2. Low bidder for the purpose of award will be the conforming responsible bidder offering the lowest amount for the Total Bid Items.
3. Any bid which is materially unbalanced as to prices for the bid items may be rejected. An unbalanced bid is one which is based on prices significantly less than cost for some work, and prices which are significantly overstated for other work.
4. Bidders are reminded that they must bid on the issued plans and specifications as amended.
Any deviations, conditions, or attachments made by the bidders thereto may render the bid non-responsive and may be cause for its rejection.
5. If awarded, the options would be exercised as follows:

QUESTIONS AND ANSWERS
(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.).
1. With regard to the Displacement Stone that is shown in the Typical Sections and referenced in General Note #10 on Sheet C-501, please clarify the following:
a. Please define the terms that are used in General Note #10 so that the Bidders completely understand the process of using the Dynamic Displacement Stone. For example, does the process simply involve the dumping of crushed stone into the water allowing the weight of the crushed stone to displace the River Sediments, or is there a different process that is intended? Please clarify.
Answer: Please refer to Specification 31 00 00 3.51 Dynamic Displacement.
b. Please clarify the intended minimum depth and minimum width of the Displacement Stone because the Typical Sections do not provide this information.
Answer: Please refer to Specification 31 00 00 3.51 Dynamic Displacement.
c. Please clarify how the Contractor will be compensated if the volume and tonnage of the Displacement Stone greatly exceeds the minimum expected volume and tonnage of the Displacement Stone.
Answer: Optional item has been added to address this to provide a contingency of additional 100 CY of dynamic displacement stone. In addition, please see clause 52.211-8.
d. Please clarify` why the NJDEP Permit in Section 00901 expects the project to require 900 Cubic Yards of Dredging River Sediments when the use of the Displacement Stone does not involve any Dredging of the River Sediments.
Answer: It is not expected that there will be dredging of river sediment. Should be considered contractor means and methods.
The permits were issued in the early 2000’s they are valid for the current phase of the project but also covered past phases of the project. It is not expected that there will be sediment removal of this magnitude.
2. With regard to the Typical Grading/Bulkhead Sections on Sheet C-501, please clarify the following:
a. The titles of both Typical Sections are confusing, which makes it difficult to interpret the intent of these Typical Sections. Please clarify what it means by the phrase “Grading - Sediments Not in Excavation”.
Answer: The Typical Cantilever Section is for Sta. 13+50 to Sta. 14+50 and Sta. 16+20 to Sta.
16+80. And the Typical Section is for all other stationing (Sta. 9+05 to Sta. 13+50, Sta. 14+50 to Sta. 16+20, and Sta. 16+80 to Sta. 20+03) where tiebacks are to be installed.
“Grading sediments not in excavation” means no dredging or excavation will take place on the river side.
b. The Typical Grading Sections on Sheet C-501 do not show any topsoil layer being placed above the Select Granular Material. Please clarify whether or not the Seeding shall be applied directly to the upper surface of the Select Granular Material, or if a Topsoil Layer is to applied over the upper surface of the Select Granular Material.
Answer: Satisfactory material shall be placed over Select Granular Material to restore the area behind the bulkhead construction to the grade shown on the site plan drawings. No seeding and sodding will be required, other than any specific requirements for soil stabilization with respect to the soil conservation district permit compliance. Item No 0006 is provided to develop a Landscape and seeding plan (refer to Section 32 92 19 Seeding), and Optional Item 4 is provided for the implementation of Landscape and seeding plan.
c. If a Topsoil Layer is to be applied to the upper surface of the Select Granular Material, then please revise the Typical Grading Sections on Sheet C-501 to include this missing information in order to properly represent the project requirements.
Answer: Refer to response for 2b.
d. The Typical Grading Sections show a Hatched area above the top surfaced of the Granular Fill and the Legend on Sheet C-501 defines the Hatched Area as the Limits of Displaced Material. With regard to the Displaced Material, please clarify the following:
i. Please provided a Definition of the Displaced Material.
ii. The Typical Sections imply that the Displaced Material will be surplus soil. Please clarify what the Contractor is to do with the Displaced Material.
iii. Is the Contractor required to dispose of the surplus Displaced Material off-site or stockpile the Displaced Material at the site?
iv. If the Displaced Material is surplus soil that is to be sampled, tested and disposed offsite then please add a New Bid Item to the Bid Proposal for the Off-Site Disposal of this “potentially” contaminated material, since it is clear from a review of the Preliminary Site Assessment Report that there were prior industrial uses all along the waterfront at this site.
