About this file

This document is an amendment to a solicitation for maintenance dredging of the Bronx River, New York Federal Navigation Project. The amendment responds to questions from a potential bidder regarding rock removal, placement of rock at the Historic Area Remediation Site (HARS), the contractor's ability to demobilize and remobilize after the no-dredging window, and the availability of the previous post-dredge survey. The key details are:

The contractor must protect piers, bulkheads and other structures during rock removal, and areas determined by the government as unable to be dredged due to obstructions may be removed from the required dredging footprint. Naturally occurring rock comingled with sediment may be placed at the HARS. The contractor will be required to comply with the period of performance, production rate, and environmental windows, and if work is not completed by January 15, the contractor will be required to stop work and remobilize when the window re-opens at no additional cost to the government. Liquidated damages will begin to accrue if the contractor has exhausted the performance period. The previous post-dredge survey is not available.

AMENDMENT 0002

AMENDMENT 0002

Bronx River, New York Federal Navigation Project Solicitation No. W912DS-

24-B-0023

The purpose of this Amendment 0002 is to 1) respond to the following questions posed by a potential bidder.

1. Questions from potential bidder and USACE responses:

Question 1: The Amendment 0001 response to question 11 indicates that the rock within the channel limits is to be removed to “restore the entire channel to the depth and width described in the plans and specifications.” Rock removal will require a conventional bucket and will not be done at a rate much lower than 8,000 CY per day. Please provide the number of additional days that will be allowed for the removal of rock.

Answer 1: The contractor must ensure the stability of piers, bulkheads, and other structures lying on or adjacent to the site of work (see Section 35 20 23, 3.2.13). Rock that is part of a structure shall therefore be protected and not removed as part of this contract; the contractor should identify safe standoff distances to protect those structures and not undermine the stability of the structure.

Areas determined by the Government not able to be dredged due to obstructions by structures in the channel may be removed from the required dredging footprint. In that case, the area will not be included for acceptance of the project. Contractor may consult the Differing Site Conditions clause (FAR 52.236-2) of the contract. The contract will be administered in accordance with its terms and conditions.

Question 2: Is the rock shown on plan sheet VH-107 permitted/authorized to be placed at the HARS?

Answer 2: See Response to Question 1 for additional context. Naturally occurring rock that is comingled with the sediment may be placed at the HARS.

Question 3: As we believe the project can’t be completed by January 15, will the contractor be allowed to demobilize on January 15 and remobilize to complete the work after the September 30 no-dredging window?

Answer 3: The contractor will be required to comply with the period of performance, production rate, and environmental windows. If work is not completed by 15 January, the contractor will be required to stop work and remobilize when the window re-opens at no additional cost to the government.

W912DS24B0023

Question 4: If the contractor is allowed to remobilize after September 30 to complete the work, will liquidated damages be assessed during the no-dredging window of January 15 to September 30?

Answer 4: LDs will begin to accrue if the contractor has exhausted the performance period. Contractor may consult the Liquidated Damages clause (FAR 52.211-12) of the contract. The contract will be administered in accordance with its terms and conditions.

Question 5: If available, please provide the post-dredge survey for the last time this channel was dredged (1991).

Answer 5: The requested survey is not available. A search of the New York District’s Operations Division physical and digital archives yielded no results.
