SECTION 00 70 00 - CONTRACT CLAUSES
The following have been modified:
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) -
ALTERNATE I (APR 1984)
The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c):
1. Complete all contract work, with the exception of painting repairs, no later than 21 March 2014.
2. While the interim completion date is 21 March 2014, the non-navigation season ends approximately 7 March 2014. In the event the contract work is not completed during the non-navigation season, the Contractor shall provide Helper Boats, as necessary, to maintain operational capabilities. Helper boats shall be provided for the period from the opening of the navigation season until the interim completion date.
Should the contractor fail to complete the work by the interim completion date due to non-excusable delays, the Contractor shall provide helper boats at no additional cost to the Government until all contract work, with the exception of painting repairs, is completed. (See also 52.211-12 Liquidated Damages – Construction.)
3. Complete all painting repairs no later than 30 June 2014. The time stated for completion shall include final cleanup of the premises.
The interim and final completion dates are based on the assumption that the successful offeror will receive the notice to proceed by 15 January 2014. The interim and final completion dates will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $837.00 for each calendar day of delay after 21 March 2014 until all contract work, with exception to painting repairs, is completed or accepted.