Answer: The hatched area detailed on Sheet C-501 is Excavation. The contractor is referred to section 31 23 00.00 20 Part 3 Execution 3.1 Excavation for information concerning this item.
Option Item 2 is provided to address the per unit cost of Excavating, Transport, Treatment and Off-Site Disposal of Upland Material Exceeding NJDEP Non-Residential Soil Cleanup Criteria and classified as Contaminated Non-Hazardous (ID 27 Waste) not suitable for landfill cover.
Option Item 3 is provided to address the per unit cost of Excavating, Transport, Treatment and Off-Site Disposal of Upland Material Exceeding NJDEP Non-Residential Soil Cleanup Criteria and classified as Contaminated Hazardous or material not suitable for landfill cover.
Note that all material is to be tested and disposed of at an appropriate facility. Soil meeting nonresidential direct contact criteria may be used as backfill (must cap).
3. With regard to the Tieback Subgrade Preparation and Backfilling Notes on Sheet C-501, please clarify the following:
a. It is not clear from reading these Notes whether or not the subgrade preparation work is localized and performed just in the immediate subgrade area under each Tieback, or if the entire subgrade area between the new Bulkhead and the Deadman Wall and for the full length of the new Bulkhead is be prepared in accordance with these notes. Please clarify.
Answer: Contractor means and methods. Suggested work is to prepare the entire subgrade area between the new bulkhead and the deadman for the full length of the new bulkhead (tie back spacing is only 4’-7”).
b. If the Tieback Subgrade Preparation Notes only apply to the immediate area underneath each Tieback, then please provide a Typical Cross Section through a Typical Tieback to show the typical minimum width of the localized area under each Tieback that is to be prepared in accordance with these Notes. Please clarify.
Answer: Contractor means and methods. Suggested work is to Prepare the entire subgrade area between the new bulkhead and the deadman for the full length of the new bulkhead (tie back spacing is only 4’-7”).
4. Please clarify the purpose of providing Structural Steel Note #5 on Sheet S-001 for this Design-Bid-Build Project because the Contractor is not responsible for designing any bolted connections for which the AISC Allowable Bolt Loads would be otherwise necessary.
Answer: Waler splice design is to be completed by the contractor and submitted to the EOR for approval. The AISC Standard is provided for information only.
5. Structural Steel Note #7 on Sheet S-001 requires the Waler Channels to be spliced to develop their full shear capacity. Please provide a Typical Detail of the required type of Waler Splice that will satisfy this structural requirement so that the Bidders can include the cost of this Splice Detail in their bid proposals.
Answer: See response to question 04
6. With regard to the Typical Bulkhead Details on Sheet S-501, please clarify the following:
a. What is the depth and extent of the Select Granular Material that identified in the Typical Bulkhead Details. Is it 12” Minimum as per the Grading Details on Sheet C-501? If so, please cross-reference the notes on the two drawings to make this better understood.
Answer: The typical Bulkhead Detail is in C-501, not S-501.
b. Please confirm whether or not the Select Granular Material must be imported to the site from an off-site source.
Answer: Yes, will need to be brought in unless excavated material meets above criteria for use as backfill (with cap).
c. The Typical Bulkhead Details do not show any topsoil layer being placed above the Select Granular Material. Please clarify whether or not the Seeding shall be applied directly to the upper surface of the Select Granular Material, or if a Topsoil Layer is to applied over the upper surface of the Select Granular Material.
Answer: See Response 2b: Satisfactory fill material shall be placed over Select Granular Material to bring the site to grade.
d. If a Topsoil Layer is to be applied on top of the Select Granular Material, then please revise the Typical Bulkhead Details on Sheet S-501 to include this missing information in order to properly represent the project requirements.
Answer See Response 2b.
