IMPORTANT INFORMATION

The Division of Solid Waste Management of the South Carolina Department of Health and Environmental Control (Department) governs the disposal of used underground storage tanks (USTs) and their respective liquid and sludge contents.

Prior to the in-place closure or removal of USTs, the UST Management Division must be informed of where liquids and/or sludge will be disposed and how used USTs will be managed. This information must be provided on the Tank and Sludge Disposal Form.

• The contents of the tank are considered a hazardous waste until proven otherwise. The hazardous waste determination can be made by testing the material using approved methods or by having knowledge of the material or process that produced the tank’s contents.

• Hazardous waste must be disposed of at a facility permitted by the Department to treat, store, and/or dispose of hazardous waste.

• The tank owner is considered the generator of any hazardous waste contained in the tank.

• A regulated tank itself is considered a hazardous waste until it is “empty” as defined by the Resource Conservation and Recovery Act (RCRA), which means that less than one inch of residual material is present in the tank after it has been pumped out. Even if a tank is “empty” as described above, the residual material inside the tank must be properly managed and disposed of as a hazardous waste.

• USTs that have been removed from the ground should be clearly marked with spray paint on both tank ends to indicate the UST Site ID # and the date of removal.

• The tank owner must obtain a manifest from the disposal facility upon delivery of tanks, liquid, and sludge. This information must be provided to the UST Program with the completed closure report. The closure report, including the noted manifest(s) and analytical sampling data/results, must be submitted within 60 days after the tank closure event.

• The Tank and Sludge Disposal Form must be submitted at least 30 days prior to the actual tank closure event. Notice of at least 48 business hours prior to the actual tank closure event must be given to the UST Permitting Coordinator, who can be reached at (803) 898-0587.

• If construction debris will buried on site during the removal, the tank owner should contact Tim Eleazer, the Division of Solid Waste Management, at (803) 898-1374 for further instructions regarding notification requirements.
