1.2 WORK COVERED BY CONTRACT DOCUMENTS

1.2.1 Project Description

The work includes clearing, grubbing, de-mucking, foundation preparation, installation of a seepage cutoff wall, canal backfilling, blasting, and all incidental related work to prepare approximately 15.3 miles of foundation for a 17.3-mile-long embankment dam, to be constructed under separate contract within the Everglades Agricultural Area (EAA). The approximate toe to toe width of the dam foundation is 260 feet in the north, east, and west; and 235 feet in the south. Surface and subsurface water management are required to conduct work in the dry, in a neat and orderly manner, in accordance with contract specifications.

1.2.2 Location

The project is located in western Palm Beach County, Florida, south of Lake Okeechobee. Access to the site will be from U.S. Highway 27 approximately 13 miles south of the city of South Bay, Florida.

1.2.3 Safety Requirements

See Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS and EM 385-1-1 .

1.2.4 Work Performed by Others

See paragraph PROJECT COORDINATION of Section 01 30 00 ADMINISTRATIVE

PROCEDURES.

1.2.5 Order of work and Restrictions

There will be multiple Notice to Proceed (NTP) issued for this project.

The first NTP will allow the Contractor to establish the Contracting Officer's Field Office, Temporary Quality Assurance Lab, as well as the Contractor's own field office within the area designated "Primary Construction Field Office Location" as shown on the contract drawings. No work outside the "Primary Construction Field Office Location" will be permitted with issuance of the first NTP. The first NTP will be issued as

SECTION 01 11 00 Page 2 stated in Clause 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK of Section 00700 CONTRACT CLAUSES in Volume 1. The second NTP will be issued no less than ninety (90) calendar days following contract award as stated in Clause 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK of Section 00700 CONTRACT CLAUSES in Volume 1. The second NTP will permit work within the full limits of construction as shown on the contract drawings. Any further restriction to the location of work is described in subsequent paragraphs of this section.

Farming activities are on-going outside the Limits of Construction for this project that are coordinated by the Florida Crystals Corporation.

Contractor's options for discharging surface and subsurface water are (1) within the Limits of Construction and (2) Off-site. If the Contractor elects to discharge water outside the Limits of Construction ("off-site") at any time during execution of the project, refer to Section 01 57 20 ENVIRONMENTAL PROTECTION for required permits and authorizations.

This contract is comprised of a base and options. The base contract will be for construction activities between stations 308+00 and 868+50 less any stations noted as "no work" within these limits. Option 1 will be for construction activities between stations 868+50 and 58+55 less any stations noted as "no work" within these limits. Option 2 will be for construction activities between stations 58+55 and 188+60 less any stations noted as "no work" within these limits. Option 3 will be for construction activities between stations 188+60 and 308+00 less any stations noted as "no work" within these limits.

The following project features must be performed in the following sequence: (1) Clearing and Grubbing, (2) Preliminary Foundation Preparation, (3) Rock Foundation Inspection and Geologic Mapping, (4) Final Foundation Preparation, (5) Controlled Low Strength Material (CLSM),

(6) CLSM Top Cover, and (7) Cutoff Wall (including Verification Drilling/Testing).

Demonstration sections are required for Preliminary Foundation Preparation, Controlled Low Strength Material (CLSM), CLSM Top Cover, and Cutoff Wall. The demonstration sections are 500 linear feet in length and are to be constructed between stations 445+00 to 450+00 and 460+00 to 465+00, as shown on the plans. The demonstration section between stations 460+00 to 465+00 applies to performing production work along the south side of the D-623 embankment alignment (between stations 457+00 and 712+00). Production work outside the demonstration section limits for these project features cannot begin until it is proven that the means and methods satisfy the requirements of the specifications. Cutoff wall demonstration is required to commence within 180 calendar days of completing the demonstration of CLSM Top Cover or following completion of 10,000 feet of CLSM Top Cover, whichever occurs first. Following successful completion and Government approval of Cutoff Wall demonstration, production in accordance with the approved Cutoff Wall Construction Plan must commence in no more than 14 calendar days. No implication is made by these time frames or distances that cutoff wall operations will not outpace CLSM Top Cover operations: the Contractor is fully responsible for controlling the pace of production work. This must be clearly detailed in the Construction Sequence and Turnover Plan.

Following completion of the cutoff wall demonstration section(s) and progression of production work that includes the completion of all features of work as outlined above and throughout the plans and technical specifications, the Government intends to request sections of completed

SECTION 01 11 00 Page 3 work be submitted for acceptance by the Government in not less than 500 linear foot sections. As Acceptance Sections are complete, the Contractor must immediately submit the documentation required of Section 01 45 08 DATA MANAGEMENT AND DATA REQUIREMENTS and Section 01 78 02 CLOSEOUT SUBMITTALS. Following approval, the completed Acceptance Sections will be removed from the Contractor's limits of construction as the Government will be turning these sections over to a future construction contract for embankment construction.

