PROPOSER’S QUESTIONS AND GOVERNMENT REPLY

Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only” and do not revise the solicitation, plans or specifications.

Q1. Please confirm this project is exempt from sales tax.

Response:. The offeror's attention is directed to FAR 52.229-3, Federal State and Local Taxes.

Determination of the applicability of taxes is the offeror's responsibility, and offerors are responsible for including all applicable taxes in their proposal. After award, the Contracting Officer may be able to assist with obtaining tax exempt certificates, however, assistance with provision of a form is not an assurance that the contractor will be able to purchase materials that are tax exempt.

A contractor or vendor who provides materials to the Corps that become a permanent part of a structure may also be exempt from state taxes. Either New York State form ST-120.1 or New Jersey State form ST-13 must be provided by the individual contractor/vendor when purchasing these materials. These forms and more specific instructions may be obtained on the New York State web site at www.tax.state.ny.us/ or the New Jersey State web site at www.state.nj.us/treasury/taxation/.

Q2. Regarding the Coal Tar Epoxy being proposed for the sheet piles, steel piles, and all associated connections other than tie rods and walers, please clarify the limits being requested as well as the minimum dry film thickness that shall be applied as the specification sections 31 41 16, part 2.6.1 & section 09 97 13.26 provide contradictory information.

Response:. The design has a sacrificial section expendable to corrosion. Therefore, no coating of the king piles and sheet piles is required.

Q3. Please confirm that prior authorization has been obtained from either the Environmental Office or Contracting Officer to allow the discharge of water that accumulates in the excavations into the existing sanitary sewer, storm drains, or to surface waters.

Response: Section 1.3 requires the contractor to get the permit.

“01 33 00 SUBMITTAL includes Solid Waste Management Permit; G, RO Stormwater Pollution Prevention Plan (SWPPP); G, RO Stormwater Notice of Intent (for NPDES coverage under the general permit for construction activities); G, RO Spill Prevention Control And Countermeasure (SPCC) Plan; G, RO”

Q4. It would be in the best interest of all parties to include an Optional Bid Item in the bid proposal to account for the potential pumping, testing, storage, and eventual discharge/disposal of contaminated groundwater encountered during construction activities.

Response:. Please see revised bid schedule.

Q5. Please confirm that as per Specification #3.6, the USACE will require the contractor to provide a 1,300SF office space with the appurtenances mentioned for the duration of the project.

Response. Yes, confirmed.

Q6. The "INSTRUCTIONS TO BIDDER" (Section 00 21 13) is not part of the Specifications that were published. Please provide this section as soon as possible for the bidders to review.

Response. This section is part of the Solicitation, not the Specifications. Please see Page 21 of Amendment 2 of W912DS24B0001 for the Instructions to Bidders

Q7. The "GENERAL CONDITIONS" (Section 00 72 00) is not part of the Specifications that were published. Please provide this section as soon as possible for the bidders to review.

Response. This section is part of the Solicitation, not the Specifications. Please reference Page 19 of the Solicitation to see Clauses Incorporated by Reference.

Q8. The "REPRESENTATIONS AND CERTIFICATIONS" (Section 00 45 00) is not part of the Specifications that were published. Please provide this section as soon as possible for the bidders to review.

Response. This section is part of the Solicitation, not the Specifications. Please see Page 21 of Amendment 2 of W912DS24B0001 for the Representations and Certifications

Q9. In reference to ITEM 0006 – OPTIONAL ITEM 1 – Railings: We have 2 shop drawings from SELCO (sheet 28 and sheet 31):

Q9a. There are light fixtures called out. Does this light fixture need to be powered as per this bid item? Where does the power supply originate? Does this bid item include running conduit and wire from the source location, up behind the vertical rail support posts, to the light fixture?

Response: The light fixtures do not need to be powered as per this bid item. Bid Item 0006 only covers installation of the railings, as well as a small amount of fabrication required for bends, change in direction, and point of inflections.

Q9b. Are the vertical rail support posts anchored directly into the bulkhead concrete? (at rough elevation between 10ft-12ft depending on location)?

Response: The vertical rail support posts are anchored directly into the bulkhead concrete. As per SELCO shop drawing sheet 28, the base plate edge shall be located 4" from landward edge of bulkhead.

