Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

https:l/beta.sam.gov/wage-determination/FL20200125/1 ?keywords=fl20200125&sort=-relevance&index=wd&is_active=true&page= 1 4/7 W912EP20R0021 13 Amendment 0001

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage https:l/beta.sam.gov/wage-determination/FL20200125/1 ?keywords=fl20200125&sort=-relevance&index=wd&is_active=true&page= 1 5/7 W912EP20R0021 14 Amendment 0001 determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

PROJECT DESCRIPTION:

The Central Everglades Planning Project (CEPP) South, a “project component,” as defined in Section 373.1501(1), F.S., is a Comprehensive Everglades Restoration Plan (CERP) Project. The Water Resources Development Act of 2000 approved CERP under Section 601 as a framework for modifications to the Central and Southern Florida Project necessary to restore the South Florida ecosystem. The overall CEPP includes a suite of storage treatment, conveyance, and seepage management measures that will provide the necessary components to deliver additional fresh water from Lake Okeechobee south to Water Conservation Area 3A (WCA 3A), WCA 3B, Everglades National Park (ENP), and Florida Bay. CEPP will restore quantity, quality, timing, and distribution of water flow to the Greater Everglades. The Final Integrated Project Implementation Report (PIR) for CEPP was published in the Federal Register in July 2014, the Chief of Engineers Report was signed in December 2014, and the Record of Decision was signed in August 2015.

The South Florida Water Management District (District) Governing Board Resolution was approved on April 10, 2014, and the Department’s Final Order was executed on April 10, 2014, outlining the District’s agreement to participate as the local sponsor of the CEPP. CEPP received Congressional authorization in December of 2016 and the Post Authorization Change Control Report (PACR) was Congressionally Authorized in October of 2018. This

W912EP20R0021 25 Amendment 0001

Permittee: U.S. Army Corps of Engineers Project: Central Everglades Planning Project South Phase: S-631, S-632, S-633, and L-67C Interim Gap File No.: 0387130-001 https://floridadep.gov/ project was recommended in the U. S. Army Corps of Engineers’ December 2014 CEPP Final Integrated PIR and Environmental Impact Statement.

The goals and objectives of the CEPP South Project are to expand on the efforts initiated with the pre-CERP Combined Operations Plan (COP) to reverse over 100 years of human induced environmental degradation within the central portion of the Everglades ecosystem. Restored water depth, duration, and distribution in WCA 3A, WCA 3B, and ENP will serve to recreate a landscape characteristic of a pre-drained system to support a healthy mosaic of plant and animal life. The restored hydrology of the Everglades ecosystem will more closely resemble a natural occurring rainfall driven system with wet and dry cycles essential to flora and fauna propagation. Improved water depth and spatial sheet-flow distribution will begin to re-establish the unique ridge, slough, and tree island micro-topography that once provided sustenance to the vast diversity of the species inhabiting the Everglades.

This permit authorizes the U.S. Army Corps of Engineers (USACE) first construction contract for the CEPP South Project, S-631, S-632, S-633 and L67C Interim Gap Project, which includes the construction of three gated, 500-cfs spillways in the L-67A levee; removal of approximately 3,000 feet of existing spoil piles northwest of the L-67A canal where the S-631 and S-632 structures will be built; degrading 3,000 feet of the L-67C levee to the southeast of the S- 633; and backfilling the East-West Agricultural Ditch with suitable excavated material generated by the project (Figure 1). The permit also authorizes backfilling of up to 0.5 miles of the L-67 Extension Canal, and the use of temporary pumps and active vegetation management to enhance flows in historic sloughs in WCA 3B.

The Corps is the federal sponsor of this project component and is responsible for its repair, replacement, and rehabilitation. All conditions found herein apply to the Corps.

PROJECT LOCATION:

This proposed work for CEPP South is within WCA 3A and WCA 3B, on or near L-67C levees, south of Tamiami Trail (US 41) and northeast of Tamiami Trail (US 41) in Miami-Dade County, Florida. The project is located in Sections 3, 4, 5, 6, and 30, Township 54 South, Range 37 East; Section 6, Township 55 South, Range 37 East; Sections 17, 20, 29, 30, 31, and 32, Township 53 South, Range 37 East; and Section 25, Township 52 South, Range 37 East.

PROJECT COMPONENTS:

This proposed work for CEPP South, as shown in Figure 2, consist of the following components:

Gated Culverts: Three gated, 500 cfs structures, to be named S-631, S-632, and S-633 from north to south will be constructed on the L-67A levee. The current design calls for the installation of two 10’ by 6’ concrete box culverts with automatic operable gates at each structure. The structures will only be able to carry the design flow of 500 cfs if a hydraulic head of 0.45 feet can be maintained at the structures. Based upon observations of flows and head-differentials at the adjacent S-152 structure, only about 0.2 feet of hydraulic head can be maintained during the wet season. The Corps is proposing to adaptively manage the vegetation downstream to address the limited conveyance of the structures, to improve conveyance and flows into the sloughs.

Remove 3,000 feet of existing spoil piles: The permittee will remove approximately 3,000 feet of existing spoil piles northwest of L-67A canal where the S-631 and S-632 structures will be built.

Degrade 3,000 feet of L-67C Levee: The permittee will degrade approximately 3,000 feet of the L-67C levee to the southeast of the S-633 gated culvert.

Backfill of East-West Agricultural Ditch: Suitable excavated material generated by the project will be used to backfill the East-West Agricultural Ditch. The L-67C will be temporarily filled but the canal will be returned to pre-project state after completion of the ditch backfill.

W912EP20R0021 26 Amendment 0001

Phase: S-631, S-632, S-633, and L-67C Interim Gap File No.: 0387130-001 https://floridadep.gov/

Backfill portions of the L-67 Extension Canal: Backfill up to 0.5 miles at the southernmost terminus of the L-67 Extension Canal (adjacent to the levee terminus) to natural grade using fill material taken from CEPP Projects (e.g., CEPP South Contract 1 and/or Old Tamiami Trail (OTT) Road Removal projects, etc) that is unsuitable for construction use, except for disposal/backfill. Fill material shall be suitable for backfill and will not include HTRW, asphalt, trash, or vegetation. With regard to OTT backfill material, no OTT fill will be used for CEPP South Contract 1, and only material that is unsuitable for construction use (i.e., muck or poor mixtures) will be used to fill the L-67 Extension Canal, as discussed in the SFWMD to MTIF letter dated June 3, 2020.

L-29 Canal Temporary Pumps and Active Vegetation Management: Design refinements are proposed to enhance flows in historic sloughs in WCA 3B once the S-631, S-632, & S-633 Structures and L-67C Gap Interim Phase features have been constructed. This includes active vegetation management in the Blue Shanty Flowway to enhance flow by reconnecting historic sloughs and installation of temporary pumps to allow the sloughs to flow south. The temporary pumps would be installed between L-67A and the CEPP South L-67D, within the alignment of the planned CEPP Blue Shanty flowway. Since the location is west of S-355A, additional pump collection sumps may need to be installed immediately adjacent and north of the L-29 Levee at the one or two selected optimal temporary pump locations. When the pumps are removed in advance of the L-29 levee segment removal, the sump excavations will be returned to the pre-installation condition. Based on the use of temporary pumps during the 2016 and 2018 deviations, it is expected that no more than two sumps (100 cfs each) at approximately 25-50 feet length (north-south dimension) by 12-25 feet width (east-west dimension) is expected.
