Section 00100A – Proposal Evaluation & Submission Instructions

A. BASIS FOR AWARD

The award will be made based on the best overall (i.e., best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the four evaluation factors: Technical Merit, Past Performance, Small Business Participation, and Price. The Source Selection Authority (SSA) will use a trade-off process to determine which offer represents the best value to the Government. This process allows the SSA to consider making award to other than the lowest priced offeror or other than the highest technically rated offeror. To receive consideration for award, a rating of no less than "Acceptable" must be achieved for the Technical Merit Factor and the Small Business Participation Factor, and a rating of no less than “Neutral Confidence” must be achieved for the Past Performance Factor. A rating of “Unacceptable” for the Technical Merit Factor or Small Business Participation Factor will result in an unawardable proposal. Offerors are cautioned that the award may not necessarily be made to the lowest price offeror or the highest technically rated offeror.

In the case of offerors for which there is no information on past contract performance or where past contract performance information is not available, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR 15.305(a)(2)(iv).) In this case, the offeror’s past performance is unknown and assigned a performance confidence rating of “Neutral Confidence.”

The importance of non-priced factors are listed in descending order of importance.

All evaluation factors other than price, when combined, are significantly more important than price.

Limitations on Substitutions for Certain Positions and/or Subcontractors

Certain items of work are considered particularly critical to successful completion of the project and may be completed by subcontractors. The Government will consider the qualifications of these subcontractors during its evaluation of the offeror’s proposal. In accordance with the Limitations on Substitutions for Certain Positions and/or Subcontractors paragraph in Section 00800 of the solicitation, if the offeror is awarded a contract the offeror will not be permitted to make substitutions without the approval of the Contracting Officer or Administrative Contracting Officer. If the offeror does not name a subcontractor for any identified item of work, it must state that it intends to perform the work with its own forces and, if the offeror receives the contract, no substitutions will be allowed without prior approval by the Contracting Officer.

See “Factor 1 - Technical Merit” for specific submission requirements regarding subcontractors.

Joint Venture Agreements

Proposals from joint ventures must include a copy of the joint venture agreement, signed by authorized representatives of both all parties. If the joint venture involves an 8(a) small business, prior approval by the Small Business Administration is required and must be submitted with the proposal. Offerors are reminded that if it is an 8(a) or HUBZone joint venture, it shall ensure that it complies with the applicable requirements of 13 CFR Part 124 and 13 CFR Part 126, respectively. The joint venture must be registered in the System for Award Management website (SAM.gov) as a joint venture in order for award to be made.

B. FACTORS TO BE EVALUATED

Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors described below.

Factor 1 – Technical Merit

Factor 2 – Past Performance

Factor 3 – Small Business Participation

Factor 4 – Price

C. FACTOR SUBMISSION REQUIREMENTS AND EVALUATION METHODS

Evaluation Approach

All timely submitted proposals shall be subject to evaluation by a team of Government evaluators. Proposals will be evaluated on the basis of the factors stated in the solicitation to select the responsible offeror whose proposal is most advantageous to the Government. Offerors are required to submit proposals with the content specified herein. Proposals without the specified content may be determined Unacceptable and removed from the competition. The Government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of the offeror. All responsible offerors whose proposals are among the most highly rated may be included in the competitive range in accordance with FAR 15.306(c)(1) and (2). The SSA may limit the number of proposals in the competitive range for purposes of efficiency in accordance with FAR 15.306(c)(2). By submitting an offer in response to this solicitation, offerors are agreeing to comply with all terms and conditions contained in the solicitation. Unless the solicitation specifically invites the offeror to submit exceptions, the SSA may reject any offer that contains exceptions. Except for any portions of the offeror’s proposal incorporated into the resulting contract by specific reference, the terms and conditions included in the solicitation, including any amendments, shall take precedence over the offeror’s proposal. In this solicitation, the words “offer” and “proposal” are used interchangeably. (See definition of “offer” at FAR 2.101.)

Proposal Evaluation

The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror's initial proposal should contain the offeror's best terms from a price and technical standpoint. The Government may conduct discussions if the SSA later determines them to be necessary. Further, if the SSA determines that discussions are necessary and if the SSA determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the SSA may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

Source Selection Decision

The SSA, independently exercising prudent business judgment, will make the source selection decision based on the proposal that represents the best value to the Government. The SSA will evaluate all proposals in accordance with the factors stated in the solicitation to select the responsible offeror whose proposal is most advantageous to the Government. The SSA will receive a comparative analysis and recommendation from a Source Selection Advisory Council (SSAC) as to which proposal represents the best value to the Government.

FACTOR 1 – TECHNICAL MERIT

Factor 1, Technical Merit includes the following: Construction Sequence and Turnover Plan, and Construction Schedule

In responding to this factor, the objective should be to instill confidence that the offeror thoroughly understands the requirements of the solicitation and has the expertise and experience required to successfully satisfy or exceed the solicitation requirements within the required period of performance (See Section 00700, FAR Clause 52.211-10).