7. With regard to the Typical Tie Rod Details on Sheet S-501, please clarify the following:
a. Please provide the minimum diameter of the Corrugated Sheathing.
Answer: Contractor to provide a diameter adequate to fit rod couplers with 1” grout all-around or 4” minimum.
b. The Tie Rod Details do not indicate the type of threaded ends that are to be provided for the Tie Rods in order to satisfy the requirements of Tie Rod Note #2 on Sheet S-001, which requires the Couplers and Turnbuckles to develop 100% of the Ultimate Strength of the Tie Rod.
For example, are the Tie Rods to be provided with Threaded Upset Ends that prevent the Tie Rods from being weakened from threads that are cut into the ends of the Tie-Rods. Please clarify this important cost factor for the pricing of the Tie Rods.
Answer: Tie rods are Grade 75 ksi all-thread rebar by Williams or approved equal, up-turned threads are not required. Reference Williams for further information.
8. Sheet Piling Note # 5 on Sheet S-001 requires a minimum spacing of 37 feet between the Bulkhead and the Dead-man Sheeting. Please clarify how the Contractor is to maintain this minimum distance where there are obstructions that cannot be removed such as existing structures that are to be protected.
Answers: Refer to Specification 31 00 00, Section 3.6.3. Any obstacle will need to be removed and backfilled as specified.
9. Please confirm if there are any M/WBE requirements for this project, and if so what are the requirements.
Answers: There is no M/WBE requirements for this project. This is a full and open solicitation
10. Drawing S-503, includes the “Sheeting Connection Detail @ Sta 13+84” detail which indicates AZ Sheeting perpendicular to the proposed bulkhead on either side of the existing gate chamber. Please confirm the following:
a. If this sheeting and concrete cap is existing or is to be designed and installed as part of this contract?
Answer: The contractor shall field verify existing sheeting as per note #1 of construction plan sheet S-503 and make a determination of what will be designed and installed as part of the contract as per Notes #1, 2 and 5 of for Sheet 6 of 37 of (Sheet C-101).
b. If the AZ Sheeting is required to be installed under this contract, what is the plan length of this sheeting along the gate chamber?
Answer: Refer to Construction Plans Sheet 25 of 37 (Sheet S-503) Note #1 and Notes #1, 2 and 5 of for Sheet 6 of 37 of (Sheet C-101)
c. If the AZ Sheeting is required to be installed under this contract, what is the termination detail for the AZ sheeting and concrete cap at the backside of the existing gate chamber?
Answer: Refer to Construction Plans Sheet 25 of 37 (Sheet S-503) Note #1 and Notes #1, 2 and 5 of for Sheet 6 of 37 of (Sheet C-101)
11. Spec section 39 "historic, archeological and cultural resources" describes a treatment plan with methods of work to existing structures. However, this work is not indicated on the plans.
Please clarify if the treatment plan methods indicated by section 39 are to be included with this bid.
Answer: Yes, the documentation, development of the treatment plan and the implementation of the treatment plan is part of this contract as Item No 0005.
12. The Government’s response to Bidders Question #1 that was provided in Addendum #2 is not reasonable, appropriate or satisfactory because the Contractor is being asked to perform a task that is impossible to perform. We are specifically referring to two parts of the Government’s Response: 1) the statement that the Contractor shall make his own judgement as to the depth of rock even though no subsurface information is provided by the Government between STA 14+00 and STA 20+00; and 2) that the Contractor shall conduct additional investigations as noted in the design set. It is the Government’s responsibility to collect and provide representative subsurface information for three important reasons: 1) the Bidders are in no position to collect this data; 2) the Government needs this information to design the project and estimate the value of the work; and 3) the Government needs this information for bidding purposes. In this instance the Government has failed to fulfill this fundamental responsibility and the Government cannot pass this Subsurface Risk/Responsibility onto the Contractor.
Therefore, in the forthcoming Addendum please provide the Bidders with the Basis of the Bulkhead Design and the Full Geotechnical Report that was used for the design of this project so that the Bidders are provided with this essential bidding information in order to determine the cost of constructing the New Bulkhead.
