Evaluation Factors for Award

In accordance with Federal Acquisition Regulation (FAR) 15.304, the following factors will be considered in evaluating the proposals:Evaluation Factors

1. Technical Factor One (1) - Experience

2. Factor Two (2) - Past Performance

3. Factor Three (3) – Management Plan

4. Factor Four (4) - Price

Basis for Award: Subject to the provisions contained herein, award will be made to one (1) Offeror who is deemed responsible in accordance with the FAR, conforms to the solicitation requirements and whose proposal is determined to be technically acceptable and offers the Best-Value to the Government, with respect to experience, past performance, management plan and price. This source selection approach, called Best-Value Tradeoff, includes an evaluation of all factors: experience, past performance, management plan, and price. The Government reserves the right to award to other than the lowest proposed price Offeror; however, the degree of importance of price as a factor will become greater as the non-price factors of proposals approach equality. The greater the equality of non-price factors of proposals, the more important price shall become in selecting the best-value to the Government.

Unreasonably high proposed prices may be grounds for eliminating a proposal from the competitive range based upon an assessment that the Offeror does not understand the requirement or the Offeror has made an unreasonable proposal.

Relative Importance of Factors: The proposals will be evaluated based on the four (4) evaluation factors I: Factor One (1) Experience, Factor Two (2) Past Performance; Factor Three (3) Management Plan and Factor Four (4) Price. All non-price factors are of equal importance and when combined are significaly more impartant than price.

Discussions: It is the Government’s intent to award without discussions. However, in accordance with FAR 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and Offerors notified in accordance with FAR 15.503.

Competitive Range: The competitive range may be limited for purposes of efficiency in accordance with FAR 15.306(c)(2). Offerors are urged to reflect their best possible terms, to include price related elements, since less than the best potential terms / prices could result in the exclusion of the proposal from further consideration.

Responsibility: In accordance with FARSubpart 9.1, the Contracting Officer will perform an affirmative responsibility determination to ensure that the awardee has the adequate resources to perform the work.

Contractor’s must provide a suitable Bank Letter of Guarantee (BLG) or Bond, in order to protect the Governments interest in the event of default.

Defense Base Act (DBA) Insurance Coverage: DBA coverage is required for work performed on this project by all contractors and subcontractors. DBA insurance is NOT priced separately and shall be included within the price proposal. The offeror will be required to provide the insurance certificate prior to receiving the Notice to Proceed (NTP). Additionally, within 14 calendar days of the date of award, the contractor shall provide any required DBA insurance certificates. DBA insurance is commercially available from carriers and self-insured employers authorized by the Department of Labor (DOL). The DOL table of authorized carriers and self-insured employers is avalaible at http://www.dol.gov/owcp/dlhwc/lscarrier.htm Refer to FAR Clause 52.000-4133, Workers Compensation Insurance (Defense Base Act) – Countries with Waivers (October 2013) for more DBA insurance information and how to obtain DBA Insurance.

The following are definitions of commonly used terms in the evaluation process:

Significant Strength is an aspect of an Offeror’s proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.

Strength is an aspect of an Offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance (see FAR 15.001).

Significant Weakness in a proposal is a flaw that appreciably increases the risk of unsuccessful contract performance (see FAR 15.001).

Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level (see

FAR 15.001).

Factor One (1) – Experience

Evaluation Criteria:

1. The Offeror will be evaluated on the depth and the relevancy of the experience as submitted in the proposal in accordance with the following criteria:

a. Projects with a similar cost magnitude. (Offerors are allowed to use higher value contracts if there is a relevant (i.e. lower value) scope of work with a measurable performance period and measureable monetary value within the larger project). An example could be a single contract that includes separate facilities, buildings, or Phased construction. Offerors shall clearly describe this relevant scope and how it related to the overall contract. (Smaller projects bundled into a larger project are not considered relevant.)

b. Project which demonstrate design-build experience.

c. Projects that demonstrate experience working in any of the European countries with projects performed in Azerbaijan being considered most relevant.

d. Projects that are completed (as opposed to in-progress or on-going).

e. Projects performed within the last seven (7) years. Projects older than seven (7) years will be evaluated but may be considered less relevant

f. Projects which demonstrate experience in building schools.

g. Projects which demonstrate experience in electrical and controls work to include transformer installation, buried electrical and control cables, control panels, disconnect switches, grounding protection, etc.

h. Projects which demonstrate experience in minor earthwork, grading, and roadway surface repair.

