AMENDMENT 2
OFFERORS' QUESTIONS AND GOVERNMENT REPLY: Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below.
These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications. By this Amendment Offerors are advised of this provision, applicable to all RFI responses.
Question 1: Solicitation indicates This acquisition is Subject to Availability of Funds. Funds are not presently available for this acquisition. No contract award will be made until appropriated funds are made available. Is there an anticipated time frame when funds will be available and approximate time frame when Notice to Proceed would be given. Any input would help with escalation and pricing.
Government Response 1: Anticipation is that award will be made July 2021 and NTP issued shortly after.
Question 2: The solicitation states that anyone attending the site visit who wishes to enter the below grade basement levels must have additional PPE, including respirators. Considering that many people who may attend the site visit may be estimators and such, and are likely not currently medically-checked and fit-tested for wearing a respirator, are there any other means to see the conditions of that space (e.g.: photographs, video, etc.) and to be able share that information with our prospective sub bidders?
Government Response 2: Please see Amendment 01 posted 25 February 2021 for instructions to request video of the basement levels.
Question 3: The solicitation includes FAR 52.225-12; however, spec section 00 00 01 item 6, as worded, appears to indicate that the Buy American Act "Does Not Apply". Please clarify.
Government Response 3: Clauses and provisions listed in the solicitation takes precedent over the spec sections.
Question 4: Item 1.4 – Progress and Completion Photos – Does this section apply to this project?
Government Response 4: The contractor will not be required to submit progress and completion photos.
Question 5: Item 1.17.1.b – Formal Partnering – Is the desire to have formal follow-on ½ day Partnering Sessions led by the initial Facilitator every 3 – 6 months throughout the duration of the project?
Government Response 5: This may be done by video conference in lieu of meeting in person given the uncertainty of travel restrictions.
Question 6: Apologies if missed, but what is the intended award and start date for the work (for purposes of pricing and developing the requested schedule)? With the project not yet formally funded, is a potential delay expected as a result, and, if so, when is it anticipated that decision / authorization will be reached (e.g.: not until FY 2022?)?
Government Response 6: The intended award date is July 2021 with NTP issued shortly after.
Question 7: The solicitation references that the Contractor shall perform work on the site, with its own organization, equivalent to at least Fifteen percent (15%) of the total amount to be performed under the contract. Must this strictly be self-performed trades work; or does project management, general conditions, general requirements, etc. count towards that requirement (e.g.: just cannot subcontract greater than 85% of the contract value)?
Government Response 7: Clause refers to 15% of on-site labor, not 15% of contract value.
Question 8: Section 002100 Evaluating Criteria 3.1.1 States that competition is unrestricted.
Does this mean anyone that meets the contract criteria can bid this?
Do we need to bid to a DBE Disabled Buisness enterprise?
Government Response 8: Yes, it means that everyone can propose on this project; unrestricted.
Question 9: 002100, 5.1.2 Relevant Past Performance indicates the Officer shall list their designer's experience in designing projects of similar scope and complexity, which have already been constructed. Part 5.2 Proposed Contract Summary Schedule indicates to include Design/Post Award Kick-Off Meeting and Design Milestone Dates. Is this project fully designed by Burns & McDonnell, if not what design requirements are required per 002100, 5.1.2 and 5.2 mentioned above? Please clarify.
Government Response 9: Yes the project is fully designed by Burns & McDonnell. Relevant past design experience as noted in 00 22 10, p 24/118, section 5.1.2, first paragraph, 3rd sentence is not required and the following text shall be removed:
"Additionally, the Offeror shall list their designer's experience in designing projects of similar scope and complexity, which have already been constructed."
In Section 5.2, p 28/118 second to last paragraph, delete text " "design milestone dates"
Question 10: Section 5.1.2 "Relevant Past Performance" indicates that submitted projects are to have been completed within the past twelve (12) years; however, the Attachment 3 form states six (6) years. Please confirm that relevant projects should have been completed within the past twelve (12) years.
Government Response 10: All the submitted projects shall be recent construction experience which means that completion should be no more than twelve (12) years preceding the date of this solicitation.
