SECTION 01 14 00 Page 2

1.2 DEFINITIONS

1.2.1 Free Work Zones or Free Zones

A work area bounded by an established perimeter designated by Base Security Forces (SFS), or authorized Government authority, for construction work to occur within a larger, secure or restricted area, defined by AFI 31-101 . Generally, once inside a designated free zone, oversight and escort requirements for construction work are relaxed or eliminated (as defined herein), and the perimeter of that zone is monitored according to Security Forces requirements.

Free zones are created inside restricted areas (RAs) when construction projects make normal circulation controls inappropriate. When possible, the Contractor will create a free zone corridor between the restricted area entry control point and the project location. If a safe corridor is not possible, Contractor-provided escort personnel will provide escort to and from the free zone. Projects requiring a free zone must be coordinated with the 50SFS at least 6 months prior to project start date.

1.2.2 Site Access Management Plan (SSAMP)

A detailed plan that acknowledges, describes, and details all unique access control, security, and phasing requirements in this Contract.

Project-specific requirements for the SSAMP are described below.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Project Security And Site Access Management Plan ; G, RO

1.4 PROJECT SECURITY AND SITE ACCESS MANAGEMENT PLAN (SSAMP)

Prior to the start of construction, the Contractor is to provide a Project Security and Site Access Management Plan (SSAMP) for approval by the Government. The SSAMP shall incorporate the constraints described below and throughout the contract documents. This shall include, but is not limited to, the following information.:

a. List of primary and secondary Contractor POCs for Project security and access management.

b. List of Contractors and Subcontractors requiring site access.

c. Anticipated and/or required free zones(s) with dates and durations.

d. Anticipated dates and durations of various work activities that will require Government oversight and/or escorts per the requirements in this contract.

f. Anticipated procedures for Contractor site security and access management for each work activity.

SECTION 01 14 00 Page 3

g. Anticipated vehicle and equipment list requiring access to restricted sites.

h. Anticipated usage of perimeter fences, barricades, barriers and similar items at free zone perimeters, etc.

i. List of anticipated closures/outages, etc that may impact Government oversight, access to other portions of the Restricted Area, or work outside of normal hours.

k. Procedures for advising Subcontractors and delivery activities on the location of the project site and appropriate POCs (primary and secondary) for Security Forces to verify project deliveries against.

l. Describe the technical approach to design and construction of the facility(ies). Include considerations for management of the work within the Schriever AFB Restricted Area (RA).

The SSAMP shall be a living document that records the Contractor's approach for compliance with work restrictions documented herein. As Contractor requirements evolve, update the SSAMP for use and reference by the Government. Coordinate SSAMP updates with overarching construction schedule and "lookahead" activities defined in 01 32 01.00 10 PROJECT

SCHEDULE.

1.5 ORDER OF WORK RESTRICTIONS

The order in which work is performed shall conform to the following constraints:

a. The existing Schriever Air Force Base (SAFB) Restricted Area (RA) will remain in operation during the entire construction period. The Contractor must conduct their operations so as to cause the least possible interference with normal operations of RA activities. See the design drawings for additional accommodations and requirements.

b. Permission to interrupt any roads or utility service must be requested in accordance with requirements listed in 01 30 00.24 OTHER

ADMINISTRATIVE AND SPECIAL REQUIREMENTS.

c. Permission to establish new free work zones shall be coordinated in compliance with the requirements listed below.

d. Any utility outages associated with the project shall be planned well in advance. Contractor shall notify the Government of any required outages that may impact any RA facilities in compliance with utility outage request requirements in 01 30 00.24 OTHER ADMINISTRATIVE AND

SPECIAL REQUIREMENTS.

e. The Contractor is responsible for all labor, costs, and materials required to construct the entirety of the work within the RA at Schriever AFB. Work within an approved free zone perimeter does not require escorts. Work within the the Schriever AFB RA requires escorts or Cleared American Surveillance Technician (CAST) oversight as defined herein. Work required to establish or remove free zone perimeter(s) also requires escorts or CAST oversight as defined herein. Finally, work in and on the existing Utilidor or RA perimeter fence serving the Schriever AFB RA requires escorts or CAST oversight

SECTION 01 14 00 Page 4 as defined herein. The Contractor is required to obtain RA escort badging and/or employing the services of escorts (CASTs, as indicated below) as required to fully execute the work within the constraints defined herein.

