subbase, and crushed aggregate layers for the concrete sections will only require proof rolling in areas as verification if compaction, compaction uniformity, or uniformity of the material is in question by the COR during construction.

Section 32 13 11 Concrete Pavement for Airfields (para. 1.5.4) Due to the tight project schedule, can aggregate quality testing and concrete mix study be conducted concurrently as long as final test reports verify aggregate quality compliance? Durability testing for aggregates per ASTM C-666 requires a 10-12 week period for a 300 cycle freeze/thaw test procedure.

Response: The schedule has been adjusted. It is the contractors risk to run both concurrently.

Section 32 13 11 Concrete Pavement for Airfields (para. 2.2.2.3) Providing the workability and coarseness factors are compliant to the workability parallelogram, can a 1" nominal maximum size coarse aggregate be used? Utilizing an aggregate blend of ASTM #57 and ASTM #8 will produce an optimum combined aggregate gradation with regard to workability and coarseness factors.

Response: The USACE specifications will most likely not be waived by the MAJCOM pavements engineer or USACE.
