RFI # Discipline Dwg Sheet/Spec Section Comment Response

47 Earthwork Spec Volume #2, Appendix A

In regard to earthwork for preparation of the site, there appears to be multiple boring reports and maps provided in the Specifications Volume #2.

Page 7 of 190 of the Volume 2 spec (Appendix A), is a Demolition Plan titled CD103. This sheet indicates 11ea borings, and is dated 12/15/05, by Tetra Tech Inc. Following this is a report by Hunt Engineering, dated October 12, 2009, starting on page 11 of 190, of the volume. This report indicates that 6ea borings were taken, and recommended undercutting 13.5’ deep, under the proposed building (the building being proposed in that report --- not the building which is part of this project). Following this report is another boring map, on page 22 of 190 of the volume, titled “Boring Location Plan” and dated 2009-10-06. It appears that these borings were taken to the western part of the proposed building site, per sheet CL101, with north being the upper right of the page. We think that the second boring map and the first geotechnical report (dated 10/12/09) go together.

Following the second boring map, is a second geotechnical report from Hunt Engineering, dated March 30, 2010. This report references 5ea borings, of which there is no map for.

This geotechnical report does not recommend any over-excavation requirements. We understand that as a part of this proposal, we are to include a geotechnical investigation.

However, it would be disadvantageous to the owner for bidders to assume that we will be required to undercut the proposed pad by 13.5’, when in fact, it may not be required.

The cost to remove and replace could be in the range of $150,000-$175,000. Can a unit price be used for removal and replacement of soil, should the geotechnical investigation call for it?

Revised Answer: In Vol 2, page 14 of 190, App A, the Hunt Engineering Report, second para of para 6.a.

states: 'The ground improvement shall consist of over-excavating the existing soil below the proposed footings and 2-feet outside the footing footprint to an ELEVATION of 13.5-feet and then backfilling the resulting excavation with properly compacted soil meeting the criteria of load-bearing fill, as defined in Section 7a. As an alternative, modified stone with fines, such as PennDOT 2RC and AASHTO #57 stone may be used to backfill the over-excavation.' For bid purposes, the only overexcavation required is 2 feet around the footings."

65 Electrical General Is there an existing building management system? No.

66 Experience

Shoule we assume that the Prime Contractor and any key subcontractors experience are included in the total 3 projects?

Please see the last sentence of Para 4.1.a (1st paragraph) of Section 00120.

67 Design all drawings Can all drawings be issued as CAD files to aid in design process? These will be provided after award.

68 Mechanical

In order to provide Leed credits would a closed loop, vertical bore geothermal system be a permitted option? If so, are there any restrictions regarding the geothermal boreholes?

Yes. Unless the RFP including any referenced material prohibits a specific system, it is the Offeror's decision to select the system.

69 Architectural 01 10 00 Para 3.6.15 Vestibule: Door path to be fitted with power assists for operation by the disabled. Define "power assists". Please see Amendment No. 0003.

Request for Proposal Solicitation Form 1442

Item 13B indicates a bid guarantee is required; however, no percentage is indicated

The Bid Guarantee Amount can be found in FAR Clause 52.228-1 in Section 00700 .

71 Design Spec Section 01 10 00 Statement of Work

Paragraph 5.10.1.2. indicates the contractor shall provide the services of a qualified regeristered fire protection engineer. Is this necessary since there is no fire sprinkler system in the building?

Yes, placement of heat detectors and fire alarm design, etc requires FPE oversight. Bid as indicated.

Request for Proposal Amendment No. 0001

Special Clause SC-1 indicates the Base Bid completion to be 540 calendar days. What amount of time should be alloted for the Government's representative to review bid documents?

Contract duration starts from Contractor's receipt of Notice to Proceed, which is after Govt's review of bid documents.

a. Experience with Similar Scope: An offeror shall convincingly demonstrate design and construction experience by providing evidence of at least three (3) projects of at least the scope, dollar value, and complexity described below, and substantially completed (greater than or equal to 75%) within the last five years as of the date of this proposal submission. For this acquisition, a project of similar scope, dollar value, and complexity is defined as a project involving the construction or design of administrative facilities of similar size. Each project must have a construction value of at least $2,000,000 U.S. dollars. For joint venture, teaming agreement, or partnership offerors, this experience shall be satisfied by submitting conforming experience from any or all of the joint venture, partnership, or teaming agreement partners. Offerors shall also provide experience information in the same manner as required for the prime contractor offeror for each subcontractor proposed to perform more than 20 percent of the project design and/or on-site construction work.