Answer: The geotechnical information along with the borehole logs were included in the bid package. The contractor is advised to review and make his/her own judgement during this contracting process.
13. The Government’s response to Bidders Question #3 makes reference to an Appendix 12 in Section 2.6 of a Design Documentation Report so that the Bidders can research the depth of rock in order to determine the cost of the Rock Sockets for the King Piles. Yet, the Bidders were not provided the referenced Design Documentation Report with the set of Bid Documents.
Therefore, please provide the full Design Documentation Report to the Bidders in the forthcoming Addendum so that the Bidders are able to perform this research.
A –The boring logs are also part of the Plan set.
14.. Bid Proposal Item #0002 is for the cost of Ladders at locations in Contracts #1 , 2 & 4A;
and, Bid Proposal Item #3 is for the Railing at locations in Contracts #1, 2 & 4A. However, the drawings do not identify the limits of Contracts #1, 2 & 3A. Please provide the missing information.
Answer: Refer general index plan sheets, G-102 to G-104
15. Bid Proposal Item #0004 is for the cost of the Final Construction Drawing Set, and is Pre- Priced at $100,000.00. However, the space in the Amount Column is left blank. If the $100,000 is a Fixed Allowance Amount that is to be included in all Bidder’s Proposals, then the Price Sheet needs to be revised in the next Addendum to show the $100,000 preprinted in the space under the Amount Columns for this Bid Item. Please clarify.
Answer: This is a fixed-price of $100,000.00. The Bid sheet Item No 004 is updated.
16. With regard to Bid Proposal Item #0005 – Option #1 the Bidders cannot provide firm fixed pricing for this Bid Item since there is no information provided to the Bidders in the bid documents that would allow the Bidders to estimate the cost of performing this indeterminate amount of Underground Storage Tank removal work. Plus, we have no idea which “basement area” is being referenced in the second line of the scope description. Therefore, we request that the Price Sheets be revised in the forthcoming Addendum to make this Bid Item a Fixed Allowance Amount of $100,000.00. Please clarify.
Answer: The site assessment of the site that discusses the location of the Underground Storage Tank is part of the Specification.
17. With regard to Bid Proposal Item #0006 – Option #2 and Bid Proposal Item #-0007 – Option #3, please clarify the following:
a. With regard to both Bid Options, please clarify which party pays for the Sampling and Testing of the contaminated materials.
Answer: There is a bid item added to the bid sheet to cover for the sampling and testing
b. Please confirm that both Bid Options apply to contaminated soil, and not to any other types of contaminated materials.
c. With regard to Bid Option #3 please clarify the type of Hazardous materials that are expected to be found in the contaminated soil, such as: Chromium Waste, Asbestos, PCB’s, etc.
Answer: Contractor may encounter semi-volatile organics, metals, PCBs, dioxin, volatile organics. District will look for previous analytical work within the 3A project site.
d. The wording used in these Bid Items is similar but not the same with regard to the potential re-use of the contaminated material as landfill cover. Bid Option #2 describes the material as Non-Hazardous Contaminated Material not suitable for landfill cover. However, Bid Option #3 describes that material as Contaminated Hazardous or material not suitable for landfill cover.
Please clarify if the different wording (underlined above) is intentional or a mistake.
Answer: Soil excavated during construction not suitable for backfill will have to be taken offsite for treatment/disposal. Soil not suitable for re-use on site will be stored in a separate area and measures taken to prevent run-off or run-on from this separate area. Contractor will take soil samples for lab analysis to determine any environmental impacts to the soil. Basic laboratory analysis will be for Volatile Organics (VOA), Semi-Volatile Organics (SVOA) Pesticides, PCB's, RCRA Metals and Dioxin. Guidelines for determining if soil can stay on site of re-use will be the NJDEP guideline for Residential Direct Contact Soil Clean-up Criteria.
If laboratory analysis shows the soil is contaminated but not hazardous, and suitable for re-use on site, (subject to capping with clean fill or concrete) the guiding criteria will be the NJDEP Non- Residential Direct Contact Soil Clean-up Criteria.
e. With regard to Bid Option #2, please clarify whether or not the Non-Hazardous material can be beneficially re-used as fill material.
