52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (JAN 2017)
(a) Definitions. As used in this provision--
“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting
Officer's discretion, result in the offeror being allowed to revise its proposal.
“In writing or written” means any worded or numbered expression which can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.
“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.
“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.
“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include
Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.
(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).
(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.
Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.
(2) The first page of the proposal must show--
(i) The solicitation number;
(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);
(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;
(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and
(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.
(3) Submission, modification, or revision, of proposals.
(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the
Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.
(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or
(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(3) It is the only proposal received.
(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal
Government processes resume.
(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at
52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.
(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.
(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.
(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.
(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.
(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the
Contracting Officer.
(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).
(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--
(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the
Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and
(2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.
(f) Contract award.
(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.
(2) The Government may reject any or all proposals if such action is in the Government's interest.
(3) The Government may waive informalities and minor irregularities in proposals received.
(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.
(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.
(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the
Government.
(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.
(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.
(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(i) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(iv) A summary of the rationale for award.
(v) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

SECTION 00 22 11 - PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION CRITERIA, BASIS OF
AWARD ONE-STEP-BEST VALUE, DESIGN-BUILD (SINGLE AWARD)
EVALUATION CRITERIA
SECTION 00 22 11
PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION CRITERIA, AND BASIS OF AWARD
1.0 OVERVIEW
1.1 This is an unrestricted competitive solicitation for a firm, fixed-price construction contract to be awarded using the Trade-Off, Best Value selection process. This Request for Proposal (RFP) is to Remove and Replace Generator Step-Up Transformers, 13.8 KV Switchgear, 480Volt Motor Control Centers, and 15 KV Bus at Denison Power Plant, TX. The solicitation criteria shall rely upon industry standards, as much as possible and firms must meet all project requirements.
1.2 Offerors will submit proposals with performance capability including identification of key subcontractors, the proposed contract duration, a preliminary schedule, and a price proposal. The Government will evaluate initial proposals in accordance with the criteria described in this Section.
Award of a firm fixed-price contract will be made to the responsible offeror whose proposal conforms with all the terms and conditions of the solicitation and represents the overall best value to the Government, considering the evaluation factors, below. The final evaluation rating used for comparison, selection, and award will reflect the ratings received during proposal evaluation. Cost and price information will not be rated but will be evaluated in accordance with FAR Part 15.4.
When combined, all non-price factors are considered significantly more important than price.
1.2.1 The proposal must describe the capability of the offeror to perform the work and understanding of the requirements contained in the Statement of Work, and set forth full, accurate, and complete information required by the RFP. The proposal should be prepared simply and economically and be legible, clear and coherent.
1.2.2 This is not a sealed bid procurement process. Issuance of this Request for Proposal does not constitute an award commitment on the part of the Government. Contract award is subject to funds availability.
1.2.3 Proposal Submissions and the Trade-Off Process. This process permits tradeoffs among price and non-price factors and allows the Government to accept other than the lowest priced proposal.
Proposals must demonstrate performance and capability information for review and consideration by the Government. Relative weights among past performance and technical factors are provided, below. The Source Selection Evaluation Board (SSEB) reviews, evaluates, and rates the proposals against the source selection criteria in the RFP. If discussions are held, a competitive range consisting of the most highly qualified firms will be established, first.
Concurrently, the Government analyzes price proposals. Price will not be rated, but will be a factor in making the final best value determination for award.

Offerors shall not request PPQs on projects that have final ACASS, CCASS, or CPARS evaluations. If a past performance questionnaire is received on a project where a final ACASS, CCASS, or CPARS evaluation exists, the ACASS, CCASS, or CPARS evaluation will serve as the official rating of record for evaluation purposes.
If any negative past performance information is received, the contractor will be given an opportunity to provide rebuttal if the Offeror has not had an opportunity to previously address the evaluation.
Entities that have no past performance shall notify Contract Specialist Amanda McGovern Amanda.M.McGovern@usace.army.mil, prior to the date and time established for receipt of proposals, that they have had no previous clients and that PPQs cannot be provided. The proposal must contain a written statement that no past performance evaluations are available.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
The Government reserves the right to verify the experience record of cited projects or other recent projects not submitted by reviewing the Past Performance Information Retrieval System (PPIRS) or other Government appraisal systems, or to interview owner or references. The Government may check any or all cited references to verify supplied information.
5.3 EVALUATION CRITERIA:
5.3.1 The Government will evaluate the extent of recent, related experience of the prime contractor as relevant to their role on this project. Experience on the similar projects identified in the project lists will receive more consideration than experience provided in the supplemental narrative. The Government may place greater importance on projects performed as a prime contractor than as a subcontractor, depending upon overall role and relevancy considerations. Federal Government project experience will not be rated inherently more important than non-Federal Government project experience.
5.3.2 The proposal must demonstrate a record of recent, related experience in construction, for the types of work required by this project. Recent experience includes projects well underway (50% or more complete) or those completed and turned over within seven (7) years of the proposal issue date for this RFP. Joint Ventures and Partnerships should separately demonstrate experience commensurate with their role on this project or explain in the supplemental narrative how their experience qualifies them for their role on this project.
5.3.3 The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing the Corps of Engineers Construction Contractor (or Architect-Engineer) Appraisal Support System (CCASS/ACASS), other DOD or Government appraisal systems, or to interview owners or references. The Government may check any or all cited references to verify supplied information.
5.3.4 To receive credit for extent (amount) of experience, the prime shall demonstrate a history of recent, relevant experience. A firm will not receive credit under this factor based merely upon the relevant experience of key personnel proposed for this project.
mailto:Amanda.M.McGovern@usace.army.mil
5.3.5 The Government will consider extent of recent experience, degree of relationship of such experience to this project, demonstrated familiarity with applicable codes and local conditions.
