SECTION 00 21 00

INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

1.1. GENERAL DESCRIPTION OF WORK.

This construction project includes removal of one 4,000 bbl bulk API fuel storage tank, removal of four 12,000 gallon STI fuel storage tanks, removal of one truck offload facility, removal of one truck fill stand facility, removal of pump house/POL storage building, removal of all aboveground associated piping and appurtenances, and removal of underground issue piping. New construction includes three new 50,000 gallon horizon AST's (UL listed 2085) fuel tanks, combined truck offload facility/truck fill stand facility include top loading capabilities, and a new POL storage building. Support facilities include storm water management, spill containment systems, roadways, fencing and gates, and general site improvements. The project includes a base bid and six (6) bid options for additional items.

The bulk diesel storage facility site is located west of the Main Gate along C Tree Road on McAlester Army Ammunition Plant, McAlester, Pittsburg County, Oklahoma.

1.2. GOVERNMENT SECURITY REQUIREMENTS.

The Offeror(s) must ensure that ALL mail sent to the Tulsa District, U.S. Army Corps of Engineers, either pre-contract or post-contract award, has a return mailing address on the outside of the envelope, package, box, etc. ANY MAIL addressed to the U.S. Army Corps of Engineers, including but not limited to bids, modifications to bids, proposals, revised proposals, bonds, correspondence, etc., will be REJECTED by the US Army Corps of Engineers mail room facility located at 2488 E. 81st Street, Tulsa, OK 74137-4290, if it does not contain a return mailing address. There will be no exceptions.

1.3. COPIES OF SOLICITATION DOCUMENTS AND AMENDMENTS.

1.4. OFFEROR'S QUESTIONS AND COMMENTS.

All contractual matters, questions and or comments relative to these documents should be submitted via Bidder Inquiry in ProjNet at http://www.projnet.org/projnet/binKornHome/index.cfm?strKornCob=HomePagePublic no later than five (5) calendar days prior to the proposal due date so that they may be given consideration or actions taken prior to receipt of proposals.

1.5. SMALL BUSINESS SIZE STANDARD/NAICS CODE.

The Small Business NAICS Code is 236220, and the size standard is $36,500,000.00. Also see FAR 52.204-8.

1.6. PROPOSAL EXPENSES AND PRE-CONTRACT COSTS.

This request for proposal (RFP) does not commit the Government to pay, as a direct charge, any costs incurred in the preparation and submission of a proposal

1.7. SITE VISIT.

All vendors are highly encouraged to attend a pre-proposal site visit, which is scheduled for 17 July 2019 at 10:00 am CT at the Lake View Conference Room, Building 47A.

Contractors shall provide a completed McAAP Visitor Access Request (MCAAP FORM 190-20) and submit via email to shawn.brady@usace.army.mil NO LATER THAN 5:00 pm on Friday, 12 July 2019.

1.8. ACCURACY IN PROPOSALS.

Proposals must set forth full, accurate, and complete information as required by this RFP (including attachments). The penalty for making false statements is prescribed in 18 U.S.C.

1001.

1.9 PROPOSAL SUBMITTAL.

1.9.1 The submittal method for proposals is electronic via ARL SAFE or email ONLY (no mailed proposals). ARL SAFE web site: https://safe.arl.army.mil.

To utilize ARL SAFE, email the following individuals below with subject line “Request Drop-off Files W912BV19R0040” and Request Code will be provided.

1.9.2 Proposals will be received until the time and date shown on Standard Form SF1442 or as amended on an SF30. Mail bid bonds to:

1.10. PROPOSAL FORMAT.

See Section 00 22 00 for Phase I proposal requirements.

1.11. JOINT VENTURE PROPOSAL REQUIREMENTS.

When proposing as a joint venture, all members of the joint venture shall sign the SF 1442 and the bid bond unless a written agreement by the joint venture is furnished with the proposal designating one firm with the authority to bind the other member(s) of the joint venture. In addition, a copy of the joint venture agreement shall be submitted with the proposal. Failure to comply with the foregoing requirements may eliminate the proposal from further consideration. If this is an 8(a) or HubZone joint venture, the offeror shall ensure that it complies with the applicable requirements of 13 CFR Part 124 and 13 CFR Part 126, respectively.

1.12 DEVIATIONS AND EXCEPTIONS.

Deviations and exceptions to the terms and conditions of the solicitation are neither encouraged nor desired. Should the offer include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the offer may be determined “unacceptable” and thus ineligible for award. Should the offeror have any questions related to specific terms and conditions, these must be resolved prior to submission of the offer.

Notwithstanding the above, if deviations and exceptions are included with the offer, the offeror shall list and describe in detail the deviations and/or exceptions as required by Sections 00 21 00 and/or 00 22 11 of this RFP. All deviations and exceptions shall be fully supported with the offeror’s rationale and shall fully explain the impact, if any, on the performance and/or specific requirement of the RFP.

1.13 GENERAL INSTRUCTIONS.

1.13.1 Offers will be evaluated using the criteria under Section 00 22 11, Proposal Submission Requirements, Evaluation Criteria and Basis for Award and compliance with the RFP technical requirements. Noncompliance with the RFP requirements will raise serious questions regarding an offeror’s technical ability to perform the services and may be grounds to eliminate the proposal from further consideration for contract award.

1.13.2 The Offer. The submission of the documentation specified under Section 00 22 11, Proposal Submission Requirements, Evaluation Criteria and Basis for Award, will constitute the offeror’s acceptance of the terms and conditions of the RFP, concurrence with the plans and specifications, and the proposed contract type.

1.13.3 It is the Government’s intention to award without discussions. Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, in accordance with FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency in accordance with (IAW) FAR Part 15.306(c)(2).

1.13.4 In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

1.13.5 If an offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the contracting officer (KO) in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

1.13.7 Debriefings. The contracting officer will promptly notify offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505. The contracting officer will notify unsuccessful offerors in the competitive range of the source selection decision in accordance with FAR

15.506. Upon such notification, unsuccessful offerors may request and receive a debriefing.

Offerors desiring debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable. All debriefings will be provided officially in writing.