Question 11: Can the interested vendors list be activated by the Contracting Officer to view any added interested vendors to the notice?
Government Response 11: Vendor list is active. Vendor has to sign in to SAM in order to view the interested vendors list.
Question 12: Please provide a list of all Non-Government advisors who helped prepare this solicitation or who will assist in evaluating submissions.
Government Response 12: Burns and McDonnell employees:
Jason Kling Jared Kleinowski Casey Sanborn
Question 13: Volume 1 – Factor 4 – Section 5.4.1 states, "Any subcontract with an aggregate total price greater than $500,000 must be included here." This implies that we must list any subcontractors that might have a contract value over $500,000. Please consider changing the value to $5,000,000; therefore, we only have to list the major trades.
This is a best value procurement, and such restrictions will limit competition.
Government Response 13: Will be updated with amendment to $2.5 Million
Question 14: Volume 1 – Factor 4 – 5.4.3 states that the Construction Quality Control Manager must have an Architectural or Engineering Degree. Is a Construction Management, Facilities Management or similar degree also acceptable?
Government Response 14: Text to read for Construction Quality Control Manager Experience and Education:
Architecture, Engineering or Construction Management Bachelors Degree with a minimum of 7 years professional experience in the field for which proposed.
Question 15: Volume 1 – Factor 1 - Past Performance 5.1.2 says the projects submitted can be no more than 12 years. Please confirm our projects can be within 12 years.
Government Response 15: Yes, projects can be within twelve (12) years preceding the date of this solicitation.
Question 16: Regarding staffing qualifications, there appear to be some potential discrepancies between the requirements of some of the individual spec sections (see several noted below) and that of section 5.4.3 of the RFP document. Please clarify which shall take precedent where conflicts exist.
a. 01 30 00 – 1.7.2 – Superintendent – minimum of 10 years' experience in construction with at least 5 years as a superintendent on projects similar in size and complexity
b. 01 45 00.00 – 3.4.2 – CQC System Manager – required to be a graduate engineer, graduate architect, or a graduate or construction management, or must hold a state Professional Engineer's license, with a minimum of two years construction experience on construction similar to this contract, one year of which as a Quality Control Representative. (or) ...may also be a construction person with a minimum of four years in related work.
c. 01 45 00.00 – 3.4.3 – CQC Personnel – are all the relevant positions indicated required to be represented on this project any time corresponding work is taking place and, if so, must they be employed directly by the prime Contractor (as opposed to by the respective trade contractor) in addition to the CQC Manager? (This seems like a lot of additional specialized supervisory personnel which will be required on a project of this size and intermittent types of work.)
d. Is the intent for the Contractor's Project Manager to really be a licensed/registered Engineer or Architect as seemingly-indicated in 5.4.3 of the RFP?
Government Response 16: Section 00 22 10, Selection Procedures and Basis of Award, Paragraph 5.4.3 Evaluation Criteria shall take precedent and is amended as follows:
POSITION EXPERIENCE AND EDUCATION
Contractor's (Offeror's) Project Manager Architecture, Engineering or Construction Management Bachelors Degree with a minimum of 7 years professional experience in the field for which proposed.
Construction Quality Control Manager Architecture, Engineering or Construction Management Bachelors Degree with a minimum of 7 years professional experience in the field for which proposed.
Superintendent (at Watervliet) Minimum 10 years professional experience in construction with at least 5 of those years as a superintendent on projects similar in size and complexity. The individual must be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance.
Construction Site and Safety Health Officer (at Watervliet) 5 years professional experience as an on-site Safety Health Officer
Question 17: Please confirm the Base Bid scope does not include replacement of any Rectifier Equipment or Busbars, and confirm the Schedules and Notes 6, 7 & 10 on Drawing EP0601 only apply if the Bid Options to replace the rectifiers are awarded?
Government Response 17: The base bid includes removal and reinstallation of all bus bars to avoid conflict with other work. Sheet EP0601, Notes 6, 7 and 10 only apply if the associated bid options are selected.
Question 18: Please provide the manufacturer names, models, and any other product information available for the existing Rectifiers and Busbars.
