About this file
This is Amendment 0003 to solicitation W9128F25R0013, which makes several key changes including: changing "Contractor Quality Control Systems Manager (CQCSM)" to "Quality Control (QC) Manager" throughout the solicitation documents; deleting section 4 of 01 45 00AT3 regarding the Contractor Quality Control Systems Manager; and extending the proposal due date to January 13, 2025.
The underlying solicitation is for a Multiple Award Task Order Contract (MATOC) with an estimated value of $99M for Facilities Sustainment, Restoration and Modernization (FSRM) services using both design-build and design-bid-build delivery methods. This is a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside under NAICS 236220 with a size standard of $45M. The Army Corps of Engineers Omaha District intends to award contracts to approximately four SDVOSB contractors to perform work within their Area of Responsibility covering nine states. The procurement uses a two-phase selection process, with Phase 1 focusing on past performance and technical approach (no pricing). Up to eight offerors will be selected to compete in Phase 2, where the government intends to make approximately five awards.

NOTES:
1. The Binding Maximum Hourly Labor Rates proposed in Table 1 are binding upon contract award for the life of the MATOC.
2. The hourly burdened labor rates shall include direct cost, payroll taxes, insurance, benefits, and any other applicable labor costs, but shall exclude profit. The unburdened hourly rates are required for Year 1 (only) for proposal evaluation purposes.
3. The binding maximum hourly rates represent the maximum labor rates that the contractor shall use when responding to a Fair Opportunity Request for Task Order Proposal (FORTOP) issued by the Government. These binding rates shall also apply to all modifications issued against task orders. The contractor may propose a lower hourly rate for these labor disciplines when responding to the FORTOP or modification request based on the tasks within the FORTOP or modification requests.
4. Adherence to these rates will be reviewed through submittal of supporting documentation by the Contractor with each task order proposal. Failure to propose the binding maximum hourly rate or a lower rate for the listed labor disciplines may result in the Contractor’s task order proposal being rejected for award consideration.
5. If a discipline is not listed in the Binding Maximum Labor Rate Schedule and is required for the Contractor to perform a specific task order, the Contractor may propose the required labor discipline and the associated fully burdened labor rate (exclusive of profit) in the proposal submitted in response to the issued FORTOP or modification request. The basis for these proposed rates will be evaluated to ensure the rates are fair and reasonable.
The Government reserves the right to request additional cost and pricing data at the task order level to determine reasonableness.
6. If during the Contract Period of Performance, the Contractor’s original personnel are no longer available, the Contractor shall provide personnel that meet the same qualifications as stated in the base contract. The Contractor shall be responsible for negotiating the labor rates for those personnel that have been provided in Table 1. The rates provided in Table 1 are the maximum that will be paid by the Government for any replacement personnel.
7. The maximum rates shall be governed by the effective date of the Task Order. Task Orders will use the prices for the 12-month period effective on the date the Task Order is issued. Modifications to Task Orders will reflect the rates of the “current 12-month” binding Maximum labor rate schedule. For example, if the rate schedule changes over on 1 November of each year, and a Task Order is issue on 1 September 2025 for 12 months work, the maximum rates will be the rates that were effective on 1 November 2024. Under the same assumptions, if a modification to the Task Order is required in December 2025, the labor rates effective on 1 November 2025 will apply.
8. The Government reserves the right to request certified pricing data; or other than certified pricing data from the contractor at the task order level to assess the reasonableness of the proposed task order pricing.
9. Qualifications and requirements for personnel identified in the Sample Project and in Section 00 10 00 are contained within Section 01 45 00.00 10 and Section 01 35 26.

If the Offeror intends to provide Maximum Indirect Rates that are different for any or all Option Periods and Extension from the Base Period, the Offeror must provide a justification for the changed cap rates.
2. The Binding Maximum Indirect Rates represent the maximum rates that the Contractor shall use when responding to all FORTOPs issued by the Government. These Binding Maximum Indirect Rates shall also apply to all modifications. The Contractor may propose lower rates for these when responding to the task order request or modification requests.
3. Adherence to these rates will be reviewed through submittal of supporting documentation by the Contractor with each task order proposal. Failure to propose the binding rates or lower rates may result in the Contractor’s task order proposal being rejected for award consideration.

