Chapter 30 Permit and Water Quality Certification Lock and Dam 3 – Navigation Safety Dredging
United States Army Corps of Engineers, Attention: Ms. Judith L.A. DesHarnais, P.E., Deputy for Programs and Project Management, St Paul District Corps of Engineers, 190 5th Street East, Suite 401St. Paul, MN 55101 is hereby granted a permit under Section 30.20(2), Wisconsin Statutes and Water Quality Certification under 401 of the Clean Water Act, and Chapter NR 299 Wisconsin Administrative Code., to remove materials from the bed of the Mississippi River - Pool No.3. The project is located upstream from the gated part of the dam between river miles 796.9 and 797.5 in the Town of Diamond Bluff, Pierce County, also described as Section 31, Township 25 North, Range 18 West subject to the following conditions:
Permit and Water Quality Certification
(Conditions apply to both Chapter 30 permit and WQC and hereafter are referred to as “permit”)
1. You must notify Dave Pericak at phone (608) 785-9108 before starting construction and again not more than 5 days after the project is complete.
2. You must complete the project as described on or before 10/14/2012. If you will not complete the project by this date, you must submit a written request for an extension prior to the expiration date of the permit. Your request must identify the requested extension date and the reason for the extension. A permit extension may be granted, for good cause, by the Department. You may not begin or continue construction after the original permit expiration date unless the Department grants a new permit or permit extension in writing.
3. This permit does not authorize any work other than what you specifically describe in your application and conceptual plans, and as modified by the conditions of this permit. Since this project is being built with a design /build contract, the COE shall submit the detailed plans developed by the contractor to the Department for approval prior to starting the project. If you wish to alter the project or permit conditions, you must first obtain written approval of the Department. This may require an amendment to the permit depending on the significance and extent of the change(s).
4. You are responsible for obtaining any permit or approval that may be required for your project by local zoning ordinances and by the U.S. Army Corps of Engineers before starting your project.
5. Upon reasonable notice, you shall allow access to your project site during reasonable hours to any Department employee who is investigating the project's construction, operation, maintenance or permit compliance.
6. The Department may modify or revoke this permit if the project is not completed according to the terms of the permit, or if the Department determines the activity is detrimental to the public interest.
7. You must post a copy of this permit at a conspicuous location on the project site, visible from the waterway, for at least five days prior to construction, and remaining at least five days after construction. You must also have a copy of the permit and approved plan available at the project site at all times until the project is complete.
8. Your acceptance of this permit and efforts to begin work on this project signify that you have read, understood and agreed to follow all conditions of this permit.
9. You, your agent, and any involved contractors or consultants may be considered a party to the violation pursuant to Section 30.292, Wis. Stats., for any violations of Chapter 30, Wisconsin Statutes or this permit.
10. The dredging, placement activity, and rock capping shall only occur during periods of low river flow (less than 20,000 cfs).
11. Placement of sediment should be limited to sediments with greater than 90% sand contents (P200 < 10%). This is consistent with island projects that have been constructed as part of the habitat projects under the Environmental Management Program. The COE shall monitor sediment transport by periodically measuring TSS concentrations upstream and downstream of the project area during periods of dredging and sediment placement. Depth-integrated sampling will be necessary to adequately evaluate movement of sediment.
12. The dredging, dredge material placement activity, and rock capping shall not occur between March 15 and May 15 of any year to minimize impacts to fish spawning.
13. Bottom materials must be removed by equipment, which is designed to minimize the amount of sediment that can escape into the water. Equipment must be properly sized so that excavation conforms to the plans submitted.
14. You must not deposit or store any of the removed materials in any wetland or below the ordinary high watermark of any waterway except where specifically approved.
15. All equipment used for the project including but not limited to tracked vehicles, barges, boats, silt or turbidity curtain, hoses, sheet pile and pumps shall be de-contaminated for invasive and exotic viruses and species prior to use and after use. This condition does not apply to equipment that is at a different location on the Mississippi River and will site be transported within the same waterway to the site and vice versa. This condition does not apply to equipment that is moved within the project site including the Lower Embankment project and navigation safety project provided the equipment was properly treated prior to arriving at the site.