1.5.1 Desire for Innovation

The Government is looking for ways to streamline construction and manage labor and other resource constraints in an effort to mutually reduce costs and achieve an aggressive schedule while minimizing impact to the Base and Base operations. The Contractor should consider these constraints when developing the project schedule and work activities, and should propose innovative and/or alternative solutions for Government consideration. Any non-standard solutions require Government review and formal acceptance prior to implementation.

1.6 BASE ACCESS AND SECURITY

1.6.1 General

The US Army Corps of Engineers (USACE) (in collaboration with Base Civil Engineering Squadron) will coordinate installation and restricted area entry with the resource managers of the areas on SAFB and with the 50th Security Forces Squadron (50SFS), and will assist the Contractor with initiating security reviews (e.g. local and national agency checks) and requesting restricted area badges as described below. The Contractor shall furnish a list of Contractor personnel, equipment, and vehicles requiring entry to SAFB and the restricted area. This list will be provided as soon as possible, but not later than ten (10) days, after contract award and maintained current as Contractor personnel are added or dismissed from the contract/project.

After initial acceptance of the list, submit changes and updates a minimum of 3 working days prior to the date of required access.

1.6.2 Base and Restricted Area Hours

See 01 30 00.24 OTHER ADMINISTRATIVE AND SPECIAL REQUIREMENTS for base and restricted area hours. Work outside those hours shall be coordinated with USACE and Security Forces Squadron per the requirements of this specification and 01 30 00.24 OTHER ADMINISTRATIVE AND SPECIAL

REQUIREMENTS.

1.6.3 Scheduled and Unscheduled No Work Days

See 01 30 00.24 OTHER ADMINISTRATIVE AND SPECIAL REQUIREMENTS, for requirements relating to weather delays and federal holidays. Official snow call or late reporting may affect the Contractor's production for which the KO will not consider reimbursement for lost work time.

1.6.3.1 Operational Delays

The Contractor and their personnel shall leave Schriever Air Force Base (SAFB) immediately and safely upon notification by the Contracting Officer (CO), his technical representative, or constituted authority when directed, that operational requirements or emergencies dictate. Normal delay should not exceed one hour in duration.

SECTION 01 14 00 Page 5

1.6.3.2 Right to Deny Entry

The Installation Commander or designated representative reserves the right to deny entry to any Contractor whose National Agency Check is unfavorable, and the right to terminate the entry authorization of any Contractor employee upon disclosure of information which indicates the individual's continued entry to SAFB is not in the best interest of national security. Additionally, the violation of or any deviation from established security procedures by the Contractor's employee may result in the confiscation of restricted area badge and the denial of future entry to SAFB.

1.6.4 Activity Regulations

Ensure that Contractor personnel employed on the activity become familiar with and obey activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. Mark Contractor equipment for identification.

1.6.4.1 Subcontractors and Personnel Contacts

Provide a contact list of personnel for the Contractor and subcontractors

- including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.6.4.2 Identification Badges and Installation Access

a. Each Contractor employee to work on the project at Schriever AFB must obtain a base pass to enter the base. The pass must be obtained prior to entry on Schriever AFB. To obtain the base pass, personnel must have in their possession, a current, valid driver's license and if driving a vehicle onto base a current vehicle registration, and current proof of insurance. Procedures for obtaining a base pass will be identified at the Pre-Construction Meeting. Expired/unregistered vehicles will not be allowed on base.

Employees who are terminated from employment will surrender any and all identification media and base passes to their immediate supervisor, who will in turn surrender same to the SAFB Pass and ID Office, and the supervisor will immediately escort the terminated employee off base, and notify Base Security Forces of the termination.

The Contractor shall provide USACE & Base Security Forces a copy of a completed "Contractor Personnel Access List", which is to include the names of all subcontractors and suppliers, and the names and driver's license numbers of all employees requiring access to the Base. The list shall also include all vehicles requiring entry onto Schriever AFB (including deliveries). The list shall be revised in its entirety and a new copy provided to USACE & the Base Security Forces as persons/companies/vehicles are added and/or deleted. When update of the contractor personnel access list is necessary, submit the list a minimum of 3 working days prior to when added personnel/vehicles require access.

b. All drivers on Schriever AFB will have in their possession a valid driver's license, valid vehicle registration, and proof of vehicle

SECTION 01 14 00 Page 6 insurance while operating any vehicle. If vehicle is registered to someone other than the operator, the operator must provide a notarized letter from the registered owner, authorizing the operator permission to operate the vehicle. Access by vehicles to the Base and project site is at the sole discretion of the Government. Security process and procedures at the Base change over time. Coordinate specific access details with the Government after contract award.