Answer: Refer to above.
f. If the above-mentioned underlined wording in Bid Option #3 is intentional, then we find the wording to be confusing because Hazardous materials need to be disposed and cannot be beneficially re-used for Landfill Cover. Therefore, to correct this problem Bid Option #3 should be revised to include the underlined wording from Bid Option #2. Please clarify.
Answer: Sampling of excavated material is necessary to determine end use- backfill or landfill
18. The NJDEP Permit in Section 00901 discusses the need to remove and dispose of roughly
900 Cubic Yards of Sediments from the Passaic River. The same permit discloses the two possible disposal options for the “dredged” river sediments, which could be either Upland Beneficial Re-Use Sites or a Solid Waste Landfill Facility that is licensed to accept the river sediments. Since the NJDEP will not be making the final determination of the end-use of the river sediments until after the Contractor has submitted the application to the NJDEP, it is not possible for the Bidders to predict this future outcome at this time. Therefore, it is not reasonable to expect the Bidders to take the risk on the end-use of the river sediments.
Therefore, we request that the Price Sheets be revised in the next Addendum to include a New Fixed Allowance Item to cover the disposal cost of the river sediments. Please clarify.
Answer: It is not expected that there will be dredging of river sediment. Should be considered contractor means and methods.
The permit has language that was more relevant in the early 2000’s when it was issued.
19. With regard to the Notes on Drawing C-501 that address the potential need for the Contractor to Drill-Through or to Excavate Obstructions during the Bulkhead Piling Work, please address and clarify the following:
a. Please identify the type(s) of pile-driving equipment that the USACE Designer considers to be appropriate for the Hard Driving Conditions that are referenced in General Note #7.
Answer: Refer to Specification 31 41 16, section 1.5 and Section 3.2.
b. General Note #7 states that the Contractor shall “form the Rock-Sockets by Driving”. This statement implies that the Designer expects the Rock-Sockets to be created entirely through the use of the Pile Driving Hammer, and that the Designer has prepared some analysis to support this expectation. Please provide to the Bidders the type and size of the Hammer that was used in the geotechnical engineering analysis, along with all other design information, that formed the basis of these expectations so that the bidders can evaluate this important design information.
Answer: Refer to the continuation statement of the Note 7 (Sheet C-5-01) as well as Specification 31 41 16, section 1.5 and Section 3.2.
c. Several of the Notes discuss the potential need for the Contractor to Drill-Through or Excavate Obstructions if the Hammer reaches refusal above the designated Tip Elevations.
However, the Bid Proposal does not currently provide any additional compensation to the Contractor to perform this “if and where required” type of work. Since it is not reasonable or equitable to expect the Contractor to take the Obstruction Risk described in these Notes we request that at least Two New Bid Items be added to the Bid Proposal to cover the cost of: 1) Excavating Obstruction that are encountered at depths less than 10 feet below original grade, and 2) Drilling Through Obstructions that are encountered at depths that are greater than 10 feet below original grade. Please provide these Two New Bid Items in the next Addendum.
Answer: The contractor will make his own judgement and embed the cost of penetrating/removing obstacles based on the available borehole logs, site survey data, and site visits.
20. The Notes on the bottom of Sheet S-504 mistakenly state that the Ladders and Railings are to be installed as per the Manufacturer’s Instructions. These Notes need to be revised to remove this unreasonable language because the fabricators of the Railings and Ladders will not take-on this responsibility and neither will the Contractor because it is not the customary role for the Contractor or the Contractor’s suppliers to assume the design responsibilities of the Designer/Engineer of Record on a Design-Bid-Build Project such as this project. Therefore, we request that the Notes on the bottom of Sheet S-504 be revised in the forthcoming Addendum to remove this unreasonable language. Also, please provide the installation details that show the quantities, sizes and types of anchor bolts or other fasteners that are to be used to anchor the new Railings and Ladders. Please clarify.
Answer: The notes will remain, and the railings and ladders shall be fabricated and installed as per the Newark Riverfront Park project referenced. Additional information regarding railings is provided within this Addendum as an attachment.