Government Response 18: The rectifiers were manufactured by Rapid Power Technologies, which has since been acquired by Dynapower. Manufacturer of bus bars is unknown. Existing sizes/ratings can be found in the reference drawings.
Question 19: Please confirm whether the existing Rectifiers are located in the exact locations where the new rectifiers are shown on the drawings? If locations vary, please provide a drawing showing locations.
Government Response 19: Existing rectifier locations are in the same general locations of new rectifiers shown on the drawings.
Question 20: Previously when this project was in pre solicitation, the magnitude of the project was listed $25M - $100M. But in the current RFP the magnitude is $10M - $25M, is there a major descope we are looking at or just the magnitude was listed as an error previously.
Government Response 20: The magnitude of $10M - $25M is correct.
Question 21: Please advise on when the photos taken from the site visit on March 4th, 2021 will be uploaded to the site.
Government Response 21: The March 4th site visit photos have been posted.
Question 22: Please confirm that there are no relevant findings included in any the previous ACM inspections and surveys, including those performed by state licensed asbestos inspectors (as referenced in Appendix A Government Response 22: Correct per Appendix B of the Specifications.
Question 23: What cabinets should the requirements in spec 40 95 00 section 2.16 apply to? The IOC or the PLC/Server Switch cabinets?
Government Response 23: 2.16 covers PLC/server cabinets.
Question 24: On drawing EI0501, the displays are called out to be 65". However, in spec 40 95 00 section 2.10, the displays are called out to be 50". Please advise on the size of these displays.
Government Response 24: Displays must be 65-inch.
Question 25: Spec 40 95 00 section 2.5.4 calls for a minimum of 20% spare input and output points. However, section 2.7.1.2 calls for a minimum of 25% spare input and outputs. Please advise what spare capacity is required.
Government Response 25: Provide 25% spare inputs and outputs.
Question 26: General note 5 on EP0701 says to see reference drawings for more information. Please provide reference drawings.
Government Response 26: Government to provide.
Question 27: Keyed note 4 on the electrical power drawing EP0101 references drawings 304 thru 307 for existing bus bar routing and details, please provide these drawings.
Government Response 27: Government to provide.
Question 28: Are there any facility operation requirements that will be in place during the duration of the project?
Government Response 28: Facility will remain in production. Communication is important. including daily meetings prior to starting that days activities (01 14 00 - 1.35.9.i)
Question 29: On the equipment schedules, there are no preferred manufacturers listed or a basis of design. Are there any preferred manufacturers or model numbers for the equipment so contractors are bidding the same products to remain competitive?
Government Response 29: No preferred manufacturers or BOD are provided.
Question 30: There does not appear to be any tank specification section. Is there a tank specification that can be provided?
Government Response 30: Steel Tank details are on drawings with submittal and NDI requirements. See future amendment for specification.
Question 31: Specification section 067301 calls for two different types of FRP gratings, 2.2.1 Molded FRP Grating and 2.2.2 Pultruded Glass-Fiber-Reinforced Gratings. Is there a preference for which grating should be basis of design, or can either one be submitted on?
Government Response 31: Both gratings are intended to be used. Molded is to be located at equipment locations;
top level, and stair tread panels, lower level trench cover. where design requires 1 ½" thick or as required by design, Pultruded is intended to be used at stair landing and center catwalk. 1" thick.
Question 32 The steel specification calls for AISC certified fabricators and erectors. Can this requirement that can be waived?
Government Response 32: Agreed. this will be removed. See future amendment.
Question 33: Note 3 and 4 on the structural drawings calls for all paint and coatings to be removed and replaced from the existing steel framing, connections, rails, plates, etc. Are there as-builts of the existing structure for what needs to be cleaned and re-coated? The current state of these documents does not provide enough information to accurately price this scope item.
Government Response 33: All steel in the plating shop, including at the operating floor, shall be cleaned and coated. Government to provide the as-built documents via beta.sam.gov, under the attachment section on 18 March 2021.
Question 34: The Gov. indicates PVDF for Chrome tank liner. A PVDF liner of this size would require special engineering to be fabricated and would run four to five times the costs more expensive. Would the Gov. accept a Koroseal liner with a skirt in lieu of PVDF?
