If no existing PPQ exists for the project, or if new information is required in the offeror’s opinion, the offeror should provide a PPQ to a representative of the owner that can provide the owner’s opinion of the offeror’s past performance for the project. The PPQ form (Form PPQ-0) to be used is provided as Attachment 7 in Section J of this solicitation. A sample cover letter to accompany the PPQ and instructions for completing the PPQ is also included. Ensure correct phone numbers and email addresses are provided for the owner’s point of contact.

For each project, Offerors and/or its JV team members and/or its subcontractors should submit the PPQ form to the client and request that the form be completed and returned to the offeror before the closing date of the solicitation. If the client requests, PPQs may be submitted directly to the Contracting Division using the following e-mail address:

Lauren.O.Minzenberger@usace.army.mil.

The only information in the email subject line MUST be the solicitation number W912DQ21R3005. NOTE: All PPQs submitted directly to the Contract Specialist must be received No Later Than the date and time specified for receipt of proposals. However, this does not preclude the Government from utilizing previously submitted PPQ information in the performance confidence evaluation.

Offerors should compile the PPQ for each project submitted under Factor 1 and should organize the information by project, and in the same order as the projects submitted in Factor 1. This will allow the reviewers to match the Past Performance information with the associated Factor 1 project. Only one PPQ should be submitted for each Factor 1 project and if more than one PPQ is received, only the first PPQ will be evaluated.

The Government may contact and interview the customer’s representative on the PPQ and reserves the right to interview other individuals acting for the customer’s representative, if the customer’s representative is not available.

At no time during this process, during the debriefing, or after award, will the names of the individuals providing reference information directly to the Government about an offeror’s past performance be revealed to the offerors or to any other party. If discussions are held, offerors may be afforded the opportunity to respond to adverse comments made by references in accordance with guidelines identified in FAR Part 15.306(b) (4). In this case, comments will be extracted and provided to the offeror.

3.3.2 CAGE Codes and DUNS Numbers

The offeror should provide the CAGE Codes and Data Universal Numbering System (DUNS) numbers for the Prime Contractor and any Joint Venture members, whose experience is being relied on for Factor 1. This information will be used by the Government to access past performance information in the Contractor Performance Assessment Reports System (CPARS).

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

SECTION M

Evaluation Factors for Award

1.0 Source Selection

The Government intends to award an 8(a) Small Business Environmental Consulting Services (ECS) MATOC to support existing and future USACE customers primarily throughout the USACE Northwestern Division (NWD) area of responsibility or other locations where NWD work may be assigned. Task orders awarded under the MATOC will be firm-fixed price.

The evaluation will be conducted in accordance with source selection procedures as found in the Federal Acquisition Regulation (FAR), Department of Defense Federal Acquisition Regulation Supplement (DFARS), Army Federal Acquisition Regulation Supplement (AFARS), Department of Defense Source Selection Procedures, Army Source Selection Supplement (AS3) to the Department of Defense Source Selection Procedures, and this solicitation. The offeror must be responsible in accordance with FAR Part 9, conform to the solicitation requirements, meet all technical requirements, and present the best value to the government, using a tradeoff source selection process.

Failure to comply with the terms and conditions of the solicitation may result in the offeror being considered unawardable.

2.0 Source Selection Process

The Government’s target is to award up to five (5) contracts for this MATOC; however, if the Contracting Officer determines during the source selection process that more than that number of contracts should be awarded, the Contracting Officer has the discretion of adjusting that number or awarding none at all. The Government may not award any contract if the resulting contract would not represent a "best value" to the Government using trade-off selection procedures as required by the federal acquisition regulations and guidance.

To arrive at a source selection decision, the Government will evaluate the technical factors and proposed price. The Government intends to award to the firms providing the proposals which are considered by the Procuring Contracting Officer (PCO) to be the best value to the Government using best value trade-off methods. The PCO’s decision will be based on a comparative assessment of proposals against all evaluation factors in the solicitation.

While the PCO may use reports and analysis prepared by others, the source selection decision will represent the PCO’s independent judgment. The source selection decision will be documented, including the rationale for any business judgments and trade-offs made or relied on by the PCO, including benefits associated with additional costs.

The award of the base contracts for this MATOC will be based on a Best Value Trade-off evaluation. Award may not be to the offerors who provides the lowest price, but to the offerors who provide the best value to the Government considering the non-price technical evaluation factors and price.

Future task orders will be competed among all members of the MATOC pool in accordance with procedures in FAR 16.505.