The following steps should be taken every time you move your equipment from the project site to avoid transporting invasive and exotic viruses and species. To the extent practicable, equipment and gear used on infested waters should not be used on other non-infested waters.
1. Inspect and remove aquatic plants, animals, and mud from your equipment.
2. Drain all water from your equipment that comes in contact with infested waters, including but not limited to tracked vehicles, barges, boats, silt or turbidity curtain, hoses, sheet pile and pumps
3. Dispose of aquatic plants, animals in the trash. Never release or transfer aquatic plants, animals or water from one waterbody to another.
4. Wash your equipment with hot (>104º F) and/or high pressure water OR allow your equipment to Dry thoroughly for 5 days.
FINDINGS OF FACT
1. Ms. Judith L.A. DesHarnais, P.E., Deputy for Programs and Project Management, St Paul District Corps of Engineers, 190 5th Street East, Suite 401St. Paul, MN 55101 has filed an application on behalf of the United States Army Corps of Engineers to remove materials from the bed of Mississippi River - Pool No.3. The project is located upstream from the gated part of the dam between river miles 796.9 and 797.5 in the Town of Diamond Bluff, Pierce County, also described as Section 31, Township 25 North, Range 18 West.
2. The project will consist of mechanically excavating 118,000 cubic yards of river bed material in the main channel above the gated portion of the dam. The material will be loaded on barges and redeposited in the lock approach and capped with rock. This dredging is being done as part of a navigation improvement project to reduce the out draft current with a goal to reduce the risk of navigation accidents that could result in a failure of LD 3. The dredging portion of the project is in Wisconsin and the material placement and a lock guidewall extension is in Minnesota. The dredging would deepen an area about 30 acres to elevation 655.0 feet. The sideslopes of the dredged area will be 5 horizontal to 1 vertical. The Pool 3 project pool level is 675.0 feet resulting in a 20 feet depth in the dredged area.
3. The dredging, redepositing of material, and capping with rock would only occur during periods of low flow (< 20, 000 cfs) to minimize the ability for sediment to be carried downstream.
4. The Department has completed an investigation of the project site and has evaluated the project as described in the application and conceptual documents dated July 2009. The COE will be awarding a design/build contract to a contractor who will develop detailed plans and specification for the project. The detailed plans will be submitted to the Department for approval prior to starting the project.
5. Sediment cores were obtained from the dredging area and these samples were analyzed for bulk chemistry and particle size gradation. Results of the analysis indicate that there doesn’t appear to be contaminants of concern in the proposed dredge cut. It is likely that migration of fine sediments will occur during dredging and sediment and rock placement due high current velocity that can be expected in the main channel or main channel border areas. Since the proposed dredge cut is in a reach of river that has been placed on Minnesota’s and Wisconsin’s impaired waters list for excessive turbidity or sediment, appropriate sediment controls are necessary to reduce downstream transport of sediment to protect downstream aquatic life.
6. The proposed project, if constructed in accordance with this permit will not adversely affect water quality, will not increase water pollution in surface waters and will not cause environmental pollution as defined in s. 283.01(6m), Wis. Stats.
7. The Department of Natural Resources and the applicant have completed all procedural requirements and the project as permitted will comply with all applicable requirements of Sections 1.11, 30.20(2), Wisconsin Statutes and Chapters NR 102, 103, 115, 116, 117, 150, 299, 345, and 347 of the Wisconsin Administrative Code.
CONCLUSIONS OF LAW
1. The Department has authority under the above indicated Statutes and Administrative Codes, to issue a permit for the construction and maintenance of this project.
NOTICE OF APPEAL RIGHTS
If you believe that you have a right to challenge this decision, you should know that the Wisconsin statutes and administrative rules establish time periods within which requests to review Department decisions shall be filed. For judicial review of a decision pursuant to sections 227.52 and 227.53, Wis. Stats., you have 30 days after the decision is mailed, or otherwise served by the Department, to file your petition with the appropriate circuit court and serve the petition on the Department. Such a petition for judicial review shall name the Department of Natural Resources as the respondent.