Q10. In reference to ITEM 0011 – OPTIONAL ITEM 6 – Additional Materials: Is the intent to price the furnish and install of 100 extra linear feet of the King Pile, Mid-Span, Deadmen, tierods, Cofferdam, and concrete/rebar bulkhead as seen in detail SECTION STA 0+00 TO STA 0+16 on S-301?

Response. Option 0011 refers to additional king pile/sheet pile length [VLF] in cases where extra length is required (ex: rock line is not exactly where it is assumed).

Q11. Refer to sheet S-501:

Q11a. Note 2 states that two rows of nelson studs shall be attached to each sheet pile. However, sections A-A and C-C show the studs welded to the flange of the king piles. Please clarify.

Response: At the cantilever bulkhead sections, studs are on the king piles. At the tie back bulkhead, studs are on the sheet piling as indicated in the section above the notes titled “TYPICAL TIEBACK BULHEAD CAP SECTION” and section C-C.

Q11b. Please clarify the note about the #6 rebar. “Provide 1” dia. holes thru waler for continuous reinforcement” . There is no apparent conflict since the walers are set behind the sheet piles and outside the concrete wall.

Response. This note is not applicable to the current project.

Q12. Refer to item 0001AA on the bid price breakdown: The quantity shown for this item is 905 LF. However, the bulkhead ends at Sta 9+13.71 as shown on sheet C-102 and others. Please clarify.

Response: The Bid Schedule has been reissued to note "Steel for Bulkhead System - Steel Sheet Piling for construction of bulkhead for Stations 0+00 through 9+13.71, complete, in accordance with the drawings and specifications, but not including Items 0002- 0014 on the bid schedule. " The quantity for Item No. 0001AA has been revised to 913.71 LF.

Q13. The bid was postponed to May 28th, wanted to confirm that this was still going to be the case with that bid date being the day after a Federal Holiday.

Response. The bid opening will occur on 4 June 2024 at 2:00PM EST.

Q14. Please confirm that the project will be hand delivered to the Federal Building in New York for a 2 PM bid opening, there was some confusion that an online or electronic submission may be an option.

Response. Please hand-deliver or postal mail all bids. Electronic submission of bids is not allowed. All bids must be received by the Contracting Office by 2:00PM EST on 4 June 2024.

1. Contract Drawing S-001 Note #3 under Sheet Piling states the sheeting and pile coating shall be Coal Tar Epoxy. Specification Section 31-41-16 Paragraph 2.6.1 states the coating on the steel sheeting and H-Piles is to be coal tar epoxy with a total minimum thickness of 25 Mil but this contradicts Specification Section 09-97-13.26 Paragraph 3.3.3 that mentions a Three-Coat Epoxy-Polyamide System with a dry film thickness of 9 Mil. Please confirm which is correct.

Response:If using steel grade A690, NO epoxy coating is required.

Response: As per Specification 01 35 29.13, Section 3.1:

"The Contractor is responsible for conducting soil analysis tests of excavated soil material to determine the levels of compounds, including but not limited to semi volatile, volatile organic compounds, trace metals and Dioxin. The excavated material must be stored on-site in water-tight containers until the test results have been analyzed and an Acceptable Use Determination (AUD) has been obtained. Test results must be submitted to the District Environmental Analysis Branch POC as well as the NJDEP and the proposed landfill processing facility.

Soil material that is tested and found not to exceed NJDEP Non-Residential Soil Cleanup Criteria but to exceed Residential Soil Cleanup Criteria may be utilized as backfill if suitable and is covered with a minimum of 6 inches of certified clean fill. These activities should be in coordination with the Environmental Analysis Branch POC as well as with the NJDEP."

RFI No. 22 A. The below USACE answer to one of the questions under RFI7 indicates no coating required.

5. Can you please clarify whether the full length of sheet piles & h-piles are to be coated per spec 099713.26? If partially coated, please specify the limits to be coated.

Answer: No coating of the king piles and sheet piles is required.

Please CONFIRM as this conflicts with the drawings and specifications as follows:

Note 3 on Dwg S001

1. ALL SHEET PILING AND STEEL PILES SHALL BE COATED WITH COAL TAR

EPOXY. SEE SPECIFICATIONS AND MANUFACTURER REQUIREMENTS.

Specifications Section 31 41 16 states:

2.6 FINISH

2.6.1 Coal Tar Epoxy

Sheet piles, steel piles, and all associated connections other than tie rods ald walers shall recieve 2 coats of coal tar epxy with a total minimum thickness of 25 mils

Response: If using steel grade A690, epoxy coating of the king piles and sheet piles is not required.