Future awards under this MATOC will be based on the assessment of proposals submitted for the task orders. The Contractor will not be reimbursed for the cost of task order proposal preparation. Task orders will be awarded based on either a lowest price, technically acceptable (LPTA) evaluation or a Best Value Trade-off evaluation. For LPTA task orders, award will be made to the offeror submitting the lowest evaluated price proposal that meets or exceeds the acceptability standards for the non-price factors. For Best Value Trade-off task orders, award will be made to the offeror whose proposal is determined to be most advantageous to the Government based upon assessment of the specific task order evaluation factors. Based upon the results of the integrated assessment of the proposals for Best

Value Trade-off task orders, the Government may make an award to other than the lowest-priced offeror or other than the highest technically rated offeror if doing so would result in the best value to the Government.

The Government intends to award without discussions in accordance with FAR 52.215-1, however, the Government reserves the right to open and conduct discussion if it deems them to be necessary. Therefore, offerors are advised to submit proposals that are fully and clearly acceptable without additional information. If award will be made without conducting discussions, offerors may only be given the opportunity to clarify certain aspects of proposals (e.g., the relevance of an offeror’s past performance information and adverse past performance information to which the offeror has not previously had an opportunity to respond) or to resolve minor or clerical errors. Adverse past performance includes past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.

If discussions are deemed necessary, they will be held only with those offerors determined to be in the competitive range. The Contracting Officer may establish a competitive range comprised of the most highly rated proposals. The competitive range may be further reduced for purposes of efficiency pursuant to FAR 15.306(c)(2). Offerors whose proposals are not included in the competitive range will be notified as soon as practicable.

Discussions will include issuance of evaluation notices. An offeror initially included in the competitive range may be eliminated from consideration for award during discussions. At the conclusion of discussions, each offeror still within the competitive range shall be given an opportunity to submit Final Proposal Revisions (FPR).

3.0 Basis of Award

The evaluation factors are listed in descending order of importance, as follows: Factor 1 – Company Experience, Factor 2 – Performance Confidence, Factor 3 – Price. Factor 1 is more important that Factor 2. Factors 1 and 2, when combined, are significantly more important than price.

4.0 Evaluation Criteria for Volume I, Factor 1 (Company Experience) and Factor 2 (Performance Confidence)

Factor 1 – Company Experience

The Performance Work Statement (Section C of this solicitation) includes a wide range of work that may be performed under this contract. While the scope of services associated with this contract is broad, the Factor 1 criteria identified below are the services that the Government considers most important in evaluating an offeror’s capability to successfully execute the type of work that the government has determined as most likely to be performed under this contract.

Project narratives submitted to demonstrate company experience should describe project characteristics including magnitude, complexity, challenges and accomplishments as it relates to the evaluation criteria.

Present project constraints such as site restrictions, cost and schedule, customer and stakeholder requirements, and any other unique considerations as they relate to the evaluation criteria in this section.

For this factor, the Government will evaluate proposals, assign strengths and/or weaknesses, and justify tradeoffs based on the Evaluation Criteria.

The government will evaluate the offerors submitted project narratives that demonstrate breadth and similarity of experience in all areas listed in Section L paragraph 3.2.1 ((e.g. CERCLA Five Year Reviews, NEPA, and Environmental Compliance (Air Quality)). Greater consideration will be provided to project(s) similar in size, scope, and complexity valued at $100,000.00 per year or greater, and performed recently. Projects closer to completion may be weighted higher by the government. The government will assess relevant experience demonstrated by the offeror and subcontractor team(s), but additional consideration shall be provided for projects on which the offeror executed the relevant work as the prime contractor.

Based on a consideration of risk in conjunction with the strengths, weaknesses, significant strengths, significant weaknesses, and deficiencies identified in the offeror’s proposal, the proposal will be assigned one of the following adjective ratings for the Company Experience Factor:

Rating Description Outstanding Proposal indicates an exceptional understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.

Proposal is unawardable.

Factor 2 – Performance Confidence

The Past Performance Questionnaires (PPQs) and Contractor Performance Assessment Reports System (CPARS) are the primary sources of information on past performance; however, the Government reserves the right to consider past performance information from other sources. The Performance Confidence evaluation considers each offeror's demonstrated recent and relevant record of performance. Absent any recent and relevant past performance history, the offeror’s proposal will not be evaluated either favorably or unfavorably on performance confidence.

The past performance evaluation will consider each offeror’s demonstrated recent and relevant record of performance on up to seven (7) examples of similar projects submitted as part of Factor 1 – Company Experience, and any additional past performance information obtained by the Government from other sources.

The Government will evaluate the Past Performance Questionnaires (PPQs) submitted with the proposal for the Factor 1 projects, along with any PPQs received directly from the offeror’s clients for the Factor 1 projects. The Government may contact and interview points of contact on the PPQs. The Government reserves the right to interview other individuals acting for the listed references, if the listed reference is not available.

In addition to the PPQs, the Government will review past performance information retrieved through CPARS, using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal whose experience is being relied on for Factor 1. All CPARS are considered recent (no greater than 6 years from time of Request of Proposal).
