SECTION 00 33 50 WEATHER, WATER STAGE AND TIDE DATA
1. The below-stated water fluctuations are for informational purposes only and are not to be utilized in conjunction with any contract-related hydrographic surveying purposes as noted on the control drawing(s) of the contract plans. All elevations in this section are in feet, National Geodetic Vertical Datum of 1929 (feet, NGVD).
2. The Central Everglades Planning Project (CEPP) South Contract 1, Levee 67A (L-67A) is located in western Miami-Dade County, between Water Conservation Area 3A and 3B (WCA-3A and WCA-3B), west of Canal 111 (C-111), north of the Tamiami Trail (US-41) as indicated in the Plans and Specifications.
3. Water stages in the project area are mainly affected by rainfall, runoff, evapotranspiration, groundwater and the water management operation of the Central and Southern Florida (C&SF) Project structures. The structures in the project area, which are listed below, are operated by the U.S. Army Corps of Engineers (USACE) and South Florida Water Management District (SFWMD).
4. Structures 11A, 11B and 11C (S-11A, S-11B and S-11C, respectively) are reinforced concrete, gated spillways with the releases of each controlled by four vertical lift gates. The structures are located in Levee 38-W between WCA 2A and WCA 3A, upstream of the project area, about 20 miles west of Fort Lauderdale. The purpose of these three structures is to make releases via gravity from WCA-2A to WCA 3A. The structures operate according to the WCA-2A regulation schedule that varies seasonally from 11.0 to 13.0 feet, NGVD and may be found at the following link:
http://w3.saj.usace.army.mil/h2o/plots/wca2ahp.pdf.
5. Structure 151 (S-151) is a six-barreled corrugated metal pipe culvert located at the point where L-67A crosses the Miami Canal. This culvert has a design discharge of 1,105 cfs and is controlled by remotely operated sluice gates. S-151 is located within L-67A, approximately 20 miles west of Miami.
The purpose of S-151 is to release water from WCA-3A to South Miami-Dade County and along the Miami Canal to meet water supply needs and to release water into WCA-3B. S-151 also provides capacity for water releases through Structure 31 (S-31) to the east coast. S-151 is currently out of service, but is projected to return to service in Summer 2020. The new structure is a four eight by eight foot cast-in-place concrete box culvert and releases are controlled with single leaf slide gates.
6. Structure 340 (S-340) is a sheet pile barrier dam located across the Miami Canal (C-123) approximately 2.7 miles south of Alligator Alley (SR 84) with a design discharge of 1,100 cfs controlled by three manually-operated sluice gates. S-340 is located on C-123 upstream of the project area. The purpose of the structure is to prevent overdrainage of the northern portion of WCA-3A by forcing flows from C-123 out into the marsh. S-340 also provides the ability to transfer water to Everglades National Park (ENP), the Metropolitan Miami, and the South Dade County areas. The structure is closed most of the time, but may be opened fully in accordance with the WCA- 3A - Site 62 "Deer Gage" operations schedule. This schedule is governed primarily by the stage at Gage 62 (Deer Gage) and may be found at the following link: http://w3.saj.usace.army.mil/h2o/plots/st62hp.pdf.
7. Structure 152 (S-152) is a ten barreled, 60-inch diameter, high density polypropylene culvert located in the L-67A canal approximately 12.3 miles http://w3.saj.usace.army.mil/h2o/plots/wca2ahp.pdf http://w3.saj.usace.army.mil/h2o/plots/st62hp.pdf southwest of S-151. S-152 flow is controlled by manually-operated vertical slide gates and has a design discharge of 750 cfs. The purpose of S-152 is to move water from WCA-3A into WCA-3B. S-152 is meant to be a temporary structure constructed as part of the Decomp Physical Model (DPM) field test.
8. Structure 9 (S-9) is a three unit pump station with a design capacity of 2,880 cfs. S-9 is at the west end of Canal 11 in the alignment of
Levee 37, approximately 0.5 miles west of U.S. Highway 27 and consists of reinforced concrete and concrete block masonry superstructure. The purpose of the structure is to pump surplus water into WCA-3A via the South New River Canal from the Davie agricultural area west of control Structure 13A (S-13A) and to pump seepage under Levees 33 and 37 back into WCA-3A. at the rate of 3/4 inch per day from the tributary drainage area plus approximately the same quantity of seepage.