If using standard steel grade A572, two layers of epoxy coating would be required for the full length of king piles and sheet piles.

For additional context, ASTM A690 is a corrosion-resistant metal higher grade than the standard A572. As per discussions with the steel manufacturer coordinating with USACE, using A690 would mean epoxy coal tar coating will be redundant, although the specification states that all steels would need 2 layers of epoxy coating. A690 grade steel is high-strength low-alloy nickel, copper, phosphorus steel piling of structural quality for use in the construction of dock walls, sea walls, bulkheads, and excavations in marine environments due to its anti-corrosive properties.

As per the structural design team, epoxy coating would make the sheet piles difficult to drive (it may create friction at the E22 connectors). Traditionally, it is either standard grade A572 with epoxy coating OR A690 without epoxy coating.

B. What is the required size of the trash racks for the existing outfalls at Sta. 0+34 and 7+06.

Response: As per detail on C-502: Stainless steel trash rack shall be 24" x 24" with 3" angle frame. Openings shall be no bigger than 3" x 3". Provide (6) 1/2" dia. X 6" long stainless steel anchor bolts.

RFI No. 23 I understand that 1000 LF is needed but if you have any spec/data sheets with regard to float size, PVC material, permeable/impermeable, ballast chain size, top cable size, end connectors, etc. then it would be greatly appreciated.

Also, if you happen to know the depth of the curtain needed or if it will vary by location then I will know to add reefing/furling lines as our standard depths are in 5 foot increments.

Response: I am assume the reference is to turbidity barrier. No spec/data sheets will be provided; it is the contractor’s responsibility to submit this items for approval as a submittal during the construction. Contractor can estimate depth needed based on tide charts and river bottom elevations provided in the contract documents. Depth will vary during tide cycles.

RFI No. 24 In reference to note 10. on C-501, “When existing ground is above the bottom of the concrete cap then the existing mud line will be moved using the DYNAMIC DISPLACEMENT STONE.

Install stone per specification section 31 00 00;” Can you further explain this process? What exactly is dynamic displacement? Is trenching the mudline, placing, and compacting stone allowable?

Response: Dynamic Displacement shall consist of placing/spreading stone uniformly on the mudline in 6” thick lifts. A 6” thick stone lift shall be placed and mechanically tamped until it is pushed into the existing mud. The process will be repeated by additional 6” thick lifts to sink (shear) stone into the mud, until the ground becomes firm and more stone can be sheard into the mud. It is expected that a minimum two (2), maximum four (4) lifts can be sheared into the existing mud to provide a firm mudline.

RFI No. 25

1. It is unclear as to what specific material is required for CLIN Item No 0005, Displacement Stone Material. Please provided specification and clarity on the intended use for this item.

Response: "Dynamic displacement stone" equates to crushed stone (washed gravel graded) defined in the specifications as stone conforming to: No. 57 of the NJDOT Standard Specifications, Table 901.03-1. Crushed stone shall be placed beneath the cap base, at tieback backfill areas, at stabilized construction entrances and wheel wash pads, bedding for proposed utilities, straw bale barrier with stone overflows (if required), and at the 4’ gravel strip along the length of the bulkhead

2. Regarding Option Items 2 & 3, Excavation Transport – The disposal of contaminated non-hazardous and contaminated hazardous materials at accepting facilities is measured in tons not cubic yards. In order to meet industry standards and maintain balanced bids between contractors, we respectfully request that the unit for these option items be changed to tons.

Response: Bid item will remain in units of cubic yards.

3. The sediment sampling results, section 00903, which was provided with addendum #2, indicate sample locations which are outside the limits of this project. Please provide updated sampling information so that balanced and proper pricing can be developed by all contractors.

Response: Updated sampling will not be performed.

4. The intent of Option Item 6, Additional Materials is unclear. Please provide specific details and locations for the additional 100 LF, especially considering that the new project bulkhead will be installed between two fixed points (the existing bridge and previously installed bulkhead). Additionally, please reference which detail should be followed and if this item is to include concrete cap, tie rods & supports, and deadman sheeting.

Response: Option 0011 refers to additional king pile/sheet pile length [VLF] in cases where extra length is required (ex: rock line is not exactly where it is assumed).

5. The intent of Option Item 8, Gravel Tracking is unclear. Please provide specific dimensions & details and also identify where access 2 to staging area is on the plans, as no mention of this can be found.

