About this file

This is Amendment 0002 to Solicitation W912DS26BA031 for the Cheesquake Creek East Jetty Rehabilitation project issued by the U.S. Army Corps of Engineers (USACE), W912DS Endist New York. The amendment was effective August 5, 2026, with a project number of 107425, and modifies the solicitation to respond to submitted requests for information. The bid opening remains scheduled for 2:00 PM EST on August 14, 2026, and the hour and date for receipt of offers is not extended.

The amendment clarifies specifications for earthwork and addresses 24 offeror questions regarding project execution. Key specification revisions require backfill material for toe excavation to be sourced from off-site borrow and classified as satisfactory per Section 02 41 00 Paragraph 2.1 testing standards. Major clarifications include: grout-filled jetty bags must be broken up and left in place; existing jetty stone cannot be reused; intact concrete seawall must not be damaged during construction with only broken debris removed; contractors must restore any parking lot damage; marine mattress payment includes actual installed length with overlap; and all permits and associated costs, including $115,000 annual beach access permits, are the contractor's responsibility. Environmental requirements mandate Horseshoe Crab and Osprey nest monitoring per Water Quality Certification conditions, with the contractor responsible for confirming documented history. The amendment clarifies that approximately 17,832 cubic yards referenced in the Water Quality Certification corresponds to CLIN 0006 Removal and Disposal of Excavated Material with no separate dredging contract. Additional requirements include project biologist coordination per Specification Section 01 57 19, vibration monitoring per Section 40 77 23, and dune vegetation restoration of approximately 0.5 acres per construction disturbance requirements. The government will not respond to further RFIs after this amendment.

OFFERORS'S QUESTIONS AND GOVERNMENT REPLY

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors for information only and do not revise the solicitation, plans, or specifications.)

Q1: The existing jetty is comprised of large grout-filled bags. Please confirm whether it is the intent of the Contract for the grout to be broken up and disposed of under CLIN 0006, Removal and Disposal of Excavated Material.

A1: Grout fill concrete bags are to be broken up and left in place per requirement in Specification Section 35 31 29.40 Paragraph 3.2.

Q2: Please confirm whether existing jetty stone located within the limits of excavation may be reused as core stone in the proposed jetty construction.

A2: Existing jetty stone located within the limits of excavation may not be reused as per requirement in Specification Section 35 31 29.40 Paragraph 3.3.

Q3: If existing jetty stone is not permitted to be reused, please confirm whether it is the intent of the Contract to require the Contractor to process or crush the material to meet the acceptance requirements of the receiving disposal facility under CLIN 0006, Removal and Disposal of Excavated Material.

A3: Existing jetty stones are not permitted to be reused. The contractor is responsible for the means and methods associated with disposal of jetty stones.

Q4: If the existing asphalt parking lot is utilized as a staging area, please confirm whether the Contractor will be required to restore or repave the parking lot upon completion of the work.

A4: The contractor is responsible to restore any area of the parking lot damaged during construction per Specification Section 01 11 00 Paragraph 1.6.

Q5: Has the USACE coordinated with the New Jersey Department of Transportation (NJDOT) regarding the use of the staging area shown in the contract documents? If so, please provide the appropriate NJDOT point of contact.

A5: The parking lot staging area and beach access route requires coordination with Old Bridge Township. Coordination with Old Bridge Township could be found in Specification Section 01 30 00 Paragraph 1.17. As noted in the contract drawings, the contractor is responsible for access permits with NJDOT.

Q6: The Federal Consistency Determination/Water Quality Certification letter states that work should be avoided between April 15 and June 30 if Horseshoe Crabs are utilizing the beach for spawning. Please confirm whether there is a documented history of Horseshoe Crab spawning within the project area.

A6: Conditions within the WQC are requirements of the contract. The Horseshoe Crab window is a requirement set by NJDEP within their Federal Consistency Determination/Water Quality Certification. It is the responsibility of the contractor to confirm with NJDEP or independent biologist if there are documented history of Horseshoe Crab spawning within the project area.

Q7: The Federal Consistency Determination/Water Quality Certification letter states that no work may occur within 300 meters of an active Osprey nest. Please confirm whether there is a documented history of active Osprey nests located within 300 meters of the project work limits.

A7: Conditions within the WQC are requirements of the contract. It is the responsibility of the contractor to confirm with NJDEP or independent biologist if there are documented history of active Osprey nests within 300 meters of the project work limits.

Q8: The Federal Consistency Determination/Water Quality Certification letter included in the contract documents references approximately 17,832 CY of dredging. However, this quantity does not appear to be included in the Contract scope. Please confirm whether this dredging will be performed under a separate contract.

A8: The volume in the WQC is an approximate volume and corresponds to CLIN 0006 Removal and Disposal of Excavated Material. No dredging will be performed under a separate contract.

Q9: Please confirm whether it is the intent of the Contract to issue the Notice to Proceed (NTP) at a time that will allow the Contractor to perform the Work during both the 2027 and 2028 construction seasons.

A9: The government would take into account the contractor's proposed schedule of work prior to issuance of Notice to Proceed to ensure the project is completed expeditiously and within the Period of Performance.

Q10: Please confirm whether the existing concrete seawall is required to be demolished in its entirety within the limits shown on the plans, or only those portions that conflict with the proposed jetty construction.

A10: Intact concrete seawall shall not be damaged during jetty rehabilitation construction. Only broken seawall debris within the limits called out on drawing C-101 shall be removed and disposed.