Each project submitted for evaluation shall include the following descriptive information: (i) project title, (ii) geographic location, (iii) date that the project was substantially completed, (iv) final project U.S. dollar value, (v) detailed description of the project, and (vi) a description of the actual involvement in the performance of the presented project. Offerors are required to provide information that convincingly demonstrates that the experience presented meets the requirements of qualifying construction and design experience (see requirements above).

b. If an offeror is a joint venture or a partnership or has a teaming agreement composed of two or more partners or proposes subcontractor(s) to perform more than 20 percent of the project on-site construction work, the offeror shall describe the project work that each member of the joint venture, partnership, teaming agreement or the subcontractors would perform. a. Designer(s) of Record

b. Design Quality Control Manager

c. On-Site Construction Superintendant/Manager

d. On-Site Safety Officer (Site Safety and Health Officer (SSHO))

e. Contractor Quality Control Manager (Contractor Quality Contract Systems Manager (CQCSM))

The Government will compare this resume information against any and all requirements contained in the RFP in the locations shown below:

a. Designer(s) of Record - Section 00700 - Contract Clauses: 52.236-25 and SECTION 01 33 16

b. On-Site Safety Officer (Site Safety and Health Officer (SSHO)) – SECTION 01 35 26.

c. Design Quality Control Manager and Contractor Quality Control Systems Manager – SECTION

01 45 04.

The qualifications of the On-Site Construction Superintendant/Manager are as follows:

Section 00120 Page 3

a. Minimum of 5 years experience as a construction superintendent with projects of similar scope and complexity.

Failure to satisfy a material requirement for any of the personnel listed above will be a basis for receiving an unacceptable rating.

All resumes shall include the following information to the extent required by the solicitation and are not to exceed three pages in length for each resume. Information presented beyond the three-page limitation for each resume will not be considered in the Government’s evaluation process.

a. Name of person

c. Name of firm with which presently associated and or employed

d. Years of experience as it applies to the position that would be filled

e. Educational degree(s), year of graduation and institution

f. Active professional registration (if any), year first registered, if applicable List of projects in which the individual has worked to include name of project(s), project location(s), and work assignments performed

4.3. FACTOR 3 - PAST PERFORMANCE: Past performance pertains to how well an offeror has performed relevant past work that is an indicator of future performance. Past performance information is not the same as experience information. Experience information pertains to what types of work an offeror has performed.

Past performance pertains to how well an offeror performs project work. For the purpose of this evaluation, past performance means an offeror’s reputation for satisfying its customers by delivering:

a. quality work

b. in a timely manner

c. at a reasonable cost

d. in a safe working environment as well as its reputation for

e. reasonable and cooperative conduct

f. overall commitment to customer satisfaction

Offerors are reminded that while the Government may elect to consider past performance information obtained from other sources, the primary responsibility for providing past performance information rests with the offeror. In the case of an offeror that does not have a record of relevant past performance, or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably as concerns its past performance. In situations of this kind, the adjective rating of neutral will be applied to the evaluation factor of Past Performance, to include the evaluation of Construction Contractor(s) and Subcontractor(s) Past Performance and Designer(s) Past Performance. There are two categories of Past Performance with this evaluation factor.

a. Construction Contractor(s) and Subcontractor(s) Past Performance:

(1) The Government will evaluate an offeror’s reputation for performing work in a manner commensurate with the six areas of interest listed above.

(2) This evaluation element is applicable to Construction contractors and subcontractors, where the total subcontracting efforts performed on site (involving management and/or construction efforts) equates to twenty percent or more of the on-site project work effort. An offeror should provide written evidence of the above described six past performance qualities (see items (a) through (f)) in the form of, but not limited to:

1. letters and certificates of commendation

Section 00120 Page 4

2. performance awards

3. performance evaluations

4. evidence of repeat work with the same clients or owners (particularly when noncompetitively obtained), etc.