The company name shall be prominently displayed on all vehicles operated on SAFB.

c. The Contractor's Superintendent must notify Base Security Forces through the Contracting Office prior to any work to be performed on non-scheduled hours/days (evenings, weekends, holidays). Any personnel working on non-scheduled hours/days must check in with Base Security Forces, prior to and at the completion of the work.

d. All equipment and materials are the responsibility of the Contractor.

Make sure that all equipment and materials are properly secured at the end of the work day. Assure that materials and equipment are stored at least 30 feet away from the RA fences (either side), unless approved otherwise by Base Security Forces. Any work area found by Base Security Forces to be unsecured (or improperly secured) will be checked for intruders and the responsible Contract Superintendent will be called in to secure the areas/equipment.

e. If any roadway is to be blocked for any reason, the Contractor must notify, through the Contracting Office, the Base Security Forces of the blockage, prior to the blockage, and must ensure that proper signs are provided by the contractor and installed to divert traffic around the affected area. As much lead time notification as possible is appreciated for proper coordination, and notification of other activities on base.

f. Contractors, Subcontractors and all personnel who report for work, and do not know the location of the job site, will be held at the entry gate to await escort service from the Construction Superintendent.

g. Base speed limits are strictly enforced with the use of radar equipment. The base speed limit is 30 MPH, unless otherwise posted.

The speed limit through the gates is 15 MPH. Motorcycle operator/riders must wear protective headgear (helmets) while riding on base. Mandatory seatbelt laws are in effect on base. Seatbelts must be fastened prior to entering the base. Cell phones may not be used while driving on any Air Force Base, including Schriever AFB.

h. See requirements above regarding scheduled and unscheduled no work days, as well as weather and federal holidays listed in Section 01 30 00.24 OTHER ADMINISTRATIVE AND SPECIAL REQUIREMENTS. Access on dates when the normal access gate is closed will be via Enoch Road Gate. However, deliveries cannot be accepted on these dates unless requested in writing from the Contracting Officer's Representative (COR) and access will be granted by the COR only under extenuating circumstances.

i. No privately owned weapons or contraband (drugs, etc.) are permitted on any military installation, at any time. Violators will be prosecuted through the Federal Magistrates Court in Denver. Cameras are also considered to be contraband on this installation.

SECTION 01 14 00 Page 7

j. Schriever AFB is considered to be a closed facility. No unauthorized tours or visitors will be allowed on the installation.

1.6.4.3 No Smoking Policy

Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.

1.6.5 Facility Access

When work work is to be performed within a facility equipped with intrusion detection and/or access control, the contractor shall notify 50SFS at the start of the work day. The security system protecting the door to the work area will be temporarily deactivated by 50SFS to allow the contractor free access to the work area.

At the end of each work day, the contractor shall notify 50SFS that all personnel are leaving the work site. This will allow 50SFS to reactivate the security system.

Only the exterior doors directly accessing the work area shall be used during construction. Interior doorways to other parts of the facility shall remain closed with their security system(s) active throughout all construction activities.

1.7 RESTRICTED AREA (RA) ACCESS AND SECURITY

SAFB is a closed base. Within the installation boundary there is a permanent Restricted Area (RA). Restricted Areas, by definition, contain priority resources and are established pursuant to DODD 5200.8 , Security of DoD Installations and Resources. Because priority resources are contained within the restricted area, a single security system and circulation controls are required and employed.

Access into this area is highly controlled and construction activities associated by this contract shall be coordinated with existing RA access control and security procedures.

The process and procedures to enter the Schriever AFB RA are different than the general requirements to enter SAFB. As referenced, the US Army Corps of Engineers (in collaboration with Base Civil Engineering Squadron) will coordinate restricted area entry with the resource managers of the areas on SAFB and with the 50th Security Forces Squadron (50SFS). The Contractor shall include provisions in their SSAMP that address and acknowledge the time, security, and oversight constraints associated with constructing new facilities inside and on the perimeter of an active restricted area.

1.7.1 Right to Deny Entry

The Installation Commander or designated representative reserves the right to deny entry to any Contractor whose NAC is unfavorable, and the right to terminate the entry authorization of any Contractor employee upon disclosure of information which indicates the individual's continued entry

SECTION 01 14 00 Page 8 to SAFB and the RA is not in the best interest of national security.

Additionally, the violation of or any deviation from established security procedures by the Contractor's employee may result in the confiscation of restricted area badge and the denial of future entry to SAFB.

