About this file
This is Amendment 0002 to a federal dredging solicitation (W912DS26BA011) issued by the U.S. Army Corps of Engineers (USACE), New York District, for work at the U.S. Merchant Marine Academy in Kings Point, New York. The amendment, effective April 6, 2026, revises bid schedules, updates specification sections, adds survey data, and establishes an RFI cutoff date of April 7, 2026.
The solicitation requires dredging and placement of dredged material from Hague Basin with four basic and optional contract line items (CLINs). CLIN 0002 covers removal of 6,110 cubic yards to -17.5 feet mean lower low water (MLLW) with no overdepth; CLIN 0003 covers 5,175 cubic yards to -15 feet MLLW plus 2-foot overdepth; CLIN 0005 (Option 1) covers 18,010 cubic yards to -12 feet MLLW plus 2-foot overdepth; and CLIN 0006 (Option 2) covers 22,680 cubic yards to -12 feet MLLW plus 2-foot overdepth. The contractor must transport, process, and place dredged material at a contractor-furnished, state-permitted, government-approved upland placement site. The base contract requires completion within 43 calendar days of Notice to Proceed at a minimum production rate of 1,500 cubic yards per day. Options 3 and 4 establish fixed completion dates of July 1, 2026, and June 19, 2026, respectively, with adjusted pricing reflecting cost differences from the 43-day baseline. Award is based on lowest total price for all CLINs 0001-0008 from the responsible, responsive bidder. Apparent low bidders must submit required site compliance documentation within 20 calendar days of notification. The government notes that quantities are estimated based on September 2025 survey data and that an additional Before Dredge survey will be performed prior to Notice to Proceed. Offerors must acknowledge receipt of this amendment prior to bid submission.

TOTAL BID (CLINs 0001 THRU 0008) $ ________________________________
NOTES TO BIDDERS:
NOTE 1: Bidders must bid on all items. Failure to bid on all work will be cause for rejection of the bid as nonresponsive.
NOTE 2: Award of contract will be based on the responsible and responsive bidder with the lowest total price for the total of the CLINs 0001 through 0008.
NOTE 3: The unit prices for CLINs 0002, 0003, 0005, and 0006 represent the cost per cubic yard for the removal of the estimated quantities of dredged material (all material except ledge rock lying above the planes of -15 feet and -12 feet mean lower low water (MLLW) respectively, plus 2 foot allowable overdepth and the plane of -17.5 feet MLLW), in the Basic Work (Dredging Areas of CLIN 0002 and 0003) and Option Work (Dredging Area of CLINs 0005 and 0006) contract areas of Hague Basin. The dredged material from CLINs 0002, 0003, 0005, and 0006 must subsequently be transported, processed, and placed at a contractor furnished, state permitted, Government approved upland placement site(s).
NOTE 4: All bidders are hereby advised that the execution of the Options is subject to the availability of funds.
NOTE 5: Exercise of Options are at the discretion of the Government and may be exercised within five (5) calendar days of receipt by the Contractor of the Notice to Proceed (Basic Work) for Option 1, Option 2, Options 3 and/or 4. If Options 1 and/or 2 are exercised, their performance periods will be consecutive to that of the Basic Work. If Option 3, or Options 3 and 4 are exercised, please see Notes 12 thru 15.
NOTE 6: All bidders are hereby advised that the estimated dredge quantities for placement in the price schedule are estimated and based on the survey data collected on 14-17 September 2025.
USACE Before Dredge (BD) survey will be performed prior to Notice to Proceed (NTP).
NOTE 7: The Government may reject a bid as non-responsive if the prices bid are materially unbalanced between line items and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low bid.
NOTE 8: Bidders are reminded that they must bid on the issued plans and specifications as amended. Any deviations, conditions or attachments made by the bidder himself may render the proposal non-responsive and may be cause for its rejection.
NOTE 9: The apparent low bidder shall submit the documents specified in Section 01 30 00, Administrative Requirements, paragraph 1.4, Contractor-Identified Offloading, Processing and Disposal Site Compliance. If the apparent low bidder does not submit the required information within 20 calendar days from the date the apparent low bidder is notified of being the low bidder, the bidder may be considered non-responsible and his bid will no longer be considered.
Information provided by the apparent low bidder regarding the 20-day submittal will be the final version. If the apparent low bidder requests to make changes to the 20-day submittal, they can only be made with approval from the Government.
NOTE 10: It is the contractor's responsibility to comply with all conditions and requirements of the Contractor furnished placement site(s).