9. Structure 9A (S-9A) is a four unit pumping station with a design capacity of 500 cfs and is located just north of and directly adjacent to the S-9 Pump Station in Broward County. The purpose of S-9A is to improve the quality and timing of stormwater releases from the Western C-11 basin by back pumping seepage lost from WCA-3A back into WCA-3A. The use of the S-9A reduces the operational dependency placed on the larger S-9.
10. Structure 333 (S-333) is a reinforced concrete, gated spillway with releases controlled by one cable operated, vertical lift gate. The structure is located on L-67 at the southeast corner of WCA-3A and south of the project area about 30 miles west of Miami. The purpose of this structure is to make water deliveries from WCA-3A to south and east Miami-Dade County to Shark River Slough and Taylor Slough areas of the ENP.
11. Structures 12A, 12B, 12C and 12D(S-12A, S-12B, S-12C and S-12D, respectively) are reinforced concrete, gated spillways with the releases of each controlled by six vertical lift gates. The structures are located in Levee 29 (U.S. Highway 41) on the south perimeter of WCA-3A, southwest of the project area, approximately 30 miles west of Miami. The purpose of these four structures is to make releases from WCA-3A to ENP. The structures operate according to the WCA-3A regulation schedule that varies seasonally from 8.75 to 10.5 feet, NGVD and the Rain-driven Plan for Water Deliveries to Everglades National Park. These operational criteria are expected to change when the Combined Operating Plan (COP) is approved (currently estimated for Fall 2020).
12. Historical S-151 headwater elevations for the period of record from August 10, 1962 to April 27, 2020, were obtained from the SFWMD’s DBHYDRO site, and are provided in Figure 1. A maximum elevation of 13.02 feet, NGVD was recorded on December 23, 1994. SFWMD’s DBHYDRO site may be found at:
https://my.sfwmd.gov/dbhydroplsql/show_dbkey_info.main_menu.
13. Historical Site 71 gage elevations for the period of record from July 19, 1991 to April 26, 2020, were obtained from the SFWMD’s DBHYDRO site, and are provided in Figure 2. A maximum elevation of 9.76 feet, NGVD was recorded on October 16, 1999. SFWMD’s DBHYDRO site may be found at:
https://my.sfwmd.gov/dbhydroplsql/show_dbkey_info.main_menu.
14. All stage data provided in this Section 00 33 50 are provisional and subject to revision. In general, historic water levels and releases are not https://my.sfwmd.gov/dbhydroplsql/show_dbkey_info.main_menu https://my.sfwmd.gov/dbhydroplsql/show_dbkey_info.main_menu necessarily indicative of future water levels and releases. It is possible that historic water levels and releases will be exceeded during the contract period.
15. The contractor should not expect that water levels/flows will be manipulated for contractor. The contractor should not expect “no flow” or dry conditions during the contract period. The contractor may be able to obtain hydrometeorological data from the Jacksonville District, Water Management Section’s website, which can be found at:
https://www.saj.usace.army.mil/Missions/Civil-Works/Water-Management/ and also the SFWMD’s website which can be found at: https://www.sfwmd.gov.
16. It shall be the contractor's responsibility to obtain information concerning rain and wind. Reference is made to the National Oceanic and Atmospheric Administration (NOAA) publication entitled Local Climatological Data – Monthly Summary, which contains climatological and meteorological observations and data, including wind, rain, and temperature data for the project area. Subscription price and ordering information is available from the National Centers for Environmental Information, Federal Plaza, 151 Patton Avenue, Asheville, North Carolina 28801-5001. NOAA also has an internet information page at: http://www.ncdc.noaa.gov/.