The Offeror shall also describe its primary role/duties in execution of the work (for example, the major components of the project which were completed by the prime’s staff/personnel and major components which were subcontracted out).
5.2.1.3 If an Offeror includes past projects which include work performed by an affiliate company, the proposal must include a factual basis showing the relationship between the companies on the project (the proposal must indicate the involvement of the affiliate in performance of the project before the agency can attribute the affiliate’s past experience or performance to the offeror).
5.2.1.4 Age: The project completion date shall have been within the past five (5) seven (7) (AM#0002) years of the original (non-Amended) date that proposals are due. The Government reserves the right to verify information on the project, and if the Government cannot verify the information, it may discount the project information, which could negatively affect the technical rating for this factor.
5.2.1.8 Provide CPARS or PPQ evaluations for each of the project examples submitted. If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, submit it with the proposal. If there is no completed CPARS evaluation, submit a completed Past Performance Questionnaire (PPQ) for the project. The standard PPQ for USACE is Form PPQ-0 (9/30/11) and it is provided as an attachment to this solicitation. Offerors are advised to ensure correct phone numbers and email addresses are provided for the client point of contact.
5.2.1.9 If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, Offerors should follow up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Contract Specialist, prior to proposal closing date. Offerors shall instruct the clients to refer to the solicitation number in the subject line. PPQs are source selection materials. All successfully submitted PPQs will receive an email confirmation upon receipt. If the offeror does not receive the confirmation, it is the Offeror’s responsibility to follow up to ensure the Government has received the information.
The Government reserves the right to contact the personnel listed on the PPQ. The inability to validate the information on the PPQ will affect the Government’s evaluation. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other procurements. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror see paragraph
5.2.1.10 of this section. In the event that a formal past performance evaluation has not been completed via CPARS, the Past Performance Questionnaire (Form PPQ-0, Attachment 1) is provided for the Offeror or its team partners to submit to the client. The PPQ should be completed by an owner or owner’s representative not affiliated with your firm. Ensure correct phone numbers and email addresses are provided for the client point of contact.
5.2.1.11 Completed PPQs shall be submitted with your proposal or to the designated personnel listed below prior to the Phase 1 proposal due date. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the designated Government's point of contacts, via email at tyler.hegge@usace.army.mil, and jennifer.c.gilbreath@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference previously completed PPQs from other RFPs into their proposal. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation at its own prerogative, nor does it preclude the Offeror from utilizing a previously completed PPQ and submitting into their proposal.
5.2.1.12 Do not submit PPQs for projects evaluated via CPARS. In the event an Offeror submits a PPQ for a project for which a CPARS evaluation is available, the CPARS evaluation will be considered authoritative.
5.2.1.13 The Government will assess the past performance on projects submitted under the Factor 1 - Past Performance and reserves the right to conduct telephone interviews with points of contact identified in the proposal. In addition, the Government may review any other sources of information for evaluating past performance of the Offeror on the submitted projects and any other previous work. Other sources may include, but are not limited to, past performance information retrieved through the CPARS using all Commercial and Government Entity (CAGE)/DUNS numbers or Unique Entity Identifier (Unique Entity ID) of the Offeror, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror. The Government reserves the right to contact any and all individuals identified in the projects submitted. It is the responsibility of the Offeror to provide current contact information for the individual identified therein.
5.2.1.14 Include all relevant information, including demonstrated corrective actions, significant achievements, and unexplained or unresolved problems.
mailto:tyler.hegge@usace.army.mil mailto:jennifer.c.gilbreath@usace.army.mil
5.2.1.15 Offerors are allowed (not required) to submit narratives that explain how the offeror has overcome any negative past performance data (CPARS), Terminations for Default, Reportable Incident Violations, etc. Narratives provide the offeror an opportunity to frame prior poor performance. Narratives do not absolve the offeror of prior performance. This information shall not exceed three (3) pages in total. The narrative should state how the poor performance was overcome and what has been done to prevent future instances from occurring again.