In accordance with the Limitations on Substitutions or Certain Items of Work, Positions and/or Subcontractors paragraph in Section 00800 of this solicitation, a letter of commitment must be provided as established under “Construction Sequence and Turnover Plan” for any proposed major subcontractor for the following: cutoff wall construction, surface and subsurface water management, placement of Controlled Low Strength Material (CLSM), and blasting. If any of that work is intended to be self-performed, it should be stated in the proposal.

A major subcontractor is defined as any subcontractor whose experience is submitted as part of this proposal and is also identified in the non-substitution clause in Section 00800 of the solicitation.

A letter of commitment is defined as a letter from a major subcontractor on official company letterhead addressed to the offeror as prime contractor, identifying the work the subcontractor intends to perform, and stating that the subcontractor is willing to be bound to perform the identified work if the offeror is awarded a contract. A letter of commitment simply stating that a major subcontractor commits to submit pricing to the offeror does not satisfy this requirement.

Failure to provide a letter of commitment from any proposed major subcontractor(s) will be noted as a deficiency. Submission of multiple letters of commitment from proposed major subcontractor for the same portion/items of work or position may be noted as a weakness.

Submission Requirements

Failure to submit any of the minimum requirements for the Construction Schedule will be noted as a deficiency.

Failure to provide clear and comprehensive detail to any of the minimum requirements for the Construction Schedule may be noted as a significant weakness or weakness.

Evaluation Method

The Government will evaluate the Construction Sequence and Turnover Plan, and the Construction Schedule to determine the degree to which the offeror’s proposal meets the requirements of the solicitation as well as the feasibility of the proposed approach. The feasibility of the proposed Construction Sequence and Turnover Plan and Construction Schedule will measure how well the means and methods proposed provide the Government with confidence of the offerors understanding of the project and potential for successful project completion in accordance with the solicitation requirements and within the required contract schedule. The Construction Schedule must be corroborated by the Construction Sequence and Turnover Plan.

The Construction Sequence and Turnover Plan evaluation determines the level of understanding of how the offeror intends to approach, sequence, and execute the work from start to completion. Narratives that demonstrate a clear understanding and provide a thorough approach for successfully managing the solicited project that gives the government a higher level of confidence may be rated more favorably by the Government.

The Construction Schedule evaluation determines the degree to which the offeror’s proposal meets the requirements of the solicitation as well as the feasibility of the proposed approach. The offeror’s schedule narrative should be expressed in calendar days, not dates.

The evaluation will include whether the offeror has demonstrated a reasonable understanding of the Construction Schedule. A Construction Schedule shorter than the contract duration of 2044 calendar days indicates the offeror is placing additional risk on the Government for any delays between the scheduled completion date and the required contract completion period. The Government will consider a condensed contract duration, which places additional cost or schedule risk on the Government, or which may create a risk of contract or performance failure as “unacceptable”.

The overall rating for Factor 1 will consider how well the Construction Sequence and Turnover Plan, and the Construction Schedule support one another. Submission of no more than the minimum requirements for the Construction Sequence and Turnover Plan, and the Construction Schedule may receive no higher than an Acceptable rating for Factor 1. Any conflict between the Construction Sequence and Turnover Plan and Construction Schedule may be noted as a significant weakness or weakness.

After listing proposal strengths, weaknesses, significant weaknesses, and deficiencies, the Government will assign an adjective rating of “Outstanding”, “Good”, “Acceptable”, “Marginal”, or “Unacceptable” for this factor to reflect the Government’s confidence in each offeror's technical ability, as demonstrated in its proposal, to perform the requirements stated in the solicitation. An adjectival rating shall be assigned, using the Technical Evaluation Ratings, which incorporate a proposal risk assessment.

TECHNICAL EVALUATION RATING SYSTEM

General: Each member of the Source Selection Evaluation Board (SSEB) will individually rate each proposal against the specified evaluation criteria in the Solicitation. The SSEB will reach consensus on the final rating assigned to ensure that it reflects the degree to which the proposal meets or does not meet the minimum requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal and provide findings in writing to the SSAC, which will conduct a comparative analysis and provide a recommendation to the SSA. The SSA will evaluate all proposals in accordance with the factors stated in the solicitation to select the responsible offeror whose proposal is most advantageous to the Government.

Rating System: After listing proposal strengths, weaknesses and deficiencies, the SSEB will assign an adjective rating of “Outstanding”, “Good”, “Acceptable”, “Marginal”, or “Unacceptable” to each factor to reflect the Government's confidence in each offeror's technical ability, as demonstrated in its proposal, to perform the requirements stated in the solicitation. The adjectival ratings shall be assigned, using the following criteria, which incorporate a proposal risk assessment:

TECHNICAL MERIT RATINGS

DEFINITIONS

Deficiency - A material failure of a proposal to meet a government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Weakness - A flaw in the proposal that increases the risk of unsuccessful contract performance.