21. The Typical Railing Details on Drawing L-567.00 show two methods of supporting the new Railings: 1) one method is to mount the Railings on top of the new Concrete Cap, and 2) the other method is to support the new Railings on Footings that identified as “SSD. With regard to these details, please clarify the following:
a. Which of the two mounting methods apply to the new Railings that are to be installed from STA 9+05 to STA 20+03.
b. Which of the two mounting methods apply to the new Railings that are to be installed from STA 20+03 to STA 37+10.
c. Which of the two mounting methods apply to the new Railings that are to be installed from STA 45+68.80 to STA 57+75.
d. If the Footing Method is to be used to support the New Railings on this project, please provide a proper detail for the footing with dimensions, type of concrete, etc.
e. Please provide the definition of the “SSD” Abbreviation.
Answer: Railings should be as per the Newark Riverfront Park project referenced. Additional information regarding the railings is included in this Addendum as an attachment.
22. With regard to the fabrication of the New Railings, please clarify the following fundamental issues.
a. The Typical Details on Sheet L-567.00 describe all of the Railing components as being made from Steel. Yet, Specification Section 05 52 00 makes reference in Part 1.2..1c, in Part 2.10, and in Part 3.3 to Aluminum Railings and Handrails. This fundamental discrepancy is very confusing and is preventing us from obtaining quotes on the new Railings, which is a major item of work for Contract 3A. Are the New Railings to be made from Steel or Aluminum?
Please clarify this important issue as quickly as possible in the forthcoming Addendum.
b. If the New Railings are to be made from Steel, then please provide the correct method(s) of coating all of the Railing Components. For example, the Typical Details on Sheet L-567.00 make reference to a Powder Coated Steel Mesh, but the drawing does not call out any other type of coating for the other Steel Railing components. Yet, Part 2.9 of Specification Section 05 52 00 only mentions the application of a Shop Prime Coat to the steel components; and, Specification Section 05 50 14 only mentions the use of Hot-Dipped Galvanizing for steel Railing components. Please note that the photographs we have seen of other Railings installed along the Newark Riverfront were not painted and they did not appear to be made from Hot- Dipped Galvanized Steel. Therefore, please clarify the types of coatings to be used for the New Railing components if the New Railings are to be made from Steel.
Answer: Railings should be as per the Newark Riverfront Park project referenced. Additional information regarding the railings is included in this Addendum as an attachment.
23. Note #1 on Sheet C-101 requires the Contractor to perform an extensive underground survey prior to starting work for the purpose of identifying all utilities and all underground obstructions that may interfere with the new construction. With regard to Note #1, please address and clarify the following:
Answer: This is a general note that all available site-specific information, including the locations of the utilities, existing shore line structures etc. is provided within the bid package. A contractor obtains utilities mark outs regardless what is available. In addition, the contractor must visit the site and note if any surface or inferred subsurface conditions would impact his/her work.
a. Please clarify why the Contractor is being asked to perform this huge task when the Government has had many years and far more resources at their disposal to have performed this type of due-diligence effort during design development.
Answer: See above. This question has been aggerated: Significant portion of the area is several feet below the future grade and is free of utilities.
b. The history of the site is well-documented in the 2,776 page Site Assessment Report that was prepared by Tetra Tech in Section 00905. Why is there any further need for the Contractor to perform any additional surveys?
Answer: As per above.
c. As currently stated in Note #1, the performance of this huge task is too broad and too ambiguous, and Note #1 can be interpreted in many ways. Therefore, the means and methods of performing this Subsurface Investigation Survey need to be better defined, and the scope of the investigative work needs to be better defined so that the Bidders can estimate the cost and time of performing the task. For example, is the Contractor required to hire a specialty firm to use Ground Penetration Radar (GPR) to scan all Upland Areas of the site for underground anomalies? What happens when anomalies ae discovered by the GPR? Is the Contractor required to perform Test Pits when suspected anomalies are discovered? How many Test Pits should the Bidders include in their Bid Proposal? What happens when the Test Pits confirm the existence of an underground utility or an underground obstruction? How does the Contractor get compensated for the performance of this work and for the removal of the obstructions?
Please clarify.