(3) Offerors are encouraged to solicit and obtain letters of recommendation from past owners, customers and clients from which written documentation contemporaneous with project performance may not be available. These past performance documents should not reference work completed more than six years prior to the date of proposal submission for this solicitation. Past performance documents older than six years will not be considered in the evaluation and selection processes.

(4) If an offeror is a joint venture or partnership, information pertaining to the areas identified as

(a) through (f), above should be presented for each member of the joint venture or partnership (unless the information being presented is in regard to the joint venture or partnership as constituted in response to this solicitation). Although the Government prefers all members of a joint venture or partnership to have satisfied all the above indicated six performance areas, the Government will consider the complementary aspects of the separate participants in a joint venture or partnership, by evaluating the joint venture or partnership as a whole.

(5) Past performance information provided for a member of a joint venture or partnership having no involvement in the project will not be considered in the Government’s Past Performance factor evaluation. Past performance information will only be evaluated from firms proposed to be involved in an offeror’s approach for performance of the solicitation work.

(6) In addition to the evidence submitted by an offeror, the Government may consider information from other sources, including but not limited to: past and present customers and their current and former employees; federal, state and local agencies (including court records); private consumer organizations; and Government past performance databases. In gathering this additional past performance information, the Government will attempt to contact an offeror’s past customers and clients for which contact information is provided by the offeror in response to the portion of the factor.

b. Designer(s) Past Performance:

(1) The Government will evaluate a proposed Designer’s reputation for performing work in a manner commensurate with the six areas of interest listed above.

(2) An offeror should provide written evidence for its proposed Designers of the above described six past performance areas of interest (see (a) and (f above) in the form of, but not limited to:

1. letters and certificates of commendation, performance awards, performance evaluations

2. evidence of repeat work with the same clients or owners (particularly when noncompetitively obtained), etc.

(3) Offerors are encouraged to solicit and obtain letters of recommendation for its proposed

Designers, from past owners, and/or customers and clients from which contemporaneous written documentation may not be presently available. These past performance documents should not reference work completed more than six years from the date of the solicitation.

Past performance documents that are older than six years will not be considered in the evaluation and selection processes.

(4) In addition to the past performance documentation submitted by an offeror for its proposed

Section 00120 Page 5

Designers, the Government may consider information from other sources, including but not limited to: past and present customers and their current and former employees; federal, state and local agencies (including court records); private consumer organizations; and Government past performance databases. In gathering this additional past performance information, the Government will attempt to contact an offeror’s past customers and clients for which contact information is provided by the offeror in response to the Experience portion of this factor.

4.4 FACTOR 4 – DESIGN QUALITY CONTROL: The Offeror shall provide information on the disciplined processes that will be utilized by the Designer to ensure the design portion of this contract is performed and provided in a manner that meets professional architectural and engineering quality standards.

Provide copies of checklists, as required by the contract in Section 01 45 04 Contractor Quality Control, that will be utilized in the contract, as well as, other procedures utilized in the Design Quality Control process.

The Offeror’s Design Quality Control program will be reviewed to determine if it the Offeror receives an “acceptable” rating for this Factor.

5.0 PRICE EVALUATION: The Government will evaluate proposals for the purpose of determining the reasonableness and completeness of the prices offered. Price proposals will be analyzed for unbalanced pricing as a part of the Government’s reasonableness determination. Completeness includes review of Proposal.

5.1 FACTOR 5 – PRICE (STANDARD FORM 1442 AND CONTRACT LINE ITEM SCHEDULE).

5.1.1 Submission Requirements:

5.1.1.1 Submit the properly filled out and executed SF 1442, along with the Price Proposal Schedule, executed Bid Bond, and Section 00600, "Representations and Certifications”. See instructions in Section 00100, “Bidding Schedule/Instructions to Bidders”. For joint ventures, partnerships, and teaming agreements, submit an executed copy of the joint venture, partnership, or teaming agreement with the price proposal.