Significant Weakness - A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.

Strength - Any an aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Deviation - Proposal implies or specifically offers a deviation below the specified criteria. The offeror may or may not have called the deviation to the Government’s attention. A deviation is a deficiency. The proposal must conform to the solicitation requirements for award.

Combined Technical/Risk Rating - The offeror’s technical solution will consist of a combined rating. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining technical ratings. (See Combined Technical/Risk Rating Method below).

Combined Technical/Risk Rating Method

Color Rating

Adjectival Rating

Description

Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk ofunsuccessful performance is no worse than moderate.

Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.

FACTOR 2 – PAST PERFORMANCE

a. Using the Company Specialized Experience Form (Attachment 1), offerors are required to provide a minimum of three, not to exceed five examples of completed projects, which demonstrate that they and/or their major subcontractors (if applicable) have experience accomplishing the following:

1. Experience successfully constructing a cementitious cutoff wall with a width not less than 18-inches and total depth not less than 40 feet below ground surface within the last 10 years from the date of solicitation.

2. Experience successfully managing surface and subsurface water within the last 10 years, from the date of solicitation, within a construction site in a sub-tropical climate, where the subsurface is highly permeable, and groundwater level is at or near ground surface.

3. Experience successfully removing overburden a minimum of five feet in depth and managing excavated material to avoid excessive handling within the last 10 years from the date of solicitation.

Additional consideration may be given for projects that contain the following relevant specialized experience:

1. Magnitude greater than $25,000,000.00.

2. Prime Contractor self-performed 65 percent or more of the project work.

3. Prime Contractor partnered with the same major subcontractor(s) proposed for this project.

4. Similar scope completed within the past 24 months from the date of this solicitation. A detailed explanation of comparisons of scope must be provided.

5. Experience with DoD and/or Federal construction projects.

6. Familiarity and/or demonstrated experience with the local codes, regulations, and market conditions within

Central and Southern Florida.

7. Familiarity and/or demonstrated experience obtaining National Pollutant Discharge Elimination System

(NPDES) Stormwater Construction Generic and/or General permits from the Florida Department of Environmental Protection (FDEP).

8. Familiarity and/or demonstrated experience obtaining dewatering/consumptive use permit(s) from the South Florida Water Management District (SFWMD) restoration permitting department.

9. Demonstrated experience building on-site batch plant(s) for mixing, transporting, and placing cementitious material.

10. Demonstrated experience using multiple tools, equipment, and techniques to prepare an embankment dam rock foundation.

11. Demonstrated experience performing dental treatment of a foundation by filling holes, seams, cracks, joints, crevices, depressions, solution cavities, and surficial defects with cementitious fill material.

12. Demonstrated experience drilling, blasting, excavating, and processing material for use as construction material.

13. Demonstrated experience constructing a cementitious cutoff wall in a rock formation to a minimum depth not less than 40 feet below ground surface.

Include the percentage of work self-performed, list trades self-performed and dollar value associated to the work self-performed in Attachment 1 under item 8. Include the extent and type of work subcontracted in Attachment 1 under item 10; identify major subcontractors, trades performed, percentage that the subcontracted work represented for the contract, and dollar value associated to the subcontracted work.

All the experiences required to be demonstrated for this factor need not have been performed on the same project, however the combination of all submitted projects must demonstrate that the offeror and/or their major subcontractors (if applicable) have experience accomplishing the minimum requirements of this factor.

Do not submit more than five projects in response to this factor. If any offeror provides more than five projects, only the first five projects submitted in order of submission will be evaluated. No additional consideration or evaluation will be given for the remaining submissions.

Projects submitted must be completed within the last 10 years or 50% physically completed within the last three years from the date of this solicitation.

A completed project is defined as work performed under a project that is physically complete and has been accepted by the customer. If a project is submitted that is at least 50% physically completed within the last three years from the date of this solicitation, the offeror must explain which elements of the work are completed and provide supporting documentation from the client to confirm physical completion of those completed elements.

If the offeror proposes to use the experience of a subcontractor, the proposal must clearly demonstrate that the subcontractor will have meaningful involvement in the performance of the contract.