Response: Gravel tracking pads are proposed for soil erosion and sediment control purposes.

Crushed stone wheel-cleaning gravel tracking pads shall be installed at all site exists using crushed angular stone to a minimum length of 50 feet and minimum depth of 6". See note 13 on C-503 and Stabilized Construction Entrance Detail on sheet C-504.

6. The typical cantilever and tieback bulkhead cap details provided on plan sheet S-501 show the pile embedment to be 6” from the top of wall elevation. This would indicate that the bottom reinforcing bars would need to be run thru the king piles and sheeting. However, these details do not show the piles or sheeting extending thru the bars, but rather show the pile to be just below the bars. Please provide clarification and a revised detail accordingly.

Response: Concrete cap ties and rebar to be located just above sheet piling/king pile.

7. The bulkhead section plans and details, sheets 24 – 27, are not only “Not to Scale” but do not show the full-length layout of the various bulkhead sections identified. In order to avoid confusion and unbalanced bids between contractors, we ask that the USACE provide complete and scaled layout plans so that all contractors can accurately develop pricing in accordance with the intended design without question.

Response: The sections are typical for the given stationing. Where needed, full plans were provided. No additional plans will be provided by structural. Full plans are provided in the civil drawing set.

8. The structural/bulkhead plans suggest creating a rock socket for all proposed steel piles (W44x262). While pre-drilling can be performed, in order to create the required rock socket, the rock must be fully removed and this can only be done by the use of a temporary casing through the overburden to the top of rock. Will the use of a temporary casing be allowed to achieve this? Rock socket can be formed by drilling/coring or by other means, and the use of temporary casing is permitted.

9. The call-out for the outfall on plan sheet C-101 at sta 0+34 says 24” pipe while the existing pipe says 15” pipe. Please clarify pipe size and type.

Response: Pipe shall be RCP. For bidding purposes, please assume 24" pipe.

RFI No. 26

1) The contract drawings and specifications mention the excavation and filling in the area with the tie backs and clarify most of that fill is the 6" of bedding and 18" of #57 stone layer above the tie backs. But based on the cross section drawings in areas 4+00 to 9+00 our count shows roughly 4,000 CY of fill material needed behind the new wall to get the proposed grades. Please clarify what material is to be used to fill in behind the wall, and under which bid item it should be included? Is the intent to use the same stone material all the way up to final permanent grade for the entire 913' of bulkhead? If so, please review and increase the quantity of bid item #0005 to account for the increased quantity.

Response: The crushed #57 stone shall be placed at tie-back bundle areas as described in "Tieback Subgrade Preparation and Backfilling" Notes on C-501. Fill material shall be certified clean imported fill. Fill material shall conform to requirements in Spec Section 02 41 00 Demolition and Section 31 00 00 Earthwork. Item to be included in Bid ITEM NO0001AB - Construction of Cap, Tie-Back & Drainage.

RFI No. 27

Per Addendum 1, the sheet piles “shall be installed to minimum tip design or shall rest on top of rock using a vibratory hammer with a minimum centrifugal force of 550 kips…” o Does this note only pertain to the sheets within the king pile wall or does it also include the deadman wall?

Response: This note is for the bulkhead sheet pile installation. However, it is advised that the same hammer be used for the deadman sheeting to facilitate easy and rapid penetration/installation.

o Please describe the end of driving criteria that will be utilized for this hammer.

Response: The end of driving criteria is that the sheet piles must be installed into the design tip elevations. If necessary, pre-drilling/pre-augering/ pre-coring must be conducted to achieve this design intent/criteria.

o Can the hammer be downsized if it causes excessive vibrations to the historic bridge structure?

Response: No, the records show the specified hammer does not cause excessive vibrations. Any downsized hammer would result in failing the sheets to penetrate into the design tip elevations.

RFI No. 28

Section 002100 states that the forms SF24, SF25, and SF25A dated 8/2016 should be utilized. The forms currently available on GSA.gov are dated 10/2023. Are the newer forms acceptable to be used? If not, please provide the correct version to be used.

Response: Please use the corresponding forms dated 10/2023 on GSA.gov.

The cover sheet of the specifications states that 002113 Instructions to bidders should be followed for bid submissions and that forms within 004500 and 007200 should be completed and submitted with the contractor’s bid. These three specification sections have not been provided.

Should the entirety of document W912DS24B0001 be submitted with the bid package? If not, which sections are required?

