3.1 ARCHEOLOGICAL SITE

3.1.1 Site Protection

Archaeological Site 47PI559 is located at the base of the access road and north of Spot Dike J. No site work or mobilization of equipment on site shall occur until the archaeological site is protected. The area to be protected will be identified by the Contracting Officer's Representative and a District Archaeologist and reviewed during the pre-construction joint condition survey with the Contractor. Protective measures will include: 1) Tree and brush removal will be cut to ground level with no grubbing;

2)Topsoil shall not be stripped; 3)Geotextile shall placed over the existing ground surface; 4) A minimum of two feet of sand topped with interlocking composite mats with non-skid surfaces or other suitable material to absorb rutting and prevent other ground disturbing activities and compaction will placed over the archaeological site area; and 5) Placement of the protective measures will be monitored by a District Archaeologist. No work, parking, storage of equipment or disposal of materials will take place outside of the protected area.

3.1.2 Site Clean Up

After construction is complete, geotextile, sand, interlocking composite mats, and other materials used to protect the archeological site shall be removed. Removal of the protective measures will be monitored by a District Archaeologist. The portion of the area that is not covered by trail, shall be restored to its original condition, including topsoil and seeding as decribed in SECTION 32 92 19.00 13 SEEDING.

3.2 EXISTING UTILITIES

3.2.1 General

The Contractor shall coordinate all utility relocation requirements and make payment to the utility companies for all services, fees, and permits required to relocate and reestablish service. The Contractor shall be responsible for all costs related to protecting existing utilities.

3.2.2 Buried Utilities

The approximate locations of known existing buried utilities are shown on the drawings to the extent of available information at the time the drawings were prepared. (In general, no service connections are shown.)

Prior to commencing excavation, the Contractor shall accurately locate all such installations. In the event the Contractor damages any existing utility lines, report thereof shall be made immediately to the Contracting Officer. Repair of damaged utilities shall be in accordance with CLAUSE

52.236-9 PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT,

UTILITIES, AND IMPROVEMENTS.

SECTION 01 14 00.00 13 Page 3

3.2.3 Interruption of Services

Utility services shall not be interrupted except for brief periods to facilitate cut-ins. The Contractor shall provide temporary service and shall relocate existing utilities as required to construct the work shown and insure uninterrupted service. If interruption of services is unavoidable, the Contractor shall request approval in writing at least 30 calendar days prior to the proposed interruption. This submittal shall fully describe all details of proposed interruption and the reasons why alternatives are not feasible. The Contractor shall further coordinate with the owner of the utility and notify affected consumers at least 10 calendar days in advance of interruption of services. The Contracting Officer will not in general approve proposals which require interruption of services for more than 4 continuous hours.

3.2.4 Wisconsin Diggers Hotline

For contract work performed within the State of Wisconsin, the Contractor shall meet the requirements of the Wisconsin Statute 182.0175 "Damage to Transmission Facilities. The Wisconsin Diggers Hotline notification center telephone numbers are:

Hotline 800-242-8511 Main Office 414-259-0676

3.3 PROTECTION OF TREES

Trees to be protected shall be determined and staked by the Contracting Officer. The following measures shall be implemented for tree protection and shall be addressed in the Environmental Protection Plan required under Section 01 57 20.00 13 ENVIRONMENTAL PROTECTION:

a. The trees shall be protected from wounds to the bark and foliage.

b. The critical root zone shall be protected from compaction and grading.

c. Changes in temporary site drainage and ponding shall be minimized to the extent possible that it effects the protected trees.

The critical root zone of trees designated to be protected shall be surrounded by a high visibility fence 4 feet in height, supplied and erected by the Contractor. The critical root zone shall be defined by an area extending 1.5 feet radius from each tree for each inch of Diameter at Breast Height (DBH). The fence shall be securely erected and installed prior to any movement through the project site by construction vehicles or equipment, and remain in place until construction and clean-up are completed. The critical root zone shall remain free of all construction activities including trenching, staging, stockpiling and storage of materials. Vehicles and equipment shall not drive or park within the critical root zone. Variation to the critical root zone size or configuration will only be permitted where it is absolutely necessary for construction of the project, and requires approval of the Contracting Officer. Short duration alterations of the critical root zone involving wood chips and limited equipment travel shall be submitted in writing for approval.

The Contractor shall not operate equipment in vegetated areas outside the work limits.

SECTION 01 14 00.00 13 Page 4

3.3.1 Restoration of Damaged Trees

Any existing tree designated to be protected that is damaged by the Contractor's operations shall be replaced. Trees will be considered damaged if the critical root zone in cohesive soils is compacted, if there are significant wounds that could contribute to rot, or if distress (evident by reduced growth or other observations of distress documented by a forester) is observed prior to closing the contract. Trees shall be replaced in kind on a caliper inch per caliper inch basis (DBH) (e.g. one 6-inch red oak shall be replaced with two 3-inch red oaks, three 2-inch red oaks, or six 1-inch red oaks). The Contractor shall warrent that the replacement trees remain viable and disease free for a period of not less than one year from date of acceptance of the replacement trees.

Replacement tree size and location will be determined and staked by the Contracting Officer. Repair by pruning, aeration, soil conditioning, or other recommendation from a qualified forester will be considered as substitution for replacement by the Contracting Officer.

3.4 PROTECTION OF EAGLE NESTS

3.4.1 Protection of Eagle Nests

Where and active eagle nest exists, the following applies:

a. No construction activity within 1/4 mile of an eagle nest March 1 to May 1.

b. After May 1, no construction activity within 1/8 mile of an eagle nest until the young eagles have fledged, as determined in subparagraph (c).

c. Corps, WDNR and USFWS biologists will survey the Lock and Dam 3 project area in early spring to locate actively used eagle nests.

Corps, WDNR and USFWS biologists will determine when the young eagles have fledged and the nest is no longer occupied. This usually occurs by 1 June on the Upper Mississippi River. If the young eagles have fledged and the nest is no longer occupied, construction activity can resume without limitation due to eagle nests. The Contracting Officer will notify the Contractor in writing of any determination that an eagle nest is no longer occupied. Thees with eagle nests may not be damaged or removed by construction activity, except as approved in writing by the Contracting Officer.

3.4.2 Location of Eagle Nests

The contract drawings indicate the location of eagle nests that have been sighted in recent surveys by the Government. The contract drawings also include lines delineating 1/8 mile and 1/4 mile distances from the sighted eagle nests. The eagle nests that are active change from year to year. The Corps, WDNR and USFWS will survey the construction area in the spring to identify any actively used eagle nests. If additional eagle nests are discovered prior to completion of construction and materially change the scheduling or metholology of accomplishing the contact, the Contractor may request an equitable adjustment in the contract price and schedule. Any such adjustment shall be computed in accordance with 52.243-4 CHANGES (JUN 2007).

3.5 SITE ACCESS RESTRICTIONS

Dredging to allow access to the site is not allowed.

SECTION 01 14 00.00 13 Page 5
