About this file

This solicitation seeks proposals for maintenance dredging of the Hudson River Federal Navigation Project in Kingston and Germantown, New York. The U.S. Army Corps of Engineers requires the removal of approximately 130,000 cubic yards of sediment from two reaches of the channel to a depth of 32 feet below mean low water plus one foot of overdepth. Dredged material will be transported via hopper dredge or mechanical dredge to an upland placement site on Houghtaling Island for disposal. The contractor will be responsible for preparing the placement site prior to operations. Work must be completed between September 1 and December 31, with the Kingston portion ending by November 30 due to environmental restrictions. The contract has a value between $5-10 million and will be awarded on August 1 with a notice to proceed on August 15. Liquidated damages are $1,271.70 per day for delays in completion. Proposals were due on July 3 for this unrestricted procurement conducted by the Army Corps of Engineers, New York District.

N OTES TO BIDDERS

NOTE 1: Bidders must bid on all items. Failure to bid on all work will be cause for rejection of the bid as nonresponsive.

NOTE 2: Award of contract will be based on the responsible and responsive bidder with the lowest total price for the total of the CLINs 0001-0004.

NOTE 3: The unit price for CLIN 0002, is directly related to the estimated quantities of dredged material available for removal, except ledge rock, lying above the plane of 32 feet below COE MLW plus 1-foot allowable in the contract areas of Kingston and Germantown, Hudson River, New York, Federal Navigation Channel. The dredged material must subsequently be transported, and placed at the Houghtaling Island Dredge Material Place Site

(DMPS).

NOTE 3: The areas to be dredged contain NYS DEC Class B PCP contaminated dredge material, as indicated in the plans and specifications, and must be dredged, transported, and placed at the Houghtaling Island DMPS prior to the dredging and placement of non-contaminated Class A dredge materials.

NOTE 4: All bidders are hereby advised that the estimated dredge quantities for placement in the price schedule are estimated and based on the survey data collected between September and November 2019.

NOTE 5: The Government may reject a bid as non–responsive if the prices bid are materially unbalanced between line items and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low bid.

NOTE 6: Bidders are reminded that they must bid on the issued plans and specifications as amended. Any deviations, conditions or attachments made by the bidder himself may render the proposal non-responsive and may be cause for its rejection.

BIDDER’S QUESTIONS AND GOVERNMENT REPLY

(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s).

Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)

Question No. 1: Regarding the “Maintenance Dredging, Hudson River, NY, Federal Navigation Project; Kingston and Germantown Dredge Areas” solicitation, it is noted that there is only one dredging bid item (no. 0002) that covers both of the dredge areas. Due to the great difference in haul distances to the disposal site, the cost of dredging these separate areas are vastly different. Given this, and that the surveys included in the bid documents are from 2019, providing a single, blended cubic yard unit price poses an unacceptable risk to the contractor. We respectfully request that the USACE break the dredging bid item into two bids items, one for Germantown and one for Kinston.

Response: Upon review, USACE has determined that the requested change to the Bid Schedule, described above, is reasonable. The Bid Schedule will now show two (2) separate bid items for “Dredging Work”: CLIN 0002 (Kingston Dredging Work: (32' COE MLW + 1' OD)), and CLIN 0003 (Germantown Dredging Work: (32' COE MLW + 1' OD)) with solicitation Amendment No. 0003.

Question No. 2: Regarding the “Maintenance Dredging, Hudson River, NY, Federal Navigation Project; Kingston and Germantown Dredge Areas” solicitation, Section 01 20 00, page 4, paragraph 6. Clamshell Bucket states; “If a mechanical dredge is necessary, the dredges clamshell bucket shall be a closed environmental bucket.” However, the NY State WQC Permit, page 3, paragraph 9. Equipment Operation states; “Dredging shall be done hydraulically using a hopper dredge.” Given that the contractor is required to comply with all conditions of the Water Quality Certification (Section 00 09 02, page 1, paragraph

3.1.1 Water Quality Certificate), please confirm that only hopper dredges are permitted to perform the dredging for this contract under this permit.

Response: USACE confirms that ONLY hopper dredges are permitted to perform the dredging for this contract under permit. Section 01 20 00 is revised with Amendment No.

0003, deleting paragraph 6 – Clamshell Bucket.

Question No. 3: Is July 2019 the date of survey for the information provided on Sheet P- 103?