Government Response 34: PVDF liners in accordance with spec section 43 41 19 are required. Liners are to be bonded to tanks and not drop in style.
Question 35: Keynote 4 on S-0131 calls to review wall for leaks. What is the testing method for this scope item?
Government Response 35: Expectation is only a visual
Question 36: Please provide a specification requirement for the jib cranes referenced on S-0505.
Government Response 36: Jib crane specifications and requirements are provided on the drawings.
Question 37: Drawings call for the replacement of trench frames if corroded (Note 5 Structural Drawings), are there any locations where this is known to have occurred?
Government Response 37: No locations that we are aware of. If found Government should be notified and solution reviewed and approved.
Question 38: Please advise if the scrubber shall be fabricated from PVC or fiberglass. Additionally, please confirm that all ductwork for the project shall be fabricated from fiberglass. Would PVC ductwork with an FRP overlay be acceptable?
Government Response 38: All Ductwork will be fiberglass fabrication. Per the specification (44 10 00 - 2.10.2.1) allows either: "The scrubber housing and sump shall be manufactured of minimum 1/2-inch thick PVC or fiber-reinforced plastic (FRP) designed with UV resistance for outdoor mounting and operation. If constructed of PVC, the shell upstream of Stage 1 shall be lined or constructed of a material resistant to corrosion in the presence of chromic acid such as PVDF."
Question 39: Solicitation Page 23, 5.1 Volume 1 - Factor 1 - Past Performance states that "Contractor Performance Assessment Reporting System (CPARS) shall be submitted for projects, when available." Please confirm if this means the Offeror can submit a CPARS evaluation "in lieu of" a Past Performance Questionnaire (PPQ), or if it means "in addition to" the submission of a PPQ. We respectfully request that USACE allow for the submission of CPARS (or previously completed PPQs) "in lieu of" newly completed PPQs as it has been our experience in the past that if an official CPARS evaluation exists, the Government client will not complete any additional past performance information, since the CPARS evaluation is an official assessment of the project. Furthermore, several of our main project POCs have since retired, or moved on to other facilities/entities, so acquiring newly completed PPQs from some of these contacts has not always been successful.
Government Response 39: CPARS evaluation may be in lieu of PPQ.
Question 40: Volume 1 - Factor 2 - Proposed Contract Duration, Phasing, and Summary Schedule has a page limitation of 15 pages. As this Factor essentially asks for schedules and phasing narrative, please confirm whether or not the schedule counts towards the 15 page limitation. If it does, we respectfully request that the page limitation for this Factor be increased to 25 pages.
Government Response 40: Schedules may be in addition to the 15 page limitation.
Question 41: Volume 1 - Factor 3 - Technical Approach has a page limitation of 10 pages. As this Factor asks for very detailed narrative, we respectfully request that the page limitation be increased to 25 pages.
Government Response 41: Page limitation of 10 pages shall remain.
Question 42: Volume 1 - Factor 4 - Organizational Approach has a page limitation of 10 pages. As this Factor asks for very detailed narrative, organizational charts, and resumes (which account for 4 of those pages), we respectfully request that the page limitation be increased to 25 pages.
Government Response 42: Organizational approach page limitation remains 10 pages.
Question 43: When optioning out the rectifiers in the "Options" section of the bid submittal, are we to add the costs associated with the potential additional bussing needed as part of the rectifier cost? Essentially where do we capture that bussing cost this is a potential need?
Government Response 43: As part of each bid option, reinstall existing busbars still required, dispose of busbars no longer required and provide additional busbars required based on the new rectifier amp ratings and termination locations.
Question 44: Rectifier 208 and 308 show bussing as N/A – what does this mean? Are these spares, please clarify.
Government Response 44: Busbars are not required for RE-208 and RE-308. Govt uses existing cables to connect these to tanks.
Question 45: What is the significance of phase 0 in the order of construction? Does it mean that by following Phase 1 , 2 and 3 - the final result/ state of the facility will/shall be what is indicated in Phase 0? i.e. Phase 0 is the state after phase 3 of construction is done. Please clarify.
Government Response 45: The assumption is correct. Following Phases 1, 2 and 3; Phase 0 will be the final result.