2. Projects demonstrating experience in multiple trades listed above will be considered more relevant than those projects demonstrating one trade.

3. If more than the maximum of four (4) projects are submitted, only the first four (4) will be evaluated.

4. An Offeror will not receive credit under this factor for the relevant experience of an individual or for key personnel experience proposed for this project. An Offeror should not submit base indefinite quantity contracts and multiple award construction contracts as projects, however, individual task orders under those contracts may be submitted as projects.

The adjectival ratings from Factor 1: Experience are listed and defined below:

Rating Description

Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficinencies, and/or risk of unsuccessful performance is unacceptable.

Proposal is unawardable.

Factor Two (2) - Past Performance

1. There are three (3) aspects to the past performance evaluation: recency, relevancy (including context of data), and quality (including general trends in contractor performance and source of information). The first aspect is to evaluate the recency of the offeror’s past performance. Receny is expressed as a time period during which past performance references are considered relevant, and is critical to establishing the relevancy of past performance information. The second is to determine how relevant a recent effort accomplished by the offeror is in comparison to the relevancy criteria established under Factor One (1), Experience. With respect to relevancy, more relevant past performance will typically be a stronger predictor of future performance and have more influence on the past performance confidence assessment than past performance of lesser relevance and will be evaluated as follows:

Adjectival Rating

Description

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The third aspect of the past performance evaluation is to establish the overall quality of the offeror’s past performance (see FAR 15.304(c)(2)). A separate quality assessment rating will not be assigned for this aspect; rather the past performance confidence assessment rating is based on the offeror’s overall record of recency, relevancy, and quality of performance.

2. The Offeror's past performance will be evaluated based on the performance on projects submitted under

Factor One (1), Experience, and any other past performance information obtained and deemed appropriate by the Government. Past performance shall be evaluated in accordance with the following criteria:

e. Cost/Financial Management: Whether the Offeror met the contract requirements by completing the project at the agreed to price and where not; the extent to which the Offeror was responsible for cost increases; whether the Offeror provided alternative methods that benefited the client; whether the Offeror submitted invoices timely with sufficient documentation to substantiate requested payment;

and whether the Offeror avoided significant unexplained variances from the original price.

f. Safety/Security: The Offeror’s prior record for maintaining an environment of safety, adherence to a safety plan, and compliance with safety requirements, including following safety regulations, housekeeping, and correcting noted deficiencies, as well as the Offeror’s prior compliance with all security requirements and personnel security requirements when applicable.

3. In evaluating relevancy and determining a confidence assessment of past performance, shall also be evaluated in accordance with the following criteria:

a. The relevance of the past performance;

b. How recent the project submitted was performed;

c. Trends in the Offeror’s performance;

d. Evaluations, letters / certificates of appreciation, commendations, and awards from clients; and

e. Positive and / or negative comments that impact evaluation of the Offeror’s past performance.

4. Letters, Certificates, Commendations, and Awards: Additional consideration may be provided for letters of appreciation and commendations provided as part of an Offeror’s proposal, especially for projects submitted in response to Factor One (1), Experience.

5. The Government reserves the right to verify statement the Offeror makes regarding its past performance to determine whether they are substantiated.

6. Unavailability of Past Performance Information: In accordance with FAR 15.305(a)(2)(iv), in the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available; the Offeror may not be evaluated favorably or unfavorably on past performance.

7. Additional Past Performance Evaluation Information:

a. Negative comments received from data gathered by the Government will not necessarily result in an adverse rating. However, negative comments from relevant past performance sources may negatively impact the evaluation of an Offeror’s past performance.

b. The Offeror shall ensure that the identified references and points of contact speak English, if possible, and are aware they may be contacted for information. Offerors are reminded that the Government reserves the right to obtain past performance information from any source available. The Government may also consider other past performance information in evaluating overall risk associated with a particular Offeror.

c. At no time during the evaluation process, in the debriefing, or after award, will the names of the individuals providing reference information about an Offeror's past performance be revealed to the Offeror or to any other party.