Some examples of relevancy to this project may include, but not be limited to:
Number, size, type work, complexity, location
Dates (well under way 50% or more completed, no more than 7 years preceding date of Solicitation)
Firm's role and extent of work self-performed (brokering out all work and simply managing a cited project are examples of less relevant experience)
5.3.6 Previous experience is not mandatory for an acceptable rating. The Government will consider previous experience a strength, even if the experience is on different type projects than this project.
Similarly, the Government may consider previous recent teaming experience among the team members as value added, even if on different type design and/or construction projects than this project. The more relevant the experience, the more credit given.
5.3.7 Past Performance evaluation includes two aspects to assess the offeror’s probability of performing the requirements stated in the RFP, based on the offeror’s demonstrated performance on recent, relevant contracts.
First, the offeror’s past performance will be evaluated to determine how relevant a recent effort accomplished by the offeror is to the requirements of the RFP.
Second, the offeror’s past performance shall be given a Performance Confidence Assessment based on how well the contractor performed on past contracts.
5.3.8 The Government will assign a performance confidence assessment based on the probability of successfully meeting the contract requirements, considering the degree of success of the contractor’s recent, relevant experience. The Government will assess the past performance on projects submitted and reserves the right to conduct telephone interviews with points of contact identified in the proposal and/or to review other recent projects rated in CCASS/ACASS or other agency performance databases, review and/or contact furnished references, or to consider first-hand personal knowledge of Government employees.
5.3.9 The Government will first assess and rate the relevancy of recent projects accomplished compared to the scope of this contract for overall application to the performance confidence assessment ratings described, below. The projects will include those submitted as well as from other sources described, above. This rating is not a separate proposal rating but is only used in developing an overall past performance confidence assessment rating assigned to the Past Performance Factor.
The past performance relevancy ratings are described below.
Very Relevant: Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant: Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant: Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant: Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
5.3.10 The Government will next consider how well the offeror performed on the contracts. The
Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor performance. With respect to relevancy, past performance on projects with more relevance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment rating than past performance on projects of lesser relevance. The Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other sources not provided by the offeror. Owners/references may be asked to comment on items such as quality of design or construction, timeliness, management of the work, subcontractor management, including timely payment to subs or suppliers, safety, relations between owner and designer or contractor, level of support for such things as as-built documentation, O&M manuals, training, correcting design or construction errors, warranty work, etc. The Government will target areas covered in the requirements of this proposal including records of meeting quality, schedule, cost control, customer satisfaction, level of support for work product such as as-built documentation, O&M Manuals, training, problem resolution for design or construction errors, warranty work, and safety. The Government will not release the Interview Forms to the Offeror at any time, in order for the Government to solicit candid, unbiased interview comments. The Government also places a higher value on projects which document successful outcomes and are supported by outside source confirmation, such as furnished references, customer evaluations, or personal knowledge. The Government also places a higher value on projects involving particularly difficult or unique challenges and the innovative methods the contractor used to resolve problems successfully.
5.3.11 A degree of confidence in the offeror’s ability to successfully accomplish the contract requirements will be assigned. The rating system used for the performance confidence assessment is described below.
Neutral Confidence: No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
No Confidence: Based on the Offeror's recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Limited Confidence: Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence: Based upon the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Substantial Confidence: Based on the offeror’s recent / relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
5.3.12 Each entity (firm) will be rated on its own performance. If the Government does not obtain past performance information for the projects identified in the proposal, and cannot establish a past performance record for the offeror through other sources, past performance will be rated neither favorably nor unfavorably. The performance confidence assessment will be considered “Unknown Confidence.”
5.4 FACTOR 2 – PERFORMANCE CAPABILITY
For Technical Factors (meaning all non-cost factors excluding Past Performance) the rating methodology (DoD Source Selection Procedure 3.1.2.2) is Combined Technical/Risk Rating. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining technical ratings. This methodology provides the most flexibility and least complexity in the rating process, conduct of the comparative analysis, and best value trade-off analysis process and will be used for this acquisition.
Combined Technical/Risk Ratings
Adjectival Rating Definition
Outstanding
Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable
Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.
5.5 SUBMISSION REQUIREMENTS:
The contractor shall demonstrate recent, relevant experience on similar projects, using Construction
– Specialized Experience form – (Attachment 2). Proposals may identify state and local government and private contracts that are similar to the Government’s requirements. If the offeror is a joint venture or partnership, each firm shall provide information demonstrating experience relevant to their role on this project. Submit projects selected from those discussed in the experience narrative that are currently well underway (designed and at least 50% construction progress completed) or completed and turned over no more than seven (7) years preceding the date of this RFP. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer, or by the team member. If projects were design-build, so identify them. The offeror shall provide project information for the stated minimum number of recent and relevant projects for each area identified below. The Offeror must submit a letter of commitment for any subcontractor where subcontractor experience is used to demonstrate experience under any area.
Upon award, subcontractors proposed to be used to complete the assembly, erection, and/or manufacturing portion of the contract shall not be substituted without the Contracting Officer’s written prior approval.
The proposal may contain a supplemental narrative (not project lists), not to exceed two pages, explaining how any corporate experience that is not directly representative of this project is applicable and how the Government will benefit.
The proposal should describe any previous teaming experience between proposed team members, if not described in the project list.
5.5.1 The following elements are considered equally important to demonstrate adequate organization and performance capability: use best judgment when apportioning space/pages to each area for this factor. Provide information that describes the offeror’s organization and performance capability to execute the design-build contract per the detailed requirements herein. . Clearly but concisely describe the organizational approach to project management and execution. Do not exceed the page limits stated, above: resumes submitted for key personnel are limited to two pages each.