5.1.1.1.1 Supplemental Price Breakdown. If deemed necessary to evaluate the price proposals, the

Government will request a price breakdown of the Contract Line items in a sealed envelope marked “Price Breakdown Information,” in Excel format. The Government will provide details on where and how to send the breakdown. This information will not be needed sooner than three working days after the proposal submission due date. This information may be required for the initial proposal and, if requested, for any revised proposals. This information is not an opportunity for an Offeror to revise its non-price or price proposal.

5.1.2 Evaluation Criteria:

5.1.2.1 The contract resulting from this solicitation will be awarded to the responsive and responsible offeror submitting the lowest reasonable price that has an overall acceptable rating concerning non-pricing evaluation factors. Price will be evaluated for fairness and reasonableness through the use of a price analysis. The price evaluators will also check for appearance of unbalanced line item prices.

Offerors are cautioned to distribute direct costs, such as material, labor, equipment, subcontracts, etc.

and to evenly distribute indirect costs, such as job overhead, home office overhead, bond, etc., to the appropriate contract line items. Both parties shall presume that field overhead costs through the proposed contract duration are inclusive in the offered price for the contract.

5.1.2.2 If deemed necessary, the supplemental price breakdown information will be used to assist the

Section 00120 Page 6

Government in performing the price evaluations described above.

5.2 EVIDENCE OF BONDABILITY

5.2.1 Submission Requirements: Submit the Bid Bond in accordance with the Instructions in Section 00700, Provision 52.228-1 Bid Guarantee.

5.2.2 Evaluation requirements: This item is not rated. The Government will review the Bid Bond for legal sufficiency. The Bond must be legally sufficient.

6.0 EVALUATION PROCEDURES

6.1 The offeror that submits the lowest complete and reasonable, technically acceptable price proposal will be selected for the contract award. To be considered technically acceptable, an offeror’s proposal must not be rated “unacceptable” under any technical factors.

6.2 An “acceptable” rating will be assigned to a proposal that has satisfied all of the requirements of the technical evaluation factors set forth in the solicitation. An “unacceptable” rating will be assigned to a proposal that has not satisfied one or more requirements of the technical evaluation factors set forth in the solicitation.

6.3 The Government cannot make the contract award to an offeror that is determined to have a technical proposal that is deficient or unacceptable. An “unacceptable” rating will make the offeror ineligible for the contract award, unless the Government elects to enter into discussions with offerors and all deficiencies are remedied in a revised proposal. It is the intent of the Government to award a contract without discussions, although the Government reserves the right to conduct discussions if it is determined to be in the Government’s best interest. Therefore, an offeror that desires consideration for the contract award is advised to comply with all mandatory requirements of this solicitation for submission of price and non-price proposals.

6.4 In accordance with FAR 15.101-2, award will be made on the basis of the lowest evaluated price of proposals satisfying the requirements of the technical evaluation factors set forth in the solicitation.

WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.

Union Identifiers

An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.

Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rate.

Non-Union Identifiers

Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may

Section 00815 Page 5 include both union and non-union data. Example: SULA2004-007 5/13/2010. SU indicates the rates are not union rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.

Survey wage rates will remain in effect and will not change until a new survey is conducted.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

Section 00815 Page 6

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

1.0. PROJECT OBJECTIVES

It is the Air Force's objective that the C-5M Formal Training Unit Facility (FTUF) will have a 25-year useful design life before a possible reuse/repurpose or renovation requirement, to include normal sustainment, restoration and modernization activities, and a 50-year building replacement life. Therefore, the design and construction shall provide an appropriate level of quality to ensure the continued use of the facility over that time period with the application of reasonable preventive maintenance and repairs that would be industry-acceptable. The site infrastructure will have at least a 50-year life expectancy with industry-accepted maintenance and repair cycles.

The Government is required by Public Law 102-486, Executive Order 12902, and Federal Regulations 10 CFR 435 to design and construct facilities in an energy-conserving manner while considering life cycle cost over the life of the facilities.

The project site should be developed for efficiency and to convey a sense of unity or connectivity with the adjacent buildings and with the Base as a whole.

Requirements stated in this contract are minimums. Innovative, creative, and life cycle cost-effective solutions, which meet or exceed these requirements, are encouraged.