CHAPTER 30 PERMIT and WATER QUALITY CERTIFICATION
LOCK AND DAM 3 UPPER EMBANKMENT
United States Army Corps of Engineers, Attention: Ms. Judith L.A. DesHarnais, P.E., Deputy for Programs and Project Management, St Paul District Corps of Engineers, 190 5th Street East, Suite 401St. Paul, MN 55101 is hereby granted a permit under Section 30.12(3m), Wisconsin Statutes and Water Quality Certification under Section 401 of the Federal Clean Water Act, Section 281.15 Wisconsin Statutes, and Chapter NR 299, Wisconsin Administrative Code to place structures on the bed of Mississippi River and in wetlands of the Mississippi River.
This Upper Embankment project includes constructing nine overflow weirs, a water control structure, and an access trail. The construction footprint of the project is 4.7 acres of which 2.1 acres is wetland.
The project is located between Mississippi River mile 799.3-797.0 in the Town of Diamond Bluff, Pierce County, also described as the Sections 19, 30, 31 of Township 25 North, Range 18 West and Section 25 of Township 25 North, Range19 West. The permit and Water Quality Certification is subject to the following conditions:
3. This permit does not authorize any work other than what you specifically describe in your application and plans dated 5/01/08, and as modified by the conditions of this permit. If you wish to alter the project or permit conditions, you must first obtain written approval of the Department.
9. You must submit a series of photographs to the Department, within one week of completion of work on the site. The photographs must be taken from different vantage points and depict all work authorized by this permit.
10. You, your agent, and any involved contractors or consultants may be considered a party to the violation pursuant to Section 30.292, Wis. Stats., for any violations of Chapter 30, Wisconsin Statutes or this permit.
11. Construction shall be accomplished in such a manner as to minimize erosion and siltation into surface waters and as specified in the plans and procedures that are part of or approved pursuant to this permit. All erosion control measures must meet or exceed the approved Stormwater Construction Technical Standards found on the Department’s Runoff Management Website http://dnr.wi.gov/org/water/wm/nps/stormwater/techstds.htm#Construction developed by the Department under Wis. Admin. Code Ch. NR 151.31
Silt curtains shall be installed and maintained above and below each overflow weir/spot dike to limit suspended sediment transport. The silt curtains shall extend to the bed and above the water surface. The silt curtains shall be removed within one year of project completion.
12. Eagle nests have been identified in the vicinity of the project. Corps and
Department biologists will visit the site in the spring of each year of construction to identify actively-used eagle nests. No activity shall take place within ¼ mile of an actively-used nest from March 1 to May 1. No activity shall take place with 1/8 mile mile of an actively-used eagle nest from May 1 until Corps and Department biologists have determined the nests have been vacated. After the eagle nests have been vacated, construction activity may resume in the vicinity of the eagle nests.
13. Tree, vegetation removal and soil disturbance along the road corridor is limited to a
20 feet width along the length of the road, except as described in Findings of Fact 4 below. The work limits shall be clearly marked and trees to be protected along the corridor shall be marked. Future maintenance of the roadway and alongside the roadway is limited to a 15 feet width.
14. Prior to construction, The COE shall invite DNR staff, Corps construction and forestry staff to mark out and adjust the centerline of the access trail (following closely to the line delineated in a March 09 site visit) and to mark trees to be preserved. This field fit of the access trail will be done to avoid trees and minimize the amount of disturbance.
15. No equipment shall be operated outside of the 20 feet wide corridor without approval of the Department except at the spot dikes and in other areas where the access trail will be wider as described in Findings of Fact 4 below. It is understood that the construction is wider at each of the spot dikes.
16. The finished top elevation of the road construction and the ground surface immediately adjacent to it must be the same as the original pre-construction elevations. Because of the recent change in the construction standard to not excavate soils, there is the potential for the road compaction process to displace soils bordering the trail resulting in a higher ground surface bordering the road.
