WATERWAY: East River

LOCATION: Between Rikers Island and Hunts Point, Boroughs of Queens and Bronx, Queens and Bronx Counties, New York

A detailed description and plans of th~ applicant's activity are enclosed to assist in your review.

The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and in general, the needs and welfare of the people.

The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian

Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act.

Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity.

ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE

PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE

EXPIRATION DATE OF THIS NOTICE; otherwise, it will be presumed that there are no objections to the activity.

Any person may request, in writing, before this public notice expires, that a public hearing be held to collect information necessary to consider this application. Requests for public hearings shall state, with particularity, the reasons why a public hearing should be held. It should be noted that information submitted by mail is considered just as carefully in the permit decision process and bears the same weight as that furnished at a public hearing.

Pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531) and based upon a review of the latest published version of the threatened and endangered species listing, a preliminary determination is that the activity under consideration will not affect Federally endangered or threatened species or their critical habitat.

Based upon a review of the properties listed or eligible for listing in the latest available version of the National Register of Historic Places, there appears to be no sites included in the Register within the permit area. Presently unknown archaeological, scientific, pre-historic or historical data may be lost by work accomplished under the required permit.

Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456(c)], for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit application that the activity complies with, and will be

CENAN-OP-RE 20 July 1993

MEMORANDUM FOR THE RECORD

SUBJECT: Statement of Findings for Application Number 93-00490- Y2 by the NYC Department of Environmental Protection

1. On 15 April 1993, this office received an application for a Department of the Army permit from the NYC Department of Environmental Protection. The application requested approval to install approximately 5000 linear feet of 24-inch diameter subaqueous water main by horizontal directional drilling to a maximum depth of 100 feet below mean low water. There would be a minimum of 15 feet of clearance below the authorized dredging depth of the Federal Navigation Channel in the East River.

Approximately 600 cubic yards of excavated material from the drilling process would be transported to an upland disposal site.

The stated purpose of the proposed work is to provide a municipal water supply. The project site is between Rikers Island and Hunts Point, East River, Boroughs of the Queens and Bronx, Queens and Bronx Counties, New York.

2. Regulatory Authority: The application was submitted pursuant to Section 10 of the Rivers and Harbors Act of 1899.

3. Complete Application: The application was complete for processing on 12 May 1993.

4. Public Notice: Public notice number 93-00490-Y2, describing the proposed activity was published on 25 May 1993 for a 30-day comment period. Copies of the public notice were mailed to the adjacent property owners as supplied by the applicant, to interested members of the public, and to Federal, state and local officials or agencies included in our computerized public notice mailing list for the East River.

5. Public Hearing: The district did not receive any requests for a public hearing on the subject application, nor is a public hearing needed for this permit decision.

6. Responses to Public Notice: By letter dated 10 June 1993, the Deputy Commissioner of Historic Preservation of the State of New York indicated that the proposed work would have no effect upon any resources listed or eligible for inclusion in the National Register of Historic Places.

7. Federal Review Agencies' Comments: At the Federal Interagency Coordination meeting held on 15 June 1993, the US Environmental Protection Agency and the US Fish and Wildlife Service stated they had no objections to the proposed work and did not oppose permit issuance. The National Marine Fisheries Service (NMFS) expressed concern that the project may affect sea turtles or

SUBJECT: Statement of Findings for Application Number 93-00490- Y2 by the NYC Department of Environmental Protection their habitat. They stated that a letter regarding whether the subject proposal would affect threatened or endangered species or their critical habitat would be forthcoming.

In a 22 June 1993 letter by Mr. Michael Ludwig, Fishery Biologist, NMFS stated that since the water main installation would be isolated from the water column and inhabited sediment horizons, there should be no adverse impact on marine resources and unless modified, further consultation pursuant to Section 7 of the Endangered Species Act would not be necessary.

8. Navigation Impacts: In a 1 June 1993 transmittal, CENAN-OP-N stated they did not object to the proposal since there would be sufficient clearance below the authorized dredging depth of the Federal Navigation Channel in the East River.

9. State and Local Approvals: As of this date, applications for the subject proposal are pending with the New York State Department of Environmental Conservation and the New York City Department of Business Services. However, in accordance with 33 CFR 320.4(j) (1), issuance of a DA Permit will not normally be delayed pending state and/or local authorization.

10. Water Quality Certification: The proposed activity does not include a discharge of dredged or fill material into waters of the United States and therefore a water quality certificate or waiver is not required for this decision.

11. Coastal Zone Management Concurrence: By letter dated 9 July 1993, the New York State Department of State concurred that the subject proposal is consistent with the Coastal Zone Management Program of the State of New York.

12. The enclosed environmental assessment has been prepared in accordance with the policy and procedures set forth in the rules governing the regulatory program of the Corps of Engineers, 33 CFR Part 320 et. seq., and the policies and procedures for implementation of the National Environmental Policy Act at 33 CFR

230. The environmental assessment concludes that the proposed activity will not have a significant adverse effect on the quality of the human environment and as such an environmental impact statement need not be prepared for this permit decision.

13. As specified at 33 CFR Part 320.4(a) (2), the following general criteria will be considered in the evaluation of every application:

SUBJECT: Statement of Findings for Application Number 93-00490- Y2 by the NYC Department of Environmental Protection

a. Private and public need for the proposed activity: The proposed work would provide a municipal water supply to the public. Adequate water supplies are of importance to the public, and the proposed work would not conflict with this.

b. Appropriate Alternatives: There are no unresolved conflicts regarding the proposal. Modifying or prohibiting the proposed activity does not appear necessary.

c. Extent and permanence of the beneficial and/or detrimental effects which the proposed activity may have on the private and public uses to which the area is suited: Detrimental effects are expected to be negligible. Long-term beneficial effects in terms of municipal water supply to the public is expected to result from the proposal.

14. As specified at 33 CFR 320.4(a) (1), the subject application has been evaluated in light of the probable impact including cumulative impacts of the proposed activity and its intended use upon them. This evaluation reflects the national concern for both the protection and utilization of important resources. It includes all factors relevant to the proposal including the cumulative effects thereof: among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs and in general, the needs and welfare of the people.

15. Based upon the foregoing analysis, a review of the administrative record and after a weighing of all relevant to the application, it is concluded that the public interest to issue a Department of the army subject applicant to perform the work described .

of this statement of findings.
