AMENDMENT 0001
AMENDMENT 0001
Bronx River, New York Federal Navigation Project
Solicitation No. W912DS-24-B-0023
The purpose of this Amendment 0001 is to 1) respond to the following questions posed by potential bidders and 2) provide additional/necessary revisions to solicitation documents.
1. Questions from potential bidders and USACE responses:
Question 1: The bid schedule lists a quantity of 79,910 CY for Dredge Area 2A, bid item 0003.
Section 01 11 00 (Summary of Work), page 3, lists the volume as 73,910 CY. Section 01 30 00 (Administrative Requirements), page 9, also lists the volume as 73,910 CY. Please clarify the volume of material to be dredged for Dredge Area 2A.
Answer 1: 73,910 cubic yards (CY) is the correct volume for Dredging Area 2A, CLIN 0003. A revised Bid Schedule is included in this amendment.
Question 2: Will transloading of dredged material be allowed for this project? At what location will the contractor be allowed to perform transloading operations?
Answer 2: Means and methods utilized by the contractor for accomplishing the required work must conform with all conditions listed in the NYSDEC Water Quality Certificate (WQC). ‘Transloading’ of dredged material is not expressly described within the project’s WQC, but any ‘transloading’ must conform to relevant/applicable material handling conditions listed within the WQC and within this solicitation’s specifications. The contractor’s proposed means and methods for accomplishing the required work will be reviewed and discussed prior to award and again during the preconstruction conference.
Question 3: Please modify the contract duration to allow for a 12-day mobilization/demobilization period and dredging at a daily production rate of 3,500 cy per day, resulting in a completion date of approximately 55 days from NTP.
Answer 3: A Market Survey detailing the project parameters of concern was published on 24 June 2024. Responses to the Market Survey from multiple potential bidders indicate that the prescribed performance period and production rate are achievable. The means and methods for completing the work in accordance with the contract plans, specifications, and applicable laws/regulations (e.g. NYSDEC WQC) are left to the bidders/contractor.
Question 4: Section 01 11 00, page 3, paragraph 1.3.1 states; “…additional time will be allowed at the rate of one (1) calendar day for each 8,000 cubic yards in excess of the established limit”. As this is a shallow channel requiring tidal work dredging, please modify this to be a minimum average production rate of 3,500 cy per day.
Answer 4: Please see response to question 3.
Question 5: Per the USACE Fact Sheet for Bronx River, this channel was last dredged in 1991.
Please provide the type and quantity of debris that was encountered during the previous dredging contract.
Answer 5: Records of removed debris type and quantity are not available from the 1991 maintenance cycle, all potential bidders should anticipate the potential for encountering debris such as that listed in Section 01 20 00 including, but not limited to – “lumber, tires, scrap metal, car bodies, shopping carts, cables, pilings, line and all objects not included in the definition of natural material or material suitable for HARS placement”.
Question 6: Section 01 11 00, page 4, paragraph 1.3.1 states; “Dredging is prohibited during the seasonal no-dredging window from 15 January through 30 June.”. Given an October 22 bid date, a mid- November award date and a late November NTP are likely. This leaves ~45 days available between NTP and 15 January. As the dredging is tidal work, the completion of dredging may not occur prior to 15 January. Is the 15 January date able to be extended should the dredging need additional time due to a late- October bid date?
Answer 6: The seasonal no-dredging window is from 15 January to 30 September per the WQC dated 23 August 2024. The contractor will be required to conform with all WQC requirements, including no-dredge windows. A revised Section 01 11 00 Summary of Work is included in this amendment.
Question 7: Section 35 20 23, page 6, paragraph 3.2.1 states; “The Contracting Officer will direct the Contractor on the order of work”. As this is a shallow channel, it needs to be dredged from south to north to maximize channel depths between the dredge and the mouth of the river. Please confirm that the contractor will be allowed to commence dredging at the south end of the project and progress to the north.
Answer 7: Yes, the contractor will be allowed to commence dredging at the south end of the project and progress to the north.
Question 8: The typical cross-sections depicted in the plan sheets show an overdepth channel width (94’ at -11 MLLW) that is less than the required channel width (100’ at 10’ MLLW). Please confirm that the overdepth channel bottom is 100’ wide, matching the required channel width.
Answer 8: Yes, the overdepth channel bottom is 100’ wide or otherwise as wide as the channel toe (in the plan view) as shown on the contract plans.
Question 9: We are concerned about the completion time of the project being 32 calendar days. This seems incredibly short for a project that is estimated to be $5,000,000. Can you please confirm that the 32 day completion time frame is accurate?
Answer 9: Please see response to question 3.
Question 10: Please provide the XY coordinates and stationing of the channel vertices. Each has an identifying label (numbers 1 to 29), but we are unable to locate an associated table of points with corresponding coordinates and stationing.
Answer 10: Please find the requested XY coordinates and stationing included in this amendment.
Question 11: Plan sheet VH-107 depicts an area along the green toe that is labelled “ROCKS.” Also, there is an associated dashed line that appears to be drawn for only a portion of the distance of the rock area (assumed to be where there is missing hydrographic data). What is the intent of this rock area? Is the contractor to leave the area undisturbed? Please further delineate/identify the entire rock area in question.
Answer 11: The area of concern on Sheet VH-107 indicates the approximate location of an obstruction encountered during hydrographic surveying. In this case, shallow draft and the presence of rocks prevented the survey crew from obtaining data in this portion of the channel. The USACE intends to restore the entire channel to the depth and width described in the plans and specifications and in accordance with the NYSDEC WQC and contract specifications. However, if as work progresses, the Contractor determines that the stability of piers, bulkheads, or other structures may be jeopardized by dredging operations, the contractor shall immediately notify the Contracting Officer and/or their representative (See Section 35 20 23, 3.2.13 Safety of Structures). In addition, per the WQC dated 23 August 2024, “Where the environmental bucket repeatedly encounters resistance from consolidated materials (e.g. stone, rock) a conventional digging bucket may be used (with a written notice of intent to switch bucket at least 2 business days prior)”.
Question 12: Plan sheet VH-109 shows a small portion of the dredging area terminus ending approximately 30 feet under the Bruckner Boulevard Bridge. Is the contractor required to dredge material from under the low-clearance bridge?
Answer 12: Prior to contract award, the USACE and the apparent low bidder will discuss the low bidder’s plan to complete the project. Safety and any equipment-specific safety buffers will be discussed at this time. Per Section 01 30 00,1.7b – “The contractor shall exercise the utmost caution when dredging in the vicinity of any bridge, pier, abutment, or bulkhead to prevent the collapse, undermining or damage to these structures. In no case shall the contractor moor any plant to or tie any line, cable, chain or anchor line around any part of a bridge structure, pier, abutment or bulkhead connected therewith”. If as work progresses, the Contractor determines that the stability of piers, bulkheads, or other structures may be jeopardized by dredging operations, the contractor shall immediately notify the Contracting Officer and/or their representative (See Section 35 20 23, 3.2.13 Safety of Structures).