These materials must be removed if this does occur. A plan must be submitted to the Department for approval to restore the trail border area if regrading is necessary.
17. You must not deposit or store any of the removed materials in any wetland or below the ordinary high watermark of any waterway. All removed materials must be placed out of the floodway of any stream.
18. If river access is used to deliver materials or equipment to the construction site, the access point(s) shall be approved by the Department. A plan should be submitted that includes the locations, and materials to construct landing pad(s).
19. You must place all of the removed materials at the Monarch Paving Pit in the location shown on the plans. An alternative placement site may be used subject to prior approval by the Department.
1. United States Army Corps of Engineers, Attention: Ms. Judith L.A. DesHarnais, P.E., Deputy for Programs and Project Management, St Paul District Corps of Engineers, 190 5th Street East, Suite 401St. Paul, MN 55101, has filed an application to place structures on the bed of Mississippi River and in wetlands of the Mississippi River. The project is located between Mississippi River mile 799.3-799.0 in the Town of Diamond Bluff, Pierce County, also described as Sections 19, 30, 31 of Township 25 North, Range 18 West and Section 25 of Township 25 North, Range19 West.
2. The COE has provided information that they are the owner of the property where the spot dike improvements and water control structure will be constructed and majority of the access road. The first segment of the access road from 290th Avenue is not owned by the COE; however, a Chapter 30.12 permit is not needed to make improvements to this section of road.
3. The project will consist of several improvements to the Upper Embankment of Lock and Dam 3 including, constructing nine overflow weirs/spot dikes (A2, A3, A4, D, E1, E2, F, I, J), a water control structure, and an access trail. The upper embankment is comprised of a natural river shoreline that is overtopped regularly during high flow conditions. This embankment has been altered in several areas to restrict water flow in natural occurring channels. Nine of these areas will be substantially improved to reduce the chance of embankment failure. The improvements include a total of 1200 lineal feet of steel sheet pile driven to a depth of 40 feet. 16,000 cubic yards of material will be excavated and hauled to the Monarch Paving Pit or an alternative site approved by the Department to prepare the spot dike sites for reconstruction. Clean fill will be brought to the site including sand, gravel and heavy riprap. Each spot dike will be armored with a 2- 3 feet thick layer of riprap over geotextile. These nine spot dikes comprise 12 % of the embankment’s 2 mile length.
4. An access trail/road for initial construction traffic and later maintenance traffic will be constructed the entire 2 mile length of the spot dikes. The permanent road will be 10 feet wide and constructed of breaker rock and smaller aggregate and only a 15 feet width will be maintained in the future as a vegetation free zone. The thickness of the roadbed may be up to 30 inches and the top elevation will match the existing grade except in the immediate approaches to spot dikes A2 and E1. The plans for the construction of the road have changed as of 10-13-09 to now allow for the rock to be placed and compacted by equipment traffic without excavating the soils first. The plans for the road specify a 50 feet wide construction zone the entire length. A maximum 20 feet wide corridor will actually be disturbed to construct the road to accommodate large equipment except at the following locations :
- Turnaround area at the base of the entry trail
- A bypass area 40 ft wide by 100 feet long between spot dike E2 and spot dike F.
This is in the large flat grassed area where the 1983 embankment protection work was done and there is at least 75 ft to 80 ft of tree-free clearance.
- The following areas will need to have a 25-ft wide construction disturbance footprint to allow the trail to transition into the spot dikes and prevent water from flanking the spot dikes:
190 ft of trail from spot dike A2 to approximately half way to spot dike A3 50 ft of trail approaching spot dike E1.
5. At Spot Dike D, an existing water control inlet will be removed and replaced with a cast-in-place concrete culvert of the same dimensions and elevation with removable stop log bulkhead. The opening of the structure is 4’8” wide and 2.0 feet high. This structure will allow water through the embankment to Marsh Lake. The COE water level control plan for this structure specifies that the maximum differential between the Mississippi River and Marsh Lake is 2.0 feet to avoid seepage problems and potential failure of the spot dikes.
