At a minimum, the narrative should address past performance information such as whether the project was completed on-time/budget, whether or not the Offeror encountered any performance issues or challenges, and key and/or best management practices the offeror employed to sustain successful performance for each past performance project submitted. If performance issues or challenges did arise, provide information on how they were addressed and outcomes.

Do not request past performance questionnaires on projects that have final CPARS evaluations. If a past performance questionnaire is received on a project where a final CPARS evaluation exists, the CPARS evaluation will serve as the official rating of record for evaluation purposes.
The Government may contact references provided as part of Factor 2 – Specialized Experience, for information regarding the Offeror’s past performance on the project and for the purposes of assessing and verifying the scope of the work performed. Offerors should provide accurate, current, and complete contact information for references provided in the project descriptions.

EXCHANGES
The Government intends to award without discussions. Firms are cautioned to put forth their best efforts, and to furnish all information clearly to allow the Government to evaluate proposals. Firms should not assume that they will have an opportunity to clarify or correct anything in their proposal after submitting it.
A “Competitive Range” is a subjective determination of the most highly rated proposals in the event that the Government decides that discussions with competing firms are required or are considered to be in the Government’s best interests. In such an event, the Contracting Officer will establish a competitive range of all the most highly rated proposals.
If discussions are held, the Government may engage in a broad give and take with those firms in the competitive range, in accordance with FAR 15.306 (d).
Upon conclusion of discussions, those firms still in the competitive range, will be afforded an opportunity to submit their final proposal revisions for evaluation and selection.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable No information or did not apply to your contract
Rating will be neither positive nor negative.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the
Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Low52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government intends to make award without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions, if deemed necessary.
EVALUATION FACTORS
Factors to be Evaluated.
The following evaluation factors will be used to evaluate each proposal. Award will be made to the contractor with the Lowest Priced Technically Acceptable (LPTA) proposal.
Factor 1 – Technical Data and Drawings
Factor 2 – Specialized Experience Sub-factor 1: Site Assembly and Erection Experience Sub-factor 2: Crane Manufacturing Facility Experience Factor 3 – Proposed Contract Duration and Summary Schedule Factor 4 – Manufacturer Quality Control Factor 5 – Past Performance Factor 6 – Cost/Price
Evaluation Approach
All proposals shall be subject to evaluation by the Source Selection Evaluation Board (SSEB) in accordance with LPTA procedures as describe in Section M. Each offeror’s technical proposal will be evaluated against the technical evaluation factors, as contained in the Section L of the Solicitation to determine technical acceptability. An UNACCEPTABLE rating for any one factor will remove the offeror from further consideration. Only the lowest priced proposal receiving an “acceptable” rating in every non-price factor/sub-factor will be evaluated for Factor 6 – Price/Cost to determine price reasonableness. Trade-off is not permitted for LPTA acquisitions.
Ratings
The technical rating reflects the degree to which the contractor’s proposed approach meets or does not meet the Government’s minimum performance and capability requirements through an assessment of the proposal.
An “unacceptable” rating at any Factor level will make an offeror’s proposal unawardable.
Technical Ratings. The technical rating provides an assessment of the quality of the offeror’s solution for meeting the Government’s requirement. Each Technical Factor (Factors 1 through 5 shown above in 2.1) will receive an acceptable or unacceptable rating described in the DoD Source Selection Procedures and listed in the Table 1 below.
The term “Technical” refers to non-cost factors other than past performance that is used to assess the offeror’s proposed approach, as detailed in its proposal, to satisfy the Government’s requirement.
Table 1. Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Past Performance Ratings.
The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract’s requirements.
The Government will consider past performance information as submitted in accordance with Section L of this solicitation, and may also consider recent and relevant past performance information outside of the information provided by the Offeror and its customers. Therefore, the Government reserves the right to use both the information provided in the Offeror’s Past Performance proposal volume and information obtained from other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and commercial sources.
Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table A-2.
Table 2. Past Performance Evaluation Ratings Rating Description Acceptable Based on the offeror’s performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