NOTE 11: The Contractor shall be required to (i) commence work under this contract within five (5) calendar days after the date the Contractor receives the Notice to Proceed, (ii) prosecute the work diligently, and (iii) complete the entire work (Basic and Options 1 and 2) ready for use, not later than 43 calendar days after the date the Contractor receives the Notice to Proceed. Should any option(s) be exercised, all work is still required to be completed by the required completion date as included in the exercised option. The time stated for completion shall include final cleanup of the premises. (FAR 52.236-12)
NOTE 12: The Contractor shall meet a production rate to complete all work based upon the adjusted required completion date set forth in Option 3 and Option 4, subject to availability of funding. If Option 3 is exercised, the required contract completion date will be July 1, 2026. If Option 4 is exercised, the required contract completion date will be June 19, 2026. Hence, the additional 12 and 16 days stated in option 1 and 2 will not be applicable.
NOTE 13: Option 3 represents the difference in net price (positive or negative) for CLINs 0001 thru 0006, between completing the contract within 43 calendar days of NTP issuance, and the adjusted required completion date of July 1, 2026. For example, if completing the contract for CLINs 0001 thru 0006 by July 1, 2026 is a lower cost than completing the contract within 43 calendar days of NTP issuance, then the firm fixed price for Option 3 would be negative to reflect the reduced cost.
If completing the contract for CLINs 0001 thru 0006 by July 1, 2026 is a higher cost than completing the contract within 43 calendar days of NTP issuance, then the firm fixed price for Option 3 would be positive to reflect the increased cost.
NOTE 14: Option 4 represents the difference in net price (positive or negative) for CLINs 0001 thru 0006, between completing the contract by the required completion date of July 1, 2026 in Option 3 and completing the contract by the required completion date of June 19, 2026 in Option 4. For example, if completing the contract for CLINs 0001 thru 0006 by June 19, 2026 is a lower cost than completing the contract by July 1, 2026, then the firm fixed price for Option 4 would be negative to reflect the reduced cost. If completing the contract for CLINs 0001 thru 0006 by June 19, 2026 is a higher cost than completing the contract by July 1, 2026, then the firm fixed price for Option 4 would be positive to reflect the increased cost.
NOTE 15: If Option 3, or Options 3 and 4 are exercised, FAR 52.211-18 Variation in Estimated Quantity clause would not be authorized nor will there be any increases or decreases in quantities.

BIDDERS'S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest to all offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors "For Information Only" and do not revise the solicitation, plans or specifications.)
1) Note 15 in the amendment states "If Option 3, or Options 3 and 4 are exercised, FAR 52.211-18 Variation in Estimated Quantity clause would not be authorized nor will there be any increases or decreases in quantities." What does this mean? Does it mean that, if the options are exercised, the pay quantities for volume dredged will be fixed to what's in the solicitation, and surveys quantities will be irrelevant? Please clarify, as this has the potential to significantly impact bid prices.
Response: If the Options 3, or Options 3 and 4 are exercised, the pay quantities for the volume will remain fixed to the solicitation amount. This means that the pay volume would not be adjusted as a result of the Before Dredge (BD) Survey.
2) The amended solicitation also states "All material above the plane of 17.5 feet below MLLW must be removed and no material below the plane of 17.5 feet below MLLW shall be removed.
Dredging to a flat plane of 17.5 with zero tolerance is not feasible. Please clarify what happens in the event that grades less than 17.5 are left, and in the event that grades deeper than 17.5 are left.
Would the govt entertain adding a 6" tolerance to this work?
Response: It is recommended that dredging is accomplished as close to grade as practical using best management practices.
3) A thorough analysis of companies capable of processing/unloading/disposing of dredged material revealed that a consistent production rate of 2,500 CY is near-impossible. Barge availability is another key factor that would make this production rate unachievable. Would the govt entertain reducing the daily production requirement to 1,500 CY per day?
Response: The minimum average production rate has been updated to 1,500 CY per day for dredging, transportation, processing and placement at a contractor furnished, state permitted, Government approved upland placement site(s) unless Option 3 or Options 3 and 4 are exercised.
Should Option 3 or Options 3 and 4 be exercised, the contractor shall meet a production rate to complete the work based upon the required completion date set forth in the Option.
4) Can the govt provide any XYZ data available for the existing grades?
Response: The XYZ data for the Plans & Specifications survey is added with amendment 0002.
No RFIs will be responded to after 7 April 2026
