RFI Responses 23 Dec 2022:
Key:
Amendment 3 – RFI Response Amendment 4 – Consolidated RFI Responses per Amendment 0004
1. The CLIN’S reference a Type K and Type L, what are these types? Is there a detail or specification for them? Type L is new work where there is no existing fence. Type K is repair work where an existing fence is repaired or replaced. Specifications are the same for both.
2. Is there a design base guide that will clarify the fencing material specifications? No
3. The bid documents reference UFGS 32 31 13.53 and UFGS 32 31 13 these UFGS’s are for any type of fencing material and are very broad. Can the government please provide clarification on the exact specifications for the materials? Follow spec section 32 31 13.53
4. The solicitation states that it is a task order contract, is the base year of the contract what will be awarded first in totality and then the task orders will be comprised of various items in the options? No. This is a requirements contract. A requirements contract that ALL the requirements/needs/orders for this contract will be offered to the contractor, not to any other entity/contractor. Please see FAR 52.216-21 in the solicitation for further clarification. Task orders will awarded in the base and option years as needed.
5. Is the base year considered the seed project and the optional years are proposed/potential task orders? No. There is no seed project for open-end requirements type contracts. If contractor performs satisfactorily and need exists, the option years will be exercised. Task orders will be awarded in the base year and option years as needed.
6. If the base year is the seed project, is the bid bond for the base year or the proposed options as well that may or not be awarded in full according to the scope of work? There is no seed project for open-end requirements type contracts. The amount of the bid guarantee shall be 20% percent of the bid price or $3,000,000, whichever is less. The bid price includes the base year + 4 option years + half of option year 4.
Please see FAR Clause 52.228-1 in the solicitation.-The bid guarantee amount shall be at least 20 percent of the bid price (base + 4 option years + half of option year 4) but shall not exceed $3 million
7. If the base year is going to be divided into task orders which CLIN’S will apply? Please see FAR 52.216- 21 for procedures related to requirement type contracts. Unknown at this time which CLINs will be needed in a task order.
8. If the optional years are awarded on an as needed basis, will CLIN’S be selected randomly? No. CLINS needed for each task order will be selected for that order. Option year CLINS are listed on SF 1442 with signifier of “option” beneath the number. For example, CLINS 1001-1124 indicate option year 1, CLINS 2001-2124 indicate option year 2, etc. (see picture below from SF 1442).
9. What is the duration of the project? Is it 365 days since the base project is one year? Does each option year count as 365 days’ duration as well, except for the six months? A period of performance will be negotiated for each task order. The base and option periods are each 1 year. The base and option periods are each 365 days without any days/breaks in the contract. If required, 52.217-8 may be exercised to extend services for up to an additional 6 months.
10. It is hard to gauge the maximum and minimum value of a given task order if the optional years are not task orders in total. If the government intends to select items from the optional years CLIN’S will there be a minimum and maximum value for each task order? No. Requirement of the task order is unknown at this time. Please see FAR 52.216-19 in the solicitation for details regarding Order Limitations.
11. The statement of work mentions current work that might need to be demoed but there is no CLIN for demo, how much demo should we assume? Which CLIN’S should include demo? Review CLINs that mention removal or clearing. Removal will include disposal.
12. There is no line item/CLIN for general conditions, profit, or overhead where should these cost be added? Split between CLINS as contractor chooses.
13. The current statement of work states the CLIN’S are estimates and that the work maybe more or less, this alludes that the base year is a seed project, and the rest of the options could be individual task orders, is this correct? No, the base year is not a seed project. Please reference the description of a Requirements contract found in FAR 16.503. Repairs are to be accomplished through individual projects identified by the Government and executed as individual Task Orders.
14. If each optional year is going to be awarded in full will the performance and maintenance bonds be posted annually as opposed to a bond that is for four and a half years? Bonding companies typically do not give bonds for four and a half years all at once, especially on a task order contract that doesn’t have a clearly defined amount or scope of work. The bid guarantee is for the entire amount proposed/bid penal sum of base year plus 4 option years and half of option year 4, when the award is made a performance and payment bond will be required for the entire amount of the base year. New performance and payment bond submissions will be required for each option year in the full amount and/or the awarded task order in respective year exceeds the bond amount. it will be for the entire amount of the base bid price.
15. Will tasks order be defined/assigned yearly or on an as needed basis? As needed throughout the year period of performance.
16. Based on the task order definition/assignment it is presumed that they will be individually bonded once assigned, is that correct? If selected as the Open End Fencing awardee, per SF 1442 page 1 and box 12, according to the contract you contractor will have 10 days after award to submit performance and payment bonds for the base year bid amount.
17. What is the warranty period of work and when does it start? 1 year after final acceptance.
18. Does the warranty start at the end of a CLIN for 12 months? Or at the end of a task order for 12 months? At the end final acceptance of a task order for 12 months.
19. Will the payment and performance bonds be released yearly or at the completion of each task?
Yes, Bonds are not required at the Task Order level. Performance and payment bonds are required annually in conjunction with the base period and each subsequent option period exercised by the Government.
20. Can the government provide an ariel view or site drawings? No. After award of base contract, the contractor will have an opportunity to walk the sites as task order requirements arise. Task orders are unknown at this time. Site will be walked to discuss work required.
21. From a procurement stance it would make sense to procure one year of material at a time if each year is in fact going to be all the CLIN’s in totality, is the storage/lay down area big enough to accommodate a years’ worth of material? NA. quantity unknown. Quantities listed are estimates; quantities and delivery dates will be defined per task order as needed.
22. Since there is no site visit can we have photos of the lay down area? NA No. Since work to be performed is based on a per project/task order basis, specific sites are unknown at this time.
23. Is it possible to coordinate a site visit individually if a group one is not an option? No. Task orders needed are unknown at this time.

25. What is the terrain? Varies. Could be flat and clear or hilly and overgrown.

Historically, similar contracts have not has issues with unforeseen site conditions while installing fencing as when a specific project is identified, the customer and contractor coordinate and generate an agreement sheet to establish quantities, CLINS, and period of performance necessary to complete work. Unforeseen site conditions can be discussed when discovered. Previous contracts have not had issues installing fencing.
28. The drawings show access control to gates but there are no specifications, details, or a CLIN for these items? Are these government provided items or unapplicable? Access control gates are not applicable.
29. Based on the current drawings provided they don’t coincide with the provided CLINS’s. To name a few items, turn style gates and overhead roller gates don’t have a specification or CLIN. Can the government provide a more specific scope of work, applicable details, and specifications? Those items are NA.