17. The climate in the project area is subtropical and humid. The project area is subject to tropical storms and hurricanes from June through November and to windy and/or rainy weather during any time of the year. Temperatures below freezing are rare. May is generally a transitional month in which storms that typically occur in June through September may begin. The typical rainfall of October through May is associated with mid-latitude systems (fronts and low-pressure systems) and is distributed in a spatially uniform pattern. Typical June through September rainfall is closely associated with convective activity. These rainfall events are normally of short duration and amounts are quite variable spatially. Occasionally, daily rainfall during the typical rainfalls of October through May could be quite heavy as mid-latitude systems penetrate into Florida. Weather forecasts as well as actual rainfall information from the National Weather Service Miami-South Florida Forecast Office can be accessed at:
http://www.weather.gov/mfl/. The contractor may also obtain hydrometeorological data from the Jacksonville District, Water Management Section’s website, which can be found at:
https://www.saj.usace.army.mil/Missions/Civil-Works/Water-Management/ and the South Florida Water Management District’s (SFWMD) website which can be found at: https://www.sfwmd.gov.
18. Temporary deviations from the water management operating criteria for the above listed structures can be conducted from time to time. It is possible that historic water levels, historic releases, and design discharges will be exceeded from time to time. Historical hydrometeorological data is not necessarily indicative of future conditions.
The contractor should not expect that water levels and/or flows will be manipulated for the contractor. The contractor shall not attempt to operate any of the existing structures mentioned in this Section 00 33 50.
19. The following data are provided:

The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.
1.7 DAMAGE TO WORK
The responsibility for damage to any part of the permanent work shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as herein provided, damage to all work (including temporary construction), SECTION 01 11 00 Page 5 utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.
1.8 DAMAGE TO WORK -- COFFERDAM REQUIRED
a. The responsibility for damage to any part of the work to be performed under this contract shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1.
However, if the cofferdam(s) is constructed in accordance with plans and progress schedules approved by the Contracting Officer, but is overtopped by flood and such flood causes damage to the cofferdam or if any part of the permanent work is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precaution or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs ordered by the Contracting Officer.
The Contractor shall be compensated for any such repairs in accordance with the Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume
1. The equitable adjustment shall be based on the contract unit or lump sum prices applicable to any part of the damaged work.
b. The Contractor may, subject to approval of the Contracting Officer, or the Contracting Officer may order the Contractor to, flood or breach the cofferdam during a rise prior to, and in anticipation of, natural flooding due to overtopping. Such flooding or breach will be considered the same as though the cofferdam, if constructed in accordance with plans and progress schedules approved by the Contracting Officer, had been overtopped, in which event an equitable adjustment will be made for damages to the cofferdam and/or any part of the permanent work, as provided in subparagraph a. above.
1.9 EXISTING WORK

At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.
1.10 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)
This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.
SECTION 01 11 00 Page 6
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
1.10.1 Schedule of Monthly Anticipated Adverse Weather Delays
The schedule of monthly anticipated adverse weather delays is based upon National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
See Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA to obtain MONTHLY
ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON 5-DAY WORK WEEK. A
reasonable number of anticipated weather delay work days is obtained from the average number of days per month with precipitation greater than that indicated in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA rounded to the nearest whole number.
1.10.2 Contractor Responsibility
Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA (rounded to the nearest whole number), the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Clause DEFAULT (FIXED PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1.
1.11 UNITS OF MEASURE
The standard U.S. system of measure may be utilized by the Contractor in the performance of his work. All survey records, official documentation, engineering data, and all correspondence, including any submittals and shop drawings, shall clearly denote which system of measure is being utilized, referenced or discussed. Any omission, unprofessional or inaccurate use of a unit of measure on the part of the Contractor shall not relieve him of his responsibilities under the contract terms. The unit of measure used in this specification is the standard U.S. system.
If no unit of measure is indicated on the drawing such as on ranges, stations, slope elevations, and distance numbers, then they are to be considered the standard U.S. system.
1.12 SOUTH FLORIDA WATER MANAGEMENT DISTRICT
It is understood and agreed by the parties hereto that the project works being performed under this contract are for the benefit of the South Florida Water Management District, which agency, as the representative of the State of Florida, is responsible for acquisition of lands upon which the construction is to take place. This responsibility is pursuant to authorizing legislation of the Congress of the United States of America.
SECTION 01 11 00 Page 7
It is clearly understood that the project works to be constructed herein, upon completion, will be turned over to that agency for operation and maintenance as part of the Government's project agreement obligation.