Answer: See above, this question has been aggerated: Significant portion of the area is several feet below the future grade and is free of utilities.
d. The Bidders need to know exactly what tasks need to be completed and what end product/deliverable needs to be provided to the Government in order to satisfy Note #1, because the failure to satisfy Note #1 will delay the start of the work and impact the Schedule. Please clarify.
Answer: Means and Methods and describe this on your bid-response.
e. Please clarify and confirm that Note #1 does not require the Contractor to perform any underwater surveys along the alignment of the New Bulkhead to determine if there are any submarine obstructions or utilities in the way of the new pilings.
Answer: The scope does not include any underwater survey. The contractor’s attention is drawn to the Specification 31 41 16, Section 3.1, 3.2, 3.4, and Drawings
24. Please clarify the intended method and purpose of Seeding the newly graded areas after the New Bulkhead has been installed. Note #8 on Sheet C-101 states that all newly graded areas are to be Seeded as per Specification Section 32 92 19. With regard to the Seeding work, please clarify the following:
a. Section 32 92 19 requires far more than just Seeding, such as the hiring of Seeding
Experts and providing a One Year Guarantee for all seeded areas. Therefore, it is difficult to believe that Section 32 92 19 is applicable to this project because that Section applies to permanent landscape restoration. Yet, this project does not require permanent landscape restoration since the project site will be further disturbed and developed as a Park after this project is completed. Therefore, please clarify whether or not Section 32 92 19 is applicable to the specific needs of this project.
Answer: Item No 0006 Landscape plan has been added to this solicitation. The landscape plan adds coordination with DLUR.
b. If permanent landscape restoration work is required for this project as per Section 32 92 19 then the Bidders need to be provided with Landscape Drawings that show the specific areas where the Two Types of Seed Mixes are to be applied as specified in Section 32 92 19. Please clarify.
Answer: See response to 26 b.
c. Please clarify whether or not 4” of Topsoil is to be imported, furnished and installed by the Contractor in all areas that are to be seeded for this project.
Answer: Depth of topsoil is referred to in 32 92 19 2.2.
25. Note #12 states that the Turbidity Barrier will be located as per the Soil Erosion Permit but the Permit is not provided in the bid documents. Therefore, please instruct the Bidders as to where the Turbidity Barrier is expected to be installed for bidding purposes.
Answer: The floating turbidity barrier is to be deployed in sufficient length to ensure eroded sediments from the open work area(s) is/are prevented from entering the waterway(s) during construction activities. The barriers are not required to enclose the entire site during the life of the Contract but shall be located so as to isolate any area under active construction as directed by the Contracting Officer.
26. Note #3 on Sheet C-101 states that the Contractor shall perform clearing from the New Bulkhead or River to the Work Limits, which makes sense. However, Note #13 implies that some trees may remain, which does not make an sense and is a potential problem because the Contractor needs to have all trees removed in order to work in the narrow working limits.
Therefore, please clarify that all trees are to be removed within the working limits.
Answer: Item 006 of the bid sheet includes a tree survey and protection plan, coordination with State and replacement.
27. With regard to the New Railings and Ladders that are to be provided beyond the limits of the New Bulkhead, please clarify the following:
a. The plans that show the locations where only the new railings and ladders are to be provided do not show any landmarks, or other site related information that would typically be provided for work that is to be performed at a site. This type of information is not only standard information, but is useful, if not necessary, for bidders to be able to find these locations and visit these areas. Please furnish a Google Aerial Photograph that shows where these locations are to be found, and where the limits for the new railings start and stop.
b. Please identify the name of the railing fabricator that made the railings from the previous Riverfront project that was called PSEG Market Street.
c. The Typical Railing Details on Drawing L-567.00 include notes that call-out electrical conduit, electrical wiring and lighting to be provided as an integral part of the new Railings.
However, we have not found any other information in the bid documents that would indicate how to provide power to the railings at any of the locations where the railings are to be installed, and the Bid Documents do not provide any electrical drawings or any electrical specifications.
With this critical electrical information it is not possible for bidders to include any costs in their bid proposals for the lighting that is noted on Drawing L-567.00. Please clarify.
Answer: Railings should be as per the Newark Riverfront Park project referenced. Additional information regarding the railings is included in this Addendum as an attachment.