Response: The entire document should be submitted, acknowledge of all amendments, Representation and Certifications, Bid Bond, completed Bid schedule, Sam.gov registration and any other documents required as per solicitation and specifications.

On page G-004, there is existing sheeting laid out. Can you please provide the depth of this sheeting and whether or not it can be pulled out entirely?

Response: The design intent is to leave the existing sheeting in place and construct the new bulkhead in front of it. Reissued Civil Profile sheets C301-C302 (revised 05/09/2024) show the approximate location of the existing sheet pile; depths are assumed and not guaranteed.

On the E&S sheet G-301, there are 3 inlets in the roadway. On details sheet C-505, the requirements for inlet filters are 18" silt sock or 18" silt fence with a frame around the inlet. Would a Dandy Sack be acceptable for the roadway inlets?

Response: Any changes in Soil Erosion and Sediment Control measures shall be approved by the appropriate agency.

The top of the existing sheet pile wall at 4+00 is currently above the final grade elevation.

a. Are the sheet piles able to be cut down?

Response: Sheet piles are able to be cut down if necessary. Structural Sheets S-301 to S-304 show the following callout: "EXISTING BULKHEAD TO BE CUT DOWN BELOW TIE

ROD ELEVATION".

b. would the excavate fill be able to be used as fill between the new bulkhead and in front of the existing sheet pile wall ?

Response: The excavated fill may be used as fill between the new bulkhead and existing sheet pile wall after being tested and meeting NJDEP requirements. Soil reuse for non-hazardous soil material exceeding NJDEP Soil Cleanup Criteria must be coordinated with the NJDEP.

Refer to Specification 01 35 29.13 for procedures and requirements for soil reuse on contaminated sites.

The geotextile on table 919.01-1 calls for AASHOTO M288 class 1.

a. is this material woven or non-woven

Response: Non-woven geotextile shall be used.

b. is the geotextile under both the rip rap and #57 stone as well

Response: Yes, geotextile to be placed under riprap. Geotextile is not required under dynamic displacement stone under concrete cap.

RFI 29

Revised Bid Schedule posted with Amendment No. 2, does not include TOTALS SECTION.

Can you please provided us with a revised BID SCHEDULE?

Response: Please see the bid schedule in this amendment with the Totals section included.

RFI 30

General Note 5 on Drawing C-501 states “SOIL USED FOR BACKFILL SHALL BE ACCORDING TO THE SPECIFICATION SECTION 31 00 00”. Typical sections (CANTILEVER & TIE BACK) call for the use EXCAVATED SOILS/GRANULAR FILL, when the design grade is above the existing grade. Note 6 of the TIE BACKS SUBGRADE PREPARATION AND BACKFILL states “PLACE EXCAVATED SOIL AND IMPORT

LIGHT-WEIGHT FILL TO BRING THE SITE TO DESIGN GRADE WHEN THE DESIGN

GRADE IS ABOVE THE EXISTING GRADE (SELECT GRANULAR FILL – SEE

SPECIFICATION SECTION 31 00 00) …”. Part 2 of Section 31 00 00 does not include a specification for LIGHT-WEIGHT FILL. Can you please advise if the use of LIGHT-WEIGHT FILL is required for Construction Contract 1? If so, can you please provide us with a specification for the LIGHT-WEIGHT FILL as well as with revised typical sections?

Response: Lightweight fill shall conform to ASTM C330. Two general types of lightweight aggregates are acceptable: aggregates prepared by expanding, pelletizing, or sintering products such as blast-furnace slag, clay, diatomite, fly ash, shale, or slate; and aggregates prepared by processing natural materials, such as pumice, scoria, or tuff. The aggregates shall be composed predominately of lightweight-cellular and granular inorganic material. Lightweight aggregates shall be tested, and should not contain excessive amounts of deleterious substances; and should conform to the specified values of organic impurities, aggregate staining, aggregate loss of ignition, clay lumps and friable particles, loose bulk density, compressive strength, drying shrinkage, popouts, and resistance to freezing and thawing as specified in ASTM C330. When tested in accordance with ASTM C29, Maximum Dry Loose Bulk Density shall be maximum 50 lb/ft3.

RFI 31

Who is responsible for the permits on this project such as construction Permits, which includes environmental permits, soil erosion control permits, etc. that Newark may require?

Response. Prime contractor. Section 1.3 requires the contractor to get the permit. Also, see Clause 52.236-7 Permits and Responsibilities in SF 1442.
