TECHNICAL EXHIBIT (TE) 2

GOVERNMENT REQUIREMENTS FOR PESTICIDE APPLICATION

1. Pesticide Usage. The Government shall allow the usage of pesticides to the extent that such usage does not result in soil erosion and other detrimental effects to the environment. Herbicides shall not be used to control vegetation along primary roads passing through privately-owned property and agricultural land. Government approval to use pesticides does not relieve the Contractor of the responsibility for damages that may result from its application. The Contractor shall repair and restore damaged areas at its own expense.

2. A Pesticide Applicator certified with the State of Hawaii regulations, implementing Public Law 92-516, Federal Environmental Pesticide Control Act is required to perform and/or directly supervise all pesticide operations. Direct supervision requires the certified Pesticide Applicator to be physically present in the immediate work area when mixing pesticide or the application is being performed. The certified pesticide applicator shall also have line-of-sight visibility of all non-certified personnel applying pesticide. The Contractor shall submit a copy of the Pesticide Applicator's certificate within 7 calendar days after award of the contract and upon any personnel change to this position.

3. The Contractor shall maintain a pesticide application log (TE 3), Government's Pest Management Report. Enter the following information for each application: (a) date of application, (b) actual quantity by volume or weight of pesticide applied, (c) approximate area or linear feet covered during application and (d) target weeds. The Contractor shall submit the completed application log to the COR within 5 working days after application.