Response: The survey data shown on Sheet P-103 was collected on 1/9/1019, and 4/10/2019-4/12/2019.

Question No. 4: Is January 2020 the date of survey for the information provided on Sheet P-104?

Response: The survey data shown on Sheet P-104 was collected on 1/16/2020.

Question No. 5: Is there a more recent survey of areas B1, B2, and B3 than the information provided on Sheet P-103?

Response: The survey of areas B1, B2, and B3 provided on Sheet P-103 is the most recent information USACE possesses for said areas.

Question No. 6: Note two on Sheet P-112 states that the minimum top width of all containment dikes shall be 15 feet, and a maximum height of +50. Is this requirement only for A4 and B1? Or is this for A4, A3, A2, B1, B2, B3?

Response: As stated in note two (2) of the Dike Section Notes found on Sheet P-112:

“Minimum top width of all containment area dikes shall be 15 feet. Maximum height of all containment area dikes shall be elevation 50 feet NAVD88.” This requirement applies for all of the containment dikes, A2-A4 and B1-B3.

Question No. 7: Can you please sketch out on the disposal area drawings the areas that will require turfing / seeding at project completion?

Response: As stated in in Section 01 20 00, Paragraph 7.19.2: “The Contractor shall establish a permanent turf on the following areas: the top, exterior and interior slopes of the retaining dikes; the fill area from the interior toe of the dike to ten (10) feet out from the toe; ingress and egress corridors (except included areas delineated as wetlands); and all other areas on or outside the dike disturbed by the Contractor’s operations.”

USACE cannot sketch-out, on the disposal area drawings, the specific areas that will require turfing/seeding, as the exact areas can only be determined based on the Contractor’s site preparation and on areas disturbed through the course of placement activities.

Question No. 8: Section 01 20 00 Clause 3.2 states to review the complete report of sediment analyses to contact the Albany Field Office. Please make this report available on BetaSam.

Response: The complete reports of sediment analyses (IFB# 20B0012_Amendment No 0003_ASI_39-062 Report 082819_Full Report.pdf; IFB# 20B0012_Amendment No 0003_Hudson_K1903974_Full Report.pdf) will be made available on BetaSAM with solicitation Amendment No. 0003.

BE ADVISED: The complete reports contain data for the Kingston and Germantown dredging areas, as well as data for the Albany Turning Basin. The Albany Turning Basin is not scheduled for dredging in this contract, and all data pertaining to it should be disregarded.

Question No. 9: Are there any sieve curves that are available from the grain size analyses that were performed per Section 01 20 00 Clause 3.1? Please make those available on Betasam. This information is critical to estimating production rates.

Response: Particle Size Distribution Reports, and all other available gradation data available to USACE, can be found in the complete reports of sediment analysis provided on BetaSAM with solicitation Amendment No. 0003 (See IFB# 20B0012_Amendment No 0003_ASI_39-062 Report 082819_Full Report.pdf; Page 87; Appendix E, Percent Moisture and Grain Size Distribution Raw Data and Graphs).

Question No. 10: Water Quality Certificate item nine states the dredging shall be done with a hopper dredge. Dredging Section 35, 20 23-1.1.1 states as required within the Water Quality Certificate a clamshell environmental dredge shall be used. Please clarify immediately which type of dredge is permitted to work on this project.

Response: USACE confirms that ONLY hopper dredges are permitted to perform the dredging for this contract under permit. Section 35 20 23-1.1.1 is revised with Amendment No. 0003.

Question No. 11: Is the B.1 “Expansion Area” available to use as a fill site.

Response: The B.1 expansion area is available to use as a fill site for all Class B material dredged.

Question No. 12: Please provide a drawing that clearly shows the limits of the A-4, A-3, A-2 available fill areas, as well as the limits of the B-1, B-2, and B-3 available fill areas.

Response: USACE does not possess, and has no plans on creating, additional drawings of Houghtaling Island showing the limits of the A2-4 and B1-3 available fill areas. The centerline coordinates found on Drawing P-103 accurately reflect the centerline at the top of each dike segment, to the best of USACE’s knowledge, and may be used to determine the limits of each containment cell.

Question No. 13: Dredging section 35 20 23 clause 1.3 Material to be removed states that complete testing and sampling results are attached on beta.Sam.Gov. We have not found a separate attachment for this information.