If submitting a proposal as a joint venture, the experience of each joint venture partners can be submitted for the joint venture entity. Offerors submitting an offer as a joint venture must provide a signed copy of the joint venture agreement with the initial proposal. If the joint venture involves an 8(a) small business, approval by the Small Business

Administration is required and must be submitted with the offeror’s proposal. Offerors that are an 8(a) or HUBZone joint venture shall comply with applicable requirements of 13 CFR Part 124 and 13 CFR Part 126, respectively. All joint ventures must be registered in the System for Award Management website (SAM.gov) as a joint venture at time of proposal submission.

b. Offerors must submit one NAVFAC/USACE Past Performance Questionnaire for each project submitted. If the offeror is unable to obtain a completed NAVFAC/USACE Past Performance Questionnaire from the point of contact before the proposal due date, the offeror shall complete and submit with the proposal the first page of the questionnaire (Blocks 1

– 7) that contains contract and client information for the submitted project. It is the offeror’s responsibility to ensure that the client’s point of contact information is current and correct. The client point of contact reflected in Blocks 1 – 7 should also be familiar with the past performance they are being asked to verify and informed that they will be contacted by the Government to verify past performance.

The Government may obtain copies of all CPARS records contained in the CPARS database for the offeror or offeror’s major subcontractors, and where necessary may use those records in the evaluation and determination of confidence.

The past performance evaluation is an assessment of the offeror’s probability of meeting the solicitation requirements.

The assessment considers each offeror's demonstrated recent and relevant past performances in supplying services that meet the solicitation requirements. There are two aspects to the past performance evaluation.

The first aspect of the past performance evaluates how relevant the offeror’s past performance is to the effort to be acquired. Using the information contained in the Company Specialized Experience Form (Attachment 1), the technical evaluation team will review the projects submitted in response to Factor 2 – Past Performance for relevancy. Relevancy will be determined based on the timeframe for project completion given under this factor and the level of similarity between the offeror provided demonstrated experiences and the solicitation requirements. Projects that involve essentially the same scope, magnitude of effort and complexities as this solicitation requires will most likely be given a relevancy rating of Very Relevant (see Relevance Rating Definitions below).

The second aspect of the past performance evaluation is to determine how well the contractor performed the experience submitted. This will be determined by utilizing the completed NAVFAC/USACE Past Performance Questionnaires, CPARS record or official performance evaluation from a non-Federal entity. The point of contact noted on each NAVFAC/USACE Past Performance Questionnaire will be contacted to verify the past performance ratings provided.

If the point of contact cannot be contacted, the past performance rating will be noted as “Unknown”. It is the offeror’s responsibility to ensure that the point of contact’s contact information is current (i.e., names, addresses, telephone numbers and email addresses). The point of contact should be familiar with the performance they are to verify and be aware that they will be contacted by the Government.

Once the Relevancy Ratings are assigned, and Past Performance Ratings are verified, the Government will conclude with a performance confidence assessment based on the results. This performance confidence is the level of risk associated with the offeror as it relates to the probability that the offeror will successfully complete this project (see Performance Confidence Assessments Definitions below).

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.

FACTOR 3 – SMALL BUSINESS PARTICIPATION

This Factor consists of a Proposed Small Business Participation Plan and Past Utilization of Small Business Concerns.

Proposed Small Business Participation Plan

All offerors, both other than small business and small business shall complete a Proposed Small Business Participation Plan (SBPP) using the template found at Attachment 4. Offerors shall identify the extent to which Small Businesses (SBs), Veteran-Owned Small Businesses (VOSBs), Service-Disabled Veteran-Owned Small Businesses (SDVOSBs), HUBZone Small Businesses, Small Disadvantaged Businesses (SDBs), and Woman-Owned Small Businesses (WOSBs) will be utilized in the performance of this contract. Small business offerors shall identify their own participation as a SB, VOSB, SDVOSB, HUBZONE SB, SDB, and WOSB, and it will be considered in evaluating the proposed extent of participation of small business. Any socio-economic group without a goal where no explanation is given shall receive a rating of Unacceptable for Factor 3 – Small Business Participation.

Small Business Participation Goals

• For SB, the goal should not be less than 25%.

• For SDB, the goal should not be less than 10%.

• For WOSB, the goal should not be less than 8%.

• For SDVOSB, the goal should not be less than 4%.

• For HUBZone, the goal should not be less than 5%.

Offerors must propose goals for Small Business Participation. Small business participation goals are to be an estimated percentage of total contract dollars (total proposed amount including options). Offerors must provide an overall goal to be accomplished through collective small business participation from any type of small business, to include all small business programs, and propose individual goals for each small business program. The work to be performed directly by a small business offeror will be included in the offeror’s Small Business Participation goal. Small Business Participation Goals have been assigned. Therefore, offerors shall propose their best effort for small business participation and provide documentation to demonstrate and support their proposed small business participation goals based on the minimum assigned goal demonstrated in the Small Business Participation Goals. A goal is defined as a number equal to or greater than the assigned goals to the maximum practicable extent.

The awardee’s Small Business Participation goals will be incorporated into the contract. Offerors are to demonstrate their level of commitment to utilizing small businesses by identifying the extent to which small businesses as defined by the NAICS Code 237990 are to be…