Q11: Please clarify the requirements for imported clean fill. Section 31 00 00, Earthwork, specifies only ASTM D2487 soil classifications in Section 2.1.4 and requires the material to be non-contaminated in Section 1.6. However, Section 02 41 00, Demolition, includes more comprehensive requirements for fill material in Section 2.1. Please confirm which specification governs the imported fill material for this project.

A11: Section 02 41 00 Paragraph 2.1 will govern for any soil reused or brought from offsite. Please also see Q13 for revisions to specification Section 31 00 00, Paragraph 2.1.5

Q12: Does the pay quantity for the marine mattresses include the overlap of 8 LF or does the contractor not get paid the additional for overlap? Is the quantity measured in place or payment of actual mattresses installed? Please clarify

A12: Pay quantify for the marine mattress includes the length of mattress actually installed, with overlap at the crest of the jetty.

Q13: Specification 310000, section 2.1.5 states that the backfill for the toe of the excavation will be from the site (using existing material). Note 3 in the plans on sheets with cross sections states that excavated areas are to be filled with trucked in clean compatible materials. Is the contractor allowed to use excavated sand for the backfill at the edge of the mattresses or does that material need to be imported?

A13:Specification Section 31 00 00, Paragraph 2.1.5 is to be revised as follows: "Backfill material for toe excavation will be from an off-site borrow and must be classified as satisfactory. All backfill material to be used must adhere to testing standards set forth in Section 31 00 00 Paragraph 1.6 and Section 02 41 00 Paragraph 2.1."

Q14: What is the anticipated NTP? Due to the moratorium, improper timing of the NTP could potentially cause the contractor to lose too much time to complete the project.

A14: Please see response to Q9.

Q15: Please further define the following items and what is covered under each. There is some confusion and possibly overlap of scope of work for each.

0002AA Removal and Disposal of Debris from Jetty Footprint - 1 LS

0004 Timber Debris Removal - 1 LS

0009 Debris Removal - 1 LS

A15: Please see Specification Section 01 20 00 Price and Payment Procedure for a description of CLINs above. From Section 01 20 00 Price and Payment Procedure:

0002AA Removal and Disposal of Debris from Jetty Footprint - 1 LS

Payment will be made for costs associated with all the work and operations necessary for Removal and Disposal of Unsuitable Stone, and Timber Cribbing under existing jetty stone. Unsuitable stones include removal of deteriorated seawall at the root of the jetty and removal of existing jetty stone at the head of the jetty to accommodate marine mattress installation. Intact sections of the seawall shall not be disturbed.

0004 Timber Debris Removal - 1 LS

Payment will be made for costs associated with all the work and operations necessary for removal of the existing Timber Debris adjacent to the existing jetty as shown on the Contract Drawing.

0009 Debris Removal - 1 LS

Payment will be made for costs associated with all the work and operations necessary for miscellaneous debris removal within the project area.

Q16: As per Specification 329400 Dune Vegetation Plan, the contractor is to restore approximately

0.5 acres with the American Beachgrass. Please identify where this work is to be completed.

A16: The contractor is responsible for restoring disturbance to dune vegetation resulting from construction activities per requirements of Specification Section 01 11 00 Paragraph 1.6

Q17: On drawing P002042 for the foundation details of the navigation aid, the section for new cast in place reinforced concrete shows #4 rebar on all sides. The section for new pre-cast concrete foundation does not show any rebar other than the bars drill into the rocks. Please confirm that if the precast option is used, no rebar other than the dowels in required.

A17: Please see Specification Section 02 41 00 Paragraph 3.1.4 for USCG ATON coordination requirements.

Q18: It appears the beach access permit, which would be required under this work, costs $115,000 per 12 months. Whose responsibility is it to purchase this permit?

A18: All permits and costs associated are the contractor's responsibility.

Q19: Is a project biologist required to be a part of the contractor's team on this contract? If so, for what durations/features of work?

A19: Please refer to Specification Section 01 57 19 Paragraph 3.1.

Q20: Vibration monitoring - what qualifications must the specialist have, and for what durations /features of work should contractors anticipate hiring this person?

A20: Please refer to Specification Section 40 77 23 Paragraph 1.2 for Personnel Qualification and Paragraph 3.1 for the durations/features of work.

Q21: Excavated materials cannot be stockpiled on site. Where shall excavated materials be placed?

A21: It is the means and methods of the contractor not to stockpile excavated material on site.

Q22: Surveying Requirements - a NJ licensed LS or PE is required. Would an out-of-state licensed surveyor/PE be acceptable?

A22: Please refer to Specification Section 01 71 23 for Survey Requirements

Q23: Plantings - there is extensive language in the spec regarding plantings, yet the plans do not appear to mention any plantings. Are plantings required under this contract?

A23: See answer to Q16

Q24: Specification Section 02 41 00, Section 3.1.4, requires the existing USCG ATON and its concrete foundation to be removed, stored, and reinstalled. However, the as-built drawings indicate that the existing foundation is cast-in-place and weighs in excess of 50,000 pounds, making removal and reinstallation impractical. Please consider revising the Contract to include a separate pay item for the construction of new cast-in-place concrete foundation, matching the existing foundation dimensions and configuration.

A24: The USCG ATON drawings provided are typical drawings for information only and are not as-builts.

Note: The Government will not respond to RFIs received after this amendment. The bid opening time and date shall remain: 2PM EST on 14 August 2026.