Response: The complete testing and sampling results are available as of Amendment No. 0003.

Question No. 14: How much quantity is the Corps anticipating going into the “B” Areas within Houghtaling Island? Our initial review is that it is potentially half the quantity and well beyond what this small disposal area has previously seen.

Response: USACE anticipates that a quarter to a half of the dredge material is to be placed in Area B. USACE calculates that cell B1 currently has a capacity of approx.

119,500 CY, the connected B1 Expansion has a capacity of approx. 112,800 CY, cell B2 has a capacity of approx. 292,260 CY, and cell B3 has a capacity of approx. 73,255 CY.

Question No.15: To confirm, contractor is required to start dredging in Kingston to assure completion prior to the November 30, 2020 window closure. Additionally Kingston and Germantown “B” areas are to be dredged prior to Kingston “A” areas.

Response: Upon review of the Water Quality Certification, Section 01 20 00, and Paragraph 2 – ORDER OF WORK AND START OF DREDGING WORK is now revised to reflect NYS DEC requirements. As of Amendment 0003, Section 01 20 00 – Paragraph 2 will now state the following:

“The Contractor shall start in-water dredging at the Germantown dredge area, from sample Loc #9 and hallway to sample Loc #10, as specified in the NYS DEC Water Quality Certification. The dredged material from said sample locations in the Germantown reach will be dredged and placed first. All B subareas, specified herein and on the contract plans, shall then be completely dredged first, placed in Area B at the Houghtaling Island placement site, and accepted by the government before the contractor commences dredging elsewhere in the dredging area.”

All class B dredge material will be dredged first, starting at the above Germantown location sited in the Water Quality Certification. Once all B subareas are dredged and accepted as complete by USACE, the A subareas may be dredged and placed at Houghtaling Island.

BE ADVISED: While USACE will not require that the Kingston dredge area be completed prior to Germantown, the abbreviated environmental window for the Kingston dredge area, with no in-water work permitted after 30 November 2020, still applies.

Question No.16: Regarding the “Maintenance Dredging, Hudson River, NY, Federal Navigation Project; Kingston and Germantown Dredge Areas” solicitation, Section 35 20 23, page 2, paragraph 1.6 OVERDEPTH DREDGING states “material actually removed to a depth of two (2) feet below the depth specified and within the dredging limits will be measured and paid for at full contract price. This conflicts with the one (1) foot of overdepth shown on drawing sheet 12 of 12. Please confirm the correct overdepth to be used for this contract.

Response: The correct overdepth to be used in the contract is one (1) foot. Section 35 20 23, page 2, paragraph 1.6 is revised with Amendment No. 0003.

Question No. 17: Regarding the “Maintenance Dredging, Hudson River, NY, Federal Navigation Project; Kingston and Germantown Dredge Areas” solicitation, Section 01 20 00, page 3, paragraph 2. (Order of Work and Start of Dredging Work) states; “All B subareas, specified herein and on the contract plans, shall be completely dredged first, placed in Area B at the Houghtaling Island placement site, and accepted by the government before the contractor commences dredging elsewhere in the dredging areas.”

As there are B subareas in both the Kingston and Germantown dredge areas, is the contractor to dredge all of the B subareas at both locations prior to dredging in any of the A subareas? If so, to guarantee that Kingston is completed within the environmental window, would the correct order of work be all B subareas at both locations, then the A subareas at Kingston, followed by the A subareas at Germantown?

Response: See response to Question No. 15.

Question No. 18: Regarding the “Maintenance Dredging, Hudson River, NY, Federal Navigation Project; Kingston and Germantown Dredge Areas” solicitation, Section 01 20 00, page 3, paragraph 2. (Order of Work and Start of Dredging Work) states; “The Contractor shall start in-water dredging at the Kingston dredge area, in order to guarantee that work is completed within the environmental window.” The NY State Water Quality Certification (page 3 of 8, paragraph 16) states; “The dredged material from sample Loc #9 and halfway to sample Loc #10 in the Germantown reach will be dredged and placed first, and then covered by the cleaner materials dredged at each site.”

Given that the contractor is required to comply with all conditions of the Water Quality Certification (Section 00 09 02, page 1, paragraph 3.1.1 Water Quality Certificate), please clarify this discrepancy.

Response: See response to Question No. 15.
