RFI SET #1:

Question #1: Section 01 11 00, Paragraph 1.1.a. states: “The Contractor shall be required to (i) commence work under this contract within five (5) calendar days after the date the Contractor receives the Notice to Proceed”.

The SF 1442 states: “The Contractor shall begin performance within 10 calendar days and complete within 120 calendar days after receiving NTP”.

a. Can the Owner please clarify the commencement requirement?

Answer #1: (Revised SF 30.)

Question #2: Section 01 11 00, Paragraph 1.3 states: “This project is estimated between $15,000,000 and $35,000,000.” Further, the SF 1442 shows a Project Magnitude Range of $25,000,000 to $30,000,000.

a. Can the Owner please clarify the project magnitude?

Answer #2: (Revised SF 30 and Section 01 11 00)

Question #3: Can the Owner please provide Plan Sheets for Line Items 0004 and 0005?

Answer #3: Yes, sheet C-112 was added. See file In FBO with this amendment.

Question #4: Can the Owner please provide Cross Sections and current XYZ data for the Borrow Areas?

Answer #4: Yes, xyz data is available. See file In FBO with this amendment.

Question #5: Page 13 of Section 01 50 00 contains the following bullet point for Government Field Office Requirements:

• “Provide 2 vehicles with 4-wheel drive, less than 3 years old (minimum 6 passengers) for

Government's use. Maintenance of the vehicles including all fuel, State inspections, and required insurance shall be the Contractor's responsibility.”

Further, page 14 contains the following bullet point for the same section:

• “The Contractor shall also supply 2 vehicles with gas cards sufficient to cover the duration of the project for Government's official use. These vehicles shall be a utility vehicle type, seven passenger with 4-wheel drive not more than 3 years old. Insurance, registration, and fuel and maintenance of the vehicle including State Inspections shall be the contractor's responsibility.”

a. Will the Contractor be required to provide 2 vehicles or 4 vehicles for the Government?

Answer #5: Two vehicles.

Question #6: Section 01 45 00, Paragraph 3.4.1 states the requirements for the CQC organization to include a Safety and Health Manager. Can this Safety and Health Manager have other roles such as SSHO or Quality Control Manager?

Answer #6: No, Safety and Health Manager cannot have other roles.

Question #7: Is the Contractor allowed to perform its own Grain Size Analysis, as discussed in Paragraph 1.6.m. in Section 31 24 00?

Answer #7: Yes. Added language to 31 24 00 for core analysis: "Core Analysis. Sieving will be done using recently calibrated sieves, with sieve graduations at half phi intervals on the Wentworth scale. Sieving will include a quality control program for repeat sieving of one standard sample during the core analysis study. Tabulated results will report median size in millimeters as well as phi units. Results of the sieving will be plotted as grain size distribution and the mean, median, and standard deviation computed for each sample collected."

Question #8: Can the Government confirm that any bird nesting surveys (i.e. for Piping Plover or Roseate Tern) will be provided at the expense of the Government?

Answer #8: Yes, beginning on 15 March 2020 and continuing through the breeding season (15 August) or the date of the last fledging, a Corps’ biologist(s) or designated representative(s) shall survey and monitor the action area and identify plover territorial, courtship and nesting areas. The USACE will also provide the Contractor any survey data obtained from NJDEP/NJFWS.

Question #9: Can the Government confirm that the Contractor is only required to provide a UXO Technician on the beach, and if a UXO Technician is required on the dredge, an equitable adjustment in pricing will be made?

Answer #9: Yes.

Question #10: According to the Solicitation, all work must be completed 120 days after NTP, which coincides with the required completion date of March 1, 2020. The Solicitation also states that additional time will be considered for any options that are exercised.

a. For planning purposes, can the Owner please provide an amount of days allowed for each option, so that the Contractor can plan accordingly?

b. Because the 120 day allotment ends on or around March 1, 2020, it appears that should any options be awarded, the Contractor should receive more days which would push them past the March 1, 2020 deadline. How does the Government plan on allowing Contractors to work the optional reaches if they are past the March 1, 2020 deadline?

Answer #10: The government may exercise options within 150 day of NTP. If options are exercised within 60 days of notice to proceed (NTP), the Contractor shall be required to complete the entire base and options work exercised by March 1, 2020. If options are exercised after 60 days of NTP, the Contractor shall be required to complete the option work that is exercised (post 60 days of NTP) no later than March 1, 2021. All option work, if exercised, must be complete by March 1, 2021. Optional CLIN for mobilization/ demobilization may be exercised if option work exercised exceeds the March 1, 2020 restriction. The USACE will coordinate with the contractor to maximize the placement area next to adjacent base sections.

Question: #11: According to the Solicitation, all work must be completed by March 1, 2020, due to environmental restrictions. What are the environmental restrictions?

Answer #11: No work beyond March 1st is per the USFWS Programmatic Biological Opinion and subsequent USACE coordination with USFWS for the protection of piping plovers under Section 7 of the Endangered Species Act.

Question: #12: Previous Contracts in the same vicinity have occurred year round. Would the Government consider removing the March 1st restriction and allow Contractor to implement endangered species surveyors/biologists if necessary?

Answer #12: USACE is currently coordinating with USFWS and maintaining compliance with the USFWS Programmatic Biological Opinion.

Question: #13: Would the Owner please consider allowing Contractors 365 days to complete the Work in lieu of the 120 days?

a. If 365 days is not considered, would the Owner please consider allowing Contractors to start after March 1st, 2020?

Answer #13:The government may exercise options within 150 day of NTP.

RFI SET #2:

Question #1: We have noted the presence of an environmental window in the specifications, restricting work after March 1st. historically, dredging and beach fill has been performed in this area outside of this window. In addition, this puts a significant restraint on the ability of the government to award options, based on this schedule.

Please confirm that the environmental window will apply to this project.

Answer #1: Yes, environmental window will apply to this project.

Question #2: Please clarify the number of additional days allowed for options, should they be awarded.

Answer #2: The government may exercise options within 150 day of NTP.

Question #3: The referenced specification states that working hours for dredging are 24 hours per day, 7 days per week; however, it also states that local government approval is required to ensure compliance with local ordinances and local boards. Please confirm that dredging and beach fill operations will not be limited to reduced hours based on any local ordinances.