6. The Upper Embankment provides important public access to navigable waters in
Marsh and Gantenbein Lakes. This embankment overtops during high flows allowing access between the Mississippi river and these two lakes. The existing inlet water control structure at Spot Dike D is a low structure that also allows navigation between these waterways at even the summer low water levels. The existing and proposed inlet water structure location is at one of the original navigable Trimbelle River channels (1848 land survey and COE 1929 survey maps). The replacement structure will continue to provide a navigable access point although a portage around or over the structure will be more difficult. Navigation events are restricted to the wetted portions of the channel(s) except to cross obstructions or if on federal property only.
7. Construction access for this project is proposed to be land based from the north off 290th Avenue although river access may be used to deliver materials to the site. An entry trail from 290th Avenue will also be improved with rock and lead to a small staging area. Cultural resources have been identified at this location and a plan will be implemented to avoid soil disturbance and cap certain areas with sand.
8. The Department has completed an investigation of the project site and has evaluated the project as described in the application and plans.
9. The proposed project, if constructed in accordance with this permit will not adversely affect water quality, will not increase water pollution in surface waters and will not cause environmental pollution as defined in s. 283.01(6m), Wis. Stats.
10. The proposed project will impact 2.6 acres of wetlands if constructed in accordance with this permit. The COE has considered and applied all practicable measures to minimize adverse impacts to the functional values of the affected wetlands. No practicable alternative exists which would completely avoid adverse impacts to wetlands.
11. The COE has developed a wetland mitigation plan for the Upper and Lower
Embankments based on federal requirements for environmental mitigation under the Fish and Wildlife Coordination Act, the Clean Water Act, the National Environmental Policy Act and Corps of Engineers guidance ER 1105-2-100. The COE has a compensatory mitigation objective of 313 acres of floodplain forest which includes both wetland and upland floodplain forest. A minimum of 25.7 acres of wetland mitigation will be provided. The Department has reviewed the plan and determined that it meets the substantive requirements of the State’s wetland mitigation law.
12. The Department of Natural Resources and the applicant have completed all procedural requirements and the project as permitted will comply with all applicable requirements of Sections 1.11, 30.12(3m), 281.15, Wisconsin Statutes and Chapters NR 102, 103, 115, 116, 117, 150, 299 of the Wisconsin Administrative Code.
To request a contested case hearing of any individual permit decision pursuant to section 30.209, Wis. Stats., you have 30 days after the decision is mailed, or otherwise served by the Department, to serve a petition for hearing on the Secretary of the Department of Natural Resources, P.O. Box 7921, Madison, WI, 53707-7921. The petition shall be in writing, shall be dated and signed by the petitioner, and shall include as an attachment a copy of the decision for which administrative review is sought. If you are not the applicant, you must simultaneously provide a copy of the petition to the applicant. If you wish to request a stay of the project, you must provide information, as outlined below, to show that a stay is necessary to prevent significant adverse impacts or irreversible harm to the environment. The filing of a request for a contested case hearing is not a prerequisite for judicial review and does not extend the 30-day period for filing a petition for judicial review. If you are not the permit applicant, you must provide a copy of the petition to the permit applicant at the same time that you serve the petition on the Department.
A request for contested case hearing must meet the requirements of section 30.209, Wis. Stats., and section NR 310.18, Wis. Adm. Code, and must include the following information:
1. A description of the Department’s action or inaction which is the basis for the request; and,
2. A description of the objection to the decision that is sufficiently specific to allow the department to determine which provisions of Chapter 30, Wis. Stats., may be violated; and
3. A description of the facts supporting the petition that is sufficiently specific to determine how you believe the project may result in a violation of Chapter 30, Wis. Stats.; and,
4. Your commitment to appear at the contested case hearing, if one is granted and present information supporting your objection.
5. If the petition contains a request for a stay of the project, the petition must also include information showing that a stay is necessary to prevent significant adverse impacts or irreversible harm to the environment.