1.7.2 RA Badging

A Restricted Area Badge for Unescorted Entry only (i.e. not requiring or authorized access to classified information) may be issued to Contractor personnel meeting the following qualifications:

a. Subject will be employed for six or more months.

b. Contract is for more than six months.

c. Subject has initiated a National Agency Check (NAC) prior to requesting access.

d. Subject has received a favorable local agency/files check initiated by

50SFS/SFAC.

NOTE: Badges authorized under the aforementioned provisions are only for Area 7 on SAFB. No other areas, restricted or controlled, will be entered on the badge. Badges will not be electronically coded for any module or controlled by the Advance Entry Control System (AECS). If issued, an RA badge allows the holder "escort" privileges for un-badged personnel with general base access. See "Escorts" paragraph below. If access to any other areas are required, the badge will be issued only upon completion of the National Agency Check.

e. Security Forces personnel will verify the identity and authorization of each Contractor employee requesting entry to the installation or restricted area, and may conduct searches of any hand-carried item, container, or vehicle used by the Contractor under this contract.

f. The contractor shall absorb all costs associated with delays at the installation entry points, restricted area entry points, or any other locations affected by security entry/circulation control measures.

1.7.3 Escorts

The Contractor shall provide escorts and/or Cleared American Surveillance Technicians (CASTs) as required to fully execute the scope of work defined by this contract in compliance with the security requirements established herein and in the approved SSAMP. The Contractor may accomplish this by self-escorting personnel, employing CASTs, and/or a combination of both -as indicated in the approved SSAMP, and in compliance with the following constraints:

a. Work within the the Schriever AFB RA requires escorts or CAST oversight as defined herein.

As indicated, the contractor is responsible for all labor, costs, and materials associated with escorts and/or guards in order to complete the full scope of work within this contract.

1.7.3.1 RA Badging Quantities

The Contractor may assume that the Government will issue Restricted Area

SECTION 01 14 00 Page 9

Badges in the quantity necessary to complete the project for the duration of construction. Each requesting applicant (Contractor personnel or CASTs) must comply with the badging requirements indicated above, and comply with the ratio and line-of sight requirements described below. Each badge holder shall return their Restricted Area badge upon completion of activities that necessitate Restricted Area access.

The Contractor shall account for and absorb all time and costs associated with obtaining required badging in the project schedule. Submit requests for RA badging NLT 14 days prior to date of required access.

1.7.3.2 Escort Responsibilities

Escorts and CASTs shall comply with the most-stringent of the following on each work activity:

a. Escorts/CASTs shall not oversee more than 7 escortees for every single

(1) escort or guard (maximum 7:1 ratio). Any deviations to this ratio must be approved, in writing, buy base security forces.

b. Escorts/CASTs shall have direct line-of-sight to all assigned escortees at all times. This means that certain work activities may require more escorts than the maximum ratio allows.

The Contractor shall clearly communicate their anticipated plan for escorts/CASTs in relation to work activities in the SSAMP.

1.7.3.3 Cleared American Surveillance Technicians (CASTs)

The Contractor may employ the services of Cleared American Surveillance Technicians (CASTs) in order to address escort requirements on the project. CASTs shall meet the following requirements:

a. CASTs must possess at a minimum a favorable background investigation as verified by a National Agency Check with Inquiries (NACI) and must be an American citizen. Favorable background investigation in NACI must be maintained throughout the entire contract performance period.

b. CASTs employed by the Contractor to perform work under this Contract shall be able to communicate effectively in both written and oral English.

1.7.3.4 Non-cleared American Surveillance Technicians (NASTs)

As required and allowed by this specification, the Contractor may employ the services of Non-cleared American Surveillance Technicians (NASTs).

NASTs shall meet the following requirements:

a. NASTs shall be able to meet all Base badging requirements listed herein.

b. NASTs must be an American citizen, but ownership and maintenance of a security clearance is not required.

b. NASTs employed by the Contractor to perform work under this Contract shall be able to communicate effectively in both written and oral English.