28. The notes on sheet 6 mention clearing, grubbing, restoring, etc. Many trees will need to be removed in order to install the new wall. Please confirm that restoring trees is NOT part of this contract.
Answer: Item 006 of the bid sheet includes a tree survey and protection plan, coordination with State and replacement.
29. The notes on sheet 6 mention restoring to existing conditions. As of today the site is all weeds and no landscaping. Please confirm that topsoiling, landscaping, seeding, plantings, etc.
are NOT part of this contract.
Answer: Team has recommended inclusion of the landscape plan and coordination of this plan with DLUR, as Optional Item 4 in the bid items.
30. Please provide an approved or previously utilized fabricator of the railing shown on plan sheet 32.
Answer: Railings should be as per the Newark Riverfront Park project referenced. Additional information regarding the railings is included in this Addendum as an attachment.
31. Please confirm that NO lighting or electric is required for the railing.
Answer: Railings should be as per the Newark Riverfront Park project referenced. Additional information regarding the railings is included in this Addendum as an attachment.
32. The Table of Contents includes a List of Documents, Exhibits and Other Attachments that includes Sections #00900, 00901, 00902, 00903 & 00904. With regard to these documents please clarify the following:
a. Section #00900 is supposed to provide the Federal Prevailing Wage Rates, but no Wage Rates were provided. When will the Wage Rates be made available
b. Answer: Wage rates was provided. It’s in the 00 73 00 of the 1442

c. The Table of Contents does not include Section #00905 – Preliminary Assessment Report.
However this document is included in the Contract Manual. With regard to this 2,776 page document, please clarify the following:
i. Please clarify why this 2,776 page document is not listed in the Table of Contents.
Answer: The document is listed on the electronic Table of Contents; the addendum also includes it in the main Table of Contents.
ii. Please clarify why this document is included in the Contract Manual when is appears to include only historical / background information about the project.
Answer: The information provided in the document is useful information for the contractor to provide its bid.
iii. Please clarify whether or not the Contractor needs to know any information that is included in this historical/background type of document in order for the Contractor to perform any of the Contract 3A work.
Answer: The information regarding the UST is part of the Preliminary Assessment Report that is included in the Specifications.
33. The NJDEP Document in Section 00901 of the Project Specifications mentions the PSE&G Former Front Street Coal Gas Site. However, we do not see this contaminated site identified on any of the contract drawings. Therefore, with regard to this contaminated site, please clarify the following:
a. Please identify on a site plan drawing where this contaminated site is located relative to the work area.
Answer: PSE&G site is off the project’s limit and has been remediated by others recently.
b. Please confirm that the Contractor for Contract 3A will not be impacted at all by the PSE&G Former MGP Site and will not have be prepared to deal with any subsurface contamination from the Former MGP Site.
Answer: PSE&G site is off the project’s limit and has been remediated by others recently.
The location of the PSE&G remediation site was added to the layout plan. Please refer to other responses within this RFI that are related to this. For example, the contractor must be aware that all material is to be tested and disposed of at an appropriate facility. Soil meeting non-residential direct contact criteria may be used as backfill (must cap).
34. Please clarify whether or not there will be any time-of-year restrictions placed on water work that could disturb the river sediment and which may pose scheduling constraints on the installation and removal of the Contractor’s Temporary Sheet Pile Cofferdam.
Answer:
1. Threatened and Endangered Species- Indiana bat and the long-eared bat - a tree clearing restriction of April 1 through September 30 will be implemented for any trees six inches or greater than diameter at breast height.
2. Migratory Bird Treaty Act MBTA restricts tree or shrub/scrub removal from March 15 to July 31.
3. As stated in the National Marine Fisheries Service, Final Needs Response dated 5/16/2014, there shall be no in-water work from March 1 to June 30 to minimize adverse effects to anadromous fish passage.
35. With regard to the Allowable Ingress/Egress Location shown on Sheet G-102, please clarify the following:
a. We visited the site last week and contrary to what is shown on Sheet G-102 there is no longer any Ingress/Access to the Contract 3A work area at the location that is shown on Sheet G-
102.
