52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A
FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--
(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
a. Basis for Contract Award
(1) This acquisition will be conducted using best value trade-off process authorized at FAR
5.101-1 as implemented in FAR Parts 12 and 15, Army Federal Acquisition Regulation Supplement, DoD Source
Selection Procedures and Army Source Selection Supplement. Award will be made to a single offeror whose timely offer is deemed responsible IAW FAR, whose proposal conforms to the solicitation requirements and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the best overall value to the government price and non- price items considered. This is a small business set-aside. Offerors must satisfy the requirements described in the evaluation criteria, as well as all other RFP requirements.
(2) The technical capability factor and past performance is significantly more important than price. Price will not be rated. The Government reserves the right to award to other than the lowest price or highest rated technical proposal. NOTE: ALL NON-PRICE FACTORS COMBINED ARE SIGNIFICANTLY
MORE IMPORTANT THAN PRICE FACTOR.
(3) The Government will evaluate proposed prices for price reasonableness using price analysis techniques. Proposed prices evaluated as unreasonable (includes unbalanced, inaccurate or incomplete price proposals) may be grounds for eliminating a proposal from competition.
The Government intends to award one single award contract as a result of this solicitation. Offers received for less than the stated number of items listed in the pricing schedule will be considered ineligible for award.
b. Evaluation Criteria.
(1) The following evaluation Factors and Subfactors will be used to evaluate each proposal.
Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors and subfactors described below. The Government reserves the right to make award based upon the Price Factor in the event that the Technical and Past Performance evaluation results of all the offerors’ proposals are substantially the same
Factor 1: Technical Capability:
Subfactor 1: Recruitment and Retention Approach Subfactor 2: Staffing Plan and Scheduling Approach Subfactor 3: Quality Control Approach
Factor 2: Past Performance Factor Factor 3: Price Factor
Evaluation of the offeror’s proposal shall address each subfactor as it applies to the PWS. A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”, Paragraph c. of this section. During evaluations of each proposal, the Government will assign each subfactor an adjectival rating and write a narrative evaluation reflecting the identified findings.
Factor 2: Past Performance: Each offeror’s past performance will be reviewed to determine relevancy and confidence assessment.
Factor 3: Price: The resulting award will be a firm-fixed price contract. Price reasonableness will be utilized in the evaluation of the Firm-Fixed Price effort.
c. Evaluation Approach
All proposals shall be evaluated by the Source Selection Team (SST).
(1) The overarching evaluation approach for all factors and subfactors is as follows:
(a) Adequacy of Response - The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.
(b) Feasibility of Approach - The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.
(2) The Technical Capability factor is divided into the following subfactors:
Subfactor 1: Recruiting and Retention Approach. Business Relations Quality of Service Schedule Customer Satisfaction Personnel
(a) Each offeror will receive a past performance assessment rating based on the offeror’s ability to demonstrate recent and relevance in performing services that meet the solicitation requirements. There are three (3) aspects to the past performance evaluation: recent assessment, relevancy assessment, and performance confidence assessment.
(b) Recent Assessment. As assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have performed during the past five (5) years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.
(c) Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity to the services being procured with this solicitation. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work size and complexity to the services being procured with this solicitation. A relevancy determination of the offeror’s (including joint venture partner(s) and major and critical subcontractor(s)) past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. In establishing what is relevant for the acquisition, consideration should be given to the aspects of the offeror’s contract history that would give the most confidence that the offeror will satisfy the current procurement. The past performance information provided in the proposal and obtained from other sources will be used to establish the relevancy of past performance.
(d) The past performance evaluation team will review the past performance information and determine the quality and usefulness as it applies to the performance assessment.

Performance Confidence Assessments
Rating Definition
Substantial Confidence
Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor or past performance.
Limited Confidence
Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (FAR 15.305(a) (2)(iv)).
Therefore, the offeror shall be determined to have unknown (or neutral) past performance.
(4) FACTOR 3 – Price: Price will not be scored or rated. Evaluation of price will be performed using one or more proposal analysis techniques in FAR 15.404-1(b). Unbalanced pricing may be evaluated IAW FAR 15.404-1(g), as applicable, to assess potential performance risk which would result in unreasonably high prices. Through the techniques, the government will determine whether prices are reasonable, complete, and balanced (to include all prices contained in the CLINS and Pricing Matrix (Attachment 03 – Pricing Matrix).
Total Evaluated Price (TEP) – The TEP for award purposes will be the sum of all CLIN prices listed in the schedule for all years. To account for the option period(s) possible under FAR 52.217-8 (Option to Extend Services), the Government will add six (6) months of the offeror’s final ordering year price to the offeror’s total price. This amount will be the Total Evaluated Price (TEP). Offerors are not required to enter a price for the six
(6) month extension period.
The Government may determine that an offer is unacceptable if the pricing is significantly unbalanced.
Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques and may be rejected if the Contracting Officer determines that the lack of balance possess an unacceptable risk to the Government. Offers that are determined to be unbalanced may be rejected if the lack of balance poses an unacceptable risk to the Government.