SECTION 01 14 00 Page 10

1.8 ACCESS AND SECURITY ROLES AND RESPONSIBILITIES

1.8.1 Access Within RA

When work inside the RA, the Contractor shall comply with the following:

1.8.1.1 Contractor Responsibilities

a. Contractor will conduct initial vetting for workers using e-Verify to confirm all workers are US Citizens or US Persons and present a roster of all workers to the 50SFS (Government) who will verify using birth certificate, passport, or I-9 approved identification. Any additional workers added after the initial roster is submitted will not be allowed access until proper vetting has been completed, which may take up to 30 days.

b. After successful validation of US Citizen or US Person status, the validated construction workers will be added to the access control roster, issued a site access badge and receive a security briefing from the SSM. The security badge shall be in the possession of the worker while on site and shall be required for access to any secure or controlled area.

1.1 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE

In accordance with FAR 31.105(d)(2)(i)(b), for the predetermined schedule of construction equipment use rates, use Engineer Pamphlet (EP) 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule. Copies of each regional schedule may be obtained through the following internet site:

https://www.publications.usace.army.mil/USACE-Publications/Engineer-Pamphlets/ on pages 10 and 11 of 13.

1.2 DESIGN-BUILD CONSTRUCTION CONTRACTS (MAR 2019)

(a) Design-Build Contract Order of Precedence. The contract includes the standard contract clauses and schedules current at the time of contract award. It entails (1) the Solicitation in its entirety, including all drawings, cuts, and illustrations, and any amendments, and (2) the successful offeror’s accepted proposal. The contract constitutes and defines the entire agreement between the Contractor and the Government. No documentation shall be omitted which in any way bears upon the terms of that agreement.

(1) In the event of conflict or inconsistency between any portion of this contract, precedence shall be given in the following order:

i.Betterments: Any portions of the accepted proposal which both conform to and exceed the requirements of the Solicitation.

ii.The requirements of the Solicitation. (See also FAR 52.236-21, Specifications and Drawings for Construction) iii.All other elements of the accepted proposal.

iv.Any design products including, but not limited to, plans, specifications, engineering studies and analyses, shop drawings, equipment installation drawings, etc. These are "deliverables" under the contract and are not part of the contract itself. Design products must conform to all provisions of the contract, in the order of precedence herein.

(b) Personnel, subcontractors, and outside associates or consultants. In connection with this contract, any in-house personnel, subcontractors, and outside associates or consultants will be limited to

SECTION 01 30 00.24 Page 3 individuals or firms that were specifically identified in the Contractor's accepted proposal. The Contractor shall obtain the Contracting Officer's written consent before making any substitution for these designated in-house personnel, subcontractors, associates, or consultants. If the Contractor proposes a substitution, it shall submit the same type of information that was submitted in the accepted proposal to the Contracting Officer for evaluation and approval. The level of qualifications and experience submitted in the accepted proposal or that required by the Solicitation, whichever is greater, is the minimum standard for any substitution.

(c) Responsibility of the Contractor for Design. The Contractor shall be responsible for the professional quality, technical accuracy, and the coordination of all designs, drawings, specifications, and other non-construction services furnished by the Contractor under this contract.

The Contractor shall, without additional compensation, correct or revise any errors or deficiency in its designs, drawings, specifications, and other non-construction services and perform any necessary rework or modifications, including any damage to real or personal property, resulting from the design error or omission.

(1) The standard of care for all design services performed under this agreement shall be the care and skill ordinarily used by members of the architectural or engineering professions practicing under similar conditions at the same time and locality. Notwithstanding the above, in the event that the contract specifies that portions of the Work be performed in accordance with a performance standard, the design services shall be performed so as to achieve such standards.

(2) Neither the Government's review, approval or acceptance of, nor payment for, the services required under this contract, shall be construed to operate as a waiver of any rights under this contract or of any cause of action arising out of the performance of this contract. The Contractor shall be and remain liable to the Government in accordance with applicable law for all damages to the Government caused by the Contractor's negligent performance of any of these services furnished under this contract.

(3) The rights and remedies of the Government provided for under this contract are in addition to any other rights and remedies provided by law.

(4) If the Contractor is comprised of more than one legal entity, each entity shall be jointly and severally liable hereunder.

(d) Contractor's Role during the Design Process. The Contractor's construction management key personnel shall be actively involved during the design process to effectively integrate the design and construction requirements of this contract. In addition to the typical required construction activities, the Contractor's involvement includes, but is not limited to actions such as: integrating the design schedule into the Master Schedule to maximize the effectiveness of fast-tracking design and construction (within the limits allowed in the contract), ensuring constructability and economy of the design, integrating the shop drawing and installation drawing process into the design, executing the material and equipment acquisition programs to meet critical schedules, effectively interfacing the design and construction quality control (QC) management programs with the design QC program, and maintaining and providing the design team with accurate, up-to-date redline and as-built documentation

SECTION 01 30 00.24 Page 4 for eventual submission as Record Drawings.. The Contractor shall require and manage the active involvement of key trade subcontractors in the above activities.