Multiple construction contracts managed by both the U.S. Army Corps of Engineers (USACE) and the South Florida Water Management District (SFWMD) are ongoing both west and north of the construction limits. To minimize conflict with those contractors, construction of project features is restricted to the south and east sides of the D-623 embankment alignment (between stations 308+00 and 712+00) for 365 calendar days following the first NTP. The Contracting Officer or their duly appointed representative may remove restrictions to work location within the limits of construction at any time during the execution of this project.

As noted on contract drawings, no work is to be performed between stations

(1) 322+00 and 338+00, (2) 378+25 and 380+75 (3) 517+00 and 533+00, (4) 815+00 and 831+00, (5) 38+00 and 43+00, (6) 81+75 and 112+00, (7) 222+00 and 238+00, and (8) 250+00 and 254+00. In areas where no work is to be performed, the road and drainage networks are to be shared between the USACE, the SFWMD, Florida Crystals Corporation., and their representatives for the duration of this construction contract. The Contractor may not close or otherwise impede traffic along the existing road network nor obstruct or otherwise divert the drainage network(s) that are within the construction limits designated as no work areas. The Contractor will be responsible for maintaining any road or drainage network within the limits of construction for the duration of this contract, to include the roads and drainage networks within the "no work" areas.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES.

1.7 LAYOUT OF WORK

Read this paragraph in conjunction with the Clause LAYOUT OF WORK (FAR 52.236-17) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.7.1 Established Project Control

The Government has established monuments along the work site(s). Each monument is represented in the contract drawings by a Designation and in most cases, an alphanumeric Permanent Identifier (PID). Information concerning the location and elevations can be found within the Survey Notes on the plan sheets. The Survey Notes for each included field survey will cite a particular survey number, and specify the control used to conduct that survey.

See Section 00 31 21 CONTROL MONUMENT DESCRIPTIONS.

1.7.2 Layout

From the monuments, control data and elevations established by the Government, complete the layout of the work and obtain all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a result of necessary modifications to the contract work.

1.7.3 Survey

Provide equipment, tools, material, labor for laying out any part of the work from the monuments, control data, and elevations established by the Government. Maintain and preserve all monuments, stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks or monuments are destroyed by the Contractor or through negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at their discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor.

The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.

1.8 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work will be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable Contract unit or job prices as fixed and established in the Contract. If, in the opinion of the Contracting Officer, there are no contract unit or job prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the

SECTION 01 11 00 Page 6 permanent work for which there are no applicable contract unit or job prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

1.9 EXISTING WORK

In addition to FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work must be in a condition equal to or better than that which existed before new work started.

1.10 LOCATION OF UNDERGROUND FACILITIES

All underground utilities within the work limits must be positively identified by a private utility locating service. Any utilities found which are not shown on the construction drawings must be brought to the Contracting Officer's attention prior to proceeding with construction.

1.10.1 Notification Prior to Excavation

Notify the Contracting Officer at least 15 days prior to starting excavation work. Contact "CALL SUNSHINE BEFORE YOU DIG" at 1-800-432-4770 at least 5 days prior to starting excavation work. Contractor is responsible for marking all utilities not marked by "CALL SUNSHINE".

1.11 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.11.1 Schedule of Monthly Anticipated Adverse Weather Delays

The schedule of monthly anticipated adverse weather delays is based upon National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

See Section 00 33 50 WEATHER AND WATER STAGE DATA to obtain MONTHLY

SECTION 01 11 00 Page 7

ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON 5 DAY WORK WEEK.

1.11.2 Contractor Responsibility

Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the Contract, record on the daily CQC report the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. Include the number of actual adverse weather delay days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in Section 00 33 50 WEATHER AND WATER STAGE DATA (rounded to the nearest whole number), the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Clause DEFAULT (FIXED PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.12 UNITS OF MEASURE

The standard U.S. system of measure shall be utilized by the Contractor in the performance of work. Any omission or inaccurate use of a unit of measure will not relieve the Contractor of their responsibilities under the Contract terms. The unit of measure used in this specification is the standard U.S. system. The contract drawings denote standard U.S. system.

If no unit of measure is indicated on the drawing such as on ranges, stations, slope elevations, and distance numbers, then they are to be considered the standard U.S. system.

1.13 SOUTH FLORIDA WATER MANAGEMENT DISTRICT

The Non-Federal sponsor, the South Florida Water Management District, owns the land and will take physical possession of the project once completed for operation and maintenance as part of the Government's project agreement obligation.