(e) Deviating from the Accepted Design. The Contractor must obtain the approval of the Designer of Record and the Government's concurrence, in the form of supplemental agreement to the contract, for any Contractor-proposed revision to the professionally stamped-and-sealed and Government-reviewed final design that has been released for Construction before proceeding with the revision. The Government reserves the right to disapprove such a revision.

(1) The Government reserves the right to non-concur with any revision to the final design that has been released for construction, including those which may impact furniture, furnishings, equipment selections or operations decisions that were made, based on the reviewed design.

(2) Any Contractor-proposed revision to the design which deviates from the contract requirements (i.e., the Request for Proposal (RFP) and the accepted proposal), will require a bilateral modification (e.g. supplemental agreement) to the contract before any work commences.

(3) Unless the Government initiates a change to the contract requirements, or the Government determines that the Government furnished design criteria are incorrect and must be revised, any Contractor initiated proposed change to the contract requirements, which results in additional cost, shall strictly be at the Contractor's expense.

(4) The Contractor shall track all approved revisions to the reviewed and accepted design and shall incorporate them into the as-built design documentation, in accordance with agreed procedures. The Designer of Record shall document its professional concurrence on the as-builts for any revisions in the stamped and sealed drawings and specifications.

(f) Value Engineering after Award. In reference to Federal Acquisition Regulation (FAR) 52.248-3, Value Engineering - Construction, the Government may refuse to entertain a "Value Engineering Change Proposal" (VECP) for those "performance oriented" aspects of the Solicitation documents which were addressed in the Contractor's accepted contract proposal and which were evaluated in competition with other offerors for award of this contract.

(1) The Government may consider a VECP for those "prescriptive" aspects of the Solicitation documents, not addressed in the Contractor's accepted contract proposal or addressed but evaluated only for minimum conformance with the Solicitation requirements.

(2) For purposes of this clause, the term "performance oriented" refers to those aspects of the design criteria or other contract requirements, which allow the offeror or Contractor certain latitude, choice of and flexibility to propose in its accepted proposal a choice of design, technical approach, design solution, construction approach or other approach to fulfill the contract requirements. Such requirements generally tend to be expressed in terms of functions to be performed, performance required or essential physical characteristics, without dictating a specific process or specific design solution for achieving the desired result.

SECTION 01 30 00.24 Page 5

(3) In contrast, for purposes of this clause, the term "prescriptive" refers to those aspects of the design criteria or other Solicitation requirements wherein the Government expressed the design solution or other requirements in terms of specific material, approaches, systems, and/or processes to be used. Prescriptive aspects typically allow the offerors little or no freedom in the choice of design approach, materials, fabrication techniques, methods of installation, or any other approach to fulfill the contract requirements.

(g) Warranty of Design. The Contractor warrants that the design shall be performed in accordance with the contract requirements. Design and design related construction not conforming to the Contract requirements shall be corrected at no additional cost to the Government.

The standard of care for design is defined in paragraph c of this clause, Responsibility of the Contractor for Design.

(1) The period of this warranty shall commence upon final completion and the Government's acceptance of the work, or in the case of the Government's beneficial occupancy of all or part of the work for its convenience, prior to final completion and acceptance, at the time of such occupancy.

(2) This design warranty shall be effective from the above event through the Statute of Limitations and Statute of Repose or host nation law, as applicable to the place of construction performance.

(3) The rights and remedies of the Government provided for under this clause are in addition to any other rights and remedies provided in this contract or by law.

(h) Government Re-Use of Design. In conjunction with the Defense Federal Acquisition Regulation Supplement (DFARS) 252.227-7022, Government Rights (Unlimited), the Government will not ask for additional originals or copies of the design works after the Contractor provides all required design documentation and record drawing documentation under the instant contract. Further, if the Government uses the design for other projects without additional compensation to the Contractor for re-use, the Government releases the Contractor from liability in the design on the other projects, due to defects in the design that are not the result of fraud, gross mistake as amounts to fraud, gross negligence or intentional misrepresentation.

(End of clause)

1.3 CONTRACTOR SUPPLY AND USE OF ELECTRONIC SOFTWARE FOR PROCESSING

CONSTRUCTION WAGE RATE REQUIREMENTS STATUTE CERTIFIED LABOR PAYROLLS
